He returned the material sent in connection with the radio tower and said that since there would be no change in the land as such that they would have no report to make. Under new business, Mr. Myhre had found a source for the purchase of two resuscitators for about 110.00 to 120.00 each depending on the numbered ordered. The one we have at the present time is very old and al-most worn out and we should have new ones for the patrol cars. He doesn't know the exact cost but would like approval from the Council to purchase when the opportunity presents itself. When the cost is established he will then submit a requisition. Mr. Jaworski moved to authorize Mr. Myhre to commit the V i I l age for the purchase of two resuscitators not to exceed $140.00 each. Seconded by Mr. Zelinka. Motion carried. A gentleman from the audience inquired about the request for the use of Sunrise Park for a Square Dance Convention to be held in 1974. He was told that it had been approved at the last Council meeting. He then questioned the possibility of having close contact with the Police Department just in case they were needed. He was told that this should not present a p ro lbem since we have more personnel and they should be availabel when needed. Mr. Zelinka moved to approve requistions #251 through 0261, holding 1262. Minutes approved at the May 29, 1973 Meeting.A�/�f�c�c.� Vi l lage Clerk- Treasurer May 29, 1973 The regular meeting of the Lino Lakes Village Council was called to order at 8:00 P.M. on May 29, 1973 by Mayor Bohjanen. Councilmen present; Cardinal, Jaworski, Marier, Zelinka. Mr. Locher was also p resent. Mr. Zelinka moved to approve the minutes of May 14, 1973 as presented. Seconded by Mr. Jaworski. Motion carried with Mr. Cardinal and Mr. Merier abstaining. The Clerk reported that she had received $22.50 in municipal court fines; had a report from the Minnesota Department of Health concerning our water system. She asked the Council their wishes on the maintenance contract for the IBM typewriter. After discussion, Mr. Cardinal moved to buy a maintenance contract on the new machine and to combine both typewriters under the same contract. Seconded by Mr. Jaworski. Motion carried. There was discussion on the request of the Minnesota Pipe Line Company to install the second pipeline about 15' to the west of the existing line. 136 May 29, 1973 The Clerk read the following suggestions from Mr. Gotwald: 1. Find out if the new pipe line will be in the same easement. 2. If approved, the responsibility of the locating and relocating, if necessary, the present and proposed pipelines would be that of the Minnesota Pipe Line Company's in case of conflict with future insta- lation of utility lines. 3. Mr. Gotwald also said there should be a stipulation that Main Street be repaired where the line goes under the Street. 4. Make sure the line is deep enough so as not to interfer with future grading of the land for Park or any other purpose. 5. Check width of present easement and find out if they are staying within this area or if acquiring additional property. 6. Check for the possibility of relocating the present line and installing the second line along the West and South borders of the Vi I lage property. Mr. Zelinka moved to have the Clerk write to Mr. Nelson and include these questions and suggestions in her letter. Seconded by Mr. Cardinal. She is to also send them a copy of Ordinance #49. Mr. Floyd Schake appeared in connection with his business on Lake Drive. He has a body shop and uses wrecked cars for parts. The Police have tagged him for storing junk cars. There was much discussion on his method of operation, The Council suggested that he apply for a special use permit and go through the Planning and Zoning Board. He has a dealers license but doesn't want to go to the expense of putting plates on cars that he doesn't own. Mr. Schake said he would like to conform with our regulations, but needs more infromation. He asked about the installation of a fence and storing the junk cars within this area. He said that 6 of the cars that were tagged did not belong to him. It was suggested that these 6 cars be the first one removed. Mr. Jaworski felt that a l l cars not runable and not tagged would have to be removed. Mr. Zelinka moved to allow additional time for Mr. Schake to apply for the special use permit since his 14 days will be up soon. Mr. Schake asked for 30 days to remove 16 cars. Mr. Marier seconded the motion with the stipulation that if they are not removed, Mr. Schake w i l l be in direct violation of our Ordinance and wi I I be tagged. Motion carried. The hearing for the MacDonald Industries request for a special use permit was call to order at 8:45 P.M. Mr. Marier read the