Possible Villages to check are Forest Lake, Blaine, Circle Pines, New Brighton and Lexington. This time will be charged to the Utilities Department. 1 Mr. Locher reported that Mr. Bu rnste i n , Circle Pines Attorney, had contacted him and the Village of Circle Pines if filing an appeal to the gas ruling. They are willing to drop the appeal if our Village will forego the Attorneys fees and accept the construction charges to the Molin Plant. They will also agree to the boundaries as set up in the Original North Central Franchise. Mr. Bohjanen suggested that both parties get together and talk this over. Mr. Locher thought this was a good idea and will arrange it. Mr. Locher also reported that he has the easements for Peltier Lake Drive and the deed to the pump house lot and he needs a resolution from the Counci+ -to accept them. Mr. Jaworski moved to accept the recorded easements and thedeed for the pump house lot. Seconded by Mr. Zelinka. Motion carried. There was some discussion on the Open Space maps that Mr. Gotwald had brought with him. He was asked to make up 50 copies to be mailed to the people who have land involved in the open space program. There was an application from the Lino Lakes Elementary School Parents Club for a Dingo Permit for No. 10, 1972. Mr. Jaworski moved to approve the permit. Mr. Cardinal Seconded. Carried. Minutes approved at November 13, 1972 meeting Clerk-Treasurer 11 -13 -72 The regular meeting of the Lino Lakes Village Council was called to order at 8:00 P. M. on November 13, 1972, by Mayor Bohjanen. Councilmen present: Jaworski, Marier, Zelinka= Absent: Cardinal, due to work. Mr. Gotwald was present as was Attorney Beens representing Mr. Locher who was out of town. Mr. Zelinka moved to accept the minutes of the special meeting of October 24, 1972 as written. Seconded by Mr. Bohjanen. Carried with Mr. Jaworski abstaining . The minutes of the regular Council Meeting of October 24, 1972, were corrected by Mr. Marier as follows: 1st page - last paragraph, after the word 'as' add ', this creates a safety hazard for the children riding the school buses, - insert the word especially' after the word 'street'. Mr. Marier moved to accept the minutes as corrected. Seconded by Mr. Zelinka. Carried with Mr. Jaworski abstaining. Mr. Zelinka moved to accept the minutes of the Canvassing meeting of November 9, 1972, as written. Seconded by Mr. Jaworski. Carried with Mr. Marier abstaining. Mr. Jaworski moved to accept the minutes of the Special Meeting held on November 9, 1972 as written. Seconded by Mr. Zelinka. Motion carried with Mr. Marier abstaining. 1 November 13, 1972 0 The Clerk reported on the following; I. A request from NSP for a key to the pump house to be kept with the account. the Council had no objections as this is the usual practice. 2. Had received a complaint on the use and condition of the gravel pit located near 135W and the Village south border. The Clerk was instructed to write to the owner asking him to fence the gravel pit and telling him he has 60 days in which to clean it up. 3. Read a le -ter from the Auditor's office concerning Federal Revenue Sharing. 4. Read the letter from Hawkin's Chemical County concerning the Hydroflousi licic acid used in the well. The Council would like the cost figures on this to study for the possibility of putting out on bids. 5. Read a letter received from the Open Space Advisory Board. 6. Reported on the answer received from the State Highway Department in reference to th the petition by Mr. Hopkins. The Council wishes a copy to be sent to the P &Z Board so they may be informed as to the Highway Department plans for that area. 7. Reported that she had received a check from the Auditor's office for Police Funds in the amount of $2,466.03. This is the 1972 State Aid. Mr. Marier moved to deposit in the General Fund Account. Seconded by Mr. Jaworski. Motion carried. 8. REported on a notice of a workshop on Federal Revenue Sharing to be held November 21, 1972. More information will be sent at a later date. Mr. McMurchie and Mr. Uthe of Circle Pines were here to discuss the joint police force now under discussion by Lino Lakes, Centervi I le, Circle Pines and Lexington. They requested the use of the Village Hall for a meeting on November 14, 1972. Mr. McMurchie reported on the meeting held in Circle Pines last week. He gave some preliminary figures that were mostly guesstimates. Mr. Jaworski asked what the figure of $71,400.00 would give us in the way of a full time Police force. Mr. McMurchie said there would be a Chief and 3 officers - 2 cars on at peak hours and 24 hour coverage. Mr. Marier asked how this was proportioned? Where did they get the figures? Mr. McMurchie said these were last years budget figures and were furnished by The Mayors and Police Chiefs. Mr. Bohjanen asked if there had been a study made on such a combined Police Force. Mr. McMurchie said that Minestrista, Mound and Spring Park were so combined and that it was working very we l l for them. Mr. Zelinka asked why we should get involved in this sort of a force? Mr. McMurchie said that as of now all we have is a non - professional part -time force. This setup would give us professional Police officers and full time coverage. Mr. Jaworski wanted to know how a full time Police Force could be run with just 4 men full time. The County reports say that it takes 7 men to keep one car in service on a 24 hour a day basis. 