Mr. Cardinal suggested that the fee for a septic system permit should be charged at the same time a building permit is taken out for a new. home. It was decided to place the matter on the next P&Z agenda. The Clerk suggested that the charge for an assessments search be raised from the current $1.00 to $2.00 since there will be additional work with the Jandric assessments. It was decided to put this on the next, Council agenda as well as setting the charge for a copy of the new District Zoning Code.- The next budget meeting was tentatively scheduled for next Tuesday, September 14th at 8 P.M. The Clerk will check with Mr. Hill on the date. Mr. Jaworski moved to adjourn at 10 :04 P.M. Seconded by Mr. Bohjanen. Ave. Minutes approved at the meeting of Sept. 13, 1971L7L L/ Clerk- Treasurer 9/13/71 The regular meeting of the Lino Lakes Village Council held on September 13, 1971, was called to order by-Mayor L'Allier at 8 :10 P.M. with all members present. The following corrections were made to the August 23rd minutes: 1. Page 5, paragraph 6, second sentence, change to read, "He noted that only one of the present Council members was involved when Ordinances No. 28 and 29 were passed, and that two of the present Council members were on the Council when Ordinance No. 41 was adopted." 2. Page 5, bottom paragraph, end of second line, change "of" to read "and/ or ". 3. Page 7, paragraph 2, last sentence, change first part to read, "North Suburban Sanitary Sewer Board thought that in Plan A, which leaves us in the NSSSB area, ". 4. Page 8, paragraph 1, end of second sentence, add the word "benefitted. "; change next to last sentence to read, "Mr. L'Allier stated that Mr. Jandric has agreed to make a cash deposit in the bank each year to cover the total amount of the assessments for the year. ". Mr. Jaworski moved to accept the minutes of the regular August 23rd meeting as corrected. Seconded by Mr. L'Allir. Carried unanimously. Mr. Jaworski moved to accept the minutes of the September 7th budget meeting as written. Seconded by Mr. Cardinal. Carried unanimously. The Clerk reported that she had posted and caused to be published the notices of filing of affidavits of candidacy. The dates for filing are September 21st through October 5th. The Clerk reported that since 794 people had voted in the November 3, 1970, general election only 6 judges would be needed for the November 2nd election per shift. She inquired whether the Council felt a second shift of judges for counting ballots would be necessary since it was an off -year election. After discussion, Mr. Jaworski moved that only one shift of 6 judges be selected for the November 2, 1971, election. Seconded by Mr. Cardinal. Carried unanimously. The Clerk was instructed to use her own judgment as to whether additional 1 1 evenings to those of October 7, 8 & 12 would be necessary for voter regis- tration. The office will be open until 9 o'clock P.M. on those days for registrants' convenience by law. The Clerk reported that she had received a letter of intent from Mr. Lawrence Cichy, new owner of the Oasis Loungs, as to his residing in Lino Lakes as of September 1st, and that on the approval of Mr. Myhre and Mr. Locher, she had mailed him the necessary licenses for that date. Mr. Locher stated that the statement was adequate for the purpose. He noted that the certificate of insurance received for Mr. Cichy caused one problem in that the form contained a different statement then the required 10 -day cancellation clause. The Clerk was instructed to call and write Mr. Cichy to have this changed under Ordinance. No. 31, Subdivision 3. W. Locher read the limits of the policy which were considerably more than required. The Clerk stated that she was running low on the pink checks and asked authorization to reorder. Mr. Bohjanen moved to authorize the purchase of 2000 blank checks which would be a two -year supply. Seconded by Mr. Cardinal. Carried unanimously., The Clerk reported receipt of the affidavits of publication for Ordinance #57, the weed notices and the advertisements for bids on the sewer & water lateral project for Jandric. The Clerk reported that 2 more complaints on the Lino Lakes Riding Stable had been received from Frank McKoy and Emmet Libel. Mr. L'Allier noted that the complaints were getting repetitious, that there is violation after violation, and suggested that the Council set a special hearing to consider revoking the special use permit. Mr. Jaworski moved to set a special hearing to consider the complaints received on the Lino Lakes Riding Stable during the next regular meeting on September 27th at 8:30 P.M. Seconded by Mr. Cardinal. Carried unanimously. W. Locher noted that all parties should be notified in writing. The Clerk mentioned the Metropolitan Council Community Assistance Program letter which had been brought up at the last meeting and asked if there were any comments. There were none. Mr. Cardinal introduced Mr. Dick Koch of 6307 Baldwin Lake Road who wishes to build a house on his extra lot, but is unable to get