The regular meeting of the Lino Lakes Village Council held on Apri112, 1971.
was balled to order at 8:10 P.M. by Mayor L'Allier with all members present.
Mr. L'Allier moved to accept the first 8 pages of the minutes of March 22nd as
Corrected. Seconded by Mr. Jaworski. Carried unanimously.
W. Jaworski moved dal accept pages 9 to 11 of the minutes of March 22nd as
corrected. Seconded by Mr. Rosengren. Vote: Aye -- W. Jaworski, W. Cardinal,
Mr. Rosengren, W. L'Allier; No-- W. Bohjenen. Motion Carried.
The Clerk reported that a letter announcing an 8% rate increase from NSP had
been received,, as had 2 booklets on the Metro Transit plans; these were passed
around.
Mr. Bohjenen moved that the Lino Lakes Village Council go on record' opposing
the bill which would finance Metro Transit by levying a mill rate on
residential electric bills. Seconded by Mr. L'Allier. Carried unanimously.
Mr. L'Allier asked the Clerk to make copies of the NSP letter and booklet for
the Council and to put thematter on the next agenda.
Mr. Cardinal had no report at this time.
Mr. Je$oreki stated that he had contacted some of the Park Board.members and
had discuased the proposed park reserve. Representing their opinion, Mr.
Jaworski moved that the Lino Lekea Village Council go on record as opposing
the present proposed park reserve at Lino Lakes because of its size, because
it involves good developable land and because provisions have not been made
for adequate reimbursement of tax loss.
Mr., L'Allier noted that he h d madethe point at the last meeting that we should
go. through normal channels; he had seen many of the people present at sub -
committee meetings on S.E. 1237 (H.F. 1678); also, he had .talked with the
Per Board and PO7. members whoieel that the timing on this is important; the
members bad bo ob'jeotiona to going on record opposing this plan ainpe there is
en;'opportunity to look at alternatives.
Mr. L'Allier seconded Mr. Jaworski's motion. A letter dated 1 April 1971 from
the. Metro Park Reserve Board was read which stated that the Board would take
no official action on the proposal until the communities have bad a reasonable
time to provide alternative recommendations, and which directed their staff
to take no action toward establishing a park reserve at Lino Lakes until at ie
least six months have elapsed, provided staff shell, on community request,
cooperate with community planning efforts. The same letter had been sent
.to the mayors of Centerville Forest Lake, Forest Lake Township, Columbus
Township, Hugo, Oneka Township, Blaine, Circle Pines, and Lexington.
Mr. Jaworski stated that he bad not finished his motion and wished to add the
following: Per the Perk Reserve Board letter of April 1, 1971, we request that
the Park Reserve Board take no official action to establish a park reserve at
Lino Lakes, but rather allow Lino Lakes and Anoka - County to develop plans
and ordinances to protect pertain marshes, wetlands and lands abutting meandered
lakes and water ways. We also reiterate our vigorous objections to Senate
File 1237 and House File 1678 and especially those parts which give the Park
Reserve Board the powers of eminent domain and taxation and, as an alternative,
favor allowing the counties and their municipalities to preserve the lands
within their boundaries.

Mr. L'Allier stated that the letter was nothing more than a threat since
if we don't have a plan they Shall go aheed.whioh he resents. Mr. L'Allier
seconded the motion. Mr. Bohjanen commented that until they reassure
him that this is in a bill, the letter means nothing, the same as what, he
has been hearing at the hearings. Mr. L'Allier oommented on changes which
Rep. Albertson had made in the bill at the hearing.
Don Metier asked why the Council was playing around with the word "present"
There was considerable discussion Mile the tactical value of the wording
and what steps members of the County Board had taken in regard to these
bills. Mr. Jaworeki stated that he would withdrathe work "present"
from the motion. Mr. L'Allier seconded the amended motion. All members
voted Aye.
Mr. L'Allier stated 'Oaths had a eopy of an ordinance from Orono covering
Marshlands, eta., that he would like the.menbers to look over. Mr. Jaworeki
moved to have the Clerk make eopiee of the Orono ordinance for the Council
members to see if we can determine such lands in Lino Lakes to be preserved.
Seconded by Mr. Bohjanen. Carried unanimously.
Mr. L'Allier stated that he had had the Clerk write to all the Mayors and
the Chairmen of the Board of the municipalities in Anoka County bringing
their attention to the 2 bills in the Legislature concerning the Hetra
Park Reserve Board and asking then to oppose these for the reasons we had
stated in our resolution :opposing them. He had receive some calla on the
letters.