64 11 -13 -72 Mr. McMurchie said the full time men would be supplemented by Auxiliary men who would be the the second man in the car and would be there just to assist the officer. Mr. Marier wanted to know where the home office would be, and who would be in charge. 1 Mr. McMurchie said there would have to be a building, either rented or bui It, for the force and would probably be some where around where our Old Village Hall was as this is near the Center of the 4 Villages. He said that this force would have to be sent up by one Village and the other Villages would then contract for their Police coverage from them. The Police Chief would be the man in charge and would answer to a Police Commission set up by the 4 Villages. Mr. Zelinka asked if he was suggesting that we would save money by going this route. Mr. Murchie said, No, that all the Polices Forces are behind times and in order to bring them up to date it is going to cost the Villages money and there is no way to avoid it whether we go it alone or as a combined force. Mr. Bohjanen said that the meeting scheduled for the 14th is open and all Councilmen are urged to come. Mr. Bohjanen and Mr. Myhre wi I I be there, Mr. Marier said he would like to attend. Mr. Zelinka has a previous meeting and Mr. Jaworski said he would try to make the meeting. Mr. Bohjanen thanked Mr. McMurchie for his time and presentation. Mr. Bohjanen reported that he had a member for the aPark Board. He would like to submit the name of Mr. James McGeary for consideration by the Council. After discussion, Mr. Bohjanen moved to appoint Mr. James McGeary to the Park Board. Seocnded by Mr. Jaworski. Motion carried. The Clerk was instructed to write Mr. McGeary informing him of the appointment and the date of the Next Park Board meeting. Mr. Jaworski reported that he had received two bids for the work on 64th Street and Mr. Backlin, as per instructions, had taken the lowest bid and proceeded with the work. We have received one bid for the removal of the stumps on Peltier Lake Drive. Mr. Zelinka moved to modify the motion in the October 24, 1972 minutes and remove the last sentence stating, ' it was also suggested that a performance bond be posted.' Seconded by Mr. Marier. Motion carried. Mr. Jaworski asked about a snowmobile sales and service being conducted from a garage on Main Street in a residential area. There is also a sign that has no permit. Mr. Jaworski moved to have the Clerk write a letter to this owner and inform him that his operation is illegal and that he must either remove the sign or obtain a permit. Mr. Marier seconded. Carried. There is alos a sporting goods operation on Ware Road being conducted from a garage and the Clerk is to write a letter to them also. Mr. Marier had no report from the P& Z Board. He said he would like to discuss the Federal Revenue Sharing but would leave that for new business. Metro had asked Anoka to present their Park Proposal and we should get our input to them as soon as possible. He asked about the maps and was told that we have fifty copies of both the Village proposal and the County's The Clerk is working on a mailing list and should have it completed by the end of the week. A Copy of each map and a notice of the meeting is to be sent to all people who have lands involved in this plan. Mr. Zelinka moved to set up an Open Space Meeting for November 28, 1972 at 8:00 P. M. at the Village Hall for all people are to be notified. Mr. Jaworski seconded. Motion carried. Mr. Zelinka reported there were no meetings of the Enviromental Commission or the Personnel Commission. The Personnel Commission is down to one member, he had a couple of prospects and Mr. Bohjanen added the name of Curt Kramer. Mr. Zelinka suggested someone from a different area such as Chomonix. Mr. Marier suggested Mr. Johnson. He also reported 1 1 1 11 -13 -72 65 on a complaint of a local resident who had obtained a permit to repair a drainfield and had been told by the Plumbing INspector that the entire system would have to be replaced. Mr. Boyd was present and there was much discussion on this problem. Mr. Gotwald said that a cess pool, such as this home has, must have a bottom that is four feet above the water table or the tank must be replaced. He suggested a boring to find the water table in that area. Mr. Zelinka will talk to the owner and get back to Mr. Boyd. Mr. Tom Melchor wasn't present but Mr. Boyd presented his side of the argument over the reinspection on the Melchor plumbing. Mr. Boyd said that it did not pass the final inspection and that if the air leak was below ground that he would forget it, but if the air leak is above ground then it must be found and repaired. There was much discussion on the plumbing Code and how it should be read and enforced. There was some information from the State Inspector on the Berghorst case but Mr. Locher will have more information for the eext meeting. Mr. Beens read the amendment to Ordinance #30. SECTION 2, PERMIT REQUIRED, 2.01. of Ordinance No. 30, of the Village of Lino Lakes, Anoka County, Minnesota adopted by the Village Council on November 26, 1962, is hereby amended to read as follows: SECTION2. PERMIT REQUIRED. 