HomeMy WebLinkAbout2001-031 Council Resolution• Council Member 2a.r/3cr1i adoption: introduced the following resolution and moved its CITY OF LINO LAKES RESOLUTION No. 2001 -31 RESOLUTION APPROVING A MINOR SUBDIVISION AT THE NORTH/EAST CORNER OF BIRCH STREET AND HODGSON ROAD WHEREAS, a request has been submitted to the City of Lino Lakes for a Minor Subdivision on the north/east corner of Birch Street and Hodgson Road for property legally described as: (see attached legal description) WHEREAS, the City Council of the City of Lino Lakes found the requested Minor Subdivision to conform to the criteria as set forth in the Zoning Ordinance of the City of Lino Lakes. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Lino Lakes that the Minor Subdivision requested is hereby approved with the following described conditions: Dedication of 27 -29.73 feet of right -of -way along the west property line of both Parcel A and B as required by Anoka County. 2. Approval of this minor subdivision does not guarantee, nor imply approval of any subsequent development plans for the property. Council Member O'Donnell seconded the motion. Motion carried unanimously. COMMUNITY DEVELOPMENT DEPARTMENT REPORT Resolution No. 01 — 31, Minor Subdivision, 325 Birch St., Rockey Goertz, (3/5 Vote Required), Jeff Smyser — City Planner Smyser advised this case involves a request by Rockey Goertz and Larry Grubbs to subdivide a 39.67 acre parcel of property located at the north/east corner of Hodgson Road and Birch Street. This minor subdivision would create two (2) parcels: Parcel A 3.98 gross acres /3.51 upland acres Lot size: approximately 493 x 330 Parcel B 35.69 gross acres /26.85 upland acres Mr. Grubbs would retain ownership of the 3.98 parcel for future commercial development and Mr. Goertz would retain the 35.69 acre parcel for development similar to the enclosed sketch plan for Spirit Hills. The property is currently Zoned R -1 Single Family Residential and located within the existing MUSA line. The property immediately south containing Apitz Garage and the small corner house is Zoned GB, General Business. Utilities can be extended to serve the property. The Draft Comprehensive Plan guides this area for a mix of commercial, low density residential and medium density residential. The current Comprehensive Plan guides the area for single family residential. Mr. Grubbs also owns the adjoining Apitz Garage and is the potential owner of the adjoining City /County owned property at the corner of Hodgson Road and Birch Street. The City /County and Mr. Grubbs are currently working on an agreement that would include right -of -way dedication along Hodgson Road and transfer of the remaining parcel to Mr. Grubbs. The property owner has agreed to dedicate an additional 27' to 29' of right -of -way on the east side of Hodgson Road in this location, which is acceptable to the County. Only the minor subdivision is being reviewed at this time. The concept plan is for illustrative purposes only. Mr. Goertz plans to submit a preliminary plat /PDO for April review by the Planning and Zoning Board and Council. Staff has reviewed this minor subdivision request and would comment that the applicant has demonstrated that a future street layout is possible to serve the plan and minimize access onto Birch Street. The applicant has met with Anoka County regarding right -of -way needs for Hodgson Road and is willing to dedicate the additional right -of -way along the west property line and has revised his sketch accordingly. The proposed new lots (A & B) meet the minimum lot dimensions and other requirements under the current zoning. Staff recommended approval of the minor subdivision with conditions. 7 • COUNCIL MINUTES FEBRUARY 26, 2001 City Planner Smyser noted the Planning and Zoning Board also recommended approval on a 4 -0 -1 (Rafferty) vote to approve this minor subdivision based on conditions at their February 13, 2001 meeting. City Planner Smyser reviewed the information regarding zoning for commercial /residential comparing the existing land use map to the proposal. Mr. Rockey Goertz came forward and referred to a sketch of the concept plan noting the plan will go through the City process. He stated the land needs to be split up for a business deal. The street layout does have the County's blessing. The right -in right -out option has been approved. The preliminary plat will be submitted in March 2001. Council Member Carlson asked if the right -in right -out will be at the same point as the access. Mr. Goertz stated the right -in right -out will be a little to the north of the access. The access will then be eliminated. Council Member Carlson moved to adopt Resolution No. 01 — 31, based on the following conditions: 1. Dedication of 27 — 29.73' of right -of -way is dedicated along the west property line of both Parcel A and B as required by Anoka County. 2. Approval of this minor subdivision does not guarantee, nor imply approval of any subsequent development plans for the property. Council Member O'Donnell seconded the motion. Motion carried unanimously. Resolution No. 01 — 31 can be found in the City Clerk's office. SECOND READING, Ordinance No. 03 — 01, Rezone City Hall Park from Rural to Public Semi - Public to allow for the Location of a PCS Tower, (4/5 Vote Required), Jeff Smyser — City Planner Smyser advised the City Council approved the first reading of Ordinance No. 03 — 01 on February 12, 2001. This is the second reading. After approval of the second reading, the ordinance will be published in the newspaper. The ordinance becomes effective 30 days after the publication date. To summarize, Qwest proposes to construct a 135 -foot high tower for antennas for wireless telephone service. Such towers are not allowed in the Rural zoning district. City Hall Park currently is zoned Rural. Towers are allowed in a PSP Public Semi - Public district. Qwest has requested rezoning City Hall Park to PSP. Council Member O'Donnell moved to approve the SECOND READING, of Ordinance No. 03 — 01, as presented. Council Member Reinert seconded the motion. • Council Member Carlson voted yea.