Mr. L'Allier stated that he would like to have the Clerk send a similar
letter to the Mayors and Board Chairmen of all municipalities of the other
six counties in the Metro area calling their attention to these bills..
Mr. Bohjanen felt that we should add in that we hed gone on record opposing
this bill. Mr. Jaworeki felt that a. copy of the motion favoring abolishing
the Metro Council should go throughout the seven - county area. Mr. L'Allier
noted that we have to face up to the fact that this wont happen, some areas
favor the Metro Council. He felt that if we are to get support against
the Metro Council we have to oppose direct bills, since these may have
some effect in the area. After further discussion it was deoided that
the Clerk would send the above letter throughout the other 6 counties.
Mr. L'Allier noted that there would be a hearing on the companion bill
in Room 118 of the Senate tomorrow night at 7:30.
Mr. L'Allier passed out sheets containing instructions on how to contact our
legislators. He stated that both our Representative and Senator have said
that they will oppose the Metro Parks Reserve bills in their present form.
He asked that persons in the audience who know people living in the other
6 counties ask them to contact their legislators on these bills also.
A lady in the audience asked of the Mayor meant that no one else from other
counties had appeared at the hearings on the bills. W. L'Allier noted
that there is an inter - county governmental unit which was supposed to have
brought an alternative proposal, but had not; he had heard that Hennepin
County had banked out. There was oonsiderabli discussion. The same lady
asked why Mayor L'Allier had not gotten together with the other Mayors
in the 6 counties. More discussion.
Mr. L'Allier noted that Tom Strand of Springsted,. Inc., was present as well
as Don Carley; he asked Mr. Gotwald to lead the discussion on the
Jandric proposal. Mr. Gotwald reiterated the story of obtaining sewer
for the Lakes Addition #2 area up to the present time. A lett4/er 12/ fr1

was read requesting sewer and water connections for 25 to 30 homes for this
fall. W. Gotwald noted that they had sold 9 lots in the last 2• weeks.
yr. Gotwald presented a map showing proposed lateral lines in Lakes Add'n
#2, which would service 66 lots. He gave the estimated cost breakdown as
follows:
Collector laterals $118,000
Lift station 30,000
Foroe main 6,000
Water distribution: 6" & 8" 115,000
Well 25,000
Pu phouae and tank 15,000
Controls 5,000
10% contingency 31,000
Engineering fees 38,000
Legal fees 3,000
Fiscal agent fees 6,000
Administration costs '3,000.
Total $395,000
Don Carley stated that he had talked with Springsted on this and noted that
the proposal had been reduced by half from the original. He gave details on
the bonding procedure noting that this would be for 5 years and that there
was no reason why Jendric'oannot put up a bond for assessments, guaranteeing
a minimum of 1 year's payment. The bond would be for 1 1/2 times the actual
assessment for each lot. fir: Strand suggested starting with 2 separate bonds.
There was considerable discussion. W. Gotwald recommended that the Council
adept a resolution ordering the taking of bide for the projects.
After more discussion,, yr. Jaworaki coved to authorize the Engineer to take bids
on the water and sewer projeote for Lakes Addition #2, notee that the formal
resolution will be provided later by the Attorney; alto authorising the Clerk
in conjunction with the Engineer to submit ads for the bids; also, incorporating
in the ad that the bids will be held for 90 days; also, that, if the ads are
put in this week's paper that the bids would be opened on May 6th; if the ads
go in the next week's paper that the bids woulid be opened on May 13th. Seconded
by fir. Cardinal. Carried unanimously. If necessary, a special meeting to
consider the'bide will be set dt the next meeting.
yr. Gotwald mentioned the previous correspondence oonoereing the sewer problems
at the•Youth Center. Butler engineers have now come up with a proposal to
run a force main from the Youth Center to the hookup on North Road; he showed
the line on a Village map. This proposal would Dose an estimated $150,000
'and would eliminate the present facility. He noted that no one else could be
served by the force main.
fir. Gotwald stated that for the first time the Youth Center could be seen as
an asset, namely that if we expand our sewer system to serve them we could
get a Federal grant and could assess that 150 acres by,footage. Thin could
not happen if this proposal goes through. W. Gotwald'suggested that Lino
Lakes send a letter to the State Architect indicating that we may put in
sewer service to'the Youth Center in the next 2 to 5years, wording the
letter so that we do not obligate onreelves to do so. After disouasion with
the Attorney, 1[r. Cardinal moved to authorize the Attorney and the Engineer

to draft a letter to the State Architect stating that we foresee the
possibility of installing sewer in the Youth Center area within the next
5, years. Seconded by Mr. Rosengren. Carried unanimously.
