HomeMy WebLinkAbout04/09/1973 Council Minutes118 March 13, 1973 The special meeting of the Lino Lakes Village Council was called to order at 8:10 P.M. by Mayor Bohjanen. Counci Imen present; Jaworski, Marier, Zelinka, Absent; Cardinal. Mr. Locher was also present. Mr. Busch, Mr. Dielentheis and Mr. Meyer were here to represent U.S. Lakes Development Co. This meeting had been called for the purpose of rezoning certain lands in Lakes Add. #2. Mr. Locher read the publication notice to that effect. Mr. Busch said that U.S. Lakes was in agreement to having this property rezoned to RI. Mr. Bohjanen asked for comments from the Council. Mr. Marier questioned the outlots designated on the new plat and what was going to happen to the to the outlots not covered in this rezoning application. He said the intention of the P &Z was that all the lands involved be rezoned to RI. Mr. Locher explained that the outlots being rezoned were the ones designated on Lakes #2 plat since Lakes Add. #3 is not a legal plat yet. The legal description is from Plat #2 and the ones on Plat #3 are what the new designation will be. Mr. Marier felt there should be some reference to work with. Mr. Busch said they have an overlay and Mr. Meyer will get a copy to the office for our files so there will be e continuity to the plats. Mr. Bohjanen asked of there were any objections to this rezoning. There was none. Mr. Zelinka moved to approve rezoning as requested from Agricultural (A) to Residential, Single Family (R -I), the following described real estate situated in the Village of Lino Lakes to wit: Outlots C and 1, Lakes Addition No. 2 and to rezone from Multiple - Family Residential (Townhouse) (R -5) to Residential, Single Family (R -I) and to thereby withdraw any Special Use Permit granted to allow the construction of townhouses on the following decribed real estate, to wit: Outlot G, Lakes Addition No. 2. Seconded by Mr. Jaworski. Motion carried. Mr. Zelinka moved to adjourn at 8:30 P.M. Seconded by Mr. Marier. AYE. Apri 19, 1973 The regualr meeting of the Lino Lakes Village Counicl was called to order on Apri 19, 1973 at 8:00 P.M. by Mayor Bohjanen. Council- men preserht; Cadinal, Marier, Zel inka.. Absent; Jaworski . Mr. Locher and Mr. Gotwald were also present. Mr. Zeliiika moved to approve the minutes of the March 26, 1973 meeting as written. Seconded by Mr. Cardjnal, motion carried. Mr. Jaworski arrived 1 1 April 9, 1973 The Clerk reported that she had received the first Federal Revenue Sharing check in the amount of $5,515.00. The local board of Equal- ization is set for May 9, 1973; she had received the minutes from the Rice Creek Watershed Distric and the N.S.S.S.B. Also a notice of the N.S.S.S.B. meeting of April 12, 1973. She had received a request for a Bi ngoPermi t form the Lino Lakes Parents Club for April 13, 1973. The time would be from 7:00 P.M. until about 10:30 or 10:45 P.M. Mr. Jaworski moved to grant the Special Permit for Bingo. Seconded by Mr. Marier, Motion carried. Mr. Resch had requested the use of the Hall for an Athletic Assc.' meeting on April 25, 1973. Mr. Jaworski moved to grant this request. Seconded by Mr. Cardinal. Motion carr=ied. Mr. Gerald Johnson of the Police Department appeared before the Council to present a suggested design to be painted on the doors of the new Patrol Car. The cost of hand - painting this emblem on both doors and the word "Police" in 4" letters on the trunk was $100.00. This bid was from the Beck Auto Body in Lexington. Mr. Zelinka moved to have this emblem painted on the new car and instructed the policeman to enter a requistion for the work to be done. Seconded by Mr. Bohjanen. Mr. Marier asked if this was for 1 or 2 cars. He was told just the new one for the present. Motion carried. Mr. John McLean and Mr. Joe Davis appeared in behalf of the Lino's Club to present their plans for Lino Park. Enclosed with these minutes is a copy of their proposal. The general concensus of the Council was of approval. Mr. Marier felt that before the Council could give final approval that this should go through the Park Board. We have these bodies for a purpose and they should not be by- passed. The Council agreed with him. Mr. Cardinal asked the Clerk to mail cards to all Park Board members asking them to attend The meeting on April 16 to discuss this Park proposal. Mr. Harold Lehman was in the audience and Mr. Cardinal asked him to take a look at the plan and make his comments. Mr. Cardinal also asked if he had talked to any other Park Board members. Mr. Lehman looked the plan over and had no suggestions at this time and he told Mr. Cardinal that he had not discussed this with any of the mem- bers. Mr. Cardinal asked if Mr. Lehman had any objections to the Council giving preliminary approval to this plan in order for the Club to get started on the rough grading right away. Mr. Lehman