HomeMy WebLinkAbout03/26/1973 Council Minutes1 12 March 12, 1973 Mr. Cardinal reported on the meeting of the Rice Creek Watershed District in regards to the Lexington Avenue Lan df i I I . There were over 100 people in attendance with 2 from Lino Lakes and none from Centervi Ile. The only people who were in favor of the l andf i I I were the 3 proposing it. There was a doubt as to whether Blaine had issuedca permit for the operation or not. The Rice Creek Watershed Board had asked for more information from their Engineer and since that report isn't back, they made no decisions on the matter. Mr. Glen Rehbein asked to be allowed to install water and sewer lin es in the Shenandoah Plat. He said the streets are impassable and he had to do something about them, he felt that to surface the streets now and have to tear them out in a year to install the lines was very impractical. He asked if Mr. Gotwald could get permission from the PCA for him to go ahead with the installation. He would assume all costs of pumping and hauling and was willing to put this in writing. Mr. Gotwald said Mr. Rehbein's first request was turned down because our sewer comprehensive plan is not complete and he cannot complete it until the land use map is completed. Mr. Gotwald did feel that if Mr. Rehbein submitted his plans with the stipulation that he would assume all cost of pumping and hauling, he would stand a better chance of having it considered. Mr. Bohjanen felt that in order to give an intelligent answer we must wait the report on the study being made. The general feeling of the Council was that will assist Mr. Rehbein in any manner that they can. Mr. Cardinal moved to approve requisitions #216, 217 and 218. Seconded by Mr. Jaworski. Motion carried. Mr. Cardinal moved to pay the bills #5001 through #5030 inclusive. Seconded by Mr. Jaworski. Motion carried. Mr. Cardinal moved to adjourn at 11:45 P.M. Seconded by Mr. Marier. AYE. CLERK -TREASURE R March 26, 1973 The regular meeting of the Lino Lakes Vi Ilage Council was called to order by Acting Mayor Zelinka at 8:00 P.M. on March 26, 1973. Councilmen present; Cardinal, Jaworski, Marier. Absent; Mayor Bohjanen who was out of town for his employer. Attorney Locher was alos present. Mr. Jaworski moved to accept the minutes of March 12, 1973 ass presented. Seconded by Mr. Cardinal. Motion carried. The minutes of the March 13, 1973 Special meeting were corrected as follows; 113 March 26, 1973 last paragraph, add after "carried ", with Mr. Marier voting, No, be- cause the property that had been set aside for open space had not been resolved." Mr. Jaworski moved to accept the minutes as corrected. Seconded by Mr. Marier. Motion carried with Mr. Cardinal abstaining. The Clerk reported on the letter from Mr. John Mi Iton requesting our feelings on the Northtown Corridor. The Council could not remember any information we had received on this. The Clerk was instructed to write to Mr. Milton's office informing him of this and to also check our files for any information that might have been received. She had talked with Mr. Dielentheis in regards to the back -up well and pump on Cutlass Circle. Mr. Dielentheis said they would be glad to leave the pump hooked into our system but he felt that we should assume the electric charges for the pump. Mr. Cardinal moved to leave the pump hooked up and the Vi I lage to assume the charges for service. Seconded by Mr. Jaworski. Motion carried. She had computed the hours and cost to the Police Department in regards to the service given the Treatment Center. She was instructed to mail this to the proper offices. The Clerk and the Mayor were authorized to sign the 1973 contract with Milner Carley Engineering. Read a letter from the Anoka County Health Department in regards to the property located at Highways #8and #49. This property is owned by George Reiling of St. Paul. They have written him a letter informing him of the condition of the property and asking him to clean it up and fi I I in the basement. We have received the first quarter payment of State Aid in the Amount of $13,101.53, and rgunicipal court fines in the amount of $17.50. Read the letter from Mr. Dupre, building inspector, on the condition of the barn on Birch Street. The Council requested the Clerk to write and ask Mr. Dupre for his recommendation as to what should be done; should it be torn down or is it repairable? Reported on a meeting conducted by the State Highway Department but the letter had arrived too late for the Council to attend. The Clerk was instructed to write the Highway Department informing them of this. Mr. Cardinal reported there had not been a quorum at the Park Board meeting but that he had informed the ones who were there of the pro- gress being done by the Lino's Club. Mr. Cardinal said they had heard something about a year ago but nothing since. Mr. Zelinka said they have about 1,100.00 committed at the present time to put into the Park. They will ask some assisstance from the Council. Mr. McLean has a colored drawing of the proposal. Mr. Jaworski asked that he appear at the next Park Board meeting. 