The regular meeting of the Lino Lakes City Council was called to order at 8:00 P.M. by
Mayor Bohjanen. Council members present: Karth, McLean, Schneider, Zelinka. Absent:
None. Mr. Locher was also present.
Mr. Karth moved to approve the minutes of July 25, 1977 as presented. Seconded by Mr.
Zelinka. Motion carried unanimously.
Mr. McLean asked the minutes of July 26, 1977 be held for clarification.
The Clerk presented the following items for Council consideration:
..Notice of publication of the scheduled public hearing for Rohavic Oaks to be held
Monday }, September 12, 1977 at 8:45 P.M.;
..A letter from the Anoka County Fire Protection Council of which all members have a
copy;
..The East -West Street in Pine Haven designated as 126th Street N. E., is not consistent
with the alignment of the streets in Lino Lakes. This Street is more in line with 81st
Street. Since the Plat has been filed, the correction of the street can only be attached
to the plat. In discussing this matter, Mr. Locher said all street name changes must
be done by Ordinance. Mr. McLean moved to change 126th Street N. E. in the Plat of Pine
Haven to 81st Street West. Seconded by Mr. Zelinka. Motion carried unanimously. Mr.
Schneider moved to authorize the Attorney to draw up the necessary ordinance. Seconded
by Mr. Karth. Motion carried unanimously.
..Mrs. Mary Sullivan, of the EQB, had dropped off a copy of her report to that Board at
their meeting scheduled for 8:30 A.M. on Tuesday, August 9, 1977. Each Council member
has a copy of the report. Mr. Locher, Mr. Gotwald and Mr. Short have been asked to att-
end. Mr. McLean moved to authorize this attendance. Seconded by Mr. Karth. Motion carr-
ied unanimously.
..Mr. Mobley from the audience, said he had been asked to attend this meeting. Mr. McLean
moved to authorize the Building Inspector to also attend this hearing. Seconded by Mr.
Zelinka. Motion carried unanimously.
..The method of computing the population figure to be used in the determination of the
amount of State Aid to be received in 1978 had been received from the Department of Rev-
enue. They will add the 1970 census figure to the estimated figure from the Metropolitan
Council and divide by two. The population figure to be used is 3,981.
..A letter from MSP setting forth the rate increases.. There will be hearings held on
this matter and the rate can be either confirmed or reduced. There will be more at a
later date.
..The League of Minnesota Cities is holding a farewell reception for Mr. Dean A. Lund on
Wednesday, August 31, 1977 from 4:30 to 6:30 P.M. at the Member's Lounge, St. Paul Arts
and Science Center at 10th and Cedar Streets in Saint Paul. All members are invited.
..The Clerk had called the County Highway Department on the Federal Aid Urban Boundary
projects and was told that Anoka County cannot qualify for these funds due to the lack
of traffic volume.
Mayor Bohjanen asked for Mr. Edmundson's questions. Mr. Edmundson was present to determine
what the City is asking for in the way of money in lieu of Park Lands in the Colonial Woods
project.

