The regular meeting of the`Lino Lakes Village Council held on October 26, 1971
was called to order at 8 :08 P.M. by Mayor L'Allier with all members present;
also present were Mr. Gotwald and Mr. Locher.
Donald liarier requested that paragraph 3 on page 2 be corrected by deleting most
of lines 7, 8 & 9. There was discussion. Mr. Bohjanen moved that the Oct. 1st
budget minutes be corrected as requested by Mr. Wrier. There was no second to
the motion, which then died.
Mr. Jaworski moved to accept the minutes of the October 1st budget meeting as
corrected. Seconded by Mr. Cardinal. Motion carried with Mr. Bohjanen voting
"No".
Mr. Cardinal moved to accept the minutes of the regular October 12th meeting
as written. Seconded by Mr. Rosengren. Carried unanimously.
The Clerk reported receipt of the following: 1) affidavits of publication of
Ordinance #58, 2) affidavits of publication of the bond sale notice, 3) muni-
cipal court fines in the amount of $183.50 for September, 4) certification
from Drovers State Bank, South St. Paul, that it has issued a certificate of
deposit in the principal sum of Fifty Thousand Dollars in favor of U.S, Lakes
Development Co. subject to first lien on the part of the Village of Lino Lakes,
5) a letter from Milton C. Honsey, Chairman of the Metro Sewer Board, which
confirmed that the Lino Lakes -- Centerville interceptor is part of the approved
1971 Capital Improvements Program to provide service to Lino Lakes, that it
will be built during 1972, and that any municipality that will be served by a
project that is being planned and constructed will share in the cost allocation
during the budget year, 6) a quarterly report from the Centerville Volunteer
Fire Dept;, which was read.
The Clerk requested authorization to order 300 payroll check blends, a one-
year's supply. Mr. Rosengren moved that the Clerk be authorized to order 300
payroll checks after comparing prices. Seconded by Mr. Cardinal. 'Carried
unanimously.
The Clerk stated that Roy Backlin had compiled the time spent in putting in
culverts and hauling fill for Columbus Twp. She wished to know what hourly
rate to charge them for man and backhoe per hour, noting that the rate for man
and truck had been set at $8 /hr. after discussion, Mr. Bohjanen moved to set
the rate of $12 per hour for man and backhoe. Seconded by Mr. Rosengren.
Carried unanimously.
Mr. Cardinal moved to grant a special use permit for sign application #114 to
Naegele Outdoor Advertising based on the approval of the Engineer and the P&Z.
Seconded by Mr. Rosengren. Motion carried with Mr. L'Allier abstaining as the
sign would be located on his farm.
Mr. Cardinal reported that Glenn Rehbein had requested a variance at the P&Z
meeting for a model home to be placed on Lot 5, Block 2 of the proposed
Glenrae Estates. After discussion, Mr. Cardinal moved to grant a variance
to Glenn Rehbein for a model home to be built on Lot 5, Block 2 of the pro-
posed Glenrae Estates, with the stipulations that we receive letters from the
Engineer And the Planner that the home fits in with the scheme of the pro-
posed plat, and that the model home will not be sold as a residential unit
or used other than as a model home until the final plat is accepted, on the
following described property: The East' 130 feet of the West 483 feet of the
North 150 feet of the SW 1/4 of the SW 1/4 of Section 29, T31N, R22W, Anoka
County, Minnesota, subject to Birch Street. Seconded by Mr. Rosengren.
Carried unanimously.

Mr. Cardinal stated that a letter had been received from Mr. R. A. Matthews.
2046 Lindy in Roseville, who wishes to operate a game fish farm on the East
shore of Peltier Lake. After discussion, Mr. Cardinal moved that we write to
Mr. Matthews asking him to contact the St. Paul dater Dept. and the Conserva-
tion Department for tentative written approval from them before we consider
the matter. Seconded by Mr. Jaworski. Carried unanimously.
