The minutes of the March 23rd meeting were corrected and Mr. Cardinal moved to accept them. Seconded by Mr. Rosengren. Carried unanimously. Mr. Rosengren moved to approve the cigarette license application for Sandra LeTendre, d/b /a Louie's Cafe. Seconded by Mr. Bohjanen. Carried unanimously. The Clerk reported that our March allotment in the amount of $5,158.37 had been received; also that $32.50 had been received from Municipal Court. A letter from the Twin Cities Area Metropolitan Transit Commission stated that the scheduled April 15th breakfast meeting with Anoka County municipal officials would be held at 8:00 a.m. at Howard Johnson's Restaurant on Central Avenue. Another letter had been received from Attorney Reidenberg concerning the bids by Lexington on the Municipal Court property. He stated that he would have an accounting of the entire proceedings shortly. A letter from the Fire Underwriters Inspection Bureau was read stating that they would be inspecting both the Centerville and Lexington Fire Departments and hold further dis- cussion with us. The Clerk was asked to send copies of the letter to the two fire departments. Mr. Locher had sent a copy of the approving legal opinion from Nir. Charles B. Howard on the $100,000 municipal bond sale and had enclosed statements from lair. Howard and IIIhimself on the bond. A statement had been received from Mr. Van Housen, Planner, and copies of same had been mailed to Council members. However, an itemized breakdown of the statement had been 1 8 requested so that time used on certain projects might be charged to that project. Mr. Locher stated there might be a problem in collecting for this time if the bills had already been sent and paid by the respective persons. The Clerk was asked to type copies of the ordinance concerning the sewerage of inflammable liquids and mail them to the P&Z and Council. The letter from Chomonix regarding the park dedication for Lakes Addition No. 2 was read, stating that they will set aside 6.5 acres for park purposes or a possible cash settlement, whichever we decide we want. Mr. Ja *orski mentioned that the Park Board had held a special meeting on April 2nd to discuss this with the Engineer and the Planner. Jandric representatives had also been present. They had decided to hold off on picking a park site and to take credit for the acreage like we had done in Lakes Addition No. 1. Mr. L'Allier stated that he had talked on the phone with the rest of the Council members and all had agreed to accept this letter for additional credit. However, they had all felt that prior to any additional plats, we would decide on which acreage to take for a park or else take money. Alternatives considered were land on the unplatted south side of Reshanau Lake, on the north side or asking Jandric to guarantee some land on each of the lakes they hold land on. Mr. L'Allier stated that on the basis of this letter and the receipt of the necessary street bonds, the Clerk and he had signed the final plat of Lakes Addn. No. 2. Mr. Jaworski stated that they had received the information that Jandric only owns land on Reshanau Lake. Mr. Gotwald commented that they hold a contract for deed on land near the creek. 1 Mr. Locher stated that the street bonds were okay except that the name of Stan S. Watkins, principal for Bituminous Surface Treating Co., was not typed in and that this should be corrected. The Clerk will clear this with U. S. Lakes. The Clerk read a letter from Chomonix stating that Lakes Addition No. 2 must have water and sewer service no later than August 1, 1970 based. on their projected possession dates. After discussion, it was decided the Clerk would send a letter to U. S. Lakes stating that our Engineer is working on the information requested by the Metro Sewer Board, that he expects to have the preliminary reports within the next month, that we cannot commit ourselves to an exact date. We can probably have water for them by August 1st, and sewer within one year, but that a temporary tank could be used for a few houses. Carbon copies will be sent to the Council members. The Clerk read e letter from Peter Scherer regarding 64th Street and a notarized letter from Harry Proulx he had submitted to the Council in 1967 concerning the Village's responsibility for maintenance thereof. The Clerk stated that this letter could not be found in the file and was thought to have been removed sometime in 1967 when the files had been found opened. W. Scherer stated that the problem was that the Village had rebuilt 64th in 1966 so that it followed the section line and no longer came straight into his place. The letter had stated to what point the Village had originally main- tained the road. Mr. Scherer stated that the Village was now only maintaining about half of the road compared to prior rebuilding. There was considerable discussion, including the producing of the road easements acquired in 1965. Mr. Scherer stated that