Seconded by Mr. Zelinka. Motion carried unanimoulsy. Mr. McLean moved to adjourn at 12:00 midnight. Seconded by Mr. Zelinka. Aye. These minutes were approved at the June 27, 1977 meeting. Edna L. Sarner, Clerk- Treasurer June 27, 1977 The regular meeting of the Lino Lakes City Council was called to order at 8:05 P.M. on June 27, 1977 by Mayor Bohjanen. Council members present; Karth, McLean. Absent; Schneider, Zelinka. Mr. Locher and Mr. Gotwald were also present. Mr. McLean moved to approve the minutes of June 13, 1977 as presented. Seconded by Mr. Karth. Motion carried unanimously. The Clerk reminded the Council that on the July agenda will Employee evalua- tions and consdieration of computing the Police Contract with Centerville in the same manner as the Fire Contracts are computed. After some discussion on this matter, the first budget hearing was set for August 1, 1977 at 7:30 IIIp.m. with all department heads to be present. The direction of the Council will be set at that meeting and further meeting dates set. IIIThe Public Hearing for West Oaks of Bald Eagle was called to order at 8:35 p.m Mr. Locher read the published notice of the hearing. Mr. McLean reported there had been an Enviornmental Worksheet done on this project and mailed to all the agencies necessary. Mr. McLean asked Mr. Bruggerman if there had been any changes in this plat since it had been submitted to the Planning and Zoning and Mr. Bruggerman said, No. Mr. Kulaszewicz was in the audience. He had called requesting permission to hold a block party. The Clerk had checked with the Attorney and the matter had been cleared with the Insurance agent. Mr. Karth moved to approve this party. Seconded by Mr. McLean. Motion carried unanimously. Forms for application for refund from the State on the Shade Tree Program had been received. This was given to Mr. Locher to look over. After some dis- cussion on this matter, the Clerk was instructed to contact Mr. Beach for his assistance on filling out the application. A letter from the Anoka County Comprehensive Health Department was read. This letter sets forth the manner in which this department will assist the local communities. It would appear they will only act as a go- between. There was some discussion of the problems of obtaining a person to act as a Health Officer. The City Council felt they coan only continue to operate in the present manner. The Clerk reported on the following items: ..The SAC of $1500.00 for the remodeling at MMTC had been received. ..A letter from the Metropolitan Waste Control Commission approving the in- stallation of the sewers on LaMotte Road was read. This is to be a part of the Comprehensive Sewer Plan for the City. June 27, 1977 Mr. Bruggerman was asked if he had any further information as to the Metro Council. Mr. Bruggerman explained that he had been called late Monday and asked to appear at a meeting that evening. This had been with Mr. Doyle. The recommendation to require an Enviornmental Impact Statement had been forwarded to the Metro Council for action on Thursday, June 23, 1977. The Metro Council had asked the Envoirnmental Quality Board to require this impact statement. Mr. Bruggerman said they would not accept any informatio The action by the Metro Council was to merely rubber stamp the recommendation. Mr. McLean asked hot the 'Human Resourses' commission got involved with this plat - he felt this is an agency that has no dealings with plats. There was no answer to this. Mr. Bruggerman said there will be another meeting - he felt that some member of the Council should be present at that meeting. Mr. Locher suggested that perhaps Mr. Burman should be asked to attend. Mr. McLean read the protion of Mr. Doyle's report that says the area being platted is in the open space program and is in the process of bieng acquirred by Ramsey County. Mr. MCLean pouted out, this City has never be contacted by anyone from Ramsey County on this matter. He felt this statement was misleading. Mr. Bruggerman thought the next meeting would be with the EQC and he asked that an official from the City attend. After some discussion, the Council authorized Mr. Gotwald or Mr. Short to attend this meeting. Mayor Bohjanen said, if he has enough notice of the meeting, it might be possible for him to attend. Mr. Karth offered to substitute for the Mayor. Mr. McLean pointed ou t the matter of the developers agreeing to plat accor ing to the planned ordinances and suggested these ordinances be passed in order to clear this