It was decided that a special meeting would be called in Jape to look over samples
of panelling, etc. from the bidders before the contract is awarded.
Mr. Cardinal moved to authorize the Engineer, in conjunction with the Clerk, to
open the bids after the 21 days of published notice, in order that he might report
on them at the June 22nd meeting. Seconded by Mr. Rosengren. Carried unanimously.
Mr. Jaworski moved to adjourn at 9:47 p.m. Seconded by Mr. Rosengren. Carried

Clerk - Treasurer
The regular meeting of the Lino Lakes Village Council held on May 25, 1970, was
called to order at 8:04 p.m. by Mayor LtAllier with all members present.
Mr. Bohjanen moved to accept the minutes of the May llth meeting as so corrected.
Seconded by Mr. Rosengren. Carried unanimously.
The Clerk presented the following license applications:

Mr. Cardinal moved to authorize the granting of these licenses as set forth by the
Clerk with the exception of those applications from Stanley Thayer, with the
stipulation that Mrs. Ruth Cegla must submit a duplicate bond for her off -sale
liquor application as well as a certification of liquor liability insurance; also
with the stipulation that any discrepancies noted by the Attorney on any of these
applications be corrected. Seconded by Mr. Bohjanen. Motion carried unanimously
with Mr. Rosengren abstaining since his application was included.
Mr. Jaworski moved to hold action on the applications by Mr. Stanley Thayer pending
a police investigation with a police report to be made to the Clerk and the Council;
if this report is favorable, the licenses can be authorized at the next meeting.
Seconded by Mr. Cardinal. Carried unanimously.

The Clerk presented the following names for election judges to serve at the
Hospital Bond election to be held on June 30th: DFL -- Agnes LaMotte, Joyce
Dufresne, Kay Olson, Agnes LeTendre and Signe Miller; GOP -- Imogene Secretan,
Madlyn Crandall, Jean Krube, Phyllis Blaylock, Dee Winter and Lynn Hansen. The
Clerk noted, however, that Imogene Secretan would be inelligible since she is a
paid employee of the Village; thereupon her name was striken.
Mr. Bohjanen moved to select as election judges for the June 30th Hospital Bond
election the top 4 names from each list with the remaining names to serve as
alternates. Seconded by Mr. L'Allier. Carried unanimously.
Mr. Cardinal moved to grant a 3.2 beer license to the Civil Defense for their
auction to be held at Sunrise Park on June 14, starting at 12 o'clock noon until
all items are sold. Seconded by Mr. Rosengren. Carried unanimously.
The Clerk read the notice of the Annual Meeting of the Anoka County Association of
Municipalities to be held at Spring Lake Park on May 27th with election of 1970 -71
officers to be held. Reports from several committees will be heard.
A letter written by Mrs. David Fritz, Secretary of the Lino Lakes Parents Club,
was read concerning their desire to have speed limit and school warning signs
posted on Main Street in the school area. Mr. L'Allier voiced his concern of the
Council which has been trying for two years to have such signs put in that area.
He read the dates that the matter had been brought up at Council meetings as well
as the dates of letters written to Anoka County officials on the subject. Mayor
L'Allier pointed out that Lino Lakes has no control over signing the road since it
is County State Aid Highway, and recommendations must be made from the County to
the State to have a speed limit set.
Mayor L'Allier also pointed out that Officer Myhre had been to Anoka today to talk
with the County Engineer and Commissioner Burman; that he had done much searching
of the records to see if there were some mandatory laws concerning speed limits in
a school zone, etc. Mr. Myhre stated that Commissioner Burman would be at our
next Council meeting to report. Mr. L'Allier noted that Mr. Myhre had done much
work on his own concerning the matter previous to the tragedy; he wished that they
had heeded us prior to this time.
Mr. Bohjanen felt that the requested marking should be done immediately, but mentioned
that signs are hard to come by as the State is slow in this. He mentioned that we
have really tried to get this area speed zoned as well as other areas in the
Village, but still have no indication when it will be done.
There was some discussion from the audience (many concerned residents of the
affected area were in attendance). Mr. L'Allier stated that State Statute 169
requires a 30 m.p.h. zone in an urban area and defines an urban area as any 1/4
miles filled with homes less than or 100 feet apart. It was noted that this area
had not been checked for that requirement.
Mayor L'Allier read from the letters written to the County as well as answers
promising work and stating the County's policies on priorities. After discussion,
Mr. Bohjanen moved that letters be written to Senator Greig, Representative
Plaisance, County Administrator Steffen, County Engineer Lundheim, County Attorney
Johnson, Commissioner Burman, and the State Highway Department as well as the
State Attorney General's office referring to the hazardous conditions which still
exist in the Lino Lakes Elementary School area on Main Street, listing the dates
of correspondence with the County on the matter of speed zoning, asking them to