recommendation from the Planning and Zoning Board that the special use permit be approved with the stipulations set forth by the Board. Mr. Jaworski was concerned about the possibility of the tower toppling. Would it fall within the guy wires? Mr. MacDonald said, Yes, and this was borne out by Insurance Company studies. If this were not the case then the Insurance rates would be prohibitive construction such as this tower. He also stated that the site for the base of the tower had been changed and it was now 350' from the front leg line. 3 7 May 29, 1973 Mr. Locher read the puEil icatiQn and the rnainl inc9 l ist in connection with this special hearing. Mr. Bohjanen asked of there were any objections to this tower from anyone present. There was no one in the audience who voiced any objections. Mr. Mikelson, from WCCO, stated that all differrences between his orginaza- tion and the MacDonald Industries had been worked out and they had no objections to the tower. Mr. Zelinka moved to grant the special use permit for one 500' radio tower to the MacDonald Industries per recommendations from the P &Z Board. Mr. Jaworski asked of WCCO sti I I intended to bui Id their tower? Mr. Mikelson said this may be where they end up but at the present time, there was nothing definite. • Mr. Marier asked if it would make a difference in the tax structure if this land was not rezoned to commercial. The Clerk said the classification of property for tax purposes is based on the usage of the land, not the zoning. So it could bery well be zoned ag and classified as commercial and assessed as such. Mr. Cardinal seconded the motion. Mr. Jaworski asked if this permit must be renewed or is it on a continuing basis. Mr. Locher said there is no provision for renewal in our Ordinance. Mr. Marier felt that there should be some follow upon all special use permits. He moved that all special use permits be reviewed every two years. Motion was seconded by Mr. Jaworski. Motion carried. Mr. Cardinal called for a vote on the original motion. Motion carried. Mr. MacDonald thanked the Council. Mr. Zelinka moved to close the hearing at 9:15 P.M. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski reported that he had met with Columbus conerning'Pine Street. They felt that from 4th Avenue to Old Highway #8, they would consider sharing the cost, but the portion beyond 4th Avenue, No, since this is a dead end street and there are other parts of the township that would object to money spect on this part of the Street. Mr. Jaworski felt that Pine Street should be a conty road and he had requested Mr. Burman to attend this meeting. The Clerk had called his office. He had a previous meeting but would send a representative. There was no one in attendance from the County. Mr. Bob Morehouse, of Columbus Township, felt that the County wanted no part of Pine Street. The Council felt Anoka County had made some sort of an agreement in 1967 or so to work with Washington County on 24th Avenue. The Clerk is to check the files for information on this matter. She was also instructed to write the Anoka County Commissioners asking them to assume the responsibility for Pine Street and 24th Avenue. Mr. Morehouse said he would ask the Clerk for Columbus Township to write and the Clerk is to contact Hugo for 138 May 29, 1973 the same purpose. She vas.. also asked to contact Hugo and them to put Mr. Jaworski and Mr. Marier on the agenda for their next Council meeting, June 4th. The Clerk is to contact Mr. Gotwald and ask him to compute the cost of surfacing Pine Street from 4th Avenue to Old Highway #8. Mr. Clem Frazer was in the audience. Mr. Locher reported on the progress of the Bruder case. Mr. Myhre had issued a citation for 4 junk cars in violation and Mr. Locher read the citation. Mr. Frazer asked if anything had been done about the gas tank. Mr. Locher said that Mrs. Bruder had refused to allow Mr. Livingston on her property to inspect the gas tank. Mr. Locher was in the process of finding out if Mr. Livingston could enter the property without the owner's permissions. Mr. Locher read from our Ordiance covering the storing of inflamable liquids and said that a citation could be wssued since from the information available it would seem that Mr. Bruder is in direct violation of that Ordinance. Mr. Cardinal asked if the tank could be inspected from Mr. Frazer's yard? Mr. Locher said that this had already been done. Also, Mr. Bruder has no license to store inflamable liquids. The consensus of the Council was that Mr. Bruder is in' violation of the Ordinance governing the storage of inflamable liquids and the Fire Marshall, Mr. Livingston, will be instructed to issue a citation. Mr. Marier reported that Mr. Boyer had appeared before the