The special meeting of the Lino Lakes City Council was called to order at 8:00 P.M.
by Mayor Bohjanen on March 23, 1976. Council members present; Karth, McLean, Schneider,
Zelinka. Absent; None. Mr. Locher was also present.
Mayor Bohjanen said this meeting had been called for the purpose of considering the
Union Contract with the Police Department. Mayor Bohjanen introduced Mr. Karth and
Mr. Schneider to the Union representatives. Mayor Bohjanen asked Attorney Locher
to bring the members up to date on the latest information.
Mr. Locher said there had been two meetings with the mediator and the recommendations
from that office had been a 10% salary increase for the two patrolmen and the Clerk/
Typist and a 52% raise for the part -time personnel. The City had offered a 51%
raise to all personnel with 50% toward insurance.
It was suggested that the contract be gone through once againfor areas of agreement.
In Article III, a subdivision 3.12 had been added dealing with the probationary per-
iod. It was ggreed this period should not exceed fifteen (15) months total employ-
ment period.
Article IX, the posting requirement of the seniority list was deleted and the phrase
'and be available upon request of an employee' was added.
Article XII, which deals with overtime was discussed. Mr. Zelinka felt that with
a department to size of this one, the overtime should be considered as over and
above a forty (40) work week, not on the eight (8) hour shift.
Mr. Bastain said this would be a major point of contention. They are prepared to
tae this to arbitration.
Mr. Locher asked if the overtime is up to the individual or to the discreation of
the Chief?
Mr. McLean asked if comp time can be used and Mr. Bastain said, No. Mr. Locher
said he had researched this question and had received the same answer. Article
XII, sub. 12.1 was held.
Article XV was amended as follows; after first word add 'are expressly' and change
the work 'period' in the second line to 'shift'. The Council emphasized the personnel
must be appointed to the higher classification.
Mr. Zelinka moved to approve Article XV with the changes. Seconded by Mr. McLean.
Motion carried.
Article XVI deals with sick leave. The Union wanted an unlimited accumulation but
would settle for 120 days. The City offered 90 days, with a doctor's certificate
required after an absence of 3 days. Mr. McLean moved to hold this article.
Seconded by Mr. Zelinka. Motion carried. The hold deals with the number of days
only.
Article XVII deals with vacation time. The final proposvl was 0 to 4 years - 10
days; 5 - 10 years - 15 days; II - 20 years - one day per additional year. Vacat-
ions to be taken after the year is worked. Mr. Zelinka so moved. Seconded by
Mr. McLean. Motion carried.
On Article XVIII, subdivision 18.4 was deleted andon Article XIX, subdivision 19.1
was deleted. Subdivision 19.2 was set at $46.20 per month for full time employees

only. Mr. Zelinka so moved. Seconded by Mr. Karth. Motion carried.
Article XXIII deals with clothing allowance. The Council agreed on the original
issuance of uniforms and replacement for clothing damaged in the line of duty.
After some discussion, Mr. Zelinka moved to agree on an annual clothing allowance
of $125.00 after the first year and for full time employees only. Seconded by
Mr. McLean. Motion carried.
Article XXIV and Article XXV were passed at this time. The Union asked for a copy
of the "False Arrest Policy ". Mr. Locher said he would take care of that matter.
Mr. Bastain said on two of the remaining hold artitiles, the union would agree to
the 90 day accumulation of sick leave if the City would agree to overtime after
8 hours. Mr. McLean said if the overtime is controlled by the Chief.
Mr. Zelinka moved to accept this proposal. Seconded by Mr. McLean. Motion carried.
The matter of the salaries was considered. Mr. Wisenburger asked what the City would
offer. Mayor Bohjanen said the offer had been 52% and the City's position hasn't
changed.
Mr. McLean moved offer the following schedule for consideration;
Starting salary would be 8% of 875.00 - $945.00
After six months
One Year
Two Years
Three Years

