HomeMy WebLinkAbout04/08/1974 Council Minutes1 1 1 269 April 8, 1974 The regular meeting of the Lino Lakes City Council was called to order at 8:00 p.m. by Mayor Bohjanen. Councilmen present; Jaworski, Marier, McLean. Absent; Zelinka. Mr. Locher and Mr. Gotwald were also present. Mr. Marier moved to approve the minutes as corrected. Seconded by M. Jaworski. Motion carried. The Clerk reported: She had received notice of some tax forfeit land available - Lot 9, Block 2, Lexington Park Lakeview addition. Mr. Marier moved to table this until April 22, 1974. Seconded by Mr. Jaworski. Motion carried. Had received a letter from Mr. Askew dealing with the agreement between Anoka County and Lino Lakes with reference to the Chain of Lakes Park Development. Mr. Locher reported that he has a copy of the same letter and the map. On the map they have included parcel 2 and the land area that was to be a golf course in the Country Lakes area. He also has copies of the agreement signed by the Anoka County Commissioners and need the signatures of the Council of Lino Lakes. Mr. Marier asked if by signing this agreement, this legally binds the Board of Commissioners? Mr. Locher said it binds the Board of Commissioners and also this Council. He said it represents a statement of intent and feels there is a moral responsibility on future Boards and Councils to abide by this agreement. Mr. Marier asked if this document was legal? Mr. Locher said, Yes, Mr. Marier asked, if with the maximum of 2500 acres to be acquired by the County we discover that more is being taken, do we challenge? Mr. Locher said, Yes, but the burden of proof would be with the City. Mr. McLean asked if the agreement meant that the 2500 acres are to be taken within the boundaries as defined on the map? Mr. Locher said, Yes. Mr. McLean asked if we compute what is being taken within this boundary and find that the acreage is too much, then we challenge? Mr. Locher said, Yes. Mr. Marier suggested having Mr. Gotwald make an overlay by which the total acreage could be computed. He so moved. Seconded by Mr. Jaworski. Motion carried. Mr. Gotwald said he would first check with the County. Mr. Marier asked the Clerk to make note in the minutes of the fact that Mr. Gotwald has the copy of Exhibit "A". Mr. Mclean moved to ratify the agreement as presented and authorize signatures of the Mayor and Clerk. Seconded by Mr. Jaworski. Motion carried. The Clerk read a letter from the County Attorney: announcing a hearing on the condemnation of certain parcels of land. The only interest of the City lies in the special assessments and unpaid taxes. Mr. Locher asked if he should attend this meeting. Mr. McLean moved to authorize Mr. Locher to attend the hearing. Seconded by Mr. Jaworski. Motion carried. 270 April 8, 1974 The Clerk reported that a Federal Revenue Sharing Check in the amount of $7,188.00 had been received; $70.12 for sale of tax forfeit land; $8,382.30 in back tax settlement. She had received a call about a security light on the corner of Birch and Hokah Dr. in the Shenandoah project that Mr. Rehbein is having disconnected. The Resident asked if this light could be taken over by the City and left. Mr. Jaworski moved to have the City assume the cost for this street light. Seconded by Mr. McLean. Motion carried. Mr. Jqworski handed a letter to Mr. Bohjanen from Mr. Kronholm. Mr. Bohj anen asked the Clerk to read the letter. Mr. Kronholm thanked the Mayor and Councilmen and all the individuals involved with assisting at the time of the kidnapping. Mr. Bohjanen suggested that at this time the problems of the roads in Shenandoah be taken up. He explained that before anything can be done<in that area, the City must have more information as to the status of the interceptor. At the present time, the Comprehensive Plan is being tied up by the Engineer with the Metro Council. Mr. Bohjanen asked Mr. Gotwald if he had any more information. Mr. Gotwald said there is no change from the last month's report. The Metro Sewer Board is waiting for a report from the Metro Council Enginner. He had talked with the Sewer Board this day and he had been told that the report should be in some time this week. A lady from the audience asked what happened a year ago. This was supposed to be taken care of at that time. Mr. Gotwald said that the status of the Interceptor hasn't changed in the last year. The mains and laterals cannot be installed in the Shenandoah Project