The general feeling of the Council was too much had not been included since the area can be cut back according to the wishes of the people at the public hearings. Mr. Carley said i f you order a public hearing for this enti re area, then the people can make their- wishes known at the hearing if sewer isn't wanted in certain areas by the people, then that area can be deleted. But, if you do not order a hearing for a certain area, and these people want to be included, then it must be done by petition or possibly anottyp,r, hearing. Mr. Carley felt that the wise thing to do would be to `ir64�tie study /and hearing for the entire area and delete from it as the people indicate . There was more discussion as to the area covered by this study. What could be deleted or what areas it might not be feaible to service at this time. There was also discussion on the points of hookup to the interceptor and which areas would flow into which lines. Mr. Zelinka moved to authorize Carley Engineering to make a feasibility study for the Village on the area bounded by Baldwin Lake Road To County Road 'J' East on County Road 'J' to highway #49, North on Highway #49 to Birch Street, then along the Southeasterly edge of Baldwin Lake to the Westerly edge of the Village. Aye Minutes approved at the meeting of Aug. 13, 1973..iL,..6_, Clerk-Treasurer August 13, 1973 The regular meeting of the Lino Lakes Village Council was called to order at 8:05 P.M. by Mayor Bohjanen. Councilmen present; Cardinal, Jaworski. Absent; Marier, Zelinka. Mr. Locher and Mr. Gotwald were present. The minutes of the July 23, 1973 meeting were corrected as follows: Page 5, first line, change "Jaworksi" to "Cardinal ". Mr. Cardinal moved to approve the minutes as corrected. Seconded by Mr. Jaworski. Motion carr- ied. There was not a quorum for the approval of the minutes of the special meetings. These minutes were held until such time as Councilmen necessary for approval are present. A gentleman representing the Forest Lake Masonic Lodge appeared before the Council seeking a 3.2 beer permit for August 26, 1973 in connection with a horse show that will held at Rehbein's Arena. The Council re- minded him the Village must have a copy of thei r liability insurance. The gentleman s a i d there wi I I be a copy mai led to the office. Mr. Cardinnl moved to approve the 3.2 Beer permit contingent on proper insurance papers. Seconded by Mr. Jaworski. Motion carried. Mr. Zelinka arrived at 8:20 P.M. 182 August 13, 1973 Mr. Kenneth Gourley appeared before the Council asking that money he has in escrow at Centennial State Bank be released. The plumbing and electric wiring on his home has been brought up to code and has passed final inspection. Mr. Cardinal moved to release this money. Seconded by Mr. Zelinka. Motion carried. The Clerk was instructed to write the bank notifying them of the decision of the Council. The Clerk reported that she had received an informational guide for preparing 1974 municipal budgets and had made copy for each Counci 'man. She read the letter from Mr. Charles Lefebvre, Anoka County Auditor, requesting that the Clerk's office continue with voter registration as in the past. There will be additional instructions from his office at alater date. There was a letter from the Attorney General's office concerning an anti -trust suit against, General Motors, Ford and Chrysler Motors. There was a questionnaire to be fi I led out in regards to vehicles purchased by the Vi I lage since 1968. The Clerk and Mr. Backl in was instructed to check old records for the necessary information and fi I I out the form. There was a survey form on Election procedures practiced by the Village. The Clerk is to fi l I out and return. There were letters from the Metropolitan League of Municipalities, Hennepin County League of Municipalites and League of Minnesota Municipal ites announcing meetings and League dues. These letters were tabled for future consideration. The Clerk had made copies of letters from Mr. Robert Herbst, Metro Sewer Board on the Comprehensive Sewer Plan fi led by Blaine, Rice Creek Water= shed Board concerning Mr. Anderson's driveway on Birch Street, a letter from the Bicentennial Commission, Rice Creek Watershed District Minutes. These were informational letters and needed no action. There was a letter from Mr. Mattke, Centennial School District, in Parks and Rec- reation announcing a meeting on Wednesday, August 15, 1973. Mr. Jaworski and Mr. Boh j anen wi I I try to attend this meeting. Mr. Paul Breher had written asking for the opportunity to submit a quotation for insurace for the Village. This letter was put on file. There was a letter from North Central requesting permission to extend the natural gas line located on Orange Street for an additional 800' in order to service the homes in that area. After looking over the plans and checking with Mr. Gotw lad, the Council gave their approval to the extension with the