HomeMy WebLinkAbout08/09/1971 Council Minutes62 8/9/71 The regular meeting of the Lino Lakes Village Council held on August 9, 1971, was called to order at 8:10 P.M. by Mayor, Ralph L'Allier. All Council members were present. Mr. Bohjanen moved to approve the minutes of the July 26, 1971, meeting as written. Seconded by Mr. Cardinal. Carried unanimously. Mr. Jaworski noted that the minutes of the July 29, 1971, special meeting did not included the fact that the Mayor did vote on all issues. It. was advised that this be changed. The Clerk reported receipt of affidavit of publication for resolution on im- provement in Lakes Addition No. 2. The Clerk asked if the Council wished to continue membership in the League of Minnesota Municipalities at $380.00 per year. Mr. L'Allier indicated we should continue membership. It keeps them up to date and is a good bargaining tool. Mr. L'Allier moved they continue membership. Seconded by Mr. Jaworski. Carried unanimously. A telegram sent to the Circle Pines Utilities Commission was read. It ex- plained why the Council members were unable to attend the 'Utilities Commission Meeting of July 28; 1971. Mr. L'Allier moved that letters of invitation be sent to representatives of both the Circle Pines Utilities Commission and the North Central Gas Co., to meet with them at the Lino'Lakes Village Hall at 8 P.M., August 16, 1971. Seconded by Mr. Bohjanen. Carried unanimously. Mr. Cardinal had no report. Mr. Jaworski had no report. Mr. Rosengren•reported work on roads is progressing: There are still a couple culverts needing repair. He wondered if we have to have bids on $1500 worth of gravel. Attorney Locher indicated that from $500 to $5,000 two written bids are needed. Mr. Rosengren wondered if it is necessary to check with owners in order to cut down overhanging branches around mail boxes. • Mr. Rosengren hadn't 'heard from anyone in regard to this yet. Mr. L'Allier suggested they send these people a copy of the letter or else call the people involved and tell them they are in violation. Engineer, Mr. Gotwald, showed a map of the overall county thoroughfare-plan. He had outlined some county roads we could trade for village. He indicated if there are two communities maintaining them it is very difficult. • There is good relations between Washington County and our own community, however. It was suggested that 5 -6 mile stretch of Bald Eagle, a village road, should be swapped for Birch, .Elm 'and Lilac. • If boundary roads are county it works out best. This eastern boundaru street has been a problem, Mr. Rosengren and Mr.'Gotwald noted.• The village h as done a lot on all these roads - they have been kept up well. Mr. Cardinal moved that we should drop a note to the Administrator:(with carbon copy to Bob Burman)• twlling them we would like to arrange this, and ask to set up a meeting. Seconded by Mr. Bohjanen. Carried unanimously. 1 8/9/71 Mr. Gotwald reported we are ahead of schedule on 24th and 80th Streets. We've improved one half mile of 7th Street. Some streets aren't finished as yet. It was suggested that a letter be sent to Mrs. Wilhelmy advising her we will be •_unable to upgrade that road. Mr. Rosengren pointed out that Rolling Hills Dr. should and will be repaired. There is a soft spot in one place under it. It will have to be graveled and . oiled and that will improve it greatly. Mr. Gotwald displayed a book which indicates some 100 roads started as far back as 1863. It shows right -of -ways and historical documents. He suggested the book be bound. In 1886 people petitioned for a road. There is a 66 foot right -of -way on Holly. It is on record. We did try to get an additional easement at one time. Mr. Cardinal moved to have this book bound and photo- static copies made. Also to have someone lay out roads with boundaries, etc., as indicated in this book, for a large village map. Seconded by Mr. Jaworski. Carried unanimously. There was further discussion as to just how much work should be done on roads such as Holly. Should we vacate, update or barricade roads indicated in this book. It was stated no further work will be done other than what has been decided. It was stated that if the village were to do more work on them, an insurance company should be called so we aren't liable. Mr. Rosengren reported the village pond is shaping up. Mr. Bohjanen reported there was much general discussion at their last meeting. The gas issue was one. They took a look at the Metro Sewer Board's charges for area. Plan A and C have since been thrown out, and Plan D is still higher. Mr. L'Allier stated there are a lot of unanswered questions. He said under Plan A alone it was $179,000. Mr. Bohjanen stated the weeds haven't been cleaned from around the village sign on Sunset. He'll see to this himself. Mr. L'Allier reported there have been four applications for assistant constable. He recommended the hiring of Gerald Edwin Johnson, who lives in northeast Blaine, at $125 per month. We would purchase uniforms. All four applications were passed among the Council members for their inspection. Mr. L'Allier moved that Mr. Johnson be hired. Seconded by Mr. Jaworski. Carried unanimously. Attorney Locher had no report. Engineer, Mr. Gotwald, had no