until the interceptor is installed. If not, there is a possibility of either one or the other being lower or higher and this would necessitate the use of a lift station. A gentleman from the audience asked what had to be done to bring the street up to City standards. He said that Glenn Rehbein had promised roads last September. The roads in the area are impassable. He said he was investigating the possibility of legal action to force the installation of the streets in the Shenandoah project. Mr. Bohjanen told the gentleman that the installation of the street surfaces depends on the installation of the interceptor. Mr. Gotwald repeated that Mr. Rehbein cannot complete the streets until the mains and laterals are in and they cannot be installed until the interceptor is engineered and the grade is set. The mains and laterals for that project have been designed and have been approved by the PCA, but have not been approved by the MSB of the Metro Council. Someone asked about the high water table in that area. Mr. Gotwald said there is a water problem only on some lots, the borings done in that area were favorable. Mr. Rehbein said the problem is that the water is being trapped. The thawing during the day and freezing at night is causing the problems. He cannot install a storm sewer because the mains must go below the storm sewer. 1 1 April 8, 1974 There was more discussion on the possibilities of making these streets passable until there is work on the interceptor. Mr. Rehbein will do all he can. Mr. Gotwald made note of the fact that it would be 6 to 8 weeks before any work could be done on those streets and by the time there should be an answer from the Metro Council as to the status of the interceptor. A paper was passed for the people to sign. Mrs. James Kohler remarked that their road is also impassable and their car must be parked out at the end and they have to walk in. This is Mound Trail and is supposed to be maintained by the County. Mr. Jaworski suggested to Mr. Backlin that from now on if the roads that are supposed to be kept up by the County aren't then he should see that the work is done. Mr. Jaworski suggested that the only way the Metro Council is going to approve the interceptor is for us to present a need and force the issue. The way to show a need is if pipe is already in the ground. He would like for the Council to consider giving approval to Mr. Rehbein for the installation of his mains and laterals and haul the sewage as is now being done in Country Lakes. Mr. Marier asked for how long? Mr. Jaworski said for as long as it takes to get the interceptor. Mr. Rehbein had agreed to pay for the cost of hauling. Mr. Rehbein agreed with Mr. Jaworski. He would pay for his share of the cost of pumping the sewage from the Shenandoah project. He felt that this is a way to put pressure on the Metro Council for approval of the interceptor. Mr. Rehbein asked Mr. Locher what legal rights do they have in this matter? Can the City instagate a law suit? Mr. Locher said that a law suit would be unwise, 1.) it would be long, 2.) it would be costly; and 3.) there is no assurance of the outcome. He felt that other areas are pressuring the Metro Council for the cancellation of this interceptor and there is not much the City can do. Mr. Maisio asked who puts culverts under roads to drain water. He has water standing along the street in front of a home he built on Orange Street and felt that if there was a culvert under the street the water would drain. Mr. Jaworski said the City puts the culverts under the streets but the owner must put their driveway culverts in. Also, water cannot be drained onto another property owners land. He pointed out that this is not an accepted City Street. Mr. Backlin reported that he had talked to Mr. Maisio and had advised him to lower the road below the yard level, then slope it to the swamp, cover with Class 5, then there would be no water problem. Mr. Maisio said that the water standing in the ditches keep the roads soft - if the water was drained off, the road would be dry. Mr. Jaworski moved to have the Clerk to contact Mr. Bud Sauter and have him start the work on Orange Street immediately. Seconded by Mr. Marier. Motion carried. Mr. Bohjanen presented the Fire Marshall's report. He had inspected two gas tanks and written citations for violation of the Ordinance. He gave them 30 days to either bury or remove. He has been inspecting business places for fire extinguishers and will have a full report for the next Council meeting. There is a State Fire school that Mr. Bohjanen felt the Fire Marshall should attend. Mr. McLean so moved. Seconded by Mr. Jaworski. Motion carried. 