Mr. Cardinal reported that Dale Tresler had requested a variance at the P&Z
for a 14' by 20' building to be used as living quarters for his married
daughter while her husband attends school. Mr. Cardinal noted that the 280
sq. ft. building doesn't meet the requirements and that the P&Z had recommend-
ed denying the variance. Mr. Tresler had stated that it had been his intent
at the time he moved the building onto his lot to use it for his photography
work; he had installed running water and a half bath at that time; he has
since remodeled it for living quarters. Mr. L'Allier asked if the couple
were living in it now; Mr. Cardinal stated that they were not as far as he
knew. Mr. Jaworski moved to deny Mr. Tresler's request for a special use
permit to use the extra 14'x20' building on his lot for living quarters.
Seconded by Mr. Cardinal. Carried unanimously.
Mr. Cardinal asked Mr. Locher if he had been able to get any answers on the
road which the Ericksons had asked about building on at the P&Z meeting. Mr.
Locher stated that he hadn't been able to get anything from the County Atty.
yet. He pointed out the parcel in question on the plat map (S1 /2 of Sect.
31), noting that the property is along proposed Hwy 51, that the 1 acre lot
has neither enough size nor frontage as required. Both Mr. Locher and Mr.
Gotwald felt that Hwy 51 may still be constructed. The property abuts the
NW corner of intersection of Baldwin Lake Road and Town Road; the Village
maintains the road to the south line of the intersection. There was consid-
erable discussion on the County's responsibility and possible turnback of the
existing easements. It was decided that Mr. Locher will write to Bob Burman
giving him all the details on the easements and asking the County to take
action.
Mr. L'Allier felt that since the Village trucks have'to turn around at the
end of Baldwin Lake Road, they use the entire intersection for this, and thus
felt that the Erickson property has a driveway to a Village road. Mr. Bohjanen
moved to approve a variance for Donald Erickson with the stipulation that all
requirements of the ordinances have to be followed, including submitting a
legal description. Seconded by lax. Cardinal. Carried unanimously. There
was some discussion on future use of the land behind this piece.
Mr. Cardinal mentioned the letter received from Mr. Locher concerning Mr.
Richard Roberts' hog firm on Holly drive. Mr. L'Allier felt that this
operation required a special use permit. Mr. Cardinal moved to set hearings
on a special use permit for Mr. Richard Roberts before the P&Z at 9 P.M. on
November 17th and before the Council at 9 P.M. on November22nd. Seconded
by Mr. Rosengren. Carried unanimously. Mr. Locher will handle the notices;
the Clerk will notify those concerned about'the hearings.
Mr. Cardinal stated that he had received a survey from Mrs. Vivian Rehbein
who wishes to request a variance for a piece of Land less than 2 1/2 acres.
He will refer this to the next P&Z meeting.
Mir. Cardinal reported that Marvin Ramacher and Marvin LeTendre had applied for
a variance to Section 4.16 of the zoning code on Lot 7 of Golden's Rice Lake
Terrace, 6935 Lake Dr. The Clerk stated that they had filled out an appeal
for a variance to the zoning code, and had a letter from the Highway Dept.
granting permission to grade along Hwy 49 for an entrance thru the right -of-
way to the building site.

Mr. Ramacher stated that he had met with Mr. Van Housen this morning, that
Mr. Van Housen had not been too happy with the plans, that he had been with
his site planners all day and felt sure that the revised plans were in
compliance with the ordinances. They had changed the request from a 15 -foot
setback to a 25 -foot setback in order to.put the building in line with the
Dick Olson home on the adjacent property. Parking facilities were made along-
side the building rather than in the right -of -way; there was also room in the
rear for parking; the plans show a 30' driveway. Mr. L'Allier felt that this
took care of the main objections. Mr. Ramacher stated that they would put in
shrubs surrounded by crushed rock between the building and sidewalk, and would
landscape the grounds differently instead of the screening which could not
have survived snowplowing. The maps were consulted.
Mr. Locher stated that the access to the property lies partly on Lot 6 as
well, that he had talked with Mr. Redipenning of the County Hwy Dept. about
the easement. Mr. Redipenning guessed that in 10 years there may be a 4 -lane
highway in that area; the County's jurisdiction on the easements is subject
to the State's. Mr. Ramacher stated that the'State,had, given no restrictions
as to how close they could build to the line. Mr. Locher said that Mr.