Mr. McLean suggested delaying a decision on this matter and consider the proposal presented
at the last Council meeting for a flat charge per lot. Mr. McLean asked this matter be
considered by the Council and concluded within the next 30 days.
Mr. Edmundson said this is the way things are handled in Shoreview and he has no objections
Mr. McLean moved to study the park land changes and ordinances necessary to set this pro-
cedure and any plat owing money being dealt with at this time be included under this con-
sideration, this matter to be considered at the September 12, 1977 meeting. Seconded by
Mr. Zelinka. Motion carried unanimously.
Mr. Roger Kolstad presented the hard shells for the Air Park. Mr. Locher said he had not
checked the abstract. Mr. Kolstad said the abstract is being brought up to date and should
be ready by the end of this week. After some discussion, Mr. Zelinka moved authorize the
Mayor and Clerk to sign the hard shells subject to-he abstract receiving the Attorney's
approval.
Mr. McLean asked that the consideration of the park land be included in this motion, this
plat to be considered under the above ordinance to be studied at the September meeting.
Mr. Locher said he will not certify the hard shell to the County Surveyor until the abstract
has been checked. Mr. McLean seconded themotion. Motion carried unanimously.
Mr. Kolstad requested a building permit for one lot in the Air Park. He said the owner
has arwrtgage committment that expires soon. Mr. Kolstad has not completed the bond for
the installation of the streets. It was suggested that he obtain a letter of credit or
a road bond for the necessary footage to reach this lot and then the building permit could
be issued.
Mr. Locher reminded the Council that the lot cannot be transferred to a new owner until the
plat is filed. Mr. McLean moved to have the Clerk contact Mr. Gotwald for the cost of
installation of the necessary footage and get the figures to Mr. Kolstad this week. Sec-
onded by Mr. Karth. Motion carried unanimously.
Mr. Gene Mobley, Building Inspector, was in the audience. He read a portion of a letter
from the PCA approving an asmosis septic system for areas where regular type systems will
not work.
He asked the Council for consideration of an Ordinance that would require all contractors
who operate within the boundaries of the City of Lino Lakes to be licensed and bonded. He
felt this is necessary to protect the home buyers. Mr. Mobley said the amount of the lic-
ense fee is not important, but the bonding is.
Mr. Mobley also requested the Council to consider a 'disclosure ordinance', relating to the
sale or transfer of all properties within the City. This would apply to empty land as well
as existing homes.
The Clerk was instructed to call the League of Minneosta Cities for sample ordinances on
these matters. Mr. Zelinka so moved. Seconded by Mr. McLean. Motion carried unanimously.
These samples are to be forwarded to the Attorney and presented to the Council for consid-
eration.
Mr. Zelinka suggested that a letter being written by the Building Inspector be very clear
and concise. He had read a couple that were not clear in their meaning.

Mr. Mobley told the Council that he would be glad to meet with any of them to go over the
building code to include all phases. Mr. Mobley thanked the Council for their time and
attention.
The Public Hearing on the proposed ordinances was called to order at 9:05 P.M. Mr. Lo-
cher read the published notice. Mr. McLean set forth the items of concern with these
ordinances. On the requirement of a 'Special Land Use Permit' requirement, Mr. Locher
said that new legislation passed this past session requires a building permit on all
agricultural residents. This requirement became effective July 1, 1977. There was an
addendum to Sec. 3 of the proposed ordinance stating that if a building permit is nec-
essary then the land permit will not be required. Mr. Locher will write the addendum
for publication.
After discussion clearing the points of these ordinances, Mr. McLean moved to approve
the Ordinances including the addendum. Seconded by Mr. Zelinka. Motion carried unan-
imously.
Mr. McLean said the ordinance setting the rural and urban service boundaries should be
considered at an early date. Mr. McLean moved to set the hearing date for this Ordin-
ance for September 12, 1977 at 9:15P.M. Seconded by Mr. Karth. Motion carried unanim-
ously.
The Clerk is to call Mrs. Sullivan tomorrow morning before the EQB meeting with the
information of the passage of the Ordinances.
Mr. Karth moved to close the hearing at 9:15 P.M. Seconded by Mr. Zelinka. Motion
carried unanimously.
The Clerk had received copies of a proposed re- alignment of the corner of Highway #49
and Lake Drive. This map is to be forwarded to Mr. Gotwald for his inspection.
Mayor Bohjanen said he had talked to Mr. Burman on the burning problem in the Chain of
Lakes Park and he will be meeting with the PCA at the sight on August 12, 1977. They
will consider ceasing the burning and going to more chipping. Mayor Bohjanen will report
on this later.
Mr. Burman also reported the matter of West Shadow Lake Drive is still under consider-
ation. He hoped to have most of the expense of installing that street covered by the
County. Mr. Burman has asked for a committment from the City. Mr. Karth will contact
Mr. Burman on this.
Mayor Bohjanen said the triangle at the corner of Main Street and Highway #8 had been
mowed and cleaned by a Boy Scout. He had been approached to put in a Park bench or a
picnic table at this location. He will work with Mr. Burman on this matter.
Mr. Karth presented a map for the installation of new street lighting. There is seven-
teen new lights proposed for installation. Mr. McLean suggested checking some of the
lighting on the east side of the City. He felt some of these may be security lights
installed and paid for by private citizens.
Mr. Peter Scherer, from-the Audience, suggested a ligrit at the intersection of County
Road #14 and County Road #84. This is East of 135E and is a very dark corner. The
other locations suggested were Birch and Centerville Road and Birch and 20th Avenue
NOrth. Since these are County Roads, they will be contacted on this.
Mr. Karth reported the seal coating is completed except for a small patch in the drive-
way at the City Hall. This will finished in the next day or so.