Mr. Gotwald stated that, persuant to the Mayor's request, he had compiled
e list of street which had not yet been taken over by the Village, as
foliows: Maple Street and Orange Street which are on record but not `
maintained, Birch Larvae ", which is not on record and not maintained; 77th
Street East and West, 82nd Street East to the end; Marshan Lane and
Hansen Road, all of which are maintained but have no right of way re-
corded. He reoc mended that we straighten out the records and get a
60 feet right of way on these last roads.
After discussion, Mr. L'Allier moved that the 4 street (77th East and
West, 82nd, Morahan and Hansen Rd.), after we are able to get the necessary
easements, be made a part of the Village road system; this is to include
Lois Lane from Old Highway 8 East as far as it is now used; this motion
to pertain only to the portion of the roads as now used and maintained.
Seconded by Mr. Bohjanen. Carried unanimously. Mr. Gotwald and Mr. Locher
will work out the easements on the plat maps and will take care of all
loose ends.
There was dissuasion on Orange, Maple and Birch streets, with Mr. Rosengren
and Mr. Gotwald being asked to determine the correct manes of these streets
from the plat maps; the roads in Twilight Acres.were also discussed. It was
noted that it -would be impractical to call improvementshearings for
Twilight Acres now with assessments coming... Mr. Bohjanen moved to authorize
Mr. Rosengren to haul in fill in Twilight Acres, contingent on the weather,
in order to upgrade the streets, and to perform. routine maintenance.
Seconded by Mr. Cardinal. Carried unanimously.
Peltier Drive and 80th were discussed. Mr. L'Allier moved to authorize
Mr. Rosengren to use whatever means necessary to take care of the bad spots
in 80th Street, at an estimated post of $300 for e scraper plus labor.
Seconded by Mr. Cardinal. Carried unanimously.
After considerable discussion, Mr. L'Allier offered,a resolution to be sent
to the County Commissioners asking them to move with dispatch to complete
the County section of read they are building East of Centerville, Birch
St. 1 mile West of Centerville Road and the freeway service road East of
135E; the resolution to be sent to the members of the County Board and
to Jake Lundheim. Seconded by-Mr. Jaworski. Carried unanimously.
Mr. Gotwald reported that he had spent 1 1/2 hours with Joe Davis going
over the area West of the Hall in order to lay out ball diamonds; they had
decided that it would be best to put only 1 diamond in in order to provide
adequate parking and due to the terrain. Mr. Jaworski will work further
with Mr. Davis on this.
Mr. Myhre was instructed to keep an eye on a giant junkyard which had grown
up behind Luther's Sport Shop in the undeveloped land of Lakeview Woodlands.
Mr. Bohjanen that there had been no C&BDC meeting, thpy gave up the time
for a concerned citizens group to hear a report by the chairman of the
Minnesota Taxpayers Association, Mr. Bohjanen reported that he had

attended all the subcommittee hearings on the Park Reserve Board bill and
had given testimony at the April 6th beating. He presented Mr. Schwartz
of 6325 Baldwin Lake Road who turned over a complaint against Cleo Cross
of 6125 Baldwin Lake Road for violation of the nuisance ordinance. The
complaint was signed by 11 residents on the street and covered junk vehicles,
tras#} accumulation, manure and excess animals. Photographs accompanied the
complaint which was accepted by the Council. Copies will be sent to the
police department and the Health Officer.
Mr. Schwartz also stated that a lot of garbage, furniture and appliances was
being duped along County Road J and suggested that the Village provide
facilities for dumping or mandatory pickup. After discussion the Clerk was
instructed to send a letter noting the complaint to Anoka County asking them
to correspond with Ramsey County on this. Mr. LIAllier noted that the police
have -been asked to check junk cars, giving warnings and tickets when necessary.
W. L'Allier read the police report for March as follois: 2,837.4 miles driven,
201 home and business checks, 20 complaints/ 18 assists to/by other depart-
ments. 6 accidents, 6 escapees from the Youth Center (all returned), 1 hour
spent at the Youth Center (314 on escapees, 1/2 on a fire), 3 thefts amounting
to $1,014.70 (including a smowmobile), 2 Stolen autos recovered amounting to
$5,500, 2 junk warnings given, 1 buildimg•fire.and 1 oar fire.