114 March 26, 1973 While on the subject of Parks, Mr. Jaworski requested the use of the Village Hall garage on a Sunday to hold a rummage sale. He will be here to move the equipment. This was agreeable with the Counci I . The date will be set later. Mr. Jaworski reported that the Stand -pipe is in and working perfectly. Mr. Jack Rector has been driving the truck and has the run down to about 45 minutes for a round trip. Mr. Jaworski presented the bids on the roads and reported that before the work is started that Columbus and Hugo must be contacted in regards to Pine Street and 24th Avenue. There was discussion on how this had been handled in the past and what we could or could not do with this bid. The Engineer will notify the bidder of the acceptance of his bid and take care of the performance bond. Mr. Jaworski moved to award the road improvement contract to the H &S Asphalt Co. of Anoka for road work on the roads specified on the Village Map- to contact Hugo and Columbus as to their share of the cost on Pine Street and 24th Avenue. Mr. Jaworski and Mr. Marier to appear at the Hugo Council meeting on April 2, 1973. Seconded by Mr. Marier. Motion carried unamiously. The Clerk is to contact the Hugo Village Clerk and ask that Mr. Jaworski and Mr. Marier be put,,on their agenda for the meeting on April 2, 1973. Mr. Jaworski also reported that in talking with Mr. Gotwald it was recommended that Mr. Backl in have as reference a State Specs for Roads manual. Ther is a requisition for the book. Mr. Jaworski had also contacted Welsch Tree Service on the removal of the stumps on Pelte r and Sunrise. They will be out this week to take a look. The First engine purchased for the Police car would not fit so it had been exchanged. The second engine was frozen. Mr. Jaworski presented figures on several ways to repair the car. Mr. Marier moved to purchase a new short block for the 1970 Plymouth. Seconded by Mr. Cardinal. Motion carried. Mr. Ze I i nka reported there is no b i l l from the Electrical contractor for the work on the stand pipe. Mr. Marier moved that all cost incurred in installing the stand pipe be charged against the construction fund. Seconded by Mr. Jaworski. Motion carried. Mr. Marier reported on the P &Z meeting of the 2Ist. Mr. Henry Speiser had appeared asking for a variance to Ord. #21 to split his lacre lot in order for his son to build on one half. This would create two Tots of 104' frontage each. Since our Ordinance requires 150', the re- commendation of the P &Z was that this request be denied. There was discussion on the fact that this is all the land he owns; that he can- not purchase any more; that a house had been built next to this property in 1968 on a one -half acre lot; that each request must be passed on its own merit. Mr. Marier said he was only passing on the recommendations 1 1 1 March 26, 1973 of the P &Z Board but he felt that by granting a variance in this case, we would be setting a precedent and opening up the way for more and more of these requests. And where do you draw the l i n e . I f we grant var- iances in cases such as this, then he felt that our Ordinance is wrong. Mr. Jaworski asked Mr. Locher if the Counci I would be setting a precedent or is each case considered on an individual basis. Mr-. Locher sai d that each request must be considered indi vi dually. Mr. Cardinal moved to grant a variance to Mr. Henry Speiser on the property described as fol lows: That part of the Northwest 4 of the Southwest 4 of Section 29, Township 31, Range 22, Anoka County, Minnesota described as fol lows to -wit: Beginning at a point of the South line of said Northwest 4 of the Southwest 4 distant 744 feet East from the Southwest corner thereof; thence North along the line parallel with the West I i ne thereof a distance of 208.7 feet; thence East pa ra I I e I with the South line thereof a distance of 208.7 feet; thence South parallel with the West line thereof a distance of 208.7 feet to the South line of said Northwest 4 of the Southwest 4; thence West along the South line thereof a distance of 208.7 feet to the point of beginning. providing that the land passed a perc test. The reasons being that this is the only parcel that he owns and he is not landlocking any other lands. Motion was seconded by Mr. Jaworski. Motion carried with Mr. Marier voting, No. Mr. Marier reported that Mr. Leo Hager-, who owns land on Bald Eagle Blvd. had appeared asking for a variance for 350' of land he owns. He would like to split the land and give 150' to a relative for the pur- ose of building a home. The P &Z had recommended that the request be denied. Mr. Hager was not present at the Council meeting, so Mr. Jaworski moved to table this request until the next Council meeting and have the Clerk contact Mr. Hager and ask him to be present. Seconded by Mr. Cardinal. Motion carried. Mr. Marier reported that Mr. Donald Allen had appeared before the P &Z asking for a sanitary landfi II for property he owns near Hol ly Drive and 12th Avenue. He had bought the property to be used for the running of cattle but now finds that it is too low. He had contacted the County and they had referred him to the ViIlage. He was told that he must first go through the Anoka County Health Department, the Rice Creek Watershed Board and the PCA. Mr. Marier had given him the names of people to contact and he will report back to the Council. Mr. Marier felt possibly Mr. Allen had bought the land sight unseen. He also felt that Mr. Allen wanted the correct information in order to the job right. Mr. Roy Stanley had also appeared with a preliminary plat. The P &Z had requested that the Counci I set a date for a hearing. Mr. Cardinal moved to set April 18, 1973 at 8:30 P.M. for the hearing before the P &Z and April 23, 1973 at 8:30 P.M. for the hearing before the Council. Seconded by Mr. Marier. Motion carried. 