Jaworski moved to authorize Mr. Gotwald to attend this meeting and give
testimony in opposition to the landfill in regards to water quality.
Mr. Marier said that the object of the Rice Creek Water Shed District
Board was to protect the water. They have the men to do this job without
any input from our Engineer. Mr. Cardinal is a member of the Board and
he could speak for the Council.
Mr. Zelinka asked how the Lexington Council felt about the landfill.
Mr. Jaworski said they had voted 4 out of 5 in favor of it. Mr. Zelinka
agreed with Mr. Marier that it is unnesessary to send our Engineer to this meeting.
Mr. Cardinal said our Resolution opposing the landfill has been read and is
on file, so our feelings in this matter are known.
Mr. Zelinka seconded the motion. Motion fai led, with only Mr. Jaworski
voting, Yes.
Mr. Backlin asked the Council to get some clairification allowing him to
dump the sewage into the system in case he is questioned. Mr. Locher
will ask for designated spot from the MSB.

March 12, 1973
The regular meeting of the Lino Lakes V i I l age Counci 1 was called to
order at 8:00 P.M. by Mayor Bohjanen.. Counci Imen present; Cardinal,
Jaworski, Marier, Zelinka. Mr. Locher and Mr. Gotwald were also present.
The minutes of the Feb. 26, 1973 meeting were corrected as follows;
Page 5, paragraph 2, add "send us" after the word "will" in the first
sentence.
Mr. Marier moved to approve the minutes as corrected. Seconded by Mr.
Cardinal. Motion carred.
The minutes of the special meeting of March 5, 1973 were corrected as
follows:
Page 3, parapgraph 1, 6th line, delete the word "better" and
insert "More economical"
Page 3, 3rd paragraph at end of sentence add "because of the open end
bid submitted by Batzli ".
Mr. Zelinka moved to approve the minutes as corrected. Seconded by Mr.
Cardinal. Motion carried.
The clerk read the bids received for the printing of the information
bulletins. The Circulating Pines - $88.00; Forest Lake Times - $91.85;
Blaine Life - $90.00. Mr. Zelinka moved to accept the low bid from the
Circulating Pines for the printing of 1,500 information guides for $88.00.
Seconded by Mr. Jaworski. Motion carried.

The Clerk had received a request from Northwestern Bell for permission
to lay buried cable on Marsham Lane. Mr. Gotwald looked at the plans
and said they meet the requirements. Mr. Cardinal moved to approve the
plans. Seconded by Mr. Zelinka Motion carried with Mr. Marier abstaining.
She asked for instructions as to the purchase of the Directory from the
League of Municipalities. Mr. Jaworski moved to purchase the Directory
at a cost of $4.00. Seconded by Mr. Zelinka. Motion carried.
She had received a request from the Minnesota Pinto Horse Asso. for the
use of the Hall on March 31, 1973 at 12:00 P.M. for a meeting. Mr.
Cardinal moved to allow the use and to contact the Police Department
to have one of the Officers here to open and lock the Hall for them.
Seconded by Mr. Marier. Motion carried.
Mr. Cardinal questioned the Clerk on the plane in Marsham Lake. She told
him she had written the owner telling him to have an answer as to his
plans by this meeting but had heard nothing from him. There was discussion
as to what should be done and how to proceed. There was a suggestion to
turn the matter over to the Rice Creek Watershed District. The Clerk
will get the owner's name and address to Mr. Cardinal. Mr. Locher will
also contact the Sheriff's office. Mr. Zelinka moved to have the Attorney
take the necessary steps to get some action on this. Seconded by Mr.
Cardinal. Motion carried.
Mr. Cardinal moved to contact the Anoka and Ramsey County Officials for
a permit to haul the sewage over posted roads. Centerville Road had been
on this date with a load limit of 5 ton. The motion was seconded by Mr.
Marier. Motion carried.
Mr. Jaworski reported that the stand pipe and electrical work at the lift
station will be in by the end of the week.
Mr. Marier reported there had been no P &Z meeting but the Open Space
Commission had met with the County Representatives. Mr. Robert Burman
agrees with the 7 point concept but the remaining Commissioners have not
yet expressed their opinions. It had been impossible to get the entire
group together for a round table discussion and until this is done there
probably won't be a decision from the County leve l . The representatives asked
for a 90 day delay, but the Commission had asked for answer within 30 days.
They had also requested the feelings of Mr. Jandric and had asked Mr. Glenn
Rehbein to attend their next meeting which is tentatively set for the early
part of April.
Mr. Zelinka reported that neither the Enviornmentalor Personnel Commissions
had met. He had attened the meeting with the Metro Sewer Board and felt
that some of our questions had been answered. He felt that the unfairness
of the funding has veen recognized. The MSB would also agree to write in an
automatic extension of the agreement. He said the method of allocation had
been explained and their had been an indication of their willingness to work
with us.

