HomeMy WebLinkAbout09/13/1976 Council Minutes1 1 September 13, 1976 The regular meeting of the Lino Lakes City Council was called to order at 8:00 P.M. on September 13, 1976 by Mayor Bohjanen. Council members present; Karth, Schneider. Absent; McLean, Zelinka. Mr. Locher and Mr. Gotwald were present. The minutes of August 16, 1976 and August 23, 1976 must be held for approval until the meeting of September 27, 1976 due to lack of a quorum of the members present at those meetings. The Clerk reported on the following items; ..A copy of the Natural Resources Model Ordinances had been received from the Met- ropolitan Council. Copies have been made for members of the Planning and Zoning Board. ..Information from the Metropolitan Transit Commission concerning Federal Aid Ur- ban Program - all members have a copy. ..A letter from the Blaine Midway All Pets, Inc. had been received - all members have a copy. ..A letter from Mr. Frank Marzitelli, Commissioner of Highways designating County Road 14 and County Road 23 North of 14 as haul roads in conjunction with the up- grading of County Road 23 in Columbus Township. ..The information contained in the dues from the League of Minnesota Cities is cor- rect in that the population figures is the 1970 census figure of 3,692. Mr. Schn- eider suggested this matter be discussed at the budget hearings. ..A policy statement from the Metropolitan Council on the Resource Recovery Facil- ities for Amendment to the Metropolitan Development Guide on Solid Waste Manage- ment. All members have a copy. ..Receipt of $3,300.00 as reimbursement from the State for the attendance of three officers to the BCA. ..A note from Mr. David Torkildson, Anoka County Park Director, informing the Coun- cil the County Park Department will be responsible for the inspection and removal of diseased trees in the parkland. ..A letter from the Anoka County Comprehensive Health Department setting the dates and times for flu immunization shots. This will be posted and has also been pub- lished in the local papers. ..A copy of the permit for pumping water issued to the Metropolitan Waste Control Commission by the Department of Natural Resourses in conjunction with the install- ation of the interceptor. ..District Nine of the Minnesota Department of Highways is holding Highway Days on September 23, 24 & 25 at Maplewood Mall. All are invited to attend. ..All Council members received a copy of the letter from Mr. Burman in answer to the speed study request. ..Mr. Schneider asked for a clarification as to the problems with Mrs. Oman coll- ecting unemployment. The Clerk reported that she had received a request for sal- ary earned by this employee for a period of time. This had been reported. September 13, 1976 The form also asked to make a note if the employee left the place of employment for any reason other than lack of work. Mrs. Oman had resigned and this was noted on the form. A redetermination of benefits had been received and the Clerk was advised by the City Attorney to file an appeal, which she did. Mr. Schneider ask- ed if there had been a request for references . The Clerk said there had been one call. The person calling had been told of the prejudice of the Clerk by the Clerk. The person calling said she was checking into Mrs. Oman's former places of employ- ment because of the eight positions in the past ten years. She was told that Mrs. Oman had good qualifications and the ability to perform, if she wanted to. The Clerk had been asked if she would rehire Mrs. Oman and had said, No. ..A request for a variance from Mr. Webster and Mr. Rehbein for the transfer of title on a parcel of land of less thatn 21 acres. These parcels will be purchased by the Metropolitan Waste Control Commission for sites for the installation of the lift stations. Mr. Karth moved to pass these requests to the Planning and Zoning Board and then poll the Council for their opinion in order not to delay the install- ation of the lift stations. Mr. Schneider felt that in the future all requests for references should be hand- led by the Personnel Commission. After some discussion, Mr. Schneider so moved. Seconded by Mr. Karth. Motion carried unanimously. Mr. Larry Leibel appeared before the Council on behalf of his parents who request- ed a variance to split a parcel of land in order for Mr. Leibel to build a home and be near his parents. This request had been rejected by the Planning and Zon- ing Board since each parcel would have a front footage of 104' and not the required 150'. Mayor Bohjanen felt that since Mr. Leibel had been unable to attend the Council meeting where this had been discussed, Mr. Leib& should be allowed to present his side of the request. Mr. Leibel said his parents are getting too old to be able to take care of the property. He said that in order to buy land that he could afford he would have to go to North Branch. His parents will give him the land and the reason for the diagonal split is in order not to disturb their driveway. Mr. Gotwald said the only requirement that a variance would need to be considered for is the 150' requirement since each lot would have more than one acre. Mr. Schneider felt that since this had been rejected he would like to hear Mr. McLean's report on this matter. He asked Mr. Leibel if he could return for the next Council meeting. Mr. Leibel said he works nights and it's almost impossible for him to get off work. Mayor Bohjanen said he would recommend this variance be allowed. Mr. Schneider felt he would like to hear the other side of the story. Mr. Leibel repeated his reasons for