HomeMy WebLinkAbout07/12/1971 Council Minutes7/12/71 The regular meeting of the Lino Lakes Village Council held on July 12, 1971, as called to order by Mayor L'Allier at 8:01 P.M. with all members present. Mr. Gotwald was present; Mr. Locher arrived a few minutes later. The following corrections were made to the minutes of June 28th: Page 4, para- graph 4, line 2, change sentence to read; "Mr. L'Allier noted that a good portion of low land is involved. "; page 6, paragraph 3, line 2, last word, change "sand" to "oil "; page 7, paragraph 6 (no. 2), line 12, change phrase to read "policeman if feasible.". Mr. Cardinal moved to accept the minutes of the June 28th meeting as corrected. Seconded by Mr. Bohjanen. Carried unanimously. The Clerk had received a booklet and:phamplet on the 1971 State Building Code. She reported,that.$41,321.40 had been received,on the June settlement aryl that the claim to the State regarding the Youth Center in the amount of $782.82 had been paid. Notice had been received from the Metro Sewer Board on a meeting to be held on July 15th at 9 A.M. at the Fridley City Hall, at which time the cost allocation methods being considered for 1972 and proposed sewer charges will be explained. Mr. L'Allier and Mr. Bohjanen both stated that they planned to attend; Mr. Gotwald was asked to attend also. The Clerk reported that letters from the Village of Circle Pines and from North Central Public Service regarding gas service for Molin Concrete had just been received today. Mr. L'Allier felt that the matter should be tabled since the information had been received at the last minutes and the Council had no time to study the information and make an intelligent decision; also, nothing had been received from Molin. After discussion, Mr. Jaworski moved to table the matter, . and to have the Clerk write Molin officials asking them for a written reply to her letter dated June 29th, and that is such reply is received in time that the matter be placed on the next agenda. Seconded by Mr. Bohjanen. Mr. Ross, Industrial Engineer for North Central, asked that Molin be sent copies of their letter since it included an offer for firm gas (natural and propane at natural prices). The motion was amended to include sending Molin Concrete copies of the correspondence just received from both Circle Pines and North Central. The vote on the motion was unanimously in favor. Mr. Cardinal had no report. Mr. Jaworski reported that a Mr. Reinertson had re- quested a beer permit for a softball tournament to be held at Sunrise Park on July 31 and August 1st. He will furnish insurance and collateral in case of the park not being cleaned up. Mr. Jaworski moved to grant Mr. Reinertson a beer permit as requested at such time that he furnished proof of insurance and collateral. Seconded by Mr. Cardinal. Carried. unanimously. Jr. Jaworski reported that the Park Board would meet on July 15th instead of the Monday scheduled. Mr. Jaworski stated that the Council had talked about building a baseball diamond at the Hall, but had found that it was not feasible to build 2 diamonds. The Park Board had suggested that 2 baseball diamonds at the south end of Sunrise Park near Rustic Lane. He had found that it would cost some $550, if the Village hauled in the dirt and had the Columbus grader level if off. Mr. Jaworski had contacted a private contractor who would do both diamonds for $450. These costs did not include the backstops; he had no prices on those yet. After discussion Mr. Jaworski moved to put in 2 baseball diamonds at Sunrise Park at a cost of $450 without the backstops. Seconded by M. Cardinal. Carried unanimously. 1 1 1 47 7/12/71 Mr. Rosengren noted the letter received from Commissioner Burman regarding the turnback of County Road #54 to Lino Lakes, specifically the portion on the East County Line. After discussion, Mr. Cardinal moved to table the matter for the present and to authorize Mr. L'Allier and Mr. Rosengren to attend the next County Road Board meeting to discuss the matter. Seconded by Mr. Jaworski. Carried unanimously. There was further discussion. Mr. Rosengren asked the Council's wished on mowing the grass and weeds along the roads. He stated that there was a possibility of renting a 5' sickle bar for the Cub tractor and doing,it ourselves rather than contract the work. After discussion,'Mr. Rosengren moved to mow the grass along the roads with our own equipment. Seconded by