The Clerk will send the code to Mr. McLean for the Planning III & Zoning to look over. Mr. Jaworski moved to pay the bills as audited. Seconded by Mr. Rosengren. Carried unanimously. Mr. Myhre stated that the new squad car was in town and that a problem with the alternator was being fixed. Mr. Rosengren stated that Meyer Sign Company will paint the doors on the car for free. The purpose of the meeting was to open bids submitted on the $100,000 general obligation municipal building bonds of 1970. Mr. Locher showed the affidavits of publication of the sale from Commercial West and the Forest Lake Times and stated that proper notification of the meeting had been made. Mr. Ron Langness of Springsted, Inc. stated that one bid had been received, although three offers had been pending; the market had jumped during the day and the other two bidders had changed their minds. The Clerk opened the bid which was from Piper, Jaffrey & Hopwood of Minneapolis. Included was a check in the amount of $2,000 as required. The interest rates were listed as follows: 75 1972 thru 1975 6.75 % 1976 thru 19 6.50 % Net Interest Cost $52,117.50 1977 thru 19 6.60 % 1978 thru 19 6.70 % Net Effective Rate 6.9956% 1979 thru 19 6.75 % 1980 thru 19,x, 6.80 % Mr. Locher stated it was proper to inquire of the recommendation of the fiscal agent before action was taken on the bid. Mr. Langness stated that because the market was going up and down, he definitely recommended that Lino Lakes accept this bid unless they wished to wait awhile for another, which might be as high. Mr. Cardinal moved to adopt a resolution authorizing the acceptance of the bid from Piper, Jaffrey & Hopwood and authorizing Springsted, Inc. to print the bonds, coupons, etc., and deliver these to the buyer, also authorizing the signatures of the Mayor and Clerk- Treasurer on the same. Seconded by Mr. Jaworski. Carried unanimously. RESOLUTION AWARDING THE SALE OF $100,000 MUNICIPAL BUILDING BONDS, FIXING THE FORM AND SPECIFICATIONS THEREOF, DIRECTING THEIR EXECUTION ANDODELIVERY AND PROVIDING TAXES FOR THEIR PAYMENT. BE IT RESOLVED By the Village Council of the Village of Lino Lakes, Minnesota, as follows: 1. The bid of Piper, Jaffrey & Hopwood, Minneapolis, Minnesota to purchase $100,000 Municipal Building Bonds of the Village described in the notice of sale thereof, is hereby found and determined to be the highest and best bid received pursuant to duly advertised notice of sale and shall be and is hereby accepted, said bid being to purchase bonds bearing interest as follows: Bonds maturing in the years 1972 to 1975 inclusive, six and seventy -five hundredths per cent (6.75 %) per annum; bonds maturing in 1976, six and fifty hundredths per cent (6.50 %) per annum; bonds maturing in 1977, six and sixty hundredths per cent (6.60 %) per annum; bonds maturing in 1978, six and seventy -five hundredths per cent (6.75 %) per annum; bonds maturing in 1978, six and seventy -five hundredths per cent (6.75 %) per annum; and bonds maturing in the years 1980 to 1982 inclusive, six and eighty hundredths per cent (6.80 %) per annum at a price of $98,040.00. The Village Treasurer is directed to retain the good faith check of the successful bidder pending completion of the sale and delivery of the bonds, and the Village Clerk is directed to return the checks of unsuccessful bidders forthwith. 2. The Village shall forthwith issue Municipal Building Bonds in the aggregate principal amount of $100,000, said bonds to be dated March 1, 1970, to be 20 in number and numbered 1 to 20, both inclusive, in the denomination of $5,000 each, bearing interest as above set forth, payable March 1, 1971 and semiannually thereafter on March 1 and September 1 in each year, and maturing serially on March 1 in the years and amounts as follows: $5,000 in 1972 and 1973, $10,000 in 1974 to 1982, both inclusive, without option of prior payment. 