Mr. Zelinka asked about quotes on road supplies- he was concerned if these materials were

purchased under a contract. Mr. Karth will check with Mr. Volk on this matter. The quotes
for materials should be submitted with the vouchers for payment.
Mr. McLean had no report from the Planning and Zoning Board but would like to set up a
meeting with Mr. Locher, Mr. Gotwald and Mr. Short to formulate the exact wordage in an-
swer to the system statement. This meeting would be on Monday, August 15, 1977 at 8 :00
P.M. He would then request that a special Council meeting be scheduled for Thursday,
August 18, 1977 for Council approve of this statement. This will enable the material
to be in the mails on the 19th and be received by the Metropolitan Council before the dead-
line of August 23rd. Mr. McLean so moved. Seconded by Mr. Zelinka. Motion carried un-
animously.
There is a scheduled meeting in Forest Lake on August 17, 1977 at 7:30 P.M. in the Senior
High School regarding the election of Metropolitan Council members. Mr. McLean said he
has a Planning and Zoning Board meeting that evening but felt that the City should be re-
presented. Mr. Schneider and Mr. Zelinka said they plan to attend. Mayor Bohjanen said
he will try.
Mr. Schneider had no report from the Park Board. However, there was a meeting at the MMTC.
Mr. Zantek has been transferred from his position at that facility and Mr. Schneider moved
to write a letter of appreciation for his cooperation. Seconded by Mr. McLean. Motion
carried unanimously.
Mr. Schneider also had met with Mr. Ehrmantraut of Northern Instruments on the possibility
of obtaining sewers for his building. Mr. Schneider had suggested that Mr. Gotwald be
contacted in this matter. The business is expanding and he has need for sewer services.
He will present his ideas to the Council by letter.
Mr. Zelinka reported on the meeting of the Personnel Commission held on August 1, 1977.
They have scheduled a meeting for August 11, 1977 to prepare a salary schedule dchedule
for budget consideration.
Three items are to be considered by this Commission; 1) overall salary recommendations;
2) adjustments to bring to medium range; 3) change of some job descriptions.

Mr. Johnson had moved to recommend to the Council that all newly hired full time employees
will be subject to a 90 day probationary period at a rate of 10% less than normally paid
at their present skill level. This motion had been passed by the Personnel Commission. Mr.
Zelinka moved to approve this motion. Seconded by Mr. Schneider. Motion carried unanimously.
The Personnel Commission had felt the Fire Contracts are computed by population using the
population of the MMTC. The Clerk is to call the Fire Chief in Lexington and check this
matter. If this is the case, then the City should be reimbursed for providing coverage
for that facility.
The Clerk had presented a recommendation to the Personnel Commission for changing Mrs.
Anderson's status from part -time to a full time employee and had also included a salary
recommendation. This change to be effective as of August 1, 1977. The Personnel Comm-
ission had considered this matter and had recommended the change of status as of August
1, 1977 with the 10% deducted from part -time salaries to be restored.
Mayor Bohjanen asked how this would complare with the hourly wage of the Police Clerk and
was told it was lower. There was discussion on this matter. Mr. Zelinka moved to place
Mrs. Anderson on full -time status as of August I, 1977, restoring the 10% difference in
salary, for the remainder of the year 1977, this position will be discussed for 1978 at

