Mr. Locher said the assessment could be appealed if the residents were paying them but in this case the builder is paying so there is no appeal in that area. They can appeal the plat on charges of capriciousness but that was a pretty difficult charge to prove. Mr. Locher pointed out that his quarrel is with the Company and not with the Village. The meeting broke up about 10:00 P.M. with many people still carrying their conversation to the members of the Council that were present. 11 -9 -72 A special meeting of the Lino Lakes Village Council to certify the ballots was called to order at 7:45 P. M. on November 9, 1972, by Mayor Bohjanen. Councilmen present: Cardinal, Jaworski, and Zelinka. Absent: Marier. Seconded by Mr. Cardinal. Aye. Minutes approved at November 13, 1972 meeting Clerk- Treasurer I1 -9 -72 The special meeting of the Lino Lakes Village Council was called to order at 8:00 P. M. on November 9, 1972 by Mayor Bohjanen. Councilmen present: Cardinal, Jaworski, Zelinka. Absent: Marier, due to illness. Attorney Locher and Engineer Gotwald were also present as were Mr. Marvin Rehbein. Mr. Jaworski asked Mr. Gotwald if an inspector was present at all times on the water and sewer project in U. S. Lakes #2. Mr. Gotwald said, yes, that any time work was being done there was a project engineer present who worked with the contractor. Mr. Gotwald explained the extra charge for bedding rock. I1 -19 -72 He said there is a copy of the delivery order on each load that was ordered for the project and that the charge of the system is much less than the amount that was delivered. The difference being that part of the rock was used by the contractor to make his work easier and therefore could not be charged to the system. He also explained that the bid price of any project is only an estimate and that the measurements are taken from a map. When the actual work is done the measurements can be off; either too little or too much, therefore adjustments in the amount of footage is necessary. About one -half of the overage is due to change orders from Chomonix for extra outlets that they wanted put in and were not in the original estimate. The overage amounts to 5.1% of the original estimate which is well within the normal limits. There was a question as to the difference of using bed rock or pilings. Mr. Gotwald said that the cost of pilings is about $160.00 to $170.00 per piling up to 22', after that the charge is approximately 5.70 per foot and some pilings go to 40' thus getting very expensive. They are also needed every 8 foot or so. The reason for the bed rock in this area wasn't so much that the soil was unsuitable but that a trench would not stabalize, This rock must be leveled by Hand so that the grade is absolute. This section of water and sewer mains are about 10 feet below water level. Mr. Jaworski moved to accept the water and sewer systems in U. S. Lakes Addition #2 and to make final payment to Mr. Marvin Rehbein in the amount of $40,608.88. Seconded by Mr. Zelinka. Motion carried. There was discussion on the manner of pumping and the equipment needed for such a project. Mr. Rehbein suggested utilizing the lift station pump. Mr. Gotwald thought this could be done. He will check on this and get a letter of recommendation into the Clerk as soon as possible. Mr. Gotwald also stated that he is convinced that the Metro Sewer Board should assume some part of the cost of hauling. -Mr. Locher agrees with him. Mr. Gotwald feels that the sewer Board should pay the difference between the charges to the users and the cost of hauling. He said the average charge to home owners for sewer service is about $80.00 per year. Mr. Zelinka moved to authorize Mr. Locher and Mr. Gotwald to contact the Metro Sewer Board with this idea and to work out with them the details to get the best possible price for the Village. Seconded by Mr. Cardinal. MOtion Carried. The Clerk was insturcted to contact Mr. Carlson and inform him that as of November 10, 1972 the bi llings for the haulings are to come to the Village. Mr. Zelinka mvoed to have Mr. Locher draft an Ordinance for the operatmpm of the Water and Sewer Systems and present it to the Council for study and adoption. This Ordinance wi 11 include the rates for water and sewer usage. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski asked about water meters. Mr. Gotwald reported this will be included in the Ordinance. The charge is usually based on the cost. He will contact the Clerk with details on water meters and possible sources of purchase them. He also recommended that the Village not advertise for bids, since we will need so few to start with and the process of advertising is so costly. In one community that Mr. Gotwald deals with, the cost of the meters is about $56.00 and the charge to the home owner is $80.00 . This included install= ation acid overhead. These would be remote read -out meters and the installation is just a matter of removing a spacer at the home and installing the meter and gound wire. Mr. Zelinka suggested that no matter where we purchase the meters, there must be a repair and mai ntai nence location here in the area in order to avoid delays. Mr. Cardinal moved to authorize the Clerk to visit other Villages and look at th eir systems of billings and to report back to the Council on this. She is authorized to use up to �0 h ours for this purpose and is to keep tract of the hours and charge this time to that 62 II -9 -72 department. Seconded by Mr. Zelinka. Motion carried. Possible Villages to check are Forest Lake, Blaine, Circle Pines, New Brighton and Lexington. This time will be charged to the Utilities Department. Mr. Locher reported that Mr. Burnstein, Circle Pines Attorney, had contacted him and the Village of Circle Pines if filing an appeal to the gas ruling. They are willing to drop the appeal if our Village wi11 forego the Attorneys fees and accept the construction charges to the Molin Plant. They will also agree to the boundaries as set up in the Original North Central Franchise. Mr. Bohjanen suggested that both parties get together and talk this over. Mr. Locher thought this was a good idea and will arrange it. 1 Mr. Locher also reported that he has the easements for Peltier Lake Drive and the deed to the pump house lot and he needs a resolution from the Counci+-to accept them. Mr. Jaworski moved to accept the recorded easements and thedeed for the pump house lot. Seconded by Mr. Zelinka. Motion carried. There was some discussion on the Open Space maps that. Mr. Gotwald had brought with him. He was asked to make up 50 copies to be mailed to the people who have land involved in the open space program. There was an application from the Lino Lakes Elementary School Parents Club for a Dingo Permit for No. 10, 1972. Mr. Jaworski moved to approve the permit. Mr. Cardinal Seconded. Carried. Mr. Cardinal moved to adjourn at 9:30 P. M. Mr. Jaworski seconded. Aye. M. on November 13, 1972, by Mayor Bohjanen. Councilmen present: Jaworski, Marier, Zelinka= Absent: Cardinal, due to work. Mr. Gotwald was present as was Attorney Beens representing Mr. Locher who was out of town. Mr. Zelinka moved to accept the minutes of the special meeting of October 24, 1972 as written. Seconded by Mr. Bohjanen. Carried with Mr. Jaworski abstaining . The minutes of the regular Council Meeting of October 24, 1972, were corrected by Mr. Marier as follows: 1st page - last paragraph, after the word 'as' add ', this creates a safety hazard for the chi Idren riding the school buses, - insert the word especially' after the word 'street'. Mr. Marier moved to accept the minutes as corrected. Seconded by Mr. Zelinka. Carried with Mr. Jaworski abstaining. Mr. Zelinka moved to accept the minutes of the Canvassing meeting of November 9, 1972, as written. Seconded by Mr. Jaworski. Carried with Mr. Marier abstaining.