matter. Mr. Locher agreed and said there must be a published notice and a public hearing since this involves some zoning changes. The Council members had no questions on the plat of West Oaks of Bald Eagle. Mr. McLean moved to approve the final preliminary plat as presented. Second- ed by Mr. Karth. Motion carried unanimoully. Mr. Bruggerman said he would forward any information he receives as to the time and date of the meeting. Mr. Karth moved to close the public hearing at 9:10 P.M. Seconded by Mr. McLean. Motion carried unanimously. The Clerk continued her report: ..A notice from the State of Minnesota informing the City that NSP has applied for a rate increase of 14.6% for residential customer; 14.5% for commercial users and 14.4% for street lighting. A pre- hearing conference will be held July 18, 1977 in the American Center Building at 150 E. Kellogg Boulevard in Saint Paul, Minneosta. Hearing dates will be set at that meeting. ..A letter from the Metro Council concerning the improvement grant funds for home improvement had been read. This allocates $3,267.00 to the City for improvement to homes. After some discussion, the Council decided this program was not applicable to the City. ..Read a letter from Mr. Torkildson in reference to the meeting scheduled for June 30, 1977 at 2:00 P.M. for members of the Park Commission. The June 27, 1977 d Council felt this is a very inconvenient time for a meeting. The Clerk was instructed to write Mr. Torkildson with this information and ask that future meeting be set in the evening when these persons are available. Mayor Bohjanen had received a letter from Mr. Richard Dougherty of the Metropolitan Waste Control Commission, concerning the lift station in Country Lakes. The Commission felt this station is fitill the respon- sibility of this City and asked that we have it repaired. The Council flet that since the Commission has removed the original pumps and modified the control panel, the maintenance of this facility is their responsibility. Mr. Locher was instructed to write to Mr. Dougherty giving him this information. Mayor Bohjanen had received a letter from the Metro Council seLLing the estimated population figure for Lino Lakes at 4,270 as of April 1, 1977. Mr. Karth opened the bids received for the equipment advertised for bids. One bid of $51.00 for the 1973 Plymouth; the mower - one bid of $78.00; one bid on each of the snow plows for $6.00; and $51.00 for the 1966 Ford Pick -up. Mr. McLean moved to accept the bid of $51.00 for the 1966 Ford Pick -up. Seconded by Mr. Karth. Motion carried unanimously. Mr. Karth moved to accept the bid of $78.00 for the Ford mower. Seconded by Mr. McLean. Motion carried unanimously. Mr. Karth moved to reject all other bids. Seconded by Mr. McLean. Motion carried unanimously. Mayor Bohjanen moved to authorize Mr. Karth to set appropriate prices on the patrol cars and advertise, with a minimum price of $250.00 on the 1973 Plymouth - all other material to be sold for junk. Seconded by Mr. McLean. Motion carried unanimously. Mr. Karth presented a list of the streets to be seal coated this summer and the estimated costs. This was discussed with no changes being made. Mr. Karth said this was to bring the Council up to date on what is being planned. Mr. McLean presented the report from the Planning and Zoning Board meeting of June 15, 1977. Mrs. Walter Tauer had applied for a variance to split a lot on Lake Drive. The Planning and Zoning had recommended approval of this split providing a legal description for each parcel was provided. This information had been delivered to the Clerk's office. Mr. McLean moved to approve the variance. Seconded by Mr. Karth. Motion carried unanimously. The plat of Shenandoah III had been consdiered by the Board. Mr. Rehbein had re- aligned the street to line up with the street in Shenandoah I and have curved the street to create a more acceptable plat. There are several streets platted to the North and South of this land so that when the area is developed this will eliminate the long cul -de -sac. After some discussion, Mr. McLean moved to approve the preliminary plat with the following stipulations; 1) this must be cleared with the DNR, Anoka County Highway Department, Anoka County Park Board; 2) money to be accepted in leiu of land with value to be comput after final approval. Seconded by Mr, Karth. Motion carried unanimously. 