Mr. Locher reported on his conversation with Mr. Dougherty and then he
presented the figures that they will use in place of the $6,600.00
offered in the first agreement. The MSB w i l l pay $2.00 per /thousand
gallons of sewage hauled, payable monthly upon receipt of an invoice but not to
exceed $12,000.00 for the year 1973. The contract will be renewed
annually until service is available in that area.
Mr. Jaworski questioned the requirement of going back and paying 2
of the $275.00 for the homes that were already hooked up. He felt
that if this was required in that area, why not the entire Vi I l age. He
also questioned how much would be offered to help defray the costs for
the truck, tanker and construction necessary to to utilize this equip-
ment.
Mr. Locher s i ad the $275.00 covers the cost of the interceptor and
disposal units -this is to be no further charges from the MSB. He
also reported that some Federal Funds were available that had not been
ear - marked for a special project and Mr. Dougherty felt they could be
used for this project. Mr. Locher discussed the method of using the amount
of water used to tabulate the sewage since in-:the summer months the water
usage will rise but not necessarily the amount of sewage. Mr. Dougherty
said they will take the exact amount hauled if this canbe an accurate
tabulation.
Mr. Bohjanen asked if this $275.00 will cover the cost of the interceptor.
Mr. Locher said Mr. Dougherty had been emphatic on that point, there
wi I I be no other charges to the MSB. Mr. Locher had asked for this in
writing.
Mr. Zelinka also questioned the point of the present homes hooked up to
the systems being required to pay 2 of the $275.00. Does this also
mean homes with private sewer systems?
No, this only applies to existing homes hooked into the laterals and
building permits already issued this month. The Clerk said there had
been no building permits issued for March. The Village will pay Z of
the $275.00 for the existing homes hooked into the system and all new
bulding permits issued will pay the full $275.00.
Mr. Marier asked Mr. Locher if he had understood Mr. Dougherty to say
that he would meet with the Council and present the stady being made?
Mr. Locher said, Yes, he asked the Coucil if they would like to meet
with him here at the Hall.
Mr. Gotwald said before they set a date to meet with Mr. Dougherty, he
felt they should hay a few days to study the report. This report should
be in the office by the end of the week.
Mr. Zelinka asked Mr. Locher to consult with Mr. Dougherty and find
which dates would be convenient for him. Then we can set a date. He
asked Mr. Gotwald if he had seen copies of the maps accompanying the
report.
Mr. Gotwald said he had a glance at some maps but didn't know if they

