HomeMy WebLinkAbout11/12/1973 Council MinutesNovember 7, 1973 Mr. Marier said that he had read all the Candidates accomplishments throughout the years and was concerned about who was taking credit for what. The next ten years will prove who has done the job with the necessary cooperation, interest and particulary the interest of the taxpayer. He was suprised at the tenuous tone of present accomplishments and information in all departments. He had served with the P &Z for 2 years and to the best of his knowledge, the Mayor had only attended one meeting in the two years. He felt that the Mayor should balance the budget and present it to the Council and not the other way around. The Mayor should also attend some of the Park Board meetings, which was not being done at the present time. Mr. Marier pointed out to the Council that Councilwoman Swanson formulated present procedures and acted on them to their present status. He also felt that the Mayor should take a more positive and active part in the Open Space Program for the Village. Mr. Marier moved to accept the ballot totals as presented by the Clerk and to certify the results to the County Auditor. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski moved to adjourn at 8:20 P. M. Seconded by Mr. Marier. Aye. November 12, 1973 The regular meeting of the Lino Lakes. Village Council was called to order at 8:03P. M. on November 12, 1973 by Mayor Bohjanen. Councilmen present; Cardinal; Jaworski; Absent; Marier, Zelinka. Mr. Hawkins was here to substitute for Mr. Locher who is out of town. Since the necessary quorum to correct the minutes was not present, Mr. Jaworski moved to table the approval of the minutes until such time as a quorum was present. Seconded by Mr. Cardinal. Motion carried. The Clerk reported that a Resolution was necessary to designate the roads to be plowed by the County. Mr. Jaworski moved to have the County plow; 64th St., both East and West; Handen's Road; Cedar Street from the Centerville limits to I35E; LaMotte Road; and the cut -off portion of Birch Street now designated as a service road; With the County to plow the West side of Centerville Lake and the Village to plow Peltier. Seconded by Mr. Cardinal. Motion carried. Mr. Jaworski requested that an itemized statement as to hours on each road be included with the statement from the County. Mr. Zelinka arrived during the above discussion. The Clerk had received a Fire Contract Renewal from the Village of Lexington. Each Councilman has a copy of this. There was some discussion on the request for 10 year contract. Mr. Cardinal moved to approve this contract for the one year with the length of the contract to be negotiated at a later date. Mr. Zelinka felt that the mathematical errors should be corrected before we approve this contract. Mr. Cardinal withdrew his motion. Mr. Cardinal moved to table this contract until figures are clarified. Seconded by Mr. Jaworski. Motion carried. Mr. Zelinka moved to approve the minutes of Oct. 23, 1973 as corrected. Seconded by Mr. Jaworski. Motion carried with Mr. Cardinal abstaining. f November 12, 1973 Mr. Jaworski moved to approve the minutes of November 7, 1973 with the stip- ulation that if Mr. Marier feels there are corrections to be made, he can do so at a later date. Motion died for lack of a second. Mr. Zelinka moved to put the approval of these minutes on the agenda for November 26, 1973. Seconded by Mr. Jaworski. Motion carried. The applications for the Deputy - Clerk's position was reviewed. The Clerk recommended the hiring of Joanne Pankratz. After some discussion Mr. Cardinal moved to hire Joanne Pankratz as permanent full time Deputy- Clerk. Seconded by Mr. Zelinka. Motion carried. The Clerk asked that the Personnel Commission review the Deputy- Clerk's duties with the idea of appointing her as Deputy- Clerk - Treasurer and having her bonded so that when the Clerk is absent for whatever reasons the business of the Village can be done. The Council agreed with this and directed Mr. Zelinka to take this up with the Personel Commission. Mr. Cardinal made a resolution authorizing the Clerk to cash the Certificates of Deposits bought with SAC funds and transfer the monies in the General Fund. Seconded by Mr. Jaworski. Motion carried. 