HomeMy WebLinkAbout11/08/1971 Council Minutes11/8/71 The regular meeting of the Lino Lakes Village Council held on November 8, 1971 was called to order at 8 :05 P.M. by Mayor L'Allier with all members present. Mr. John Burke represented the Babcock & Locher firm, replacing Mr. Locher who was out of town. Mr. Jaworski moved to accept-the-minutes of the October 26th regular meeting as corrected. Seconded by Mr. Bohjanen. Carried unanimously. Mr. Cardinal moved to accept the minutes of the October 27th special meeting as written. Seconded by Mr. Rosengren. Carried unanimously.- 115 Mr. Jaworski moved to accept the minutes of the November 3rd canvassing meeting. as written. Seconded by Mr. Rosengren. Carried unanimously. The Clerk reported receipt of a letter from North Central Public Service Co. stating that gas rates would be reduced about 1.8¢ per 1,000 cubic feet effective with billings made after October 27, 1971. Copies of the letter and accompanying tariff sheets will be made for Council members. Springsted, Inc. had sent a letter requesting approval of their billing for services connected with the $550,000 bonds. Mr.,Cardinal moved to authorize payment of the $4,375.00 Springsted bill after receipt of the $550,000 bond money, subject to the Attorney's reviewal. Seconded by Mr. Rosengren. Carried unanimously. Mr. L'Allier mentioned that out of 37 bond sales in the Nov. lst listing from Springsted, Lino Lakes had received the third lowest bid which is excellent at this point, showing the attractiveness of the community from the bonded indebtedness standpoint. The Clerk reported receipt of'a notice from the Anoka County Auditor stating that it is adviseable that we review the budget levy certification and if necessary, re- certify.the budget. Mr. L'Allier stated that we will most likely have to re- certify the budget, but that there should be no problem.as we had no increase in the levy over,last year. It was noted that the new tax law is not clear on many points. Mr. Bohjanen asked where clarification would come from; Mr. L'Allier stated that it would come from the State through the County. The Clerk noted a letter from Western Casualty and Surety Company that on- sale liquor Bond 397708 for Lawrence Cichy in the amount of $5000 would be cancelled on December 5, 1971. The Clerk was instructed, on a motion made by Bohjanen and seconded by Cardinal, to send.a letter to Mr. Cichy advising him that he must show proof of having a bond effective that date, or else we will cancel his licenses under the ordinance. The Clerk noted that all Council members had been given copies of a letter from Lennox to Mattson Building & Supply concerning the exhaust fan for the council room. The Clerk stated that she had received the correct legal description for the parcel on which a variance had been granted to Mrs. Bob Lundgren on May 24, 1971. Mr. Bohjanen moved to include in the variance the exact legal descrip- tion as set forth in this document and place same in the minutes. Seconded by Mr. Rosengren. Carried unanimously. Mr. Cardinal reported that some time ago, he, Glenn Rehbein and Mr. Dupre had viewed a house which Jerry Rosengren had asked to be moved in, and they had found a house to:be okay. However, the house had been moved in but no building or moving permits had been issued. Mr. Dupre stated that Jerry Rosengren was going to get the permits, but hadn't, so he had red - tagged the building. Mr. Cardinal noted that the contractor :had moved the house sooner than expected. There was discussion. Mr. Bohjanen stated that he couldn't understand, unless there was some emergency, why the contractor shouldn't 16 11/8/71 deposit the $50 first. Mr. Ted Winiecki inquired whether we were going to let him get by with the ordinance violation. Also, he though that the set- back hadn't been met. Mr. Dupre stated that the new code called for a 40' setback' he had found that the house was back 43 feet. Mr. Cardinal stated that Jerry had agreed to put 1 1/2 times the cost of repairs in a bank to be held until the refacing was completed. Mr. Dupre stated that the inside of the house was good; that the outside was siding dashed with stucco, which was partially chipped off. Jerry stated that he planned to remove the remainder of the stucco and repaint the house. He noted that the house had come down Old Hwy 8 from Stacy.. Mr. Cardinal moved to allow Jerry Rosengren to obtain the moving and building permits, with the stipulation that he refaces the house, and that 1 1/2 times whatever cost