Mr. Bohjanen. Carried Unanimously. Mr. Rosengren asked about cutting the hay here at the Hall. Mr. Bohjanen moved to authorize Mr. Rosengren to find someone to cut the hay at the Hall. Seconded by Mr. Cardinal. Carried unanimously.. Mr. Rosengren reported that the blacktop work on 7th Avenue was finished. They had not been able to complete the blaektopping on West Rondeau due to the rain. Some repair work had been finished; the parking lot had been oiled but not yet sealed. He asked about work on the pond at the Hall. After considerable dis- cussion, Mr. L'Allier moved to authorize W. Rosengren to request bids on land- scaping the pond and surrounding area and also to request bids on placing sod around the flagpole area (possibly this work will be donated). Seconded by Mr. Cardinal. Carried unanimously. Mr. Rosengren stated that the turnapul was digging out the soft spots on 80th St. and hauling the material to fill along the East County Line. Mr. Rosengren asked about the possibility of grading and gravelling the portion of Pine St, from the Old Montaigne farm West to the Robinson home. He stated that Columbus was willing to do the work if we would split the cost. The plat map was viewed, showing the assessments for Pine St. extend about 150 feet West of the center line of Section 6. Mr. Gotwald suggested that the Village put sulfite dust control on the East County Line, on Pine St. and on 80th. He mentioned that we could save about 5¢ per foot by doing it ourselves, but if we were in a hurry it would be better to have Macklin do the work. After discussion, Mr. Jaworski moved to have sulfite sprayed on our portion of Pine Street, on 80th Street and on the East County Line, with Mr. Gotwald to recommend who should do the, work, at an estimated cost of $4000 based on an approximate cost of $1000 per mile. Also, Columbus will be contacted to see if they are interested in doing their part of St. at the same time. Seconded by Mr. Cardinal. Mr. Locher stated that the Village would need easements to go further on Pine St. to the Robinson home, or else start 6 years of maintenance for a cartway. Mr. L'Allier wondered about the legality of spending Village funds on road which are not record when already have roads on record which need work. Mr. Locher recommended getting the easements. Mr. L'Allier asked how we could justify the cost; Mr. Locher stated that we can't legally. Mr. Backlin stated that as long as he can remember Columbus has been maintaining the road into Robinson's house. Mr. L'Allier mentioned that it might be Columbus road then. Mr. Backlin stated that although the road easement is split between the two municipalities along its length, the maintenance arrangement has been that we take care of Pine St. from Hwy 8 to 1 block East of 4th Avenue (Co.Rd. 23) and Columbus does the remainder. Mr. L'Allier didn't feel that we should 48 7/12/71 pay for their portion of the road and noted that we had upgraded our part for which Columbus didn't contribute. It was decided that Mr. Gotwald would check out the distance each municipality maintains. Al Ross noted that Columbus had maintained the road to Robinson's at the time he was Road Supervisor. The vote on the above motion was taken here; it carried unanimously. Mr. L'Allier advised Mr. Ross of the action taken on Cty. Rd. #54 since he was interested in the matter. Mr. L'Allier noted that resolutions had been obtained from all ten municipalities at one time. Mr. Ross stated that the County wanted to give us back a piece and expect us to square it with Oneka, but how? The County gets State aid and we can't, being under 5000 population; Mr. Ross felt it was mandatory that the County take over the portion on the County Line. Mr. L'Allier pointed out that last year they had gone on record wanting to take it over. Mr. Ross stated that he has the minutes from 1964 on this. Mr. L'Allier asked that he give them to the Clerk to make copies. Mr. Bohjanen asked about the sewer charges. Mr.,Gotwald stated that he had called Mr. Dohorty but had no answers. Mr. L'Allier stated that he had met with Dick Sha and Dave Larson but they didn't have the exact cash amounts yet, either. Apparently, the assessment may be made by either of 2 formulas, depending upon whether the old NSSSD is included with Minneapolis or not. We should get the answers at the July 15th Sewer Board meeting. Mr. Bohjanen asked if we could get our Hospital Board