1090.00
1135.00

These figures would apply to full time Patrolmen only with 10% additional for Sargent.
Mr. Bastain asked if this would become effective 1/1/76? Mr. McLean said there had
been no discussion on the duration. Mr. Bastain asked if this would apply to part -
time personnel? Mr. McLean said this did not deal with them at this point.
Mr. Zelinka seconded the motion. Motion carried.
Chief Myhre felt the part time personnel should be paid the same hourly rate as the
full time men. Mr. McLean had no problem with that. Mr. Zelinka so moved. Sec-
onded by Mr. McLean. Motion carried.
The Chief's salary is an adminstrative matter to be dealt with by the Council.
Mr. Zelinka said for general purposes the longevity date of hiring would be 1/1/75.
Mr. McLean moved this longevity date be noted in the contract. Mr. Zelinka seconded.
Motion carried.
The date of effectiveness for the contract and the duration was discussed. Mr. McLean
suggested the contract become effective 1/1/76 with a 4% escalator effective 1/1/77,
this to be an 18 months contract with the renewal date to be July I, 1977. This is
better timing for the cash flow and would make negotiating easier due to the date
of tax receipts.
Mr. Bastain said based on the salary proposal by the City in the schedule he is
agreeable to take back to the employees for a vote. However, he would ask that on
1/1/77, the rate of adjustment be 6%; add one more holiday; and increase the

insurance payment to $50.00.
Mr. McLean suggested using the cost of living index as of that date instead of the
4 %. There was discussion on this method with no decision reached.
Mr. Bastain said the union can agree with the 12 months contract - cannot agree to
The 4%, would agree with the 18 months contract but only with the 6% escalator
clause.
Mr. Schneider felt that a 4% increase is all the City can live with. Mr. McLean
asked if the contract could be reopened for a six months agreement?
Mr. McLEan moved to agree to a one year contract effective 1 -1 -76 to 12 -31 -76 with
a six months re- opened clause to specify wages, holiday, and insurance only to be
negotiated.
Mr. Schneider asked if there is any problem with a cut back? Mr. Bastain said,
No, the contract allows the City to determine the use of the personnel and there
is no problem with the cutting of the hours of the personnel.
Mr. Karth seconded Mr. McLean's motion. Motion carried.
On the matter of the Police Clerk /Typist, Mayor Bohjanen asked Mr. Locher to read
the correspondence with the Police Officer's Training School which denies the app -
licaton of Mrs. Pankratz for entrance into the school on the premise they do not
consider her as a Police Officer.
After the letters were read, Mr. McLean asked if the Union was familar with the
City's answer to the Human Rights charges that had been filed by Mrs. Pankratz?
They knew of this matter.
Mr. Bastain asked if the City is creating a job description of a Police Clerk?
Mr. Locher said this has existed at all times. This would merely add a third job
classification of that of a Police Clerk under Article 11, Subdivision 2.1.
Mr. Zelinka moved to create the job classification. Seconded by Mr. McLean. Motdon
carried.
The fact that she had been sworn in was discussed. Mr. Locher pointed out that
all Council members are sworn in with the same form. There is nothing special
about it. Mr. Zelinka asked if it is necessary for her to be a sworn person to
handle certain papers and he was told, No.
Mr. Bastain said Mrs. Pankratz was asking for $750.00 per month.
Mayor Bohjanen said that he would only approve an 8% salary increase. This is
consistent with the salary increases of the other employees. Mr. Bastain went to
consult with Mrs. Pankratz. Mr. Wisenburger told Mr. Locher, who reported to the
Council, that Mrs. Pankratz would settle for $730.00 per month and drop the charges
with the Human Rights Commission.
The Council refused the offer and Mr. Wisenburger returned to consult with Mrs.
Pankratz.
Mr. Bastain returned to the Council chambers and said the final offer was $725.00
per month for Mrs. Pankratz.

Mayor Bohjanen recommended this salary be held at 8% to be consistent with the
remaining employees. He asked for a motion to that effect. Mr. McLean so moved.
Mr. Zelinka seconded. Motion carried.
Mr. Bastain said they will prepare a contract, present it to the employees for app -
roval; if approved they will send copies for Council signatures.
There was some discussion on the need to post City Street. Mr. McLean moved to
authorize Mr. Karth to consult with Mr. Gotwald on this matter. Seconded by Mr.
Zelinka. Motion carried.
Mr. McLean moved to adjourn at 12:00 midnight. Seconded by Mr. Schneider.
Motion carried.