report. Mr. Rosengren indicated 24th Ave. is a real problem. It is dusty and they'll try to get at it. Mr. Roger Barnes from the audience, spoke up and indicated he is quite upset with the village for giving him two tickets for littering at 6352 Hodgson Rd. He had a small repair shop there and had to discard a lot of sheet metal, furnaces, etc. He indicated he has furnaces out in front, etc., but he has garbage pick up once a week, on Monday, and they take everything then. The Chief of Police indicated that on April 6, 1971, he was given a warning ticket. This gave him 9 days in which to clean up the premises. On April 22, 1971, 16 days later, it still was not taken care of. On June 15, 1971, in court, the Judge gave him a fine and 10 days to clean up all the things. Another picture taken, July 19, 1971, more than one month later, shows a clutter of furnaces, etc. The Chief of Police maintains this is the same junk as shown on the April 6th picture. Fa 4 8/9/71 Mr. Barnes said there is always day to day garbage. His neighbors are going to testify in court tomorrow that he has weekly garbage pick -up. He says there are things over a week end, but not over several months. He challenges the picture dates. What he wants is advice as to what to do. He indicated some of the junk in back belongs to previous owner and he didn't feel, since he only had contract for deed, that he was responsible for that. He felt on July 19,1971, he was tagged just before junk pick -up. He asked that the Chief of Police show the Judge the photos. Attorney Locher read the legal material pertaining to why he was tagged, and informed him that contract for deed made him responsible for the property. He advised the building of a nice - looking fence or enclosure to hide the junk' from view. The Chief of Police indicated other warrants were issued on many junk car areas at this same time. It is done routinely twice a year. Mr. L'Allier reported the fact that letters have gone to people in the village, from the County Health Inspector's Office, indicating if their sewage disposal systems were not working properly. The Engineer agreed we should turn letters of complaint over to the attorney. Soil, weather, etc., in this area means sewage and septic systems just aren't going to work properly year around. One solution would be a one to two million dollar sewer project. The mayor ad- vised he would never back such a program. Mr. Bob Hutchison, County Health Inspector, reported that last February he got several calls on other problems and in the process found there were some sewage problems. In May 1971 more letters came in he said. They checked into the whole picture rather than just one problem property. There were between 40 and 45 letters sent out the first part of June 1971 to obvious sewage discharge problems. They advised corrections would have to be made. Some parties could simply alter their existing systems. Some couldn't. The whole county has been reviewed as to lakes and streams. He said that conditions were such here in Lino Lakes, that looking at one problem they found more. Mr. L'Allier indicated there have been some complaints that inspectors came when people weren't home. Mr. Hutchison said inspectors were to obtain permission from someone on premises, but it didn't always have to be an adult. If no one objected they looked at property. If someone requested they not go on their property they didn't. Mr. L'Allier advised complaints would be turned over to the Village Engineer, if he says it wouldn't help to upgrade the system, we hope the county wouldn't take any further action. Mr. Hutchison indicate1 a poor sewage system could be helped by a family changing some of their water using habits such as not doing laundry on the premises. A lady in the audience said she received a letter and the first one was nice, but that it indicated the second would be more firm. She said they go down six feet and hit water and quick sand - what are they to do? Mr. Hutchison said gravity drainage from basement can be an answer for some systems. Sump pump would be cheaper than abandoning the property. Mr. Gotwald said there are a few things that can be done. Drain fields can still be operated at 6 foot level as indicated by the lady. Percolation tests can be taken by the building inspector. These tell you how many feet drainage tield.will be required. There are some very expensive ways to correct problems, and some systems just might need a little maintenance. Mr. Hutchison said some areas (not necessarily Lino Lakes) in county just don't have sufficient cess pools. He indicated he would be happy to have any suggestions and it would be fine to have these matters turned over to the village engineer and he in turn contact him. Mr. Bohjanen asked if the Council couldn't be advised when checks of this type are going to be made. Mr. Hutchison said yes, they could. The sample letter sent the first part of June 1971, was passed to the Council members for their examination. Attorney Locher indicated that the trespassing law has recently been changed. It now states that it is not a criminal trespass unless you tell someone to leave and they don't. Except in the case of someone coming on property and