P &Z asking for a variance to the 22 acre requi rement. His property is located on Bi rch Street with 208' front footage and a depth of 241'. The P &Z recommended approval of the variance. Mr. Marier so moved. Seconded by Mr. Cardinal. Motion carried. Mr. Fran Burque appeared seeking permission for the removal of top soi I on the East side of the Village on property he owns. Mr. Locher read from the ordinance governing such operations. There was a not on Mr. Locher's copy of the ordinance requiring a special use permit and setting the cost at 100.00 plus 0.15 per yard to be put in escrow for the restora- tion of the land. The yardage to be determined by the Engineer. There was much discussion on this. The Clerk found the minutes of Aug. 28, 1972 and read where this was passed by Resolution on the Council. Mr. Burque said he would think this over and contact the Clerk. Mr. Marier also reported that Mr. Kelling had run into quite a mix up in the house numbers while working on the assessment. He had explained how the numbering s 'kstem had been set up for the Village. Mr. Kelling had recommended that all new house numbers be issued from the Clerk's office in conjunction with an overlay to be provided by the Engineer providing the Building Inspector doesn't already have one. Mr. Marier so moved. Seconded by Mr. Cardinal. Motion carried. Mr. Marier read the recommendation of the P &Z that some positive action be taken on the sanitary l andf i 1 at the old grave pit. There was much discussion on this. Mr. Jaworski moved to have the Police issue tags to Mr. Herbst, Mr. Rei 1 ing and others in the Vi I lage who have junk collecting on their property. Seconded by Mr. Marier. Motion carried. Mr. Bohjanen 1 1 1 May 29, 1973 also mentioned a collection of rubbish on the North end of Reshanau Lake that should be taken care of. Mr. Marier moved to notify the Western Sign Company who owns the Skelly Oil sign on 35W and Co. Rd. 14 that their sign permit has been cancelled and they are to remove the sign and all the debris. Seconded by Mr. Cardinal. Motion carried. Mr. Locher had checked Mr. Resengren's Liquor License application and found it all in order except for the 10 day wri *ten notice before cancel ation. Mr. Marier moved to approve the application contingent on this clause being added. Seconded by Mr. Cardinal. Motion carried. Mr. Cardinal reported on the Park Board meeting. The members had been dissappointed that there had been no work done on the diamond at the Hall property. Mr. Cardinal had contacted Mr. Backlin and the work is progress- ing satisfactorily and should be ready for the league to use by the 1st of June. The parts are here for the mower and the grass should be cut in the Parks. Mr. Jaworski reminded Mr. Cardinal that new doors are needed on the warming house at Sunrise and that the caulking should be replaced around the door frame. Also, the trim on the warming house should be painted. Mr. Jaworski reported that he and Mr. Marier had inspected the roads and were very dissappointed with the qua l: i ty of the work done. Mr. Jaworski moved to instruct the Clerk to hold all bills from H &S Asphalt Co. Until the work is brought up to the specifications. Seconded by Mr. Marier. Motion carried. Mr. Cardinal felt that when work is being done on our roads there should be an inspector in order to avoid problems such as this. Mr. Jaworski brought up the matternof Ware Road and 64th Street. We have bids submitted by Mr. Shifsky last fall that he wasn't able to get done and Mr. Jaworski believed that some repair work on Ware Road sti I I must be done. The Clerk is to check the minutes on this matter. Mr. Ze I i nka had no report. Mr. Bohjanen reported on the bad spot on Centervi I le Road and Peltier Drive. There was discussion on putting up "No Parking" signs on Peltier Drive. The Council agreed that Mr. Backlin is to install these signs as soon as possible. Mr. Jaworski will call Mr. Backlin. Mr. Bohjanen also reported on the Flag raising ceromony conducted by the VFW on Memorial Day. The Flag is smaller than the last but this is an all weather Flag. Mr. Bohjanen felt that the Village had started a pattern by flying the Flag 24 hours a day and that the VFW will provide a Flag whenever necessary. Mr. Cardinal felt that flying the Flag 24 hours was fine but it is such a high flag pole that the Flag takes such a beating and we should not fly a ragged Flag such as the last one. Mr. Jaworski moved to only fly the Flag during office hours. Seconded by Mr. Cardinal. 