stipulation that, if, in the future, the lines should interfer with Village construction, it would be the reponsibility of North Central to relocate the line. North Central had also written a letter stating they will be able to meet the gas needs of existing customers and to provide for normal growth for the next heating season. Since the arrival of Mr. Zelinka, there was now a quorum to approve the minutes of the special meetings. The minutes of July 25, 1973 were corrected as fol lows; Page 6, paragraph 6, put period after "Indebtness" and delete the remainer of the sentece. Mr. Jaworski moved to approve the minutes as corrected. Seconded by Mr. Zelinka. Motion carried with Mr. Cardinal abstaining. Mr. Zelinka moved to approve the minutes of July 31, 1973 as presented. Seconded by Mr. Jaworski. Motion carried with Mr. Cardinal abstaining. 1 1 1 August 13, 1973 Mr-. Bohjanen gave a brief report on the NSSSB meeting where our position on the Lino Lakes-Centerville interceptor was confirmed. There seemed to be some doubt on the part of the NSSSB as to the ability of Lino Lakes and Centervi I le to finance mains and laterals to utilize this interceptor Mr. Carley and Mr. Bohjanen assured the Board there was no problem in that area. Mr. Bohjanen also informed them that we would(ontinue to work for this interceptor-. Mr. Gotw I ad reported that, his firm has completed the comprehensive study that was ordered by the Counci I and is ready for printing. He should have it in the Clerk's office by the end of this week. Mr. Bohjanen felt that a joint meeting of the Centerville and Lino Lakes Councils should be set up in order to discuss this situation. He felt there is a better chance to put this over by joint effort of the two Villages. Mr. Bohjanen reported that the misunderstanding with Centervi l le over Police protection had been cleared at the Aug. 6, 1973 meeting with the Police. He had also attended their last Council meeting and had turned over the reports from the Pol ice Department. The Centervi Ile Council has written to the County Sheriff's office asking for more patrol l i ng on the County Roads in this area. Mr. Zelinka felt that a letter should be sent from our Vi I lage with the same request over the signature of the Mayor and the Clerk. Mr. Bohjanen asked the Clerk to formulate such a letter for his signature. The Clerk reported that she had had a complaint on speeding on 20th Avenue South. There was discussion of this problem but since this is a County Road, we cannot post a lower speed limit. The Council also felt that the County would not post it at a lower speed. There was discussion as to how this could be controlled. Mr. Jaworski suggested removing the I i ght from the top of the Fi re Marsha I I's car, equiping it with radar, paint the doors and use it as an unmarked car for traffic control. There was discussion on this idea and Mr. Locher said it could only be used part of the time for that purpose, it will sti I I have to be used as a Fi re Marshal I's car. Mr. Jaworski said the Fire Marshall doesn't use the red light and if he really needed one, a drop light could be put on the inside of the car. Mr. Jaworski moved to re -equip the car as he had suggested. Seconded by Mr. Cardinal. Motion carried. Mr. Cardinal reported that things in the Parks are progressing. There is a requisition for paint for the Hockey Rinks. A boy from the School work program will be here tomorrow morning at 9:00 AM to start painting. The only stipulation is that he must work 8 hours a day for a period of two weeks. If the painting is finished before the two weeks are up, Mr. Backlin wi I I find other work for him to do. Mr. Cardinal asked Mr. Backl in to check on a new door for the warming house at Sunrise Park. Mr. Bohjanen asked Mr. Cardinal if they had found a building to be used as a warming house at the Hall property. Mr. Cardinal said, "Not yet." 184 August 13, 1973 Mr. Jaworski brought up the subject of the pond in front of the Hall. Should it be filled inlor the bottom sealed and maintained as a pond? There was discussion on both ideas with Mr. Bohjanen asking Mr. Cardinal to have the Park Board make a study and bring a recommendation to the next Council meeting. Mr. Jaworski reported that he had attended the Columbus Township Board meeting and discussed Pine Street with them. They have discussed this subject and have concluded that there just ins't enough money in their road budget this year to do any work on this street. They are checking into the idea of purchasing equipment to enable them to do their on road work. They are discussing the purchase of a Seman mixer for $1,500.00. They would like Lino Lakes to go in with them on this purchase on a 50/50 basis. The cost figures will beComputed and compared with contract figures for the feasibility of this move. The Counci 1 asked that Mr. Jaworski keep in contact with them on this idea. Mr. Bohjanen asked about dust control