A letter from the Metro Park Board addressed to Clarence Johnson was read,
stating that Afton State Park has no power of condemnation.
Mr. L'Allier inquired of Mr. Locher the status of the comprehensive zoning
plan. Mr. Locher stated that we were marking time because of the park plan
and waiting fora map designating certain areas from the P&Z.
Mr. Locher stated that the certificates of insurence.for Olson Plumbing and
Sewer Service exceeded our requirements and sho 1dbbeff.Iled. He will contact
Mr. Stein and Mr. Menkveld regarding past due billings.
After discussion it was decided to delay action on the proposed NSSSB
agreement until the next meeting.
Mr. Cardinal presented Chet Herubin who inquired what regulations the Village
had concerning setting up a business dealing in antique cars and repair parts
for same. He would like to set up business in the old Village Hall building,
and stated that he has a warehouse in Coon Rapids for stripping the vehicles;
no stripping would done here. He has not finalized the deal on the building
but would like to sound out the Council before doing so. Mr. Locher stated
that no special use permit would be required because this would be covered
under retail stores and shops; the limitation on having 300' Of frontage
would be taken care of because of the road and the open land to the.North.
Mr. Herubin stated that a few complete cars would be standing cm-Wide for
sale, but these would be licensed and in running condition and would be in
either original or semi - restored finish.
Mr. Cardinal moved to grant Mr. Herubin permission to have his antique cars
and parts shop with the stipulation that there would be no dismantling at all,
and the only vehicles allowed on the premises would be compete, licensed and
in running condition; also, that Mr. Herubin submit written plans for
fencing, etc., and that this be tentative approval only, with his request to
be resubmitted with written plans. Seconded by Mr. Bohjanen. Carried
unanimously. Mr. Herubin wes,egin instructed to resubmit plans, to keep
the stipulations in mind, and to realize that this was only the intent of
the Council, not definite approval.
Mr. Cardinal reported that he had located a safe which we could have for
nothing if we could provide, transportation. Because of its large size,
it world have to go into the shop and would require a crane to lift it.
Mr. Rosengren moved to get the safe; Mr. Cardinal will handle the matter.
Seconded by Mr. Jaworski. Carried unanimously.
Mr. Cardinal reported that the Lino Lakes Riding Stables on Birch Street
had been taken over by the new owners ( Sandra Dobryanow & Riok O'Connell)
who would like to have George kith's special use permit transferred to
themselves. There was discussion with the new owners being advised of
recurring problems and stipulations to be followed. Mr. Jaworski moved,
on the Attorney's advice, that the matter be-referred to the P&Z at their
next meeting on April 21st. Seconded by Mr. Cardinal. Carried unanimously.
Mr. Locher stated that the special use permit could be reassigned like in
the case of the Baldwin Lake Trailer Park. However, Mr. Siith must assign
his rights to the permit over to,the new owners. (Mr. Smith had left before
the discussion came up). Mr. Cardinal had a copy of the original permit
to take to the P&L meeting.
The bills were audited. The final bill from Mattson Building & Supply
was referred to Mr. Gotwald before payment. Mr. Cardinal moved that the
Clerk write to the serttoe stations in the Village reminding them that the
license numbers of the Village vehicles should be written on,the charge
slips. Seconded by-Mr. Bohjanen. Carried unanimously.
The Clerk was instructed to make copies of the rough draft of the community
profile for all the Council to look over prior to the next meeting.
Mr. Gotwald suggested that the Assessor obtain 2 copies of the USGS maps for
Lino Lakes (1967) to aid in the house count for the burn ban and which
could be submitted as evidence to thewPCA.
Mr. Cardinal asked Mr. Gotwald to check the distance from the Standard
sign on the SE Corner of I35E and Main Street to the Mercott's house to
see whether it might be within the 500 -foot limit.
Mr. L'Allier instructed the Clerk to ask for a cover sheet on the gas bills
in the future., Mr. Locher noted that these billing problems will be taken
care of when we get our own tank and pumps.
Mr. Bohjanen moved to pay all the bills except the Mattson bill. Seconded
by-Mr. Jaworski, Carried unanimously.
Mr. Jaworski requested the use of the Hall on the 15th of April for the
Centennial Hockey League.
Mr. Jaworski moved to adjourn at 10 :50 P.M. Seconded by Mr. Rosengren Aye.