a building permit be- cause that portion of the road is not a Village street. Mr. Locher noted that there are deeds to the County for the roadway, but that Jake's Office refused to accept them for maintenance; they refuse to take responsibility. Mr. Koch stated that the snow is plowed sometimes by the Village and some- times by the County. Mr. Rosengren maintained that Village trucks do not go on that part of the road. There was considerable discussion on the matter with the general feeling that if the County would deed over the easements to the Vil]ge, then we would accept the road for partial maintenance. Later, a petition signed by 35% of the affected land owners could ask for total Village acceptance of the street and up- grading with the affected land owners assessed for the costs. Mrs. Koch presented their.abstract to Mr. Locher, this showing easements to the County. It was decided to nave Mr. Locher write Anoka County indicating that he had done research on the subject, relating to the abstract, telling them to without proof to the contrary by the County, we request them to acknowledge ownership of that portion of Baldwin Lake Road and that they maintain it. Mr. Locher stated that he would be seeing County Attorney Bob Johnson to- morrow and would broach the matter. 9/13/71 Mr. Rosengren asked if the Council has the right to take over any such roads having like status. Mr. Locher stated that we could not, but that we could undertake maintenance and get cartway easements after 6 years. Mr. Locher took the Koch's abstract with him, to return it later. Mr. Jaworski reported that he had a request for a beer permit from Al Robinson of the Drifter's Snowmobile Club for October 14th or thereabouts and that they were getting insurance to cover the event. Mr. Jaworski moved to issue a beer permit to the Drifter's Snowmobile Club subject to receiving a certifi- cate of insurance for October 14th (the correct date to be ascertained by Mr. Jaworski). Seconded by Mr. L'Allier. Carried unanimously. Mr. Jaworski stated that he would like to build another hockey rink for a cost of :2200. in Sunrise Park immediately South to the present hockey rink, and would move the skating rink to the other side of the warming house. There was discussion on the number of boys using the facilities as well as other rinks. Mr. Jaworski moved to,build an additional hockey rink at Sunrise Park. Seconded by Mr. L'Allier. Carried unanimously. Mr. Rosengren stated that they were curtailing the road program for lack of money. Two jobs were left to be done, Rolling Hills Drive and Linda & Laurene. Mr. Locher was asked to comment on progress on the West end of Pine Street. He stated that he had called property owners along the South side of Pine Street and had run into resistance from the Moyers who refuse to give any property to the Village because their taxes had gone up so much. Mr. Locher had told them that he was only verifing an existing easement on which nothing was filed. Owners of the other parcels are willing to sign deeds; these in- clude Veiera, Killian, Antonozzi, Mauseth and Robinson. Mr. Locher stated that if Moyers refuse to sign a deed then we would need an affidavit from someone that the road was there. He noted that the Moyers did not close the door, but that they felt that they were singled out and would appeal this; it would be between them and the County Assessor. Mr. Rosengren stated that the road was there before his time. Mr. Jaworski will take the deeds to Mrs. Robinson for her signature before a Notary and 2 witnesses. Mr. Locher stated that he had tried to get the Columbus attorney on this; when he finally did talk to him on another subject he had not thought of this matter. Mr. Rosengren noted that the whole length in concern was the old Montaigne farm. Mr. L'Allier wished to have the Clerk check the old road book to see if this was included. Mr. Bohjanen moved that Lino Lakes take over the West end of Pine Street for partial maintenance at this time, that the cost of further up- grading later would be assessed against the benefitting property owners, and that this statement of intent should be added onto the deeds. Seconded by Mr. Cardinal. Carried unanimously. There was some discussion on the maintenance of the new part. Mr. Cardinal moved to authorize Mr. Rosengren to get a minimum of three affidavits on the existence of that portion of Pine Street if we are unable to get Moyers to sign the deeds. Seconded by Mr. L'Allier. Carried unanimously. Mr. Rosengren moved that Lino Lakes proceed the same as on Pine Street with Orange, Maple and Eva streets for acceptance for partial maintenance, and that when such roads are up- graded that the costs will be assessed against the benefitted parties. Also, that Mir. Locher be authorized to proceed with 9/13/71 getting deeds for the cross -over between Orange and Maple streets including discussing the possible transfer of one of our lots in Block 3, Nordin Manor, for Lot 11, Block 3, Nordin Manor and parcel #305 of Auditor's Subdivision