the budget hearings. Seconded by Mr. Karth. Motion carried unanimously. This will increase
IIIMrs. Anderson's salary to $3.85 per hour.
Mr. Schneider questioned Mr. Zelinka as to effective date of salary increases and Mr. Zelinka
said this had been discussed. The Personnel Commission had indicated the effective date shoul
be the 1st of the year but realized this must be left to budget consideration.
The Personnel Commission will also present recommednations for Police salaries. The need
for a Sargent will also be discussed, as will rotating shifts and weekend availability of
officers.
Mr. Locher said there should be an assessment role prepared for the La Motte sewer pro-
ject. Notice of the hearing and mailed notices must be two weeks prior to the meeting.
This must be on file in the City Offices for inspection. Mr. Locher said it is not re-
quired by law but he would suggest the amount of the assessment be included in the mailing.
This assessment role must be certified to the County Auditor prior to October 10, 1977
in order to be placed on the 1978 assessment roles.
Mr. McLean moved to set the assessment hearing for La Motte Sewer Project for September
12, 1977 at 9:45 P.M. Seconded by Mr. Zelinka. Motion carried unanimously ,&L' (rte i

Mr. Locher asked if this was to 100% assessed to the property owners and was` t• d, Yes.
Mr. Locher suggested using both the Auditor's and County Treasurer's list for mailing.
He said the property owners have until November 15, 1977 to prepay the assessments without
interest.
IIIMr. Locher felt that repeaters should have no more consideration than an adult, but he said
some of the offenders break the law just to get their names in the paper; some feel if they
have the name, they might as well play the game, thus becoming repeaters because of the pub-
licity. Mr. Locher said at the present time, the names are absolutely confidential.
Mr. Locher had received a letter from the Union stating the demands for the 1978 Police
Contract. There was a copy for each Council member. This matter will discussed at the bud-
get hearing scheduled for August 11, 1977. The Clerk was instructed to make a copy of this
memo for all Personnel Commission members.
Mr. Locher reported there will be a meeting in the Anoka County Commissioners room on
August 9, 1977 at 10:00 A. M. in connection with the re- spelling of some of the names of the
Lakes located within the City. The one in question is Rondeau - it seems some one wants
to retain the spelling as "Randeau ".
Mr. Zelinka introduced the subject discussed previously on the State Law requiring the
confidentiality of juvenile offenders. Mr. Locher had made some calls but as of this
date has not received an answer.
Mr. Zelinka felt the names of the offenders should be made public in order to deter this
action. He felt letters should be written to the State Legislatures stating the City's
position on this matter. Mr. Zelinka emphasized this is his opinion and he would like
an opinion from other Council members. Officer Hillyer was in the building, Mr. Zelinka
asked him to present his thinkings on this matter.
Officer Hillyer said there is merit to both sides of the question. It was suggested that
a panel of persons who deal with this problem be assembled for an evening of discussion
on this mater.

Officer Hillyer thought the severity of the crime should be considered.
Mr. Zelinka moved to table this matter for now but asked that this be on the agenda for
discussion at least once a month until a decision is made.
Mr. Karth suggested considering making the names public the second offense. Mr. Zelinka
thought this should be brought to the State Legislature pointing out the mistakes of the
current law. Officer Hillyer asked Mr. Locher if he personally felt publicity would be
a deterrent to juviles becoming hard core criminals and Mr. Locher said, Yes.
Mr. Zelinka's motion was seconded by Mr. McLean. Motion carried unanimously.
Mr. McLean moved to approve requisitions #774 through and including #776. Seconded by
Mr. Karth. Motion carried unanimously.
Mr. Zelinka moved to approve checks #8118 through and including #8163, with a correction
in spelling on #8159. Seconded by Mr. Schneider. Motion carried unanimously.

These minutes were approved with corrections at the August 22, 1977 regular Council meeting.