Redipenning had said there was no problem if they build on the line.
Mr. Gotweld stated that he had visited the site and that the drainage meets
all the requirements; also, the sanitary sewer system for this operation would
be less than for a family, so there should be no problem. Mr. Ramacher noted
that he had had the plumbing put in and inspected, but when the plans were
not okayed, it had been ripped out. Mr. Locher noted that as far as the re-
quirement of having 300 feet in width for commercial between two residential
lots was concerned, Ramacher and LeTendre also own lots, 8, 9, 19 & 11, be-
sides which the adjoining lots 6 and 8 are vacant, so this is okay.
Mr. Bohjanen moved to grant a variance to Marvin Ramacher and Marvin LeTendre,
d/b /a/ Skyline Auto Body, to build at a 25 foot setback from the Highway ease-
ment on Lot 7, Golden's Rice Lake Terrace per the revised plans in accordance
with the Planner's recommendations, and that all changes to be made are to be
listed on the building permit. Seconded by Mr. Cardinal. Carried unanimouly.
Mr. Cardinal noted that these people had been misinformed ahead of this,
that they had an okay from the Building Inspector. Mr. L'Allier told Mr.
Ramacher to have the Building Inspector call the Clerk concerning the
Council's approval.
Mr. Jaworski reported that he had gotten the lumber for the hockey rink, that
they were proceeding with the work and hoped to be done in 3 -4 weeks.
Mr. Bohjanen asked if we had heard from the State on the Community Profile.
The Clerk was asked to write to the State on this again. Mr. Bohjanen asked
if we had any "watch for children" signs as he had received a requat for
same to be put on 4th Ave. near the Main Street intersection. There was no
Objection to putting up such signs; Mr. Rosengren will check on this. Mr.
Bohjanen asked if we had heard anything on the intersections to be fixed by
the County. Mr. Rosengren stated that they had done nothing, that he will
compile a list to be taken care of.
Mr. L'Allier reported that we had received several applications for the 5th
part -time police position, that he and Mr. Myhre had narrowed these down to
two, namely Steven M. Johnson from Blaine and Marcel H. Rivard, Jr., from
Centerville. Mr. L'Allier moved to hire Marcel H. Rivard, Jr., since he not
only is qualifies, but this will give us someone on the East side of the
Village where we can leave the police car. Mr. Bohjanen asked if he would
be hired on a training basis and was told yes, that he was and would be riding
with someone until fully trained. Motion was seconded by Mr. Cardinal.
Carried unanimously.
Mr. L'Allier read the September police report as follows: 2,332.8 miles
driven, 301 home and business checks, 19 complaints, 9 assists to/by other
departments, 7 escapees from the Treatment. Center, time involvedo- 3 1/2
hours, 3 aids to motorists, 3 burglar alarms (false), 2 stolen auto re-
covered, 2 domestics, 2 acts of larceny, 1 stolen snowmovile, 1 missing per-
son (returned), 1 accident and 1 legal paper served. Mr. L'Allier stated
that before the next Council meeting all members will have copies of the
contract for policing in Centerville.
Mr. Rosengren asked to report (he was not on the agenda since expected to be
out of town). He stated that Rolling Hills Drive and Linda & Lauren were
done. The contractor was done with the pond, but-the plastic has yet to be
laid. Mr. Rosengren noted that the pump for filling the pond should have a
smaller inlet pipe since it shuts off and on rather than running continuously
as it should. He will cLeck with Ludwig on putting a 1 1/2 inch pipe on the
well rather than the 2" outlet which was installe. Mr. Rosengren reported
that the drainage work was done in the Lakeview area, and a turnaround had
been made on 74th St. South of. the Youth Center.
Mr. Locher reported that the certificate of insurance received for Roger D.
Aukema dba Lake State Mechanical Contractors "'as adequate. Also, we had
received notice that the rates for workmen's compensation insurance would be
increased by 9.5% as allowed by the Commerce Commission of Minnesota.