1 The Clerk read the reports from Mr. Dupre concerning the trailer on Highway #49. He stated that no one is living in the trailer and it is not connected in any way. The Council agreed that if it is only parked there is nothing to be done. As to the house on Gladstone, Mr. Dupre felt that it should be torn down and be rebuilt salvaging the useable lumber. Mr. Jaworski moved to instruct the Building Inspector to condemn the building and instruct the owner to rase. A time limit to be set after condemnation. Seconded by Mr. Cardinal. Motion Carried. The North Central Natural Gas Rate Authority on Gas Rates was discussed. Mr. Jaworski felt that because of the inconsistency of the gas rate that the Village should join this North Natural Gas Rate Authority and he so moved. Mr. Cardinal seconded. Mr. cardinal asked Mr. Hawkins if there would be dues in connection with membership in this orginazation. Mr. Hawkins said he wasn't sure at this time, but thought there would probably be some dues to defray adminstration costs. Mr. Clem frazer asked if this orginazation would look into discrepancies in bills. Mr. Hawkins thought that the main purpose of the orgazation was to study differences in rates not billings. Mr. Bohjanen felt this was one of the questions that would be asked at the meetings. The motion carried. The Clerk reported that a Bingo permit had been issued to the Lino. Mother's Club for last Friday Night. Mr. Jaworski moved to ratify the issuance of the permit. Seconded by Mr. Cardinal. Motion carried. A member of the Lino Athletic Associa- tion requested the use of the Hall for a meeting of that organazation for November 28, 1973. Since that date is open the request was granted. He apologized for the delay in the request for the Bingo permit, saying it was caused by a mix -up and thanked the Council for rushing it through. There was a questionaire from the League of Municipalities concerning the dates of our elections under the new law and some other questions pertaining the same law. Mr. Jaworski moved to table this until the first or second meeting in 1 1 November 12, 1973 January. Seconded by Mr. Cardinal.'Motion carried. 217 The Clerk had a request from St. Joseph's Catholic Church for a Bingo permit for Sunday, November 18, 1973. Mr. Cardinal moved to grant the permit. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski asked the clerk to check on the fact that this had already been granted at a previous meeting. The Clerk had received a letter from the Lino Lions Club stating that they had paid $2000.00 to Mary Rehbein for work done on Lino Park. The remainder of this bill will be sent to the Village. There was also a letter from the Anoka County Park Board concerning the purchase of some land owned by the Village to be included in the Open Space Program. Also, a letter from the State Highway Department in response to our Land Use Maps that were presented to the Metro Council. All Council members have copies of this letter. Mr. Bohjanen had the Clerk read a letter of resignation from Mr. Arthur Hawkins of the Enviornmental commission. Mr. Cardinal moved to accept the resignation with regrets. Seconded by Mr. Zelinka. Motion carried. The Clerk was asked to write a letter of thanks to Mr. Hawkins. Mr. Bohjanen said that Mrs. Sawyer will also be resigning from that Commission due to health problems. The Clerk read a letter from Chief Myhre recommending the promotion of Sal Costa to Sergeant. Mr. Zelinka moved to approve the promotion. Seconded by Mr. Cardinal. Motion carried. She also read a letter of resignation from Patrolman Richard Hauer effective November 30, 1973. Mr Cardinal moved to accept the resignation. Seconded by Mr. Zelinka. Motion carried. The Clerk was instructed to write a letter of thanks to both Mr. Hauer and Mr. Johnson who had resigned previously. The specs for the Patrol Car was discussed. Since the purchase of this vehicle is in the 1974 budget, Mr. Cardinal moved to table the publication of the ads for bids until the second meeting in December. Seconded by Mr. Zelinka. Motion carried. There was discussion on the fact that the last meeting in December falls on Christmas Eve. Mr. Zelinka moved to hold the second meeting in December on the 26th. Seconded by Mr. Cardinal. Motion carried. Mr. Bohjanen had received a call from Mr. Mel Carter on the amount of damages done in the installation of the Pipe Line. There was discussion on the damage done to East Rondeau Lake Road by the cats used by the company. Mr. Jaworski moved to authorize Mr. Gotwald to inspect the road and the ball diamond, compute damages and to inform Mr. Carter. Seconded by Mr. Cardinal. Motion carried. Mr. Bohjanen had asked the Councilmen to submit names for the Advisory Board for the Forest Lake Council. He would like to submit the name of Mr. Frank Resch as chairman for this position. Mr. Jaworski so moved. Seconded by Mr. Bohjanen. Motion carried. Mr. Resch is to pick the four members to serve with him and submit their names for Council approval. Mr. Cardinal reported that Mr. Webster had a problem with a motor home turning around in his yard and the driver and passengers getting into a brawl with Mr. Webster. He thought our Police Department was quite slow in arriving and he would like the Plice to contact him so he can press charges against the driver. 