140 May 29, 1973 W. ,OPTier asked if this was because of the condition of the Flag for the last couple of- months? Mr. Jaworski said, Yes, and because the Flag takes such a beating in bad weather becasue of the height of the pole. Mr. Bohjanen said there had been no report to the Council that the Flag was torn, and that the old Flag had been too big for the height of the pole. This one was smaller and is a storm Flag that is used aboard ships and made to be flown 24 hours a day. Mrs. Bohjanen asked who will raise the Flag on Saturdays and Sundays? Mr. Jaworski said the motion was that the Flag only be flown during office hours. Mr. Marier stated "you don't see the Flag flying 24 hours over the County Courthouse, do you ?" Mrs. Bohjanen said she didn't know becasue she didn't live in that community. Mr. Cardinal called for a vote on the motion. The motion passed with Mr. Bohjanen voting, No, and Mr. Zelinka abstaining. Mr. Bohjanen reported that the bugler did a splendid job and felt that a letter of "Thanks" should be mailer to him. He will give the name and address to the Clerk. Mr. Zelinka said the Village had loaned the steam cleaner to Forjay for an experiment last week and he felt that they owed the Village a days rental. If the cost will be computed and a bill mailed to them it will be taken care of. Also, they have purchased two units that are larger than ours and if they are needed by the Village, the units are available. Mr. Locher reported that he had not had a meeting with Mr. Dougherty and no report on the sewer situtuation. The Clerk reported that a Mrs. Larson from the Metro Council wi I I at the Village offices on May 30th. She did not know in what connection. Mr. Jaworski moved to apply the $1 1 ,030 in Federal Revenue Shaa-i ng monies to the Road budget. Seconded by Mr. Marier. Motion carried. Mr. Marier asked for a schedule from the Police Department. He would l i ke the hours the men are scheduled to work -not just the days. Mr. Cardinal asked for total hours worked during the month. Mr. Myhre said this was available from the daily log sheets. He presented a sheet to the Council. Mr. Cardinal said this isn't what he wanted. He asked Mr. Myhre to give the daily log reports to the Clerk for computation. He would like them for the year if possible. Mr. Cardinal moved to have Mr. Myhre turn over the daily log sheets to the Clerk for computation. Seconded by Mr. Zelinka. Motion carried. Mr. Myhre will leave them on her desk. She was instructed to compute the hours for the Counci I . The Council scheduled a meeting with the Police Department on June 4th, 1973 at 8:30 P.M. to work out these problems. Mr. Marier suggested meeting with Mr. Backlin the same evening at 9:30 P.M. This was agreeable with the Council. May 29, 1973 The Council also asked Mr. Myhre to have the schedule worked out including the hours for them to look at that evening. Mr. Zelinka asked if the Council shouldn't take some action on the resign- ation of Mr. Lundberg? Mr. Cardinal moved to accept the resignation of Mr. Virgil Lundberg from the Police Department and the position of Constable. Seconded by Mr. Zel inka. Motion carried unanimously. Mr. Zelinka asked if Mr. Lundberg had put in enough hours in May to warrant 'a pay check for that month? Mr. Jaworski said this can be worked out at the Police meeting on June 4th. Mr. Zelinka reported on the fact that Anoka County now owns the Majestic Golf Course and leases it to the community. The ownership of the golf course at Country Lake had entered into the conversation at the Open Space Meeting and he wondered if this would be something for the Council to look into. There was discussion but no decision was made. Mr. Marier brought the subject of the money in escrow by U,S, LAkes to pay off the Improvement bonds for the water and sewer in the Country Lake area. This should be checked out for the next Council meeting. Mr. Marier also asked Mr. Locher to get a copy of the "Sunshine Law" passed by the Legislature. There was discussion on the age limit on drinking since the new law goes into effect on the 1st of June. Our Ordinance only says "minors" and does not specify the age. Mr. Locher had checked Mr. Cichy's application for a liquor l i cense and found there is no insurance policies. Also, the retail off -sale license must have a $3000.00 surety bond and the one enclosed is only for $1000.00. This will have to be changed. Mr. Marier moved to hold the application until the requirements are fulfi I led. Seconded by Mr. Cardinal. Motion carried. Mr. Jaworski moved to approve requistions #263 through #265, holding #266. Seconded by Mr. Marier. Motion carried. Mr. Jaworski moved to pay bills #5136 through #5150 inclusive. Seconded by Mr. Cardinal. Motion carried. The Council agreed to hold payroll check #2082 for discussion with the Police Department at their meeting on June 4, 1973. Mr. Cardinal moved to adjourn at 11:30 P.M. Seconded by Mr. f arier. Aye.