will be placed in a bank and a letter received from that bank stating 'that such amount be held for the Village until the work is completed, and that a time limit of 90 days be allowed. Seconded by Mr. Jaworski. After discussion, it was decided to set the cost of repainting the house at $500 (although Mr. Rosengren plans to do the work himself) and thus the amount to be held set at $750. This amount will be included in the stipulations on the permit. The motion was reread. The vote on the motion was as follows: Aye: Mr. Jaworski, Mr. Cardinal and Mt.,L'Allier; No: Mr. Bohjanen; Abstain: Mr. Rosengren. Motion carried. There was discussion on whether the mover should be penalized for moving the house in without obtaining the permit. Mr. Bohjanen moved to issue a tag for violation of the ordinance on moving of buildings against the mover (Safeway). Mr. Burke felt that we might have a weak case since Jerry had told the mover that he would obtain the necessary permits. Mr. Dupre stated that he issues moving permits to both movers and individuals. After more discussion, Mr. Jaworski seconded the motion, noting that we probably won't win, and that we should tighten up the ordinance. The motion .. carried with Mr. Rosengren ab- staining. Mr. Cardinal stated that as long as we were on ordinances, he would suggest that Ord. 43A on employees be amended so that the period of time worked by permanent part -time employees and temporary employees be counted towards their probationary period if they begone full -time employees. He thought it was silly to have a six- months probationary periof for employees who have worked previously. There was discussion. Mr. Cardinal made a motion to amend Ord. No. 43A by having the Attorney put the correct warding in under Section 3 of Ord. 43A, Subsections.(B) and (c), in the form of an additional sentence that the period of time spent as perma- nent part -time and temporary employees should be considered as, or towards their probationary period, when such employees are hired as full -time employees. Seconded by Mr. Rosengren. Carried unanimously. The Clerk was instructed to give each member of the Council as well as Mr. Marier a copy of the new complete ordinance books. Mr. Jaworski had no report. Mr. Rosengren stated that we would be getting the gas pump in a couple of days; the cost of both the tank and pump will be about $600. Most of the snowfence has been put in except for corn fields which haven't been picked. He reported that Mrs. Hansen had called about a culvert on 64th Street which drains into her lots. He stated that he could see no problem; Mr. Gotwald had checked it out and had seen no.problem since the water drains on the road right -of -way; perhaps in winter the water overflows. Mr. Rosengren stated that Roy Backlin had checked a culvert on Bald Eagle Lake Blvd., where a man plans to move a driveway and will need a culvert. He had received a bid on the old dump truck from Contractor's Exchange, Inc. in the amount of $400 if we would like to sell it. Mr. Jaworski noted that we had asked $1000 earlier from Circle Pines for the truck, plow and wing. After discussion, Mr. Jaworski moved to run ads in 3 or 4 papers advertising for bids on the truck, plow and wing, as is, with bids to be taken until the end of the month. Seconded by Mr. Cardinal. Carried unanimously. Mr. Rosengren mentioned that the paint was peeling on the Village entrance signs, and that the population figures sbuld be changed.to the 1970 census figures. Mr. Bohjanen stated that he has a man ready to look at the signs for painting. Mr. L'Allier suggested that we write the State asking them to put the new population figures on their Village signs. Mr. Bohjanen inquired whether the Planner had submitted a bill yet, and was told yes, that one was in with the bills to be audited. Mr. Bohjanen request - ed that the Planner, Engineer and Attorney be advised to submit their final billings for the year for payment before the end of the year, and that all other outstanding bills, such as for work projects, be paid before January 1st in order to have a better financial picture. Mr. Bohjanen stated that the name of Julia Faymoville had been suggested to him-as a candidate for Citizen of the Year, and that he wished to nominate her for that title as she is deserving of it. The matter will be put on the agenda for the next Council meeting. Mr. Bohjanen asked if we had heard any- thing yet from the County on• fixing the intersections; Mr. Rosengren stated that we had not, but