No. 138. Seconded by Mr. Cardinal. There was discussion. Mr. L'Allier asked that Mr. Gotwald check ,on the drainage ditch and call Mr. Locher before he contacts these people if there is any conflict. Mr. Locher stated that we don't know if the roadways are on the lines; he suggested also that some- one personally contact these people about the matter before he approaches them. Mr. Rosengren stated that a 60' road would be sufficient. The vote taken on the motion was unanimously in favor. Mrr. Rosengren stated that he had had requests for street lights on the corner of Linda and Laurene as well as on Linda &,Hodgson. Mr. Bohjanen stated that residents wish lights on Nancy Drive at both ends. Also, the County had left rough edges on several streets. Mr. Rosengren will contact the County on these approaches. Mr. Rosengren stated that he had nothing yet on the gas tank. He thought we would be better off to get our own tank rather than buy from Houle. There was discussion. Mr. L'Allier asked him to get prices on a 2000 gallon tank; he will check the difference in price on the 2000 and 3000 sizes. Mr. Cardinal noted that we don't want to go to a large tank (10,000) because of evaporation loss, etc. Mr. Jaworski inquired about the pumps that print a ticket, but Mr. Rosengren stated that these were too high; we should wait a year. Mr. L'Allier interrupted his report for Mrs. Don Swanson who had a petition to present to the Council. Mrs. Swanson stated that people in her immediate area (West of Marshan Lake) wanted the Council to curtail hunting on the West side of Marshan Lake as well as George Watch Lake. She listed several complaints on misuse of firearms as well as the problems the hunters have with the muck, etc. Also, that many persons are using the area for dumping and mischievous purposes. After some discussion, the wording on the petition was read. There was discussion on excluding the gun club area. Mr. Locher stated that since there are good reasons, the ordinance on no- hunting areas could be amended. He thought that the matter should be re- ferred to the P&Z for Wednesday evening considering the lack of time before the hunting season opens. The Clerk was instructed to ask the Assessor to draw the area owned by the One Shot Gun Club on a map and to make a copy of the petition for the P&Z. Also, to contact the members of the Gun Club so that they can be represented at the P&Z and the next Council meeting. It was noted that two members of the P&Z know the area well, namely Mr. Kelling and Mr. Rehbein. Mr. Locher suggested that since the road into the area is a private road it might be better to request the land owners to police this themselves rather than amend the ordinance. Mr. Jaworski moved to send the matter on to the P&Z for Wednesday, Sept. 15. Seconded by Mr. Rosengren. Carried unanimously. The matter will be on the next Council agenda. There was further discussion on leasing of land. Mr. Bohjanen inquired how we were coming on Peltier Drive. The Clerk stated that she had talked with Mrs.. Wilhelmy on August 28th and had been told that the survey was not done. She was asked to call Mrs. Wilhelmy.again to double check. Mr. Bohjanen reported that he had talked with Mr. Zastrow on moving the panels under the table, and that Mr. Zastrow thought it would cost about $12. Mr. Cardinal moved to have Mr. Zastrow move the panels to the front. Seconded by Mr. Jaworski. Carried unanimously. 83 84 9/13/71 Mr. L'Allier noted that he had cancelled the budget meeting set for to- morrow evening since Mr. Gotwald had not completed the estimate on the number of hookups to sewer next year. Mr. Jandric had estimated that 10 homes would be ready this year with 60 homes expected next year, all these to be hooked up after the interceptor is run in. Mr. Gotwald felt that the Baldwin Lake Trailer Park will be forced to hook up next year also and that this would probably be enough to cover the MSB assessment. Mr. L'Allier noted that the Metro Council had passed Plan A but had cut the Metro Sewer Board budget which may lower our 1972 MSB assessment some. Mr. Gotwald had thought he might have a complete report the next week. The date of October 5th at 8 P.M. was tentatively set for the next budget meeting. The Clerk will check with Mr. Hill. Mr. L'Allier read the police report for August as follows: 2,750.8 miles driven, 280 home and business check, 31 assists to/by other departments, 22 complaints, 6 accidents, 4 domestics, 4 burglar alarms (all false), 4 acts of larceny, 3 stolen items recovered (2 cars, 1 bicycle), 3 escapees from the Treatment Center involving 31& 1/4 hours time, 3 legal papers served, 1 missing persons report, 2 missing persons recovered, 1 emergency message delivered and 1 aid given to a motorist. Mr. Rosengren noted that Ivan Proulx, sitting up high in the Columbus grader, had spotted a stolen motorcycle in a ditch. Mr. L'Allier reminded the members of the matter of purchasing an exhaust fan for the Council Chambers. It was felt that such was needed for a