272 April 8, 1974 Mr. Jaworski reported on the prices of the dump truck according to the specs. He suggested going to a standard transmission because of cost and delivery time involved with an automatic. He also suggested omitting the two way plow because of cost. The total cost that Mr. Bscklin had given him was approximately $15,500.00. Mr. Jaworski emphaized this is not a bid price. Mr. Marier asked how much was approiated in the budget for this truck? Mr. Jaworski said, $10,000.00 had been budgeted. Mr. Marier asked where he planned on acquiring the extra $5,000.00. Mr. Jaworski felt that it could be worked out within the budget. Mr. Rehbein offered the information on the cost of some trucks he had just purchased. Mr. Marier moved to table the consideration of the truck until we could assess this information. Seconded by Mr. Jaworski. Motion carried. Mr. Jaworski asked,'Mr. Locher if the Open Meeting Law covers all municipal meetings? Mr. Locher said, Yes. Mr. Jaworski asked if this would cover the Utilities Commission meetings? Mr. Locher said, Yes,. is part of the municipal operation. Mr. Jaworski said the last two Circle Pines Utility Commission meetings had been called for Saturday morning at 7:30 a.m. and the City office had been notified last Friday afternoon. Mr. Jaworski moved to have the Clerk write and ask where their announcements of the meetings are posted and when in order for us to be able to know when the meetings are planned so the liaison from the Council can make arrangements to attend. Seconded by Mr. McLean. Motion carried. Mr. Jaworski made note of the fact that there is still a political sign standing on the service road east of the freeway. He suggested that the owner of the sign remove it. Mr. Bohjanen said that he would take care of it immediately. Mr. Jaworski said that on Saturday two of the City employees had been jumped because they had met with him at Hank's cafe. He said if he wanted to call a meeting with the men after hours, he would meet with them any place he chooses and if any one had any problems with the roads or where the employees met with him, they are to see him and not reprimand the employees. Mr. Marier asked about the signs that Mr. Amundsen had turned in as having no permits. The Clerk reported that about 6 of them have been turned in and paid for. Mr. Marier asked if a time limit had been put on the notice. The Clerk said they were supposed to be in by April 15, 1974. He asked Mr. Jaworski if he had made any plans as to what was to be done on what roads this summer. He felt in view of the oil ahortage, these plans should be made soon and presented to the Council. Mr. Jaworski agreed and felt that he could have this information by the next Council meeting. He felt that amount of new work we do depends oft how much reworking has to be done on the roads that were surfaced last year. Mr. Marier felt that the Country Lakes project is at a standstill. He moved that the Clerk prepare a complete financial report on the status of the special assess- ments and the $550,000.00 bond issue in that area, and have it ready for the next Council meeting. Seconded by Mr. McLean. Motion carried. This subject is to be put on the agenda. 1 1 1 1 1 1 '7 3 April 8, 1974 Mr. Marier moved to have the Clerk find out about the tax deliquent land included in the Open Space program. What is the County's responsibility in reference to this matter. She is to find out how much is deliquent and what the County plans to do and when. Seconded by Mr. Jaworski. Motion carried. The Clerk was informed that the complete list was in the Blaine Life. Mr. Bohjanen said he had an extra copy and will drop it off at the office. Mr. McLean said he had no suggested changes of Ordinance #57A. He asked if any of the Council had any questions or suggested changes. There was none. Mr. McLean moved to approve Ordinance 57A as presented and to publish. Seconded by Mr. Marier. Motion carried. Mr. McLean presented two bids on fencing for Lino Park. One from North Suburban for $2250.00 for 890' and $2.50 for each each lineal foot; one fromkSears for $246.05 for 890' and $2.38 for each extra lineal foot. In reviewing the Park it was computed that 940' of fencing