2.01. No person shall move any building over, along or across any highway, street or alley in the Village, nor shall any person move or place any building upon any lands within the Vi I lage for a period longer than 24 hours without first obtaining a written permit therefore from the Building Inspector, and paying the required fee therefore to the Village. Mr. Zelinka moved =to accept the amendment to Ordinance #30 which is Ordinance #30 -C. Seconded by Mr. Marier. Motion carried. Mr. Bohjanen reported that the Assessor had hired Mr. ARnold Kell ing to do the field work for her as the Deputy Assessor, also mentioning that the Assessor has the privilege of doing this without the approval of the Council. Mr. zelinka reported that there had been several requests for a light at the driveway into the Village Ha l l . There was discussion as to what type of light and if it is should it be incorporated with some sort of identification sign. Mr. Jaworski will check on reflective signs. Mr. McLean thought that there had been an offer to install one from one of the big advertising companies free at the time of construction. He will check on this. There was also requests for lights at North Road and Highway #49. Mr. Gotwald said there should be a map from the Highway Dept. on their plans for lighting at that intersection included in their construction plans. The Clerk is to check. There is need for a light at the corner of Birch and the second curve, across from the Klang property and at Main and 20th. Mr. Bohjanen asked if Northwestern Bell wasn't required to notify the Village as to when they are working in our Village especially in the laying of underground cable. Mr. Marier said that this a County right -of -way and he was sure that the easement had been obtained from the County. Mr. Jaworski read a letter from Mr. Gotwald stating that the Mi l ler Road has been completed as to specifications and he recommended the release of the bond posted by Mr. Miller. Mr. Jaworski moved to release the bond. Seconded by Mr. Zelinka. Motion carried. 66 Mr. Glenn REhbein said there was a lot of problems with deer hunters and he thought we should post "NO DEER HUNTING' on our entrance signs to the Village. There was discussion on the type of signs that should be used. Mr. Zelinka moved to put temporary signs for III now. Seconded by Mr. Jaworski . Motion carried. Mr. Marier said he had some questions on the water and sewer project. He asked Mr. Gotwald the original estimate and the final figures. Mr. Gotwald said he didn't have his file with him but he gave the amounts in round figures. Mr. Marier questioned the amount of rock and was paid for . He said some of the delivery slips had no destination marked on them, some were for Lino Lakes, some Jandric, some U. S. Lakes and some Chomonix, He asked how did we know how much of the rock was actually del ivered to that project. Mr. Gotwald said that a project engineer was on duty at all times and he collected the slips from the drivers and that the only slips he collected were the ones that were actually used on the project. I f the contractor had ordered rock for his own purposes, these were not collected by the engineer and were not added to the cost of construction. Mr. Bohjanen asked what was a normal coverage on a project of,this size. Mr. Gotwald said there is no normal - it all depends on the job and the problems encountered. If the project runs 20 %.over then a decrease might be asked for but by the same token, if a project runs 20% under, the contractor might ask for an increase. Mr. Marier asked if it w -sn't normal to have material designated to point of delivery. Mr. Gotwald said, Yes, but it isn't always done. Sometimes this is left up to the driver and at the time of construction in the Chomonix area, there was a strike and rock was almost inpossible to get. The one place where it could be obtained was very busy and this is very easy to overlook. Mr. Marier then asked about the extra manholes and Mr. Gotwald explained the cost and where they were located. Mr. Marier said we were billed for $13,500.00 for rock and he wondred, 'did it really arrive at the project' Mr. Gotwald said they have delivery slips for all the rock. Mr. Marier would like copies of the delivery slips. Mr. Gotwald said he would get the copies to Mr. Marier. The Clerk was asked to check for purchases of spark plugs for the Police cars and report back at the next meeting. There was discussion on the Federal Revenue Sharing and Mr. Marier moved to apply our share to our budget thus reducing the mill rate and lowering the taxes of the Village residents. Mr. Jaworski seconded. CArried. Mr. Bohjanen reported on a letter he had received from Mr. Johnson at the Treatment Center requesting a meeting to discuss the role of the Center should play in future treatment of patients and to discuss contracting our Police for more coverage then they are now getting. Mr. Bohjanen will set up this meeting. The Clerk reported that she had had many calls concerning the special assessments in the Chomonix area and the paying of these assessments. She asked how to handle this money. The Council suggested a daily interest account and instructed her to contact Mr. Vargasky at t the Centennial state Bank on this. Mr. Jaworski moved to approve the requesitions No. 158 thru #165, holding No's 166 and 154. Seconded by Mr. Zelinka. Motion carried. Mr. Jaworski moved to pay the bills #4798 thru #4824 holding #4802. Seoonded by Mr. Zelinka. Mr. Marier wanted #4801 also withheld. The motion to pay bills #4798 thru #4824, withholding #4802 passed with Mr. Marier voting no. 67 11 -13 -72 Mr. Jaworski moved to adjourn at 1 1 :40 P. M. Seconded by Mr. Zel inka.