they had raised the road, but only half way and that he received the runoff; also, they don't go as far as his culvert. He wished the Village to either move the property line back or to maintain 64th like they had before. Mr. O'Flannagan stated that Mr. Backlin had supervised the rebuilding of 64th. He also stated that the top of the road was only 19 feet in width. Mr. Gotwald stated that this was acceptable when the Village replaces an existing road. Mr. Gotwald felt we should use the original 1 angle of the road, departing from the section line; we should not build a road for Mr. Burque. It was decided that Mr. Gotwald and Mr. Rosengren would discuss this IIIfurther with Mr. Locher and would report back. Mr. Jerome Boyd asked about resurfacing East Rondeau Lake Road, and was told that we would try to do the roads with the highest traffic count first. Mr. Rosengren noted that we were trying to do those out -of- the -way short pieces of road first; however, one can go all the way around Rondeau Lake. Mr. Scherer stated that he had talked to Mr. Myhre on the vandalism on some roads such as 64th -- many signs had been taken down along with mail boxes. It was noted that the same thing is going on in other municipalities. The Clerk asked for the Council's opinion on requiring that the proper fees accompany all liquor license applications., Mr. Locher read from Ordinance No. 31, Section 4, Sub. 1, that a receipt for the fee must be received in order for the application to be considered. Mr. Cardinal moved that the Clerk write to all applicants that the fee must be in with the applications by the second meeting in May. Seconded by Mr. Jaworski. Carried unanimously. On the advice of the Attorney, Mr. Jaworski moved that the Clerk also write to all appli- cants for beer licenses that the fee must accompany the application before consideration is given. Seconded by Mr. Cardinal. Carried unanimously. Mr. Ray Thorp, Scoutmaster of Boy Scout Troop #65, stated that his troop would like to put in 6 hours of policing duty on Hwy. 49 can Saturday, April 18, and requested that a Village truck be used for the cleanup. They planned to start at the Hall, go up Hwy. 49 to Main Street, back down Main to the Apple Inn and back to the Hall. If this did not take six hours they might police Lino Park and Sunrise Park. Mr. Rosengren suggested that they do some of the Village streets instead, since we must do them anyway. Mr. Thorp also asked for police protection. Mr. L'Allier stated that he would ask Mr. Myhre to have someone available. Mr. Locher stated that the Village would have to provide a driver for the truck. The Clerk was asked to check with the State Hwy. Patrol and to let the Mayor and Mr. Thorp know. Mr. Bohjanen moved to authorize the use of a driver from the Roads Dept. and someone from the Police Dept. to check on the Boy Scout cleanup. Seconded by Mr. Jaworski. Carried unanimously. Mr. Thorp stated they would meet at 8:45 a.m. Mr. Cardinal had no report, but mentioned the copy of the contractor's ordinance he had received. All Council members received copies and will study the matter. Mr. Jaworski stated that he had received another complaint on the property.at Elm and 49. The Mayor stated that the Clerk had written to Mr. Zelinka on this. Mr. Rosengren reported that while cutting up the trees on West Rondeau, the old chain saw quit and it had been necessary to purchase a new one, using the old one as a trade -in. Mr. Backlin and Mr. Gotwald had looked at the North County Line; ,80th. was in good shape. The County Line was good except for the last mile. Mr. L'Allier pointed out the problems on this stretch of road, stating that the grader did not always do that piece, in fact had only been over it once this year; the road needs upgrading and reworking. Mr. IIIGotwald stated that the grader had skinned down the hills and there were no ditches. There was enough grade so that they could use the existing dirt to fill in the low spots; blow sand was available from Ken Rehbein's borrow pit. Mr. Gotwald estimated the cost of doing the mile of the north county line north of 80th, using a blade and 2 trucks for 2 days and 1,400 cu. yds. of Class 5 gravel to cost from $2,500 to $2,800. Mr. Rosengren thought the Village equipment could handle it, noting that there were lots of big rocks in the road. Mr. Gotwald stated, generally the gravel roads are in good shape. Mr. Rosengren . stated that they could start anytime on 64th, 80th and Linde and Laurene. The drainage on Linda and Laurene is poor and a- turnapul is required to put the drainage the other way; they have made an agreement with the property owners to drain these streets to the lake. Mr. Boyd asked if the Village would gravel East Rondeau and if it would be okay for him to disc it with his equipment if they didn't. Mr. Rosengren thought that the gravelling job for Rondeau had never been finished. Mr. Gotwald stated that he had received a