on P,,ne Street near the Rehbein Arena, especially on days when they have a horse show. There was dis- cussion on the use of used crank case of I . Mr. Back I i n is to check with Centervi I le- find out who did it for them and the cost. Mr. Jaworski asked the Clerk how much of the bid price on the road con- tract had been paid to H &S? She said only the two checks she didn't have the exact figures. Mr. Jaworski said since we will not be surfacing Pine Street or 24th Ave., he would like to put a 1" mat on a portion of Ware Road. Mr. Gotwald brought up the subject of the street being torn up if Mr. Rehbein gets the approval to lay his sewer lines. There was discussion on where the lines would be laid. Mr. Jaworski said that he would like to use the surplus money in the contract to seal coat the street that we had put road mi<x on this year. Mr. GotwaLd said if this would be done, there would be a good surface on all these streets. He would recommend an 1" over ~lay on Ware Road. Mr. Zelinka moved to authorize H &S Asphalt under Mr. Jaworski's super- vision, to put a 1" hot mix overlay on Ware Road from Birch Street to 62nd street providing this can be worked within the contract amount. Seconded by Mr. Cardinal. Motion carried. Mr. Zelinka moved to seal coat Holly, 12th Ave., 77th St., 80th St., and East and West Rondeau Lake Road before doing the work on Ware Road. Seconded by Mr. Cardinal. Motion carried. Mr. Backlin brought up the repair work needed on a section of 24th near Mr. Houle's place. There was discussion on how this could be repaired. Mr. Zelinka will have an Enviornmental Commission report for the next Council meeting and he wi 11 aslo write up the Police report for Mr. Bohjanen. He reported a car, License #3ND392, has been parked on the shoulder of the street just North of his house on Lakeview for several weeks. He asked that the Police check this out. The Clerk will give the information to the Police. 1 1 August 13, 1973 The sign permit application for the VFW was reviewed. I t had been recommended for approval by the P&Z with the stipulation that it be anchored at the bottom of the sign so as to eliminate the possiblity of the sign swinging in the wind. Mr. Cardinal moved to approve the sign application with the recommendations of the P &Z added to the permit. Seconded by Mr. Zelinka. Motion carried. Mr. Locher reported that Mr-. Bruder has merged with a company based in Anoka. Mr. Locher had contracted Mr-. Hausladen and the lowest price that he will consider for the lot on Maple Street is $1,150.00. Mr. Julkowski wants $600.00 clear and we assume the back taxes and interest. There was much discussion on this with Mr. Zelinka asking if we can offer a fee for an option to buy providing we can find the previous owners, Mr. and Mrs. Swanson inorder to obtain clear title. Mr. Locher said we cannot take an option to buy, this isn't legal, we cowld buy on a contract for deed and, if clear title is not obtained, drop the contract. There was more discussion on this with Mr. Zelinka feeling that we should proceed with this. Mr. Zelinka moved to authorize the Attorney to proceed to acquire the property from Mr. Hausladen for- $ I, 150.00. Seconded by Mr. Jaworski. Motion carried. Mr. Zelinka moved to authorize Mr. Locher to try to locate Mr. and Mrs. Swanson for clear title. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski moved to purchase the property from mr. Julkowski for $600.00 with the Village assuming the taxes and penalties due. Seconded by Mr. Cardinal. Motion carried. Mr. Locher wi II try to have the deeds ready for the next Council meeting and the Clerk is to have the checks written. Mr. Locher reported on the Birchwood Hills Stables court case. This case was lost because of lack of proof and witnesses who were unalbe to appear. There was discussion on this problem with the main point of contention being that horses are being rented out for riding purposes after revocation of the special use permit. The Clerk had had a call from a lady who said her daughter had paid to ride there this past Sunday, had been thrown after- about 5 minutes, had been refused another horse and /or a refund of her money. Four friends of hers had paid $16.00 to ride for 30 minutes. She had said she would put this information in a letter and mail to our Police Department. Mr. Locher had talked to Mr. Virgil Lundberg tonight and Mr. Lundberg felt that the time off in May coincided with his vacation from his regular job and he had always been paid in the past for such time off. Also, he had handled calls during that time and had on some occasions, used his private car. He had not kept a record of this since all materials were in the Patrol cars. He felt that he was entitled to 3 weeks pay which would amount to $150.00. 