would be needed to enclose the Park. In reviewing the total cost, Mr. McLean moved to accept the lowest bid of $2375.00 from North Suburban Fence Company, the installation to be supervised by Mr. Gotwald. Mr. Marier asked who is to pay for this fence. Mr. McLean said this would be paid for by the City. This would use the amount set aside by the City for the years of 1973 and 1974. Motion was seconded by Mr. Marier. Motion carried. Mr. McLean asked about the status of the Skyline Auto Body operation. Mr. Bohjanen said he had talked with Mary and it was felt that the citation should be signed by the Building Inspector. Mr. Marier did not think that the Building Inspector could issue a citation; he didn't think this would be legal. He thought the Building Inspector could co -sign the citation. Mr. Jaworski asked who the citation is to be issued to. Mr. Marier said Able Systems. They constructed the building without a permit and told the Council that it was only temporary and would be removed at the Council's request. They have been asked to remove the structure and have not compiled. Mr. Locher said that both parties could be tagged. Mr. Marier moved to have the Police and Building Inspector issue a citation to Able Systems and Skyline Auto body and enforce the Ordinance. Seconded by Mr. McLean. Motion carried. Mr. Locher presented the Ordinance prohibiting parking or putting anything on the streets especially blocking snow plowing. The Councilmen had read the Ordinance and had no additions or changes. Mr. Jaworski moved to adopt the Ordinance. Seconded by Mr. Marier. Motion carried. Mr. Jaworski asked the status of Mr. Bruder. Mr. Locher said he had talked with Mr. Bruder's employer and had been assured as soon as the snow went they would start cleaning up the property, especially the old truck. `2 4 April 8, 1974 Mr. Jaworski said the old car is gone from in front of the home but the old truck is still there. Mr. Locher said that Mrs. Delong had called and said that Mr. Bruder is storing junk on her property. He talked to Mr. Bruder who said it was only a snow fence and he would remove it. Mr. McLean asked if the variance for the transfer of the land involved in realigning Lino Park is ready. The Clerk said they are ready for the P &Z to consider at their next meeting. Mr. McLean was concerned this would interfer with the installation of the fence, Mr. Locher said that it would not. Mr. Gotwald had received a letter from Suburban Engineering asking for permission to install sewer and water service to the town house units in Country Lakes. This will have to cross a street so the damage will have to be computed in order fo the firm to post a bond. Mr. Gotwald will compute this cost and have ready for the P &Z. Also there is no street into these buildings. Mr. McLean moved that - Suburban Engineering be asked to bring their plans for the street and sewer to the P &Z. Seconded by Mr. Jaworski. Motion carried. There was no old business. Under new business, Mrs. Leible said that she had spoke with Mr. Burman and he told her that no final decision had been made as to Parcel 2. Did she understand that the Council has the final decision as to what happens to this parcel of land. Mr. Marier said, No, the Council has absolutely nothing to say as to what happens to this land. They will not make a committment. The decision will probably be made when the decision on the placement of the street is made. Mr. Marier questioned the requisition for the walkie- talkie. Why do we need three channels. Chief Myhre explained what the channels are for and why the old one won't work with the new set up at Anoka. This unit is used when a Patrolman leaves the car. They can still be in contact with the dispatcher and other cars in the area. There was discussion on setting up proper procedure and planning for the acquisistion of new equipment. These items should be planned for and put in the budget. There was discussion on the need for a plan to upgrade the equipment and certain items put in the budget in order for the Council to know where they stand. Mr. Jaworski moved to approve requisitions #399 - 403 - 406 - 407 -408. Seconded by Mr. Marier. Motion carried. Mr. Jaworski moved to pay bills #5679 through #5704 inclusive. Seconded by Mr. McLean. Motion carried. Mr. Jaworski moved to adjourn at 10:10 p.m. Seconded by Mr. arier. Aye. The minutes were approved at the April 22, 1974 meeting. Clerk-Treasurer
