RESOLUTION NO. 01-62
CITY OF LINO LAKES
ANOKA COUNTY, MINNESOTA
WHEREAS, the development agreement for the Clearwater Creek Business Center was
approved by the City Council on November 13, 2000, and
WHEREAS, Exhibit D of the development agreement requires that the developer be
reimbursed in the amount of $139,325 for easements outside of the plat, and
WHEREAS, T & G Properties, 6805 20th Avenue, P.O. Box 368, Hugo, Minnesota,
55038 is the developer of Clearwater Creek Business Center,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LINO LAKES, MINNESOTA:
1. The payment to T & G Properties, developer of Clearwater Creek Business
Center, in the amount of $139,325 is hereby approved.
Adopted by the Lino Lakes City Council this 23rd y of April, 2001.

The Northern Lights Boulevard easement is located immediately south of the plat and the exception area and runs to
the west Lino Lakes City limits. The 21st Avenue easement runs from the south edge of the Northern Lights Boulevard
easement, to Cedar Street. Based on a cost of $1.00 per square foot for permanent easement, and $0.10 per square
foot for temporary easements, the total cost is $139,325.

BACKGROUND:
On November 13, 2000, the City Council approved the Final plat for the
Clearwater Creek Business Center (CCBC). At that meeting, the City Council
also discussed and approved the development agreement for this project. The
development agreement included a negotiated settlement of the costs related to
easement acquisition in the area between the developer, T & G Properties, and
the City of Lino Lakes.
As noted on Exhibit D of the agreement, the developer is providing easements
outside of the plat to accommodate trunk sanitary sewer and water
improvements. The final easement descriptions have been prepared by the
developer's surveyor and reviewed by the City. The amount due for these
easements is $139,325. The documents transferring this easement to the City
will be reviewed and approved by the City Attorney before releasing the
payment.
OPTIONS:
1. Approve the Clearwater Creek Business Center Disbursement
2. Return to staff for further consideration.
RECOMMENDATION:
Staff recommends Option 1.