Mr. Gotwald reported on the progress of Deep Well No. 1 in Chomonix. The
drilling is done; they are pumping the last of the silt out. A test pumping
will be conducted next week to determine the size of the motor and pump which
will then be advertised for bids, along with the pump - house. He noted that
whereas Keys Well Drilling had to go through the Franconia formation to get
water at 600 feet for the golf course, this well brought water from the Jordan
layer et 304 feet, and had, approval from the State. The size of the well is a
20" outer casing and 12" inner casing, since the 16" outer casing couldn't be
used due to the large amount of crushed limestone., Mr. Gotwald stated that
the cost may come out less than expected anyway since the depth is less than
planned. There is an adequate amount of water, and the system can be expanded
to serve a larger area later by putting in a larger pump.
Mr. Gotwald stated that White Bear Lake and Vadnais Heights had inquired of the
Metro Sewer Board whether they would charge assessment for direct hookup to the
interceptor. The Metro Sewer Board had stated that there would be no direct
assessment from them since the methods of assessment would be too complicated
and might involve court cases. Mr. Gotwald stated that individuals can hook
directly into the interceptor after application to the Metro Sewer Board is
approved, and that 4he Village can assess these hookups by using the average
assessment figures of others being made during the same year of hookup. The
Village will supervise all such hookups to the interceptor.
Mr. Bohjanen asked if the matter of the Miller Bros. road had been acted on.
Mr. Locher stated that he is working on a recommendation to be ready for the
November P&Z meeting.
Donald Waalen of U. S, Lakes Development Co. asked to present a new townhouse
layout for a portion of Outlot K of Lakes Addition No. 2, to be names Chomonix
South. The remaining portion of Outlot K would be known henceforth as Outlot
A of Chomonix South. Mr. Waalen etated that there 'rould be 92 living units
in 23 buildings; the average value per unit is in the $21- 25,000 range. Most
of the buildings will have 4 units; one will have 6 units. Mr. Waalen and

Mr. Brand showed diagrams of the layouts, defining exits, etc. They requested
that hearings on the preliminary plat be set. Mr. Cardinal moved to set hear-
ings on the preliminary plat of Chomonix South before the P&Z at 9 :30 P.M. on
November 19th and before the Council at 9:30 p.m. on November 22nd. Seconded
by Mr. Rosengren. Carried unanimously. Mr. Waalen stated that they hoped to
start building a model unit by the First of December.
Peter Scherer stated that he was still waiting to see the brochure which was to
be :Tiede ly ;he Cotrtrau �i- ;; aru' Busixiess Derelopment Committee. Mr. Bohjanen
noted that he had just inquired about the Community Profile which was
turned over to the State.
r. Eugene Jerdee, ^Q^ "Test County Road J, stated that he had been told that
complainants on his repair business were going to be at this meeting. He had
come to request a special use permit to do small engine work on a part -time
basis and a permit for a small sign advertising same. No complainants were
in the audience. Mr. Jerdee stated that the building he had put up was mostly
for storage, but the rest would be for repair. The Clerk stated that the
callers had complained that they were afraid that Mr. Jerdee was planning to
return to snowmobile repair and were afraid of the noise. The 24 "x30" sign is
located about 20 feet off of County Road J.
Mr. Scherer mentioned that the County had set a 60mph speed limit on County
Road 14 at the I35E bridge area; he felt that this limit should be reduced
since the intersection is blind for County Road 84. Mr. L'Allier stated that
a letter would be sent to the County recommending that they reconsider the
60 mph signs, noting that there are some homes on one side.
Mir. Locher stated that Mr.. Jerdee would need a classification change either
through a special use, permit or rezoning, but he didn't feel we should rezone
to commercial in a residential area. After discussion, Mr. Cardinal moved to
set hearings on a special use permit for Eugene Jerdee before the P&Z at 8 :30
p.m. on December 15th and before the Council at 8 :39 p.m. on December 27th.