attend the next Council meeting on June 8th for discussion of the speed zoning as
well as painting double yellow stripes in the area and placing blinking yellow
lights and /or a red push- button light in order to prevent another fatality in
the area. Seconded by Mr. Cardinal, Motion carried unanimously.
Someone in the audience suggested a demonstration and march on the County Court-
house. This idea was dismissed with Mr. Bohjanen suggesting that the parents
attend the Board of County Commissioners meeting the following morning at 9:00 a.m.
Follow -up letters could be sent. The audience felt that our local police should
keep a closer watch on the area between 3:30 and 8:00 p.m. Mr. Locher was asked
to word a petition to be signed and sent to Mr. Burman before the next meeting.
The hearing for rezoning to commercial requested by Mr. Keith Apitz was called to
order at 8:41 p.m. Mr. Locher read the notices and declared all to be in order.
Mr. Cardinal stated that the request for a variance had been discussed at the
Planning & Zoning meeting and was recommended by that body. Mr. Cardinal stated
that Mr. Apitz was no longer asking for permission to install gas pumps, but that
if he desired to do so at a later date, he would ask for a special use permit.
Mr. Cardinal moved to grant a variance to Mr. Keith Apitz for a second 251 strip
of land described as follows:
That part of the Northeast Quarter of the Southeast Quarter, Section 30,
Township 31, Range 22, Anoka County, Minnesota, described as follows:
Beginning at the intersection of the South line of said tract and the
centerline of State Highway No. 49 as now established; thence East along
said South line and the centerline of a public road for 458 feet to the
actual point of beginning of the tract of land to be hereby described;
thence continuing East along said line for a distance of 25 feet; thence
North at right angles for a distance of 170 feet; thence West parallel
with the first course for 25 feet; thence South 170 feet to the point of
beginning.
Seconded by Mr. Bohjanen. Carried unanimously.
Mr. Cardinal moved to rezone to commercial, for Keith and Jane Apitz, the property
described in Ordinance 6T, for general vehicle and small engine repair as well as
the sale and repair of snowmobiles under the limited commercial section of
Ordinance 6. Seconded by Mr. Jaworski. Carried unanimously. The hearing closed
at 8:51 p.m. There were no comments pro or con from the audience.
The hearing set for Chomonix East was called to order at 8:52 p.m. The Clerk read
another letter from Don Waalen asking for a continuance of the hearing until
June 8th. Mr. Bohjanen moved to continue the hearing for Chomonix East until
June 8th, 1970 at 8:30 p.m. Seconded by Mr. Jaworski. Carried unanimously.
Hearing closed at 8:55 p.m.
Mr. Jaworski had no report. Mr. Cardinal stated that Mr. Omer Cardinal was again
requesting a 90 day permit to park his trailer on his own land for the summer. The
Planning & Zoning Board had recommended granting the permit.
Mr. Cardinal moved to grant a variance to Ordinance No. 39A to Mr. Omer Cardinal
to place a trailer home for a period of 90 days, from June 1 to September 1, 1970
on his lot described as follows:
Commincing at the northeast corner of Government Lot #3, Section 14, Town-
ship 31, Range 22 in the center of a public highway, thence vest on the
north line of said Government Lot #3 a distance of 269.2 feet to a point;
thence north 23° 29' East a distance of 69 feet to a point hick is the
point of beginning of the tract of land here to be described; thence
North 74° 52' west a distance of 367.5 feet to the easterly line of the
tract of land heretofore conveyed to the City of St. Paul; thence North
23° 29' East along the Easterly line of said tract of land heretofore
conveyed to the City of St. Paul, a distance of 173.35 feet to a point;
thence South 58° 30' East a distance of 366.7 feet to a point on a line
projected from the point of beginning of this description; thence South
23 29' Test a distance of 69 feet to the point of beginning, containing
in all one acre of land, more or less; being a part of what is now known
as Lot Three (3) Auditor's Subdivision Number 47, revised, according to the
duly recorded plat thereof on file and of record in the office of the
Register of Deeds in and for Anoka County, Minnesota.
The motion was seconded by Mr. Rosengren. The vote was unanimously in favor.
Mr. Bohjanen pointed out that granting this permit might cause a rash of such
requests in the future.
Mr. Cardinal mentioned that the P&Z had recommended approving sign request #26 by
Naegele Outdoor Advertizing to place a sign in the Northeast quadrant of the
intersection of Hwy. 49 and I -35W. Mr. Locher pointed out the location on the
sign map. Mr. Cardinal moved to accept sign application No. 26 for Naegele
Outdoor Advertizing as requested. Seconded by Mr. Bohjanen. Carried unanimously.
There was discussion on the location of the two information signs donated by
Meyer Sign Service. Mr. Rosengren suggested that the one sign in place on the
Faymoville property near the exit sign on I -35W be moved to 4th Avenue which is
now a dead end and is public property. Mr. Locher stated that it was his opinion
that the Village could pay for the lease for the sign on its present location.
Mr. L'Allier moved to have the first information sign moved from its Present,
location to Fourth Avenue. Seconded by Mr. Rosengren. Carried unanimously.
Mr. Rosengren stated that the suggested location for the second sign as on an
old heyroad which had been dedicated and maintained for many years, but which had
been cut off by the free ay. After discussion, Mr. Bohjanen moved to inform
Meyer Sign Service that the second information sign should be located on the
public property in Section 10 as soon as the exact legal description is obtained.
Seconded by Mr. Rosengren. Carried unanimously.
The hearing set on the preliminary plat of LaMotte's Third Addition was called to
order at 9:07 p.m. Mr. Locher read the notices and the legal description of the
plat, noting that the affidavit of publication had not yet been received; however,
all was in order.
Mr. Cardinal stated that Mr. Segal of the St. Paul Waterworks Dept. had attended
the hearing at the Planning & Zoning meeting and had stated that there was a
discrepancy in boundaries between their property and that of the LaMotte plat.
Mr. Cardinal didn't feel that it was up to the Council to resolve the dispute,
but that this was a matter to be taken up by the respective surveyors. Mr.
LaMotte stated that he felt there was no problem as the boundaries were stated
on his deed. Mr. Cardinal felt that the Council should accept the preliminary
plat subject to the resolving of the differences between the Water Dept. and
Mr. LaMotte before final approval of the plat.