call from Mr. Backlin concerning the problem of persons reading the sign on Hwy. 65 stating that they can reach 35W from there. These people don't know enough to turn on Hwy. 8 and wind up in the service drive along 35W at Main Street. The Clerk was instructed to write the State asking for directional signs to 35W at the Hwy. 8, Main Street intersection. The signs might include mileage to the freeway in both directions. Mr. Jaworski discussed spray painters with Mr. Rosengren. Mr. Gotwald stated that orders for haul roads in connection with construction work on I35E had been received from the State Hwy. Dept. The roads affected in Lino Lakes are Peltier Drive, Rondeau Lake Drive and Main Street. Mr. Gotwald stated that the State would take care of the bonds and are totally responsible for the care of the roads Mr. Gotwald also presented a request from Northwestern Bell Telephone Co. to install buried cable in West Rondeau Lake Road 500 feet North of Main Street across the road. He recommended approval of the request. Mr. Gotwald also mentioned a letter from the Conservation Department concerning the 1969 Flood Plain Management Act. He read from the letter and mentioned that if we complied with the request to complete a report, that we can get Federal assistance in time of flooding. Mr. Bohjanen moved to authorize the request of Northwestern Bell Telephone to place buried cable in West Rondeau Lake Road as proposed. Seconded by Mr. Rosengren. Carried unanimously. Mr. Cardinal moved to authorize the Engineer to complete the report for the Flood Plains Management Act and to authorize the signature of same by a representative of the Council. Seconded by Mr. Jaworski. Carried unanimously. Mr. Gotwald stated that after receiving calls from residents on Reshanau Lake as well as a Minneapolis newspaper reporter concerning pumping water into that lake, that he had made an inspection last week. Jandric has been pumping water into the lake through an 8" line for several months; a nice pond has resulted which is inhabited by a flock of geese. Mr. Gotwald stated that all the former dry areas from dredging have filled up and that the water level is about 2' higher than it was at freeze —up time. He felt that the water from an 8" line would hardly replace the amount of water lost through evaporation. There had not been enough snow to raise the level by 2' (he noted that Rice Lake and George Watch Lakes were also low); apparently it is filling in naturally, e.g., through springs. Mr. Gotwald stated that a representative from the Division of Lands and Waters was optimistic about the level; by the next meeting he expected that the level might be up another 2'. 1 1 Mr, Rosengren noted that the County had let bids to blacktop Main Street from Hwy. 8 to Hwy. 65. Mr. Scherer asked when the County was going to get going on the signs? Mr. Bohjanen stated that the Community and Business Development Commission had met on April 1st; they haven't done anymore on the brochure. W. Bohjanen mentioned that the C&BDC had thought that the new municipal building would be nearly done by next. September; therefore they had set September 19 as a tentative date for the promotion day for the Village. He stated they would have another meeting the coming Thursday evening. The Information Guides were finished -- copies were passed around. Mr. Pete Scherer stated that last year he had suggested that the Information Guides be mailed out but this was turned down as costing too much; however, everyone would get one. W. L'Allier felt that the personal contact by the Civil Defense was good; Mr. Scherer commented that not everyone is contacted. It was noted that many persons simply pay no attention to the Guides. Mr. Gotwald commented that the plans on the new Hall were 3/4 complete; the Building Committee had submitted the plans to him and he will draw up the specifications. He felt that the cheapest way out was to have the low bidder furnish the complete construction plans. The Council will get the final drawings for a resolution to let the bids. Mr. Gotwald stated there would be no final specs, only recommended specifi- cations which can be modified. On questioning by Mr. Boyd, it was noted that persons on the Municipal Building Committee had experience; also Glenn Rehbein was at present doing the same type of thing on his own building. Mr. L'Allier moved to authorize the purchase of a new riot gun, Remington Model 87Q, III12 gauge, for the police department. Seconded by Mr. Cardinal. Carried unanimously. It was noted that the present gun malfunctions. Mr. L'Allier offered a motion to send to our present legislators and those running for the legislature a resolution urging them to propose legislation authorizing State Aid Road monies to municipalities under 5,000 popuJation since the present law discriminates against those municipalities having a population less than 5,000. He and the Clerk would work up the final