The special meeting of the Lino Lakes City Council was called to order at 7:30 P.M.
on March 23, 1977 by Mayor Bohjanen. Council members present: Karth, McLean, Sch-
neider, Zelinka. Mr. Locher and Mr. Gotwald were also present.
Mayor Bohjanen said the purpose of this meeting is to inform the developers of the
community the restrictions being place on this City by the Metropolitan Council.
These restrictions are in direct relationship to the interceptor being installed on
Birch-Street. Mayor Bohjanen introduced Representative Howard Neison and Mr. Tom
Daniels, aide to Representative James Oberstar.
Mayor Bohjanen said the City had presented a package conforming to the requests as
set forth by the staff of the Physical Development Committee and the Physical Dev-
elopment Committee staff had several issues of disagreement. This had been present -
ed to the Physical Development Committee on March 17, 1977 and the recommendations
of the staff had been approved. This matter is to be presented to the Metropolitan
Council on Thursday, March 24, 1977. He felt the negative attitudes of the Metro
Council toward this City must be counteracted and this is the time to do it. Mayor
Bohjanen asked Mr. Locher to present the results of the last meeting with the Phy-
sical Development Committee.
Mr. Locher presented the four areas in which the Physical Development Committee staff
disagrees with the City:
I) Allocation of capacity in the Blaine Interceptor; the City maintains this cap-
acity was allocated to Lino Lakes at the time of planning - staff says there
has never been such an allocation.
2) Definition of "existing development "; - the City's position is that all platted
lots in the Country Lakes and Shenandoah area are to be allowed to hook into
the interceptor; - the staff says only those homes existing now are eligible
for service.
3) Rural Service area density standards and controls. The City's presentation
to the Physical Development Committee will meet Metro Council requirements;
staff says it will nod.
4) Septic tank monitoring; the City will adopt the WPC - 40 when it becomes law;
- Staff says this is not enough, this regulation may not be as strong as Metro
would like.
Mayor Bohjanen questioned the cost of installing the interceptor. There doesn't
seem to be a figure available. This interceptor was designed to serve 700 - 750
homes - the staff recommendations is that only the existing 63 units be allowed to
use the facility.
The Attorney was asked about the implied statement, 'that if the City did not con-
form to the staff recommendations, the pumps in the lift stations would be turned
off'. Mr. Locher said the Attorney who made the statement was corrected by Mr.
Starr.
Mr. McLean read the statement that these issues could only be resolved by direct
discussion with the Physical Development Committee - he asked Mr. Locher if there
had been any direct discussion and Mr. Locher said other that one member asking a
couple of questions, None. Mr. McLean asked if he had any impression as to whether
the members had read the submission of the City and Mr. Locher felt it would be
impossible for the members to read all the material submitted but he doubted if they

had even skimmed through the City's presentation. He felt the Committee depends sole
on staff recommendations, and the staff interprets the submission strictly accord-
ing to the statutes.
Mr. McLean said the City had computed the density standards by three different meth-
ods, and still haven't found a formula acceptable to the staff.
Mr. Ernie Zelinka asked if this density is enforced, does this mean the City is at
the saturation point now and Mr. Karth, said, Yes. There was discussion on the all-
owable homes to be constructed and the approximate number of existing units.
Mr. Neison asked what is Columbus Township doing to conform to Metro requirements,
Mr. Gotwald said he didn't know. The fact that Columbus does not pay S. A. C. makes
it difficult for Metro to control the development.
Mayor Bohjanen said some of the communities to the North are having this same sort
of problem with Metro. Mr. Neison said Lino Lakes is the only community in his dis-
trict that he has heard about having such problems.
Mr. Glenn Rehbein cited the history of this whole affair and suggested the City has
backed up far enough. If there is no agreement, he felt the City should instigate
a law suit.
Mr. Daniels asked what would be decided at the meeting scheduled before the Metro
Council and he was told, the Council could approve the Physical Development Committ-
ee's recommendations, disapprove and agree with the City's position or send the
whole matter back for further study.
Some of the developers in the audience asked the status of plats in the preliminary
stage. Mr. Karth said this is why this meeting was called - to inform the developers
of the possibilities in this dispute.
The general consensus of the Council was to continue to operate on the same premise
as we have in the past and if the Mettopolitan Council does not agree, then let them
sue us.
Mr. Locher was asked, if an injunction can be obtained to halt the building on the
North part of the City and Mr. Locher said, No.
There was some discussion on the fact the Anoka County Board of Commissioners had
passed a Resolution to the effect that Anoka County should be removed from the seven
county metropolitan area.
Mr. Nelson asked what position the City is taking and was told the City will abide
by the position stated in their presentation and no more. After the meeting scheduled
for Thursday the City will either win or will be in a fight.
Mayor Bohjanen felt this could be a stand off - could the City refuse to collect the
S. A. C. ? Mr. Nelsen asked he be given time to check this matter.
There was some discussion this could have on commercial property - but it was
felt there would be little effect.
Mr. Karth moved to authorize Mr. Locher and Mr. Gotwald to attend the Metro Council
meeting. Seconded by Mr. McLean. Motion carried unanimously.

Mr. Kronholm said the Legislature had created a monster without a soul - there is
no way to reach them.
Mr. Karth reminded all the developers present the decision made tomorrow could poss-
ibly offer any assistance in this matter. He also asked that all who could possibly
attend be at the hearing.
Mayor Bohjanen thanked the people for attending and offering their input into solving
this matter. He also asked them to attend the hearing tomorrow.
Mr. McLean moved to adjourn at 9:15 P.M. Seconded by Mr. Karth. Aye.