pertained to this area or not. He said there were several different
plans considered and we would have to wait and see which one is rec-
ommended for this area.
Mr. Jaworski asked if there had been any response to the 50 homes
limitation?
Mr. Locher said there is no limit but that the MSB wi I I only reimburse
us for the equivalent of 50 hook ups.
Mr. Marier presented some figures as to the debt already incurred by MSB
in the Sewer Service Area #2 of which we will become a part. He said the
$275.00 charges is a good deal in comparison to what they were under
the old system, but we should have information as to our total bill.
He would also like toknow where the present debt figures came from and
what is being done about paying it off.
There was discussion on the cost of the line and the size of the line -
if it was a force line or gravity. Mr. Gotwald said their plans call
for a gravity line form Centervi l le to Shoreview. Mr. Zel inka said he
was told that MSB would break ground for soil test in the Fall of 1973
and for construction in the Spring of 1974. Mr. Marier said once we
enter dinto this agreement with the MSB that puts us back into Service
Area #2 and under MSB jurisdiction. We must find out what Lino Lakes
bills will be and when they will start construction.
Mr. Bohjanen felt that a meeting with Mr. Dougherty was in order to
clear up any questions that the Council may have. Mr. Locher wi I I
set up a meeting at the convenience of Mr. Dougherty. In the meantime,
what about the SAC charges for units building permits will be issued for
in March?
Mr. Jim Husnik wanted to know if he could get a building permit or
would they still be frozen?
Mr. Marier moved to pass the fol lowing Resolution:
"All new residential and commercial building permits issued as of
March 1 2 , 1973 wi I I be required to pay the $275.00 SAC charges.
These monies will be put into a fund for 90 days to either be paid
to the MSB or returned with interest to the applicant. An agree-
ment to this effect must be signed by the applicants."
Seconded by Mr. Cardinal. Motion carried.
Mr. Bohjanen then called on Miss Julie Bever, from the audience who
questioned the operation of the Birchwood Hills Stables. Mr. Locher
said she had contacted him in reference to a horse she owns that was
stolen and is now at this location but the owner will not release the
horse. The owner of the stables says the horses (there were others that
have been recovered by their owners) were running loose and had turned
up at the stables. She now claimes that the horse in question belongs
to her. Mr. Locher had contacted the Humane Society and they had reported
back to Mr. Locher just before this meeting. Mr. Childs has investigated
the stables and had found any animals inside he would have immediately

impounded them. Out of 18 horses, 10 were in bad condition. The owner
has 24 hours in which to get a Vet to take care of the animals. Mr.
Childs also informed her that the place would be patrolled daily by the
Anoka County Sheriff's office. He said one animal had a bad cut -on the
leg that required attention immediately and that most of the fences were
nonexistent. The horses must be fed and cared for or they will be
impounded.
Mr. Jaworski asked if Miss Bever's horse was still there. She said it
was. Mr. Locher said this is a matter of ownership and that the Vi I lage
cannot get involved in the dispute. Mr. Locher also reported that as
late as November these girls had paid $30.00 per /month to board horses
and $2.00 per /hour to ride. This is illegal since Miss Dobraynow does
not have a permit to run such an operation at that location.
Mr. Glen Rehbein suggested that if the barn was that bad then our
building inspector should condemn it and have it torn down.
Mr. Jaworski suggested that Mr. Dupre take a look and consider having
it condemned. The general consensus of the Council was that they cannot
help as far as establishing ownership of the horse is concerned, but
Mr. Locher is to assist the Humane Society and Miss Bever's attorney in
any way he can.
Names and addresses of people who are now boarding horses will be turned
over to Mr. Locher.
Mr. Bohjanen reported that as of now we have not received a copy of the
minutes of the meeting with Circlf Pines Utility and have not received
copies of the audit reports as we requested.
Mr. Back I i n reported he had checked on motors for the 1970 Plymouth.
We can get a 360 cu. in., 1972 engine for $300.00 and a 283 cu. in.,
1970 engine for $250.00. Also, the front floor board must be repaired.
There was discussion on how much it would cost to replace the engine and
how much would be invested in this car. Also, on the use of the car, the
mileage and how long we should keep a Patrol car before trading or selling.
Mr. Marier said our budget calls for 1 new car and that we have on order.
He felt that we have a maintenance problem. Mr. Marier moved to buy
the 360 cu. in. engine with 9000 riles on it for $300.00. Seconded by
Mr. Cardinal. Motion carried with Mr. Jaworski voting No.
The Clerk opened and read the bids on the equipment that we had advertised
for sale. Mr. Cardinal moved to sell the 1939 International Tanker
to the bidder of $60.80; the 1969 Ford Patrol car to the bidder of
$205.00; the 1960 Ford Dump Truck to the bidder of $230.00 without the
snow plow equipment. Seconded by Mr. Jaworski. Motion carried.
Mr. Locher suggested making sure that they know they are buying the
equipment "as is" and there is no warranty of any kind and that we are
not selling to a minor.