that Roy Backlin will take care of any holes where our streets abut County highways. Dom. L'Allier stated that he had a request from our CD Director, Charles Cape, who had submitted a list of names for promotion. Mr. L'Allier moved that the . Council authorize the promotion of the following CD Auxiliary members as follows: Beatrice Kramer to Major; Janet Jones to Captain; Gladys Broker to Lieutenant; Ruth Rector to Lieutenant; Margaret Mitchell to Sergeant; Gloria Beecher to Sergeant. Seconded,by Mr. Cardinal. Carried unanimously. Mr. L'Allier noted that a.hearing was coming up on a motion by North Central Public Service Co. for a temporary injunction against Circle Pines Utilities serving Molin Concrete Products with natural gas. He noted some of the past history of the case, and asked the Clerk to make copies of the hearing notice for all members. Mr. L'Allier asked the Council whether they wished to make a similar request for a temporary injunction and if they wished to do so at the same time. Mr. L'Allier moved to authorize the Attorney to draw up papers for proceeding with a temporary injunction against Circle Pines Utilities Co. Mr. Bohjanen asked if it was better from a legal standpoint to have us back this (North Central's) motion•or make our own. Mr. L'Allier felt that it was better if we make our own, but noted that the.judge might not like to hear.the same thing twice and might hear both motions simultaneously. Mr. L'Allier added a stipulation to the motion, that the decision to go alone or join with North Central Public Service Co. would depend on the Attorney's opinion. There was some discussion. Mr. Bohjanen seconded the motion. The motion carried with Mr. Rosengren voting No. Clyde Rehbein stated that they couldn't get a commitment from North Central as to serving his new plat with natural gas, that he had been told they did- n't have enought gas, etc. Mr. L'Allier stated that unless they receive a formal rejection of service by letter the Council can't do anything. There was discussion. Mr. L'Allier noted that the policing contract for Centerville had not yet been reviewed by Centerville as their Mayor has been out of town. 118 11/8/71 Clyde Rehbein presented a drawing of his proposed temporary storage building for the Glenrae plat. The building would be covered by galvanized metal, the size 45' by 30', would have sliding doors, and would be located next to the woods. Mr. Bohjanen suggested that the permit be renewed every 6 months and that the Council inspect the building.every 6 months. Mr. Cardinal moved to approve the temporary building for Clyde Rehbein for a 6 month period, that the Council review the building each 6 months before renewing the permit.. Seconded by Mr. Rosengren. Carried unanimously. Mr. L'Allier noted that Mr. Locher will have the request for a PCA variance to the burning ban for the next meeting. Setting a price for a copy of the complete ordinance book was discussed. The Clerk stated that the:cost,for each of the 10 copies had Dome to $11.18 for labor and $7.42 for paper, for a total cost of $18.60 each. Mr. Jaworski moved to set the price for a complete ordinance book at $15.00, and that books be made up on order. Seconded by Mr. Cardinal. Carried unanimously. There was discussion on making up new building code books. It was decided to have the Clerk get prices on the cost of printing 50 and 100 code books; she is to ask the Engineer and the Building Inspector which ordinances to include. The matter of rescinding the fee increase for assessment searches as bad been set at the September 13th meeting was discussed. Mr. Bohjanen moved to amend The September 13, 1971 minutes, Page 6, paragraph 5, next to last line, by changing "immediately" to read "et such time as the price freeze is lifted or changed." Seconded by Mr. Cardinal. Carried unanimously. Mr. Cardinal mentioned that be had figured that pert -time help in the Clerk's department would cost about $2000 this year, and suggested that we hire a full -time Clerk - Treasurer. Mr. Bohjanen asked if he meant for full 8 -hour days and was told yes. Mr. Bohjanen stated that he thought we should let something like this go until the first of the year. Mr. Rosengren commented that we were behind a year already. There was discussion. Mr. Bohjanen moved to table this request until the first of the year. There was no second to the motion which then died. Mr. Jaworski moved to advertise for a full -time Clerk Treasurer to work 40 hours per week plus taking the Council