3. Both principal of and interest on said bonds shall be payable at the main office of the Northwestern National Bank of Minneapolis, in Minneapolis, Minnesota and the village shall pay the reasonable charges of said bank for its services as paying agent, 4. The bonds and the interest coupons to be thereto attached shall be in sub- stantially the following form: 76 No. $5,000 UNITED STATES OF AMERICA STATE OF MINNESOTA COUNTY OF ANOKA VILLAGE OF LINO LAKES MUNICIPAL BUILDING BOND OF 1970 KNON ALL MEN BY THESE PRESENTS That the Village of Lino Lakes, Anoka County, Minnesota, acknowledges itself to be indebted and, for value received, hereby promises to pay to bearer on the 1st day of March, 19 , without option of prior payment the sum of FIVE THOUSAND DOLLARS and to pay interest thereon from the date hereof until said principal amount is paid at the rate of interest to maturity payable March 1, 1971, and semiannually thereafter on day of March and the 1st day of September in each year, in accordance with presentation and surrender of the interest coupons hereto attached as they become due. Both principal and interest are payable at the main office of western National Bank of Minneapolis, in Minneapolis, Minnesota the 1st and upon severally the North- in any coin or currency of the United States of America which at the time of payment is legal tender for public and private debts. For the prompt and full payment of such principal and interest as the same respectively become due, the full faith, credit and taxing powers of the village have been and are hereby irrevocably pledged. This bond is one of an issue of $100,000 principal amount, all of like date and tenor except as to maturity and interest rate, all issued for the purpose of pro- viding money to construct and equip a building for village hall, garage and other municipal purposes pursuant to authority conferred by more than the requisite majority vote of the electors of the village voting at an election duly and regularly called and held, and pursuant to and in full conformity with the Constitution and laws of the State of Minnesota. IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions and things required by the Constitution and laws of the State of Minnesota to be done, to happen and to be performed precedent to and in the issuance of this bond have been done, have happened and have been performed in regular and due form, time and manner as to required; that prior to the issuance hereof, a direct annual irrepealable ad valorem tax has been duly levied upon all of the taxable property in said village for the years and in amounts as required by law, and additional taxes will be levied upon all of said property, if required to pay principal or interest when due which taxes may be levied without limitation as to rate or amount; and that the issuance of this bond did not cause the indebtedness of the village to exceed any constitutional or statutory limi- tation thereon. The bonds shall be prepared under the direction of the Village Clerk and shall be executed on behalf of the Village by the signatures of the Mayor and the Village Clerk and the corporate seal of the Village shall be affixed to each thereof, and the interest coupons shall be executed and authenticated by the printed facsimile signatures of said Mayor and Clerk. When said bonds have been so executed, they shall be delivered by the Village Treasurer to the purchaser thereof upon receipt of the purchase price and the purchaser shall not be obligated to see to the proper application thereof. 6. There is hereby created a separate sinking fund for said bonds, which shall be held by the Village Treasurer and used for no other purpose than to pay principal of and interest on said bonds, provided that if any payment of principal or interest shall become due when there is not sufficient money in said fund to pay the same, the Treasurer shall pay such principal or interest from the General fund of the Village and said General fund shall be reimbursed for such advances out of the proceeds of taxes levied pursuant hereto or other moneys appropriated by the Village Council for such purpose. Into said sinking fund shall be paid all proceeds of the taxes levied pursuant to this resolution and such other moneys as may be received by the Village for the purpose of, or appropriated to, the payment of said bonds and interest. 7. The Village Clerk is hereby authorized and directed to file with the County Auditor of Anoka County, Minnesota, a certified copy of this resolution, together with such other information as the County Auditor may require, and to obtain from the County Auditor a certificate that such tax has been levied and the bonds have been entered upon his bond register. 