representative here for the next meeting to answer questions on the audit. Mr. Cardinal stated that he had talked with Danny Houle; that he had the answers, but that,there was a Board meeting tonight. He will be here at the next meeting. Mr. Bohjanen stated that we should make a for- mal request to Mr. Houle but it was thought to be unnecessary as long as he already planned to attend and give.a verbal report. Mr. L'Allier offered the congratulations of the Council and the Village citizens to the Civil Defense for their first place prize on the float in the Centennial 4th of July parade. He stated that they had appeared in Forest Lake on the Fourth and in Lindstrom the past Sunday. He asked the Clerk to send a letter of congratulations on behalf of the Council. Mr. L'Allier mentioned an ordiance which would establish a committee on enviromental quality; copies will be made and sent to members prior to the next meeting for action at that time. Mr. Locher had nothing to report. Mr. Gotwald stated that he had inspected the damage done by the University of Minnesota by their exploratory wells on the LaMotte property. He suggested that Carlson get a few estimates from blacktopping contractors and arrange for repairs, estimated at $150 to $200. Mr. Locher asked if the roads had not been accepted by the Village. Mr. Gotwald stated that the records show that the center 30 feet was accepted, but there was a question on the boulevards being accepted since the work on them was not completed and the Council had withheld $500 of the bond till the work is done. Mr. Gotwald stated that technically it is a Village street, but we do not have the full release, so we should get Mr. LaMotte to take care of the problem. Mr. Gotwald stated that we have a set of catchbasins which empty into a ditch in the Outlot in LaMotte's Second Addition; this ditch turns now and runs onto Lot 4. If we get an okay from the St. Paul Water Dept., then Mr. .LaMotte will straighten out the ditch to stay within the outlot and cross the Department land. The, Clerk was instructed to write the St. Paul 'Water Dept. asking for permission to straighten the ditch. 49 7/12/71 Mr. Gotwald stated that he again would like to try to set up a meeting on the Chomonix sewer and water assessments. They want water anyway, but Jandric is holding things up. He had called Springsted and found that Mr. Springsted would be free tomorrow and Friday. He noted that Vince Lombardi, Jr., had bought a lot in Lakes Addition No. 2. Mr. Cardinal moved to set a meeting on the Chomonix assessments for Friday, July 16th at 5 :30 P.M. Seconded by Mr. Rosengren. Carried unanimously. The Clerk will contact Springsted and Jandric. A request had been received from North Central Public Service to install service to Zelinka's Forjay greenhouses. Mr. Rosengren noted an error in the wording where it mentions 4th Avenue crossing Hwy. #49 which it doesn't. Mr. Gotwald stated that he had no objection since the place is in their area; no other objections were voiced. Mr. L'Allier stated that he had had a call from Bill Horbal of the Oasis who is closing a sale on the place, Mr. Horbal had brought the prospective buyer to the meeting. Mr. L'Allier felt that we should hear him and have the police investi- gate his background; the matter can be placed on the agenda for the next meeting. Mr. Horbal introduced Larry Cichy who stated that he has a recommendation from the Brooklyn Park police. He stated that he has part time interest there in a club. Mr. Cichy stated that he is looking for a house in the vicinity so that he can meet the residency requirements. He wished to incorporate the business. Mr, Cardinal moved to authorize the. police to conduct their usual investigation of Mr. Cichy and to place the matter on the next agenda. Seconded by Mr. Jaworski. Carried unanimously. Mr. .Cichy stated that his attorney was Gerald Singer and that he could call him if we had questions. Mr. L'Allier adivsed that he gave his attorney call Mr. Locher if he had questions. Mr. L'Allier felt that the discussion on advertising for a ftill -time man should be held at the Friday meeting. Mr. Rosengren mentioned that he had heard that next year it will be mandatory that municipalities allow the use of plastic pipe in plumbing. Mr. Gotwald stated that it was rumored that there will be a maximum law where we can't exceed the specifications set forth by the State. He commented on