said, No, that any- thing that was done in the Park would be an improvement. There was dis- cussion on the things that must be done immediatedly. Mr. Zelinka moved that contingent upon approval by the Park Board, the Village Council approve this concept and the investment of $1,600.00 in this plan for 1 year. Seconded by Mr. Cardinal. Motion carried with Mr. Jaworski abstaining. Mayor Bohjanen asked that the consideration of the 2, 3, 4, years be put on the April 23, 1973 agenda. Mr. Chuck Larsen appeared seeking a Liquor license for the operation of the Blue Heron. Mr. Larsen has set up an apartment in the lower 119 120 April 9, 1973 level of the building and will be there dai ly and 3 or 4 nights during the week. This will be his only occupation. Mr. Locher read the Ord- inance concerning the requi rements for Liquor I i cense. Mr. Zelinka moved to grant a Ligour license to Mr. Chuck Larsen contingent upon his change of address, and ful ful I ing the requi rements for insurance and bonds. Mr. Locher added that his insurance must have the clause "that a 10 day written notice must be given before cancel lation." Mr. Cardinal seconded. Motion carried. Mr. Cardinal reported that he had a request from Mr. Robert Bertrand asking the use of Sunrise Perk for a Softball tournament of April 28th and 29th. He reported that Mr. Bertrand was a member of the Military Police stationed in St. Paul, and is willing to deposit $50.00 for clean up. Mr. Bertrand was told that;he must present the proper written application for a beer permit and proof of Liability insurance for the 2 days. There was discussion on the requi rements. Mr. Marier moved that a special permit be issued to Mr. Bertrand upon receipt of proof of insurance. Seconded by Mr. Cardinal. Motion carried. Mr. Jaworski reported on the meeting he and Mr. Marier had attended in Hugo concerning the work to be done on 24th. The Hugo council kept a copy of the specs and the map and will let us know by the 1st of June. Mr. Jaworski reported that he had had an inquiry about the dirt on Sunrise to be removed. The proposal was to remove and dispose of the stumps and take the dirt. Mr. Jaworski asked i f the Counci 1 had any objections to an arrangement such as this. Mr. Marier asked if there would be a limit to the amount of dirt removed. Mr. Jaworski said, Yes, that it would be to the grade specified by the Village. The Council was in agreement with this sort of an arrangement. Mr. Jaworski also reported that if it was necessary Mr. Brisson would let us take some of his property to straighten our Peltiesx Lake Drive. Mr. Gotwald didn't think this was necessary. The firm to remove the tree stumps had not been out as yet. Mr. Marier said if there was no bid by Wednesday to call him. Mr. Marier reported that the P &Z had interviewed the two prospective planners. They will take a vote at the next P &Z board meeting and present their recommendation t o the l . Counci Mr. Zelinka reported that the Enviornmental Commission will meet on April 10, 1973 to discuss the Iandfill application. A_iso,the Personnel Commission will meet on Monday, April 16, 1973 to review salaries of employees and all Coucni'men are invited to attend. He had e call from Jim Carey, a 6th grade student at Lino School, who was organizing a clean -up project and wanted to know if the Village Truck would haul away the junk they collected. Mr. Zelinka authorized the use of the truck for this project and treated the kids at Hank's Cafe. The Council instructed the Clerk to write a letter of "Thanks" to the girls and boys. Mr. Bohjanen wi l l provide the I ist. Cardinal moved to reimburse Mr. Zelinka for costs endured in clean -up of Village Streets. Seconded by Mr. Jaworski. Motion carried. April 9, 1973 Mr. Leo Hager appeared before the council to requestthe split of h i s property. He had appeared before the P &Z end they recommend that his request be denied. He has 225' frontage and wants to deed 100' to his brother. He had tried to bu7 75' from the land owner next to him but, the owner won't sell. Mr. Gotwald suggested that Mr. Hager do a perc test to see how much fill he would need and see if it was feasible to build on this location. Mr. Gotwald explained the necessary steps he should take before going ahead with the fill. He gave Mr. Hager some suggestions on the things he could do himself. Mayor Bohjanen reported that the Information Guides here. There is one wrong phone number the Clerk is changing. He reminded the Council of a meeting of the Metro Transit Commission of the Metro Council in Coon Rapids on April 14, 1973. He asked if the Council would like Mr. Hi l l at the April 23rd meeting to discuss the audit report, they said, Yes. He also presented a sign bid he had gotten for a sign at the Village Hall entrance. The Clerk is to make a copy for the Councilmen. Also, make copies of