details. Seconded by Mr. Jiworski. Carried unanimously. Mr. Rosengren thought that, if such legislation did not pass, that if Lino Lakes makes 5,000 population within a year or so that we should have our own census in 5 years. Mr. Gotwald stated that such State Aid was based on the number of road miles and other criteria- -that the rate was some $1500 per mile. Lino Lakes has some 3 to 3 1/2 miles of eligible roads and the allotment might amount to some $25,000 per year; it would be worth our while to hold another census if the population rose. Mr, L'Allier read the Police Report for March as follows: 2,566.9 miles driven, 255 business and home checks, 20 complaints, 10 escapees from the Youth Center, 10 hours spent on these, 7 assists to/by other departments, 4 accidents, 4 domestics, 3 aids given to motorists, 3 medicals, 3 cases of stolen property, 2 stolen autos, 1 recovered auto and 1 missing child (found). Mr. Al Ross noted that 5 more had escaped from the Youth Center this evening. Mr. L'Allier noted that the committee was working up a meeting with the new director of the Center. M. L'Allier asked W. Gotwald if he had talked with the St. Paul Water Dept. concerning III fixing the road around Peltier Lake. Mr. Gotwald stated that the department hasn't forgotten about it but lacks the proper material for the job. The County has done some of this around Centerville - -he will tell the representative of the Water Dept. about the County stockpile of material in Fridley. 11 The proposed amendment to Ordinance No. 32 concerning junk cars was read and discussed (this had been mailed to all earlier). Mr. Bohjanen felt that a serviceman should. be allowed to place a car on blocks until his return. After considerable dis- cussion, Mr. Locher commenced composing another section on exceptions to the ordinance. Mr. Rosengren commented on the inventory stating that some items were priced wrong; he felt that this should be placed on the agenda for next time and all should have corrections ready then. The police and the civil defense should be asked to check their inventories also. Mr. Al Ross asked Mr. Locher if there were any way of checking with NSP on rate differentials between the core cities and our area. He felt that if such a differ- ential existed that we should institute action to fight high rates like St. Paul does. Mr. Locher replied that he could check. Mr. Locher read the new section to the proposed Ordinance 32 amendment as follows: Upon prior application to the Village Council, and the Council being convinced that a valid reason therefor exists, a special permit may be issued by the Village Clerk — Treasurer for the storage of a vehicle or vehicles with the Village, which vehicle or vehicles may not have current Minnesota registration thereon. Such special permit must be reviewed annually, state the reason therefor, be non — transferable, and the applicant shall pay an annual fee to the Village therefor of $5.00 per vehicle. Mr. Bohjanen moved to adopt Ordinance 32A amending Ordinance 32 as proposed. Seconded by Mr. Jaworski. Carried unanimously. Mr. Jaworski stated that he had attended a meeting with the Mayor of Coon Rapids and representatives of all municipalities served by North Central Public Service Co. as well as the County to discuss rates. The company has stated that they would raise Heir rates since they are not making money. Coon Rapids had asked for an audit of the company which showed that they are making a 15% profit rather than the 5.8 %' profit they had claimed. The representatives had felt that it was not feasible for one community to fight the increase, but they would try to form an association like had been done to govern Minnegasco's rates, and which is paid by Minnegasco to keep from having court fights. Mr. Jaworski stated that they would meet again on April 22 on this. Mr. L'Allier mentioned that Bob Voss, Mayor of Coon Rapids, at the last meeting of the Anoka County Association, had proposed a regional regulation district for this purpose. Mr. Scherer asked Mr. Bohjanen when the brochure would be done since he felt that it had already cost us $2,000, e.g., Mr. Bohjanen's salary for the past 40 months. Mr. Bohjanen replied that the Planner had advised waiting until the airport decision is made. Mr. Cardinal moved to pay the bills as audited. Seconded by Mr. Rosengren. Carried unanimously. All other members were present. Mr. Cardinal moved to accept the minutes of the regular April 13th meeting as submitted. Seconded by Mr. Rosengren. Carried unanimously. The Clerk reported that $1,250.70 had been received from the County for personal property taxes. A copy of a letter from Commissioner Burman to Chief Deputy Auditor Gordon Harvey concerning the consideration of selling motor vehicle licenses some- Where in the Lino Lakes /Centerville area was read. There was discussion of the possible phasing out of such offices. Mr. Bohjanen moved that a letter be written