requesting the variance. Mr. Schneider moved to table this matter until the next meeting. Seconded by Mr. Karth. Motion carried with Mayor Bohjanen voting, No. Mr. Karth felt this lot should be squared off for future purposes. Mr. Leibel said the property would stay in the family. Mr. Karth said this should be reconsid- ered by the Planning and Zoning ans asked if his parents could attend the meet- ing on September 15, 1976 and they said they could. Mayor Bohjanen said he had quite a few calls and a letter from the residents of 1 1 1 1 137 September 13, 1976 LaMotte Drive asking the status of the sewer petition. He asked Mr. Gotwald to present his report at this time. Mr. Gotwald said he had checked the petition for the required percentage and 37% of the front footage is represented by the signatures. This is based on LaMotte's Second and Third Additions. Time is not a factor in this matter. Centerville will be opening bids on October 8, 1976 and Mr. Gotwald felt the low bidder for that installation will be open for the installation of the lines along LaMotte Drive. Also, the cost per foot quoted in that bid could be used as a cost figure for the feasibility report for the LaMotte area. This area will go directly into a Metropolitan Lift Station and will not be a part of the Centerville system. Mr. Gotwald said they had been ordered by the Metropolitan Council to design this area into that sewer system. He recommended the feasibility report be ordered for pre- sentation at the October 12, 1976 meeting. A resident of the area in the audience said the main concern of the people is the costs - he asked about grants. Mr. Gotwald said there are no grants available at this time. There was discussion o- the formula used to compute the costs. Mr. Gotwald said there are various formulas that can be used. They pesent sev- eral ways the assessments can be levied and it is a Council decision as to the me- thod used. Mr. Schneider asked about the cost of the feasibility report and Mr. Gotwald felt it would be under $500.00. A gentleman asked about the scope of the feasibility report and Mr. Gotwald said all facets would be considered in the report. After some discussion, Mr. Schneider moved to order the feasibility report for presentation on October 12, 1976. Seconded by Mr. Karth. Motion carried un- animously. Mayor Bohjanen asked Mr. Gotwald for any information he might have as to the status of the pumps for the Shenandoah area. Mr. Gotwald said he had done everything he knew to do and felt the only course left open was a letter to Mr. Dougherty request- ing the pumps be installed immediately as per contract. A carbon copy of the letter to be sent to the contractor. Mr. Gotwald said he would callagain. He felt the contractor is in violation of his contract and the hold -up is with the contractor. Mr. Artzen asked about the streets and Mr. Gotwald said Mr. Rehbein is now taking bids for the installation of the streets. Mr. Artzen asked if the Council had set a dead line for the streets to be installed and Mr. Gotwald said, No. There is legally nothing the City can do in this matter, the legality of the con- tract is between the Metropolitan Waste Control Commission and Northdale Construct- ion. Mr. Karth reported the grader will be available this week and asked if the City has insurance coverage on contracted equipment. The Clerk is to check with Mr. McGowan for this type of coverage. If this coverage is necessary, Mr. Karth moved to acquire the necessary insurance effective immediately. Seconded by Mr. Schneider. Motion carried unanimously. Mr. Karth reported that Hugo had done some fill work on 24th Avenue from Main Street 138 September 13, 1976 North to 80th Street and there had been some discussion of Hugo doing the maint- enance on that section of the street. The Clerk was instructed to write to the Road Supervisor of Hugo, thanking him for the work done and asking their plans as to the maintenance of that portion of the Street. Mr. Karth said that in July the Personnel Commission had recommended a 5% salary increase for Mr. Volk and the matter had been dropped. He moved to grant the 5% salary increase for Mr. Volk effective July I, 1976. Mr. Schneider asked about the salary ranges that were to be established by the Personnel Commission and the evaluation forms taht are to be filled out. Mr. Karth said the recommednation had come from the Personnel Commission and had been meant to put Mr. Volk in the salary range he would have been if he had been granted raises on the same basis as other employees. The motion carried with Mr. Schneider voting , No. Mr. Schneider said he had no qualms on the raise - just felt something should have been prepared. He would like to see a better procedure for granting salary increases. Mr. Schneider reported on a short meeting at the MMTC held on September 4, 1976. Preliminary plans for the meduim security had been looked over. The Institution is still in the process of organizing and the plans are very preliminary. The Park Board met on August 30, 1976 basically for budget considerations. The status of Outlot 1 in LaMotte's second Addition was discussed. There are three choices 1) can be leased but then must be returned to the tax rolls and the City will be liable for real estate tazes; 2) can be sold at the best possible price; 3) if a parking problem will be created and this can be documented by the Police Department, then the street could be marked as a "No Parking" zone thus limiting the number of persons using the access. Mr. Gotwald felt the original intent of the lot was for