the Centerville Fire Report. Mr. Locher read a letter on the Birch Wood Hi I Is stables and reported on the status of the investigation. He suggested keeping a close watch on the operation. He had no instruction from the Humane Society. Mr. Cardinal asked what can we do with this information. Mr. Locher said we could prosecute, their special use permit has been withdrawn and also on cruelty to animals. Mr. Marier asked if we would not be under the direction of the Humane Society and Mr. Locher said, Yes. Mr. Zelinka moved to table this matter. Seconded by Mr. Marier. Motion carried. Mr. Locher then went through the contract for the road work and explained the performance bond to the council. The contractor is to be paid by the month -90% of his bill, final payment to be made 30 days after completion. There was discussion on 24th Avenue. Mr. Gotwald will call the engineer for Hugo. Mr. Backlin will inspect except when he feels that Mr. Gotwald should look at something. Mr. Marier moved to authorize the Mayor and Clerk to sign the contract. Seconded by Mr. Cardinal. Motion carried. Mr. Zelinka moved to authorize the Mayor to sign Mr. Baclklin's application for Certification under Section (g) (3) (dd) of Regulation WWOB 1 for Operator in Responsible Charge of Water Supply System. Seconded by Mr. Jaworski. Motion carried. Mr. Locher had called teh SheMi ff concerning the airplane down in Marsham Lake. He had also talked to El Carrow, owner of the plane. Mr. Carrow says there is only about 6" of water and the rest is muck. He said he had a diver look it over and tried to decide how to get it out. One counci Imen asked how could a diver look over something in only 6" of water. Mr. Locher said the Sheriff wi 11 help and we could also contact the Department of Natural Resources. Mr. Merier asked if the Rice Creek Watershed could do anything about it? This was their department, the protection of the waterways. Ap ri I 9, 1973 Mr. Cardinal replies that the Board wants the plane out. He told Mr. Locher that Mr. Murray teh attorney for the Rice Creek Watershed will be contacting him and they will take it from there. Mr. Locher reported that Mr. Roy Stanley had called and changed his mind. He will not plat at this time, the cost of the street in comparision to the number of lots he has is prohibitive. Mr. Burque had appeared at the County Commissioners in regards to the lots he owns on 20th Street South. Mr. Lun dhe i m had inspected the property and the present set back of 6.6' is not enough, he wants 120' County right -of -way. Mr. Locher had read the letter on sewage from boats and thought that the inquiry should be answered even though we have none. Mr. Jaworski asked Mr. Backlin about the bids for the fence. Mr. Backlin said he had only one bid for the fence and one bid for the steam cleaner. Under old business, Mr. Jaworski said that he had heard that the Village will not have a float in the 4th of July Parade. No one else had heard anything about it. Mr. Jaworski thought it was good advertisement for our ViIlage. He said he would check into this matter. Mr. Cardinal said he understood that the Police Car was not being left in the Village at night. He understood that when the two men were hired that the Patrol Car was to stay in the Village at night. Mayor Bohjanen is having a meeting with the Pol ice on Wednesday April II, he wi 11 find out about this at that time. Mr. Zelinka moved to approve requisitions #231 thru #237. Seconded by Mr. Cardinal. Motion carried with Mr. Marier voting no, #234 is an open bid. Mr. Jaworski moved to pay bills #5055 thru #5078 holding #5053 and #5077. He wants clearification from the County on work done on #5053. #5077 was void. Seconded by Mr. Cardinal. Motion carried. Mr. Marier moved to adjourn at 10:20 P.M. Seconded b Mr. Cardinal. AYE Minutes approved at the meeting of April 23, 1973. Clerk-Treasurer A special meeting of the Lino Lakes Village Council was cal led to order at 8:10 P.M. April 10, 1973 by Mayor Bohjanen. Counci 'men present; Jaworski, Zelinka. Absent; Marier, Cardinal. Mr. Locher was present. Mr. Dougherty was unable to attend this meeting and Mr. Payne was here to answer questions. Mr. Payne is assistant Chief Engineer for the MSB. Mayor Walter Pracher and members of the Centervi I le Counci I were introduced to Mr. Payne. Mr. Bohjanen asked Mr. Payne if he would explain the SAC. Mr. Payne apologized for Mr. Dougherty but expJa i ned that he had a conflict of meetings. Mr. Payne then went through some of the history of the MSB and explained how it all came about. He then discussed the Reserve Capacity charges and explained why these charges could not be met by the small un- developed communities. These charges were beyond their abi Itiy to pay, thus the current concept was formulated. This allows the charges to be paid in part by the current users.