268 June 27, 1977 Mr. McLean moved to set the public hearing for July 25, 1977 at 8:30 P.M. Seconded by Mr. Karth. Motion carried unanimously. Mr. Charles Nelson had applied for a variance to split a lot in Pine Vista I. This was made necessary in order to plan the street for entrance to Pine Vista II. The matter had been discussed at the previous Council meeting. Mr. Nelson had delivered a map with the necessary land description added to the Southern lot in order to make both parcels a legal size. Mr. McLean moved to approve this request. Seconded by Mr. Karth. Motion carried unanimously. Mr. Midtaune was not represented, therefore, that plat was not considered. Mr. Ahlshouse was present with a very preliminary sketch for land located on either side of West Shadow Lake Drive. He was seeking information as to platting this area in one acre lots and the steps necessary to accomplish this. The two most important items are the surfacing of the street and the ability of the lots to contain on site septic systems. There were no decisions on this matter. Mr. McLean reported the Planning and Zoning Board had requested that only variances with complete legal descriptions be presented to the Board for consideration.. Mr. McLean so moved. Seconded by Mr. Karth. Motion carried unanimoulsy. A plat submitted for 40 acres on the SouthEast corner of Linda Street and Hodgson Road was considered. A representative for the plat, Rohavic Oaks, said they would now like to plat this area in phase 1 and phase 2 and he would like to -build his home on a portion of the land that is not included in the pahse 1 development. Since this is not platted, it will need a description by meets and boulds. Copies of the Engineer's and Planner's reports will be mailed to the developer and they will work out the phases of development and feturn to the Planning and Zoning Board. Three sign permit applications were consdiered - Forest Tagg; Rite -Way Waterproofing and Getty Refining. More information was needed on the Tagg application and the fact that he is conducting a business at that location was discussed. The Clerk was instructed to write to Mr. Tagg that he may need a special use permit. The Sign application for Rite Way Waterproofing was uiclear as to the road setback. The Getty Refining sign was to merely add the word 'Food( to an existing sign. The Planning and Zoning Board has recommended approval of this application. Mr. McLean so moved. Seconded by Mr. Karth. Motion carried unanimously. Mr. McLean said the applications for sign permits are coming before the Board very incomplete. He asked that all spaceston the application form be completed, with a sketch and a location. This is necessary for the Board to consider these applications. Mr. McLean reported the matter of the minimum land area of one acre, not to include the street easement, had been discussed by the Board. On plats this is a requirement, but on a meets and bounds description it is not. Mr. McLean aeked Mr. Locher to make this requirement a part of the new ordinance III and this is to be required on all parcels of land. He so moved. Seconded by Mr. Karth. Motion carried unanimously. The letter written by the Clerk, as suggested by Mr. Locher, dealing with the surfacing of West Shadow Lake Drive was read. There was some discussion on the present condition of that street and the usage by golfers. The letter June 27, 1977 L had been addressed to Mr. Kordia1, Chairman of the Board of Commissioners, and asked Anoka County to surface and relocate a portion of the street per City specifications and the City will assume full responsibility for maintenance. Mr. Karth moved to mail the letter. Seconded by Mr. McLean Motion carried unanimously. Mr. McLean had called Mr. Mobley on the trailer on a lot on Otter Lake. Mr. Mobley had red - tagged the unit and the owners were told it must be removed. They could not do the removal this past weekend but will be out this next weekend. Mr. Locher read a letter from an Attorney representing Mr. Pierre Nadeau. This letter was questioning the manner in which the Brokke operation was handled. Mr. Locher read the minutes pertaining to the issuance of the special use permit. This Attorney asked for a transcript of the court order. Mr. Karth felt the letter was vague and if the Attorney wanted answers he would have to be more specific. Mr. McLean felt the City should also have a copy of the Court order. He moved to authorize Mr. Locher to obtain a copy. Seconded by Mr, Karth. Motion carried unanimously. Mr. Locher said he had done quite a bit of research on the Privacy Act in conjunction