additional costs for permits. The Clerk was asked to drop a note to the Building Inspector to see if he is up -dated on the surcharge; also, to write for a copy of the new State code. Mr. L'Allier noted that Mr. Ellingsen, Weed Inspector, was in attendance. Mr. Ellingsen stated that he was ready to start cutting and spraying weeds on Wednesday or Thursday. He asked that if anyone knows of any wild hemp they should let him know so that it can by sprayed. He noted that in the SW part of the State, the State way paying up to $45 per acre to get rid of the weed. Mr. L'Allier felt that Mr. Ellingsen should continue on as usual, to hire additional help or machinery as necessary for his work. Mr. L'Allier suggested that we write the County that we are spraying the roads and remind them to do likewise. Mr. Ellingsen was asked to notify the Clerk if he found weeds uncut along County roads; he noted that he is in contact with Dave Torkildson on this. Mr. L'Allier stated that he hadn't yet heard back on limiting candlepower on signs, and asked Mr. Cardinal to take up the matter at the P&Z, Mr. Cardinal noted that this had been mentioned at the P&Z previously. Mr. L'Allier asked the clerk tomrite the State if they have any such recommendations. The Clerk stated that she had received a request for street light at Linda and Lauren. Mr, Rosengren noted that we should also have one here at the Ball by 7/12/71 the pond which serves as a skating rink He felt that we should check on other possible locations before making the request from NSP. Mr. Bohjanen asked if the Clerk had gotten a letter from the, owner of the old Hansen pit. She stated that she had not. He stated that he had the name and address of the owner and his son, by name of Joe and Tom Woehrle. The Clerk stated that such a person had called, but had not said that he owned the pit, but lived, next to it. Mr. Locher stated that he would have the State Sanitarian write the owners. There was discussion. Mr. Rosengren thought a letter should be sent.to Jake Kaufhold who had planted flowers around the flaypole and, kept them up. The Clerk will write a thank you letter to be signed by all Council members at the next meeting. The Clerk mentioned that the recently -hired Deputy Clerk, Shelley Brisson, planned to quit as soon as she got a full -time job; therefore, the Clerk had asked Mrs. Elsie Linnell, who had made application, to come in and be trained for the podition. Mr. L'Allier asked the Clerk to write Mr. John M. Kirkvold of the State Forest Service in Cambridge, to request certification for R. V. Ellingsen as a State Fire Warden to replace Roy Houle; carbon copies to be sent to Mr. Ellinsen and the Mayor. A question was raised on the burning ban. Mr. L'Allier noted that we had asked PCA for a postponement of its adoption and had no reply. He asked the Clerk to call the PCA to see what they plan to do ,on our request. The Clerk was also asked to make, copies of the burning ordinances and give to the members to hand out. Mr. Myhre asked if Mr. Locher had heard anything on the color of the police uniforms. Mr. Locher stated that he had checked with Sheriff Talbot and with the Ass't. County Attorney and couldn't find anything in the Statutes on it. Bob Johnson, Jr., will do some further checking, however. The Clerk was asked to check the records on the Caron hayroad for the next meeting. Mr. Bohjanen moved to pay the bills as audited. Seconded by Mr. Cardinal. Carried unanimously. The Clerk was instructed to void the 3 checks written on June 28th for police clothing allowances. Mr. Jaworski moved to adjourn at 9 :33 P.M. Aye., Minutes approved at the meeting of July 26, 1971 Clerk Treasurer 7/16/71 The special meeting of the Village Council of Lino Lakes was called to order at 8 :46 P.M. by Mayor L'Allier. Other members present were Messrs. Cardinal, Jaworski, and Rosengren. Also present were Attorney Locher, Mr. Gotwald, and Mr. Sprinsted, Fiscal Agent. Mr. Bohjanen was absent due to a death in the family. Mr. L'Allier stated that the special meeting was called to consider the process of assessments of water and sewer to be installed within the Chomonix project. Mr. Gotwald said that we have to determine the method of assessment. Also that bids have been taken on the well and pump. He stated that normally it would have taken 30 days but due to Metro Council problems they decided to go a 60 day period. The interceptor that was