1 6 March 26, 1973 Mr. Graham of the Spring Realty Company had appeared in behalf of McDonald Ind. in conjunction with the erection of a 500' radio tower on the Amelia Rehbe i n property located on Birch Street. He was asking for information as to the necessary action to take in regards to the use of the land. Mr. Jaworski asked it they had contacted to FAA. Mr. Marier said, No, they had only the permission of the FCC. The Clerk is to call Mr. Graham and ask him about this. Mr. Cardinal moved to set the hearing for- a special use permit for Apri I 18, 1973 at 8:45 P.M. before the P &Z Board and April 23, 1973 at 8 :45 P.M. before the Counci I for the McDonald Ind. Seconded by Mr. Marier. Motion carried. Mr. Marier reported there had been a presentation on the For -Jay operation and Mr. Zelinka will have the complete layout ready for the next P &Z meeting. The P &Z Board had recommended a Spring Clean -Up week and had asked that the Council set aside a week for this and to notify all residents. The Council agreed to set the last week in April as Spring Clean -Up week and flyers are to be distributed with the Information Guides. He also reportedthat the P &Z Board will be interviewing prospects for a Planning consultant on April 14, 1973. They will interview a represnt- ative from Midwest Planning at 8:00 P.M. and one from Beckman and Yonder at 9:00 P.M. and will have a recommendation for the next Council meeting. Mr. Zelinka said there had been no meetings of the Enviornmental Commission but that the Personnel Commission will be meeting this week to make a salary study. Mr. Locher had looked over the application by Mr. Thomas LAVaI le for sewer installation license and found the insurance in order except the copy was issued to the ViIlege of New Brighton. The Clerk is to write and ask for a copy issued to the Village of Lino Lakes and also that the Cannce l l ati on only with 10 days notice be added. Mr. Francis Burque appeared in regards to some lots that he owns on 20th Avenue So. He plans to attend a County meeting tomorrow and will have more information as to their requirements for right -of -way demands. There was discussion on the plat he presented but no action was taken. Mr. Locher and the Clerk reported that they had no news on the plane in Marsham Lake. The Clerk presented applications from U.S. Lakes for directional signs in conjunction with the opening of their new models. There was discussion as to the location and Mr. Jaworski moved to send to the P &Z. Seconded by Mr-. Cardinal. Motion carried. They asked that the location of the signs be shown on a mop,. The Clerk also reported that she had a call from Mr. Herbst this day informing her that he had posted the gravel pit. He had found it full of branches and cut trees and whi le there a truck from the Kunz Tree Service had driven in with a load but on seeing hire, had driven away and he had been unable to catch them. March 26, 1973 Rose Apitz had called with a complaint on the shooting going on on the property adjacent to Baldwin Lake. There was discussion on this with Mr. Myhre saying he had chased people out of there 5 times on Sunday. They all had shotguns, so outside of trespassing, they are not breaking any laws. The Clerk is to call Mr. Glenn Rehbein and ask him to post "No TREASPASSING" signs. Under old business, the Council was reminded of the meeting with the Metor Sewer Board here at the Hall on April 10, 1973. Mr. Jaworski said he had talked with Mr. Gotwald concerning the Metro Sewer Board Report and Mr. Gotwald would like to meet with the Council before they meet with the MSB, the evening of Ap ri I 5, 1973 at 8:00 P.M. was set for a specLal meeting with Mr. Gotwald. Mr. Marier reported that he has a conflict of meetings on the IOth and asked Mr. Locher if there was a possibility of changing the date to the Ilth or 12th. Mr. Locher said he would try. Mr. Zelinka and the Clerk had had complaints on the dogs running loose in the Lakeview area. A resident had wondered if there couldn't be a lease law in the area where we have a buring ban. There was discussion on this and, also, that dogs must be licensed at the age of 3 months. Mr. Myhre reported that he had many calls on this same problem and that the people claim that some of the dogs are from Blaine. The Clerk is to write Blaine and ask for their cooperation in cleaning up this problem. Mr. Chuck Larson appeared before the Council. He is in the process of purchasing the Blue Heron from Mr. Stanley Thayer and was asking the requirements for obtaining a Liquor license. Mr. Locher read the requirements from our Ordinance. Mr. Myhre reported that he had checked Mr. Larson's record and found no adverse reports. Mr. Larson lives in Golden Valley at the present time. He was told that in order to obtain a Liquor license, he must be a resident of the V i I l age of Lino Lakes. Also, that he would have to have a bond and insurance. These things must be presented to the Council before any action on his application can be taken. Mr. Larson asked how long it would take to the get the license once he full fi Iled the requirements. Mr. Jaworski said if all things were in order, it could be acted upon at thattime. Mr. Larson will get the necessary papers and establish residency before the next Council meeting. Mr. Cardinal moved to approve Requisitions #212 thru #229, adding an oil pump to #221. Seconded by Mr. Marier. Motion carried. Mr. Cardinal moved to approve payment of the bills #5031 thru #5052 with instructions to the Clerk that #'s 5043 -5044 & 5050 are to be charged to the construction fund. Seconded by Mr. Jaworski.