Mr. L'Allier felt that the Village Engineer and the County Surveyor would check
out these matters before the hard copies were signed anyway. Mr. LaMotte stated III
that he had already taken the plat to the County Surveyor for clarification.
Mr. Dick Hiniker, Attorney for Mr. LaMotte, came forward to state that the land
was originally homesteaded by Mr. LaMotte's grandfather in 1954; that in 1896
Mr. LaMotte's father had deeded some property to the City of St. Paul, this being
turned over to the Water Department. On his examination he has found that the
plat lines follow the legal description exactly. He felt that the dispute was
over a fenceline rather than the property line, and that this was a matter which
should be settled in District Court. He requested that the Council give pre-
liminary approval to the plat; he would confer with Counsel for the Water Dept.
Mr. Cardinal moved that the preliminary plat of LaMotte's Third Addition be
accepted after approval by the Village Engineer and the County Surveyor. Seconded
by Mr. Jaworski.
Mr. Meuwissen of the St. Paul Water Dept. presented a letter written by Mr. Segal
asking for postponement of any action on the LaMotte plat. Mr. L'Allier noted
that we did research at one time which indicated that it was not necessary to
have 2 hearings on a plat, but if a hearing is held on the preliminary plat
rather than the final, then the Council can approve the plat subject to approval
by the Village Engineer, etc. The hard copies are not signed until the Council
gives approval and authorization later.
The vote on the motion to approve the preliminary plat of LaMotte's Third Addition
was taken and was unanimously in favor of the motion.
Mr. LaMotte mentioned needing a road bond and was told that he couldn't start the III
road until we received an opinion from the Engineer and the Surveyor.
Mr. LaMotte asked if there would be a problem if the road to be built in the
First Addition could not be finished by July 1st due to the trucker's strike;
could he get an extension of time? Mr. Locher stated that this was okay under
such circumstances and no formal authorization would be needed.
Mr. Cardinal stated that Mr. Lee Smith had presented a petition for rezoning some
87 acres to the Planning & Zoning and asked that hearings on this be set. Mr.
Cardinal moved to set hearings for Mr. Smith before the Planning & Zoning Board
on June 17th at 8:30 p.m. and before the Council on June 22nd at 8:30 p.m.,
subject to Mr. Smith's submitting the proper legal descriptions. Seconded by
Mr. Rosengren. Carried unanimously. Mr. Cardinal noted that Mr. Smith had also
requested a variance from our liquor ordinance to shorten the distance between
an off -sale liquor store entrance and a church entrance to 500 feet. This matter
will be taken up at the hearings.
Mr. Cardinal reported that Mr. Karth and Mr. Husnik had reviewed the new Minnesota
Plumbing Code, which includes the use of plastic pipe, and had recommended its
adoption, as had the Planning & Zoning as a whole. Mr. Cardinal moved that Lino
Lakes adopt the new Minnesota Plumbing Code of June 1969 by reference.
It was noted that the new code is more restrictive than our existing ordinances;
also, the new code covers both plumbing and septic system work. Mr. Locher
didn't recommend the repealing of Ordinances No. 47 and 48 since some items
such as stub -ins are not included in the new code.