218 November 12, 1973 Mr. Myhre will take care of this. Where had been a Park Board meeting. Mr. Kent had called and arranged for the trailer to be used as a warming house and they will submit a list of names of people who will be at the trailer to supervise the children. Mr. Backlin is checking on the acquisition of poles for the lights. The tractor was discussed and Mr. Cardinal was asked to get some cost figures . for a replacement. Mr. Jaworski had talked to a contractor about the size of the metal building and found there is no penalty because ofthe building not being in even increments as to the footage. He has no prices as yet. Mr. Zelinka reported that due to a mix up he had missed the last Personel Commission meeting and had no other report. Mr. Hawkins had looked over the certificate of forfeiture land that the County would like to sell. Since the Village has no need of this piece of land, he would recommend that the Council sign the release so the County can proceed with the sale. Mr. Zelinka moved to grant the County the right to sell Lot 9, Block 2, Lexington Park Lakeview Additon. Seconded by Mr. Cardinal. Motion carried. Mr. Hawkins had checked the application Of Mr. William Hemauer for the off -sale liquor license now located at the Freeman's Bottle Shop. The papers were all in order. Mr. Cardinal moved to approve the application. Seconded Mr. Jaworski. Motion carried. Mr. Gotwald had checked the requests of Northwestern Bell for permission to install buried cable. He recommended approval of both locations. Mr. Cardinal moved to approve the requests to install buried cable on LaMotte Road and on Park Property and on 12th Avenue South and Holly Drive. Seconded by Mr. Jaworski. Motion carried. Maps of these locations are on file in the Clerk's office. Mr. Gotwald was questioned on the sandwashing into 'the 'Reshanau Lake from the storm sewer. He said this is a maintenance problem. The catch basin should be cleaned and the sand bar will have to be washed down every so often. Mr. Gotwald also discussed the final payment to H & S Asphalt. This figure is correct. He reported that there had been no word from the MSB. There was also discussion on the need for Lino Lakes and White Bear Township to get together to discuss the sewers in the South East corner of the Village. Mr. Jaworski questioned this since if more then one Municipality is serviced by an interceptor it them becomes a Metro interceptor. Mr. Gotwald said only if it services 1000 acres or more. Mr. Zelinka moved to have :Mr. Gotwald write to White Bear Township suggesting this study be started and slao to send a copy of this letter to the MSB. Seconded by Mr. Cardinal. Motion carried. Mr. Zelinka reported that he had met with two former Mayors to discuss their intentions when the residency requirement was written into the liquor ordinance. The general feeling was that for off -sale there was less likelyhood of requiring Police action and less problems of unwise behavior. They felt that residency was not a requirement for an off -sale license. But with the on -sale licenses, two of the following requirements must be met; 1.) Driver's License with Lino Lakes listed as Legal address; 2.) Registered voter and record of having voted in the Village of Lino Lakes; or 3.) An actual resident of the Village. He is still working on this and is waiting for an opinion from Mr. Locher. He will November 12, 1973 write a report on his findings and present it to the Council at a later date. Mr. Jaworski said there was some question as to who qualifies for Sunday Liquor Licenses. An Attorney General's ruling said the liquor should be served in conjunction with food not the reverse. He felt that there should be some checking done on this before the new licenses are issued. Mr. Frazer asked the Council to contact Judge Knutson and request that he have Mr. Bruder show why he has not complied with the Court order to clean up his property. He had been given 30 days to complete the job and the time expires this week. Mr. Jaworski suggested having the Attorney attend this hearing and request that the County clean up the property. Mr. Hawkins explained that the Court can only issue a fine or a jail term, they cannot issue such orders. In order to have this done it must go to District Court. Mr. Jaworski moved to instruct Mr. Locher to start action in District Court to have this property cleaned up by the County and assessed against the property. Seconded by Mr. Zelinka. Motion carried. Under new business, Mr. Jaworski brought up the "Citzen of the Year Award ". He asked that the Council members be thinking of a nominee. He asked that they follow the same procedure as in previous years and that the name not be made public until the award is presented. Mr. Cardinalmoved to approve requisitions #323 through #332. Seconded by Mr. Zelinka. Motion carried. Mr. Jaworski moved to approve the bills #5407 through #5347 inclusive. Seconded by Mr. Zelinka. Motion carried. Mr. Cardinal requested that the papers represented here tonight include in their reports the fact that shooting with a single projectile, which includes shotgun slugs, is illegal within the Village limits. Deer hunting is against the law except with bow and arrow. Mr. Jaworski moved to adjourn at 9:55 P.M. Seconded by Mr. Zelinka. Aye. The minutes approved at the meeting of November 26, 1973.