with a questionaire that the Clerk had received on one of the City's former employees. Mr. Locher said all the questions could be answered with the exception of the Social Security number. This can- not be released. Mr. Van Kleek's request for information as to the selling of a lot he owns on Peltier Lake and the acquisition of a building permit was dis- cussed, but no action was taken. The suggested ordinances were tabled until the full Council is present. Mr. Gotwald reported the installation of the sewer lines on LaMotte_Road is basically complete. The road will be graded and graveled. The areas where grass was'disturbed will either be sodded or seeded. The street will not be re- surfaced this year - or at the present, that is the plan. It will depend on how quickly the street settles. Mr. Gotwald said he would like to see the assessment hearing soon so this could be certified to the County for collection next year. Mr. Gotwald said he had had a call about the alignment of the street and he explained the street had been located to align with the street in Centerville. It is within the platted right -of -way although not centered on the easement. He said if it could be centered without extra costs, it would be done, otherwise, the street will be resurfaced in the same location. A request for buried cable by Northwestern Bell Telephone on East 81st Street had been checked by Mr. Gotwald. This cable may gave to be relocated in the future due to the enadequacy of the existing easement. Mr. Gotwald suggested approval of this request at this time. Mr. McLean so moved. Seconded by Mr. Karth. Motion carried unanimously. Mr. Gotwald had been requested to present some cost figures for the sur- facing of West Shadow Lake Drive. He said if the street is surfaced as it now exists, the cost would be approximately $15,000.00 - if the ditches June 27, 1977 are filled and a 32 foot driving surface restored the cost would be approximately $32,000.00. He felt there must be some kind of shoulders to that street since the ditches are deep and wide and, he flet, dangerous. Mr. McLean suggested that perhaps the costs could be shared by Drovers State Bank and Anoka County - such as the surfacing to be done by the County and the shoulders be restored by the Bank. The material dealing with the correspondence with Mr. Boland and the in- ability to set a meeting was considered. It was decided that a letter should be written to the Governor stating the position of the City and enclosing the correspondence. Mr. Karth suggested this letter should be signed by each individual Council member. This letter is to state the City is just asking for some positive action. A copy is to be sent to Mr. Boland, Mr. Oberstar, Mr. Tom Daniels and Mrs. Opal Peterson. Mr. McLean moved to approve Checks #8012 through and including #8033, with #8026 being voided. July 6, 1977 The special meeting of the Lino Lakes City Council was called to order at 7:40 P.M., July 6, 1977 by Mayor Bohjanen. Council members present; Schneider, Zelinka, Karth, McLean. Mr. Burman, County Commissioner was also present. Mayor Bohjanen said this special meeting was called to try to determine how West Shadow Lake Drive can be improved. He then turned the meeting over to Councilman Karth. Mr. Karth explained that there has already been a meeting with Mr. Kronholm Mr. Burman, Mr. Torkildson, Mr. McLean, Mr. Gotwald and others to discuss this matter. He wxplained that presently the road has a 24' surface that could be blacktopped and needs very little upgrading except shoulders would have to be constructed. Mr. Gotwald has estimated that if the surface is blacktopped as it is now the cost would be approximately $15,000.00, if the driving surface is extended to 32' and ditches filled in and shoulders provided the cost would be approximately $32,000.00. Mr. Torkildson of the Couty Park Department has stated that one possible soultion would be for the City to provide oil for the surface and the County provide all other improvements and labor. Mr. Kronholm, a resident on West Shadow Lake Drive explained about two weeks ago he had met with Mr. Burman to explore what could be done to improve the road and determine who the road belonged to. Mr. Kronholm explained the dust situation was extremely bad and the surface of the road was in a washboard condition doing damage to their vehicles. He felt the road was being used primarily by the golf course users. In one day 150 to 200 cars use this road to get to the course. 1 1