Mr. Backlin had checked on spark plug cleaners. Oee that just cleans is
$37.00 and the one with the tester is $126.00. These are new. There
was discussion on these pieces of equipment with Mr. Cardinal moving
to table the matter. Seconded by Mr. Zelinka. Motion carried.
Mr. Gotwald had no report. He told the Council that they will open and
tabulate the bids on the road work and have a report for the next
Council meeting.
Under old business, the matter of the set back l i ne requirements in the
Zoning Ord. #56 was discussed. Mr. Locher saying that an amendment is
necessary to change the Ordinance. He suggested thilt if there is more
that one change to be made, that they all be made at the same time, thus
saving on publication costs. Mr. Jaworski moved to authorize the P &Z
to study this matter and present suggested changes to the Council.
Seconded by Mr. Cardinal. Motion carried.
Mr. Jaworski had talked to Mr. Backlin on the matter of the stumps on
Sunrise and Peltier that must be removed and the dirt removal and grad-
ing to be done in these areas and they suggested letting bids for the
work to all be done by the same party.
Mr. Gotwald suggested Welsh Tree Service and had several others in
mind. These men can take a look at the work to be done and give a pretty
close estimate as to the amount of dirt to be removed and the cost in-
volved. Mr. Jaworski moved to have the Engineer get bids on this project.
Seconded by Mr. Cardinal. Motion carried.
Under new Businees, Mr. Backlin reported that he had a problem with
frozen culverts. It had been impossible to get the County out until
just today. Last Friday he had a man out to demonstrate a steam cleaner.
Mr. Backlin felt that the Village should own a steamer for use on the
culverts and could be used to clean the road equipment as well. The one
demonstrated cost over $600.00. The Council asked that he check into a
couple more for price comparisons.
Mr. Locher had looked over the information on a Wastwater Institute
being held and said the application enclosed should be filled out by
Mr. Backlin. Mr. Gotwald said he had some information on this and will
get together with Mr. Backlin about being phased in under the grand-
father clause.
Mr. Cardinal said the property on the curve cn Birch street owned by
Mrs. Klang is turning into a junk yard and he suggested having the Police
investigate.
Mr. Zelinka said the Bruder property on Lake Drive also has some old
cars and truck standing in the front yard that look as if they haven't
been moved for months.
Mr. Locher reported on the history of this operation and the steps taken
by the Village to clean it up. The Council asked that he look into it
again to see if there is something more that can be done.

Mr. Cardinal reported on the meeting of the Rice Creek Watershed District
in regards to the Lexington Avenue Landfill. There were over 100 people in
attendance with 2 from Lino Lakes and none from Centervi Ile. The only
people who were in favor of the landfill were the 3 proposing it. There
was a doubt as to whether Blaine had issuedca permit for the operation or
not. The Rice Creek Watershed Board had asked for more information
from their Engineer and since that report isn't back, they made no
decisions on the matter.
Mr. Glen Rehbein asked to be allowed to install water and sewer lin es
in the Shenandoah Plat. He said the streets are impassable and he had
to do something about them, he felt that to surface the streets now and
have to tear them out in a year to install the lines was very impractical.
He asked if Mr. Gotwald could get permission from the PCA for him to go
ahead with the installation. He would assume all costs of pumping and
hauling and was willing to put this in writing.
Mr. Gotwald said Mr. Rehbe i n's first request was turned down because
our sewer comprehensive plan is not complete and he cannot complete it
until the land use map is completed. Mr. Gotwald did feel that if Mr.
Rehbein submitted his plans with the stipulation that he would assume all
cost of pumping and hauling, he would stand a better chance of having it
considered. Mr. Bohjanen felt that in order to give an intelligent
answer we must wait the report on the study being made.
The general feeling of the Council was that will assist Mr. Rehbein in any
manner that they can.
Mr. Cardinal moved to approve requisitions #216, 217 and 218. Seconded
by Mr. Jaworski. Motion carried.
Mr. Cardinal moved to pay the bills #5001 through #5030 inclusive.
Seconded by Mr. Jaworski. Motion carried.

The regular meeting of the Lino Lakes Vi Ilage Council was called to order
by Acting Mayor Zelinka at 8:00 P.M. on March 26, 1973. Councilmen present;
Cardinal, Jaworski, Marier. Absent; Mayor Bohjanen who was out of town
for his employer. Attorney Locher was alos present.
Mr. Jaworski moved to accept the minutes of March 12, 1973 a presented.
Seconded by Mr. Cardinal. Motion carried.
The minutes of the March 13, 1973 Special meeting were corrected as follows;