subsequently doing damage. Mr. Jaworski moved that a letter be written to Mr. Hutchison informing him we would like to contact our village residents who received these letters, and that there then would be correspondence between our engineer and the County Health Inspector's office. Seconded by Mr. Cardinal. Carried un- animously. Tom Van Housen called the Clerk to say that, after flying over the village, he noticed that Molin Concrete has not done any of the promised landscaping. He felt that the village should get after them to get at it. Mr. Bohjanen moved that a letter be written to remind them of such. Seconded by Mr. Rosengren. Carried unanimously. Mr. Jaworski moved to ratify retroactively the fire contract checks which were signed at the July 26th meeting, and not yet paid. Seconded by Mr. Bohjanen. Carried unanimously. Mr. Rosengren moved that the District Zoning Code be printed by the Forest Lake Times at a cost of $6.00 per 500 sheets. The Clerk noted that if we were to photocopy them ourselves it would come to $640 plus labor. Seconded by Mr. Cardinal. Carried unanimously. Mr. Gotwald indicated he had checked on the variance on a piece of land asked for by Mr. Nadeau. He said the proposed drain tilings would work. He stated the building permit shouldn't be held up because of drainage. Mr. Jaworski moved they authorize issuance of a permit to Mr. Nadeau. Seconded by Mr. Cardinal. Carried unanimously. A lady from the audience wanted to know when something was going to be done to 24th Ave. Mr. L'Allier explained we're trying to get it turned over to the county. The county wouldn't do it before the freeway was completed. We have suggested this evening that we exchange some of these roads with the county. Then they would maintain them. Mr. Gotwald indicated that next week 24th should be graveled and dust treated. He suggested Lino Lakes and Oneka should get together. A man from the audience wanted to know when something was going to be done to 80th. He was advised ditches have to be cleaned and then work will be accomplished. Mr. Donald Szymanski brought up the fact that a variance for building permit was brought up a couple years ago. He would like to bring it up again. 66 8/9/71 Mr. Cardinal suggested the Clerk check the records and that Mr. Szymanski come to the next Plarnning and Zoning meeting on August 18, 1971. Al Robinson was wondering what was going to be done to the extreme west end of Pine Street. He says the village took fill out about 8 or 9 years ago and said they would then finish it. Nothing has been done and it sinks more each year. Mr. Locher said he would check the records on easements, as Mr. Robinson said he has one. He also indicated that if the municipality has kept it up for six years, then they must maintain it. Mr. Locher is also going to check with Columbus Township't Attorney. Mr. Gotwald said we fulfill lateral system requirements to scheduling hearings etc. Some contact with Sewer Board will have to be made to get something concrete. Mr. Jaworski moved that Mr. Locher, Mr. Gotwald and Mr. L'Allier meet with the staff of the Metro. Sewer Board to ascertain their intentions as it relates to the installation of the main interceptor. Seconded by Mr. Rosengren. Carried unanimously. Mr. Gotwald indicated Lino wants completion of lateral. Village is half way through comprehensive plan now. Mr. Jaworski moved to pay the bills as a,ited. Seconded by Mr. Bohjanen. Carried unanimously. Mr. Cardinal moved to adjourn at 9:55 P.M. Seconded by Mr. Rosengren. Carried unanimously. Minutes approved at the meeting of August 23, 1971 Deputy -Clerk 8/16/71 The special meeting of the Lino Lakes Village Council was called to order by Mayor L'Allier at 8:10 P.M. with all members present. Mr. L'Allier stated that the purpose of the meeting was to discuss gas service to the Molin Plant. Participants in the discussion were the Circle Pines Utilities Commission, North Central Public Service and the Molin Concrete Co. The Circle Pines Utilities was represented by Mr. Wayne Dannheim, Mr. Joe Davis and Mr. Jerry Pehl. The North Central Public Service was represented by Mr. Jerry O'Brien and Mr. Simon, Attorney for North Central. Mr. Bill Molin and Mr. Dick Olson were also present. Mr. L'Allier invited each side to present their views and then the Council would have the opportunity to question them. Mr. L'Allier stated that the question before the Council was whether or not Circle Pines had the authority to extend their gas lines to the Molin Plant; whether it is the Council's intent to restrict Circle Pines to areas not franchised to North Central. Mr. Dannheim spoke for the Circle Pines Utilities. He explained that their Engineers were doing some private work at the Molin Plant when the subject of gas service came up. Molin was offered gas service on a firm basis and since this was the kind of service desired by the company, they signed a contract with the Circle Pines Utilities for gas. Circle Pines was informed of the violation on the day the work was completed and no further work has been done. Mr. Jerry O'Brien spoke for North Central stating that it is not economically feasible for two utilities to operate in the same community and duplicate lines.