large' crowd. Mr. Bohjanen moved to have Mattson install an exhaust fan and to have Mr. Gotwald check out the size. Seconded by Mr. Cardinal. Carried unanimously. Mr. L'Allier stated that he would like authorization for himself and Mr. Jaworski to set up a special meeting with representatives of the Centerville Council to explore the possibility of entering into an agreement whereby we handle Centerville's policing, and that for this service the dollar amount be applied to the cost of our fire protection from Centerville. Since the cost of the fire protection will probably be more, we would pay this additional amount on an annual basis. Mr. L'Allier felt that it would be advantageous to Lino Lakes since we spend a lot of time on the East side of the Village and go through Centerville frequently. He thought that since it would eliminate duplication of ser- vices and enable two municipalities to work together it might help curtail the Metro Council efforts to solicit power towards the same end. The Anoka. County Joint Law Enforcement Assn. looked favorably on this because the Metro Council is proposing a 7- county police force and they would like to see better cooperation between the County and the municipalities rather than have a superstructure. Mr. L'Allier mentioned that Centerville has a car just purchased from the St. Paul Police Dept. which we might arrange to buy. Then if we can find someone on that side of the Village to undertake police work and keep the car there we would have more efficient policing. Mr. Myhre is compiling figures on the cost. Mr. Cardinal moved to authorize Mr. Jaworski and Mr. L'Allier to set up a meeting with the Centerville Council on the policing. Seconded by Mr. Rosengren. Carried unanimously. Mr. L'Allier reported that Mr. Gotwald had suggested setting up a special meeting with the Fiscal Agent after the bids are opened Friday to decide how to handle the sale of the bonds. After discussion it was decided to 9/13/71 have the meeting during the Council meeting of September 27th at 9 P.M. The Clerk will notify Springsted and Mr. Gotwald to be here. Mr. Cardinal asked Mr. Locher if he had found out anything about the Hansen pit. Mr. Locher stated that he and Mr. Myhre had the names of the owner and the person running the pit. Mr. Cardinal moved to table the matter of setting a meeting to consider the employment applications for full -time man until after the budget meeting. Seconded by Mr. Jaworski. Carried unanimously. Mr. L'Allier stated that the Clerk had computed the cost of the District Zoning Code to be $2.92 per copy; he felt that we should get our money out of each copy. Mr. Cardinal moved to set the price of a copy of the District Zoning Code at $3.00 per copy, and to charge postage if the copy is to be mailed. Seconded by Mr. Rosengren. Carried unanimously. 85 The fee for assessment searches was discussed. The Clerk noted that such a search presently is just a matter of signing a form, but when the Jandric improvements are in the searches will entail considerable work. Mr. Locher stated that the City of Anoka had just raised their fee to $4.00 for an assessment search. Mr. Rosengren moved to set the fee for an assessment ---- - - - -- -- search at 14.00 effective at such time as the price freeze is lifted or changed. Seconded by ltr. Jaworski. Carried unanimously. Mr. L'Allier reported that he had talked with both the Civil Defense and the Police and would propose an ordinance at the next meeting on the regulation of large assemblies (1000or mare). He read through some items. One clause excludes church and other established places for large crowds. Mr. L'Allier noted that it was nice to have the controlls beforehand. The bills were audited. Mr. Cardinal initiated discussion on the amount of money spent on the Ford tractor maintenance and the possibility of purchas- ing newer equipment. The Clerk was instructed to order for the Assessor the same maps which had been purchased for Mr. Van Housen. Mr. Jaworski moved to pay the bills as audited. Seconded by Mr. Rosengren. Carried unanimously. Mr. Jaworski will check on tractor prices. Mr. L'Alllier stated that a letter bad been received from Lexington concerning an increase in the Fire Contract fee for 1972 based on an increase in our assessed valuation. He turned the letter over to Mr. Jaworski to double check the figures before the next budget meeting. Mr. Jaworski moved to adjourn at 10:15 P.M. Seconded by Mr. Cardinal. Aye. Minutes approved at the meeting of September 27, 1971 Clerk- Treasurer 9/27/71 The regular meeting of the Lino Lakes Village Council held on September 27, 1971 was called to order at 8:14 P.M. by Acting Mayor Jaworski with all members present, Mayor L'Allier arriving in time for roll call. Mr. Bohjanen moved to accept the minutes of the September 13th regular meeting as written. Seconded by W. Jaworski. Carried unanimously. The Clerk reported receipt of municipal court fines in the amount of $370.00 for August. The Metropolitan Sewer Board cost allocation for the budget year