drainage and the St. Paul Water Department owns the rear of the lot. Mr. Schneider felt then the first place to start would be with the St. Paul Water Department to find their rules and regulations as to the use of tha *'and. Mr. Schneider had received a request from Mr. Resch for the use of the outside lights for one hour per night for three nights per weekfor one month. This is for football practice. Mr. Schneider moved to approve this request. Seconded by Mr. Karth. Motion carried unanimously. Mr. Ringaman had asked about a dog pound on Sunset Avenue. The Clerk explained it was not a request for dog pound but a dog kennel. The gentleman has an option to purchase some 68 acres of land and he raises show dogs. His purchase of the land hinges on his receiving permission for a kennel at that location. The forms had been mailed to the man and he has not pursued the matter at this date. Mr. Schneider asked about the $50,000 CD on deposit at the Drovers State Bank and the status of that CD. Mr. Locher said he has not been able to contact Mr. Kron- holm but will have a report at the next Council meeting. Mrs. Liljedahl had met with Mr. Volk and they have drawn up some guide lines for the use and maintenance of the hockey rinks. She also requested the use of the Planner for scaling out the Hall property for improvements. 1 1 1 September 13, 1976 Mr. Gotwald felt that it is possible to get this done through the University of Minnesota. The Clerk was instructed to contact the State Planner for assistance in this matter. Mr. Locher presented a copy of the Joint Powers agreement between the Lino Lakes Police and the Lexington- Circle Pines Police for law enforcement on North Road between Pointcross and Lake Drive. Chief Myhre said it would make it easier for an officer to act when the law is broken. Mr. Locher said such agreements make law enforcement simplier and less costly. A copy of the agreement should be sent to the insurance agency stating the officers that are covered. Mr. Schneider moved to approve this agreement and to authorize the Mayor and the Clerk to sign the agreement. Seconded by Mr. Karth Motion carried unanimously. Mr. Gotwald had received a copy of the reply from Mr. Boland regarding the reserved capacity in the North Road interceptor. He will read and will then present his recommendations. He had looked over the requests for variance from the Metropolitan Waste Control Commission and recommended they be presented to the Planning and Zoning Board. He could see no problems and recommended approval of the requests. Mr. Locher asked about the above ground portion of the lift stations to be in- stalled at t`;ese locations. Mr. Gotwald said there is only about 22 feet above the ground, the installation is painted and fenced. There is usually a power pole inside the fence where the controls are located. He said they take up just a small area and do not create a problem. Mr. Locher wondered if the lot in Shenandoah could still be used as a home site. Mr. Gotwald felt that it could - this is a corner lot and quite large. Mr. Schneider asked if the model home in Shenandoah had been connected with a septic system. The Clerk said there had not been a permit issued. She was instructed to contact Mr. Vadnais and ask him to check on this matter. Under Old Business, the Clerk presented the comparison figures on the copy machine as requested by the Council. Mr. Schneider felt the needed time to study this and to also fit the cost into the budget. He moved this matter be tabled until the September 27, 1976 meeting. Seconded by Mr. Karth. Motion carried unanimously. Mayor Bohjanen reported to Chief Myhre he had had reports of dragging on Lilac and he asked the Chief to watch this area. Cheif Myhre said he would. Atso, the trucks from Molin Concrete are taking the corner off the street at Lake Drive. It is not wide enough at that point to allow the truck sufficient clearance for entrance on Lake Drive without going onto the shoulder of the street. The Clerk was instructed to write the State Highway Department and ask the street be widened at that inter- section inorder to accomadate the large trucks. Chief Myhre said the auto manufactures are now accepting bids for patrol cars. He had prepared a specification list for a new patrol car and asked for approval to advertise for bids. Delivery is 60 to 90 days. The purchase of this vehicle is in the 1976 budget. September 13, 1976 Mr. Schneider moved to advertise for bids for a new patrol car. Seconded by Mr. Karth. Motion carried unanimously. Chief Myhre asked permission to have a pop machine installed at the Hall. He had talked to the employees and the general consensus was in favor. Chief Myhre said he would handle the installation and taking care of the machine, but he would ?sk that any profits be put into a fund for the purchase of police equipment. After some discussion as to where the machine would be installed. Mr. Karth moved to approve the installation of the pop machine to be maintained by Chief Myhre with the profits to be put into a police fund. Seconded by Mr. Schneider. Motion carried unanimously. Mr. Karth moved to approve requisitions #694 through and including #701. Second- ed by Mr. Schneider. Motion carried unanimously. Mr. Karth moved to approve payroll checks #3687 through and including #3704. Se- conded by Mr. Schneider. Motion carried unanimously. Mr. Karth moved to approve checks #7300 through and including #7331, holding check #7301, 7018 and 7331 until the State Aid Check is received. Seconded by Mr. Sch- neider. Motion carried unanimously.