185 186 August 13, 1973 Mr. Bohjanen felt that Patrolmen should keep a log regardless of what car is used, private or Police. Mr. Jaworski said our Ordinance does not apply to the Pol icemen and no where is there a requirement as to how many hours they must work in order to quality for a paycheck. Mr. Cardinal said the understanding he has is, if we pay Mr. Lundberg he wi I I return the uniforms and equipment that he has. This was the under- standing of Mr. Locher. Mr. Locher- wi I I call Mr. Lundberg tonight and inform him that the Counci I wi I I pay him for 3 weeks upon the receipt of Village property in his possession. The easement request of the Minnesota Pipeline Company was discussed. There are many facets of this request that does not meet with Council approval. Mr. Locher was instructed to inform the Company that since the easement runs through a ball diamond at the Hall property, that the land must be restored to its original state including the restoration of the fence. They wi I I waive damage payment i f the topsoi I is restored and the land is properly seeded. Mr-. Locher had talked to Mr. LeVesseur about the fence at Lino Park. Mr. LeVesseur would not I i ke to have to move the fence, but wi 11 if it is necessary. Mr. Locher suggested that before any decision could be made, it would be necessary to locate the fence line and draw it in on the sketch. Mr. Gotwlad said that would not be a problem. Mr-. Jaworski moved to authorize Mr. Gotwlad to locate the fence, straighten the Park lines and to negoiate with Mr-. LeVessuer on the oast of the survey. Seconded by Mr. Ze I i nka. Motion carried. Mr-. Locher said that all people that he had contacted in reference to the ForJay operation agreed that this is strictly an agricultural operation. Since this is an ag operation, no bui (ding permits are needed. The buildings are being sold from an office located within the 300' commercial zone, thus presenting no problem as to that phase of the operations. Mr. Locher had received a call from Mr. Paul Albrecht about shooting on property he owns on the East side of the Village. He felt that our signs prohibiting single shot firing but allowing shotguns should be reworded and that they were too close to his property thus giving the impression that shotgun shooting was allowed there. He said there is no mention of Lino Lakes on the signs. Mr-. Jaworski didn't feel that it was necessary to mention the Village name since these signs are within the corporate limits of the Village. The problem of the Omar Cardinal property is being resolved. Mr. Locher gave the Clerk the signed copy of the contract with the Metro Sewer Board. He said that the method of col lecting the SAC seemed to be the one used by most Villages. Mr. Gotwald agreed that the municipalities that he has contact with are using this method. In conjunction with this contract, Mr. Locher asked what the Council's wishes were on Ordinance #57B. 1 1 1 1 1 August 13, 1973 The Councilmen have had copies of this Ordinance for some time. Mr. Jaworski moved to adopt Ordinance 57B. Seconded by Mr. Ze I i nka. Motion carried. Mr. Locher w i l l arrange for the legal pub I i cation of this Ordinace. Mr-. Jaworski reported that the new Patrol car has a funny sound in the rear end at certain speeds and should be teturned for a check before the warranty expires. He asked that Mr. Back I i n arrange for the car to be taken in tomorrow. The Clerk will assist if necessary. The Clerk is to call Mr-. Glen Rehbein and inform him that the installa- tion of the street signs in Shenandoah is his responsibi lity and if they are put in by the Village, he will be billed for the cost. Mr-. Backl in said there are no more water meters on hand - should he make out a requisition for them or just order? The Council asked that he make out a requisition for 1 0 meters so we w i I I have some on hand. Mr. Backl in also reported that the intersection of East Shadow Lake Drive and Lantern Lane needs to be repaired. There was discussion on who was responsible for this work. Since the streets have not been accepted by the Vi I lage, Mr. Jaworksi moved to have the Clerk write to U.S. LAkes asking them to have the street repaired. If the street is not repaired to the satisfaction of our inspector, the bonds will not be released on Sept. 15, 1973. Seconded by Mr. Cardinal. Motion carried.. Mr. Jaworski wondered what kind of operation was being carried on at Skyline Auto Body. There seems to be a lot of steel beams in the area. He asked just what could be done a commercial zone such as this. Mr. Locher read the I ist and could not determine i f what they are doing is legal or not. The P &Z is to ask about it at their meeting on Aug. 15, 1973. Mr. Locher had made his call to Mr. Lundberg and Mr. Lundberg had agreed to accept $150.00. He will return the equipment on Wed. Aug. 15, 1973. The Clerk is to write his payroll check and Mr. Bohjanen will stop in and sign it before that time. Mr. Cardinal moved to approve requisition #282 through #292, holding #'s 283 and 286. Seconded by Mr. Jaworski. Motion carried.