minutes. Seconded'byiMr. Rosengren. Mr. L'Allier felt that he would object to paying overtime for taking the minutes and that someone else should do it. Also, we still need part time help. Mr. Bohjanen agreed that we would need part -time help too, but didn't think we should saddle the new Council with something new. Mr. Jaworski stated that he.would strike out the part of the motion about taking the Council meetings. The time limit for taking applications was set to the end of the month. The vote on the motion was as follows: Aye: Mr. Jaworski, Mr. Cardinal, Mr. Rosengren, and Mr. L'Allier. No: Mr. Bohjanen. Mction carried. Mr. L'Allier inquired of the Clerk whether some of the part -time work might be cut out if the Clerk goes full time; the Clerk agreed that it would to some extent. There was more discussion. The bills were audited. Mr. Rosengren moved to pay the bills, seconded by Mr. Cardinal, but Mr. Bohjanen wished more time to look them over. Mr. Bohjanen asked the Clerk to make copies of the Planner's bill for the Council. Mr. Rosengren. mentioned that he had a request from the Circle Pines Post- master for a decision on whether they or the Hugo post office would serve Glenn Rehbein's new plat. They felt that we should talk to the contractor first and then make a decision. The Clerk stated that she had talked to Glenn and that he preferred Circle Pines. 11/8/71 Glenn Rehbein mentioned his problem with North Central on gas service. They wanted to bury gas tanks, which Glenn doesn't feel the residents would like. He stated that with winter coming they needed to know whether they should contact Circle Pines Utilities for gas or put in oil ,heat. He stated that they couldn't get anything definite from the North Central representative, Larry Harrison, who had stated that he would try to get Glenn a,letter in 2 weeks. There was discussion. Mr. Jaworski moved to send an inquiry to North Central requesting an-answer in 2 weeks as to whether they will provide natural gas gerviee to Glenrae Estates. Seconded by Mr. Cardinal. Carried unanimously. The postal service was discussed. Mr. Rosengren moved to indicate that the Council would go along with the wishes of the developer as to which Post Office is to be used. Seconded by Mr. Jaworski. Carried unanimously. Mr. Bohjanen moved to pay the bills as audited. Seconded by Mr. L'Allier Carried unanimously. Clyde Rehbein asked if Mr. Locher bad come to any conclusion on the plumbing code as to use of plastic pipe. Mr. L'Allier noted that Mr. Locher was to have checked with the St. Paul City Attorney to see what they were going to do. Mt. Burke stated that Mr. Locher would be back late Wednesdvy; the Clerk could check Thursday. There was considerable discussion. Mr. Rosengren moved to abide by the State Code. Seconded by Mr. Cardinal. Mr. Bohjanen wished to have Mr. Burke call Clyde Rehbein after he has talked with,Mr. Locher on Tuesday evening and then follow this with a letter. Also, copies of the letter should go to the Plumbing Inspector and the Building Inspector. Mr. Rosengren withdrew his'motion. Mr. Cardinal withdrew his second. Mr. Jaworski moved that if Mr. Locher's letter is favorable, that is if St. Paul allows the use of plastic pipe above the ground, that Lino Lakes will allow plastic pipe also. Seconded by Mr. L'Allier. There was discussion, with it being noted that St. Paul has adopted the State Building Code. The motion carried with Mr. Rosengren voting, No, since he didn't feel we should do what St. Paul does for that sake alone. Mr. Jaworski moved to adjourn at 9 :56 P.M. Seconded by Mr. Rosengren. Carried unanimously. Minutes approved at the meeting of November 22, 1971y J Clerk- Treasurer 12/7/71 The special meeting of the Lino Lakes Village Council was called to order at 8 :25 P.M. on December 7, 1971, by Mr. L'Allier. Present were Mr. Jaworski, Mr. Bohjanen, Mr. Cardinal and Mr. Rosengren. This meeting was called to review the applications received for the position of full time Clerk - Treasurer. Filed of record are three Printer's Affidavits of Publication, in the Forest Lake Times, the Circulating Pines and the Blaine Life, for a two week period. The deadline given the the Notice was November 30, 1971. As of that date there was only one application, that of June Emerton. The next morning, December 1st, a second application was received from Mrs. Linda Roetmen. Mrs. Roetmen was present and the Council members had several questions of her, and discussed her qualifications with her. She indicated she had had book-