78 9. The County Auditor of Anoka County and the officers of the Village are hereby authorized and directed to prepare and furnish to the purchaser of said bonds and to the attorneys approving the same, certified copies of all proceedings and records of the Village relating to said bonds and to the financial condition and affairs of the Village, and such other certificates, affidavits and transcripts as may be required to show the facts within their knowledge or as shown by the books and records in their custody and control, relating to the validity and market- ability of said bonds, and such instruments, including any heretofore furnished, shall be deemed representations of the Village as to the facts therein stated. The motion for the adoption of the foregoing resolution was duly seconded by Councilman Jaworski, and upon vote being taken thereon, the following voted in favor thereof: L'Allier, Bohjanen, Rosengren, Cardinal, Jaworski, and the follow- ing voted against the same: None. whereupon said resolution was declared duly passed and adopted. Mr. Langness thought that it would take about 35 days to get the money; they would take care of the reinvestment of the same. The bonds will be dated March 1 and the buyer will buy any interest due if the money comes later than that. Mr. Langness stated that the current interest rate on government treasury notes was now 8 %; these will be handled through our bank; the money can -be had on one day's notice to the bank and will earn interest to the day of withdrawal. Mr. Rosengren estimated that it would take two months to complete the building when the contract is let; he thought the contractor might want half of the money at separate times or possibly in three payments in a 90 -day period, as is commonly done. Mr. Langness required signatures of the Mayor and Clerk- Treasurer on several forms. The bid check will be held until such time as the bonds are signed and delivered and the money is received. Beecher 43.20 1057 Roy H. Backlin 363.00 The regular meeting of the Lino Lakes Village Council held on February 9, 1970, was called to order at 8:07 p.m. by Mayor L'Alller with all members present. Mr. Jaworski moved to accept the minutes of the January 26th regular meeting as written. Seconded by Mr. Cardinal. Motion carried unanimously with Mr. Bohjanen abstaining since he had been absent at that meeting. Mr. Bohjanen moved to accept the minutes of the special January 29th meeting providing the exact wording of the resolution governing the bond sale be added. Seconded by Mr. Jaworski. Carried unanimously. The Clerk read the January ending fund balances as follows: Total funds - $14,507.96, General - $2,974.14 in the red, Parks - $857.62, Roads - $5,383.27, Fire - $3,703.40, Civil Defense - $620.68 and Debt - $6,917.13. The receipts in January were $1,429.44 and disbursements were $10,396.90. The Clerk stated that nothing had been received from Gethsemane United Methodist Church as requested regarding the pending off -sale license across the highway. The Lexington Fire Dept. report for the fourth quarter of 1969 was read. Mr. Bohjanen moved that a copy of the Lexington report be sent to the Centerville Fire Dept. asking that they submit the same type of report. Seconded by Mr. L'Allier. Carried unanimously. The Clerk mentioned letters from Mr. Reidenberg, Attorney handling the Municipal Court property which stated that Lino Lakes had submitted the only acceptable bid on the electric typewriter. Also, that due to some difficulty Lexington Village was being allowed an extra 30 days to bid on any other Court property in the inventory. Mr. Cardinal moved that the typewriter be purchased as bid, for $25.00. Seconded by Mr. Rosengren. Carried unanimously. A letter commending Mr. Myhre's help to a motorist in trouble was read; the motorist deeply appreciated the assistance. Also, a letter written to the Mayor from Paul Miller of Acton Construction thanking the Council for the favorable action on their rezoning request was read. Mr. Cardinal had nothing to report except that the next Planning & Zoning meeting would be February 18th. Mr. Jaworski had no report but wished to discuss the Mayor's January 12th proposal that Lino Lakes suspend all mobile home park hearings for a year and allow sites for same to be chosen. Mayor L'Allier reiterated his feelings and statements on this subject, mentioning that the period of one year was arbitrary. He felt that we were wasting the developer's time by holding hearings on mobile home parks now when the Village doesn't even know if it wants any or where they should go. Crystal Ahlman asked if hearings weren't already set for Mr. Menkveld on the 3 sites he proposed and was told "no ", that he was going to bring his proposal before the Planning & Zoning and the Council but these were not called hearings.