Seconded' by Mr. Rosengren. Carried unanimously. Mr. Locher noted that he
would need a legal description;, also that a variance was necessary for putting
up a commercial sign in a residential area.
Mrs. Elsie Linnell requested a bingo permit for the Turkey Bingo to be held at
the Lino Lakes Elementary School on November 5th. Mr. Cardinal moved to grant
the bingo permit. Seconded by Mr. L'Allier. Carried unanimously.
Clyde Rehbein stepped forward to ask the Council's feeling on his putting up a
temporary metal storage building on the proposed Glenrae plat to store trucks
and equipment in. This would be located in the area next to the old school
grounds. Clyde didn't have any details yet, but suggested that this be grant-
ed on a yearly basis until the house construction is finished. Mr. Bohjanen
stated that he would like to have some kind of drawing of the plans; Mr.
Locher noted that he would need a variance. Mr. L'Allier asked Clyde to bring
in drawings at the next Council meeting.
Clyde asked about the effect of the new State Building code on our ordinances,,
particularly pertaining to plastic pipe in plumbing. Mr. Cardinal stated that
this matter had been tabled at the P&Z. Mr. Locher stated that additional in-
formation is forthcoming since a commission has been appointed to study the
code before it goes into effect next July. Mr. Locher stated that he could
check with the St. Paul City Attorney to see if St. Paul plans to test the,
Attorney General's Opinion on the plastic pipe. He felt that if St. Paul

accepts the plastic we might as well, too. Mir. Locher noted too that in light
of the Attorney General's opinion he could not advise the Council to prosecit^
if someone uses the plastic pipe. There was discussion on what happens if
such pipe is red - tagged. Mr. L'Allier asked,Yr. Locher to check with St. Paul
and to send a letter on his findings to the Clerk with copies to the Council
and P&Z members. Clyde will wait until the November 8th meeting to, see how
this comes out.
Mr. Bohjanen moved to pay the bills as audited. Seconded by Mr. Rosengren.
Carried unanimously.

A special meeting of the Lino Lakes Village Council was called to order by
Mr. L'Allier, at 8 :10 P.M., on October 27, 1971. Those present were Mr.
L'Allier, Mr. Jaworski, Mr. Bohjanen, Mr. Cardinal, Mr. Rosengren, Mr. Locher,
Mr. Gotwald and Tom Strand a representative from Springsted, Inc. The
meeting was called for the purpose of opening bids for sale of $550,000 bonds
to be used in the Chomonix project for sewer and water.
The first bid was from Piper, Jaffrey & Hopwood, Inc. Enclosed was a certi-
fied check for a good faith deposit. The net interest cost was $68,585 with
net effective rate of 4.1567.
The second bid was from the Northwestern National Bank of Minneapolis. The
net interest cost was $62,480, with not effective rate of 3.78666.
The third bid was from the First National Bank of St. Paul. Enclosed was a
check for a good faith deposit. The net interest cost was $63,322.50 with net
effective rate of 3.8316.
Mr. Jaworski moved to adopt a resolution. sell the bonds to the Northwestern
National Bank, Minneapolis, using the format as recommended by the attorney.
A copy of which is attached hereto. Seconded by Mr. Cardinal. Carried
unanimously.
Mr. Strand advised that it takes approximately five weeks to get the money,
but the money is assured so the village can go ahead and sign the contracts.
Mr. Locher advised that there are state laws as to where these monies can be
deposited. It is adviseable to put them in a State or National Bank, Govern-
ment Securities, or use it to purchase other municipal bonds, but it cannot
be deposited in a savings and loan. Mr. Gotwald stated he would be able to
ascertain during the next week just what the first payment would amount to.
It was advised that during this five week period the village would receive
interest on this money at the rate of 3.78666. There was discussion as to
finding out where we can get the best interest, and the fact that we would
want to transfer it immediately upon receipt.
Mr. Locher advised of the receipt of Printer's Affidavits of Publication in
the ,Commercial West, October 9, 1971, and the Forest Lake Times, October 7,
1971. They are filed with the Clerk.