The vote was taken on adopting the new Minnesota Plumbing Code, with the inclusion
of the notice that we would enforce whichever ordinance is stricter on specific
items; it carried unanimously.
Mr. Bohjanen had brought up the subject of Mr. Clyde Rehbein's encroachment of a
septic system line on Mrs. Hilda Wollan's property during the above discussion.
Mr. Cardinal stated that Mr. Rehbein had promised at the P&Z meeting that the
line would be moved. Mr. Bohjanen stated that he had been told by the Wollans
that Mr. Rehbein had told them he wouldn't move it. Mr. Locher noted that if it
is a tresspass, he could be forced to move it; apparently the Wollans don't wish
to spend time and money on a court fight if Village regulations have been violated.
It was noted that the Building Inspector had red - tagged the septic system line;
the Clerk stated that Mr. Rehbein had not taken out permits to install the line
and that the contractor who did the work had no license to do so; also, they had
been warned by the Plumbing Inspector to get such permits and license. Mr. Locher
stated that this was a direct violation of Ordinance No. 47.
Mr. Bohjanen moved that a letter be written tc Clyde Rehbein and Clarence and
Hilda Wollan with a copy to the Building Inspector stating that Mr. Rehbein was
in violation of Ordinance Nc. 47 on septic system installation and that the
Building Inspector is hereby authorized to instruct Mr. Rehbein to remove the
septic system line within 1 week. Seconded by Mr. Jaworski. Carried unanimously.
Mr. Jaworski moved that a letter be written to the contractor, telling him that
since he had taken no notice of our ordinances and violated same, if he should do
so again he would not be allowed to do any more work in the Village. Seconded by
Mr. L'Allier. Carried unanimously.
Mr. Cardinal stated that a request for a variance by Mr. Clyde Rehbein and Mr.
Russell Bakken to exchange pieces of property in order to straighten out their
property lines had been recommended for approval by the Planning & Zoning. Mr.
Locher noted that the legal descriptions were in order and this was okay .if both
parties were willing. Mr. Cardinal moved to grant a variance to Clyde Rehbein
and Russell Bakken to exchange the following described pieces of property:

Mr. Jaworski inquired about what was happening as far as bids on a new truck.
Mr. Rosengren stated that they had held off in favor of getting the building
specs ready; Merit Chevrolet has one in stock similar to what we want - -he had
seen one. There' is now a 90 -120 day waiting period for the trucks. He will have
the specs worked up for presentation at the next meeting. He had had no chance
to look at the broom for the park tractor.
Mr. Locher stated that Mr. Gotwald had called him today on the building specs
bids; the specs are ready. It is only necessary to publish the ad once in the
legal newspaper at least 10 days before the bids are to be opened on June 22nd.
This will also be published in the commercial engineering paper.
Mr. Bohjanen reported that the GOP club has a flag, which was flown over the White
House, to present to the Council to fly in Sunrise Park on June 8th. Also, the
VFW will purchase a new flag to be flown at the Village Hall. Mr. Rosengren noted
that we will need a new flagpole for the new building- -also, the small pond
on the property is full of timbers and sticks.
Mr. Bohjsnen suggested that the Planning & Zoning study the matter of setting a
distance between homes built on commercial property of 10 feet the same as in
residential areas. W. Locher checked the ordinance and found no mention of this
for homes in commercial areas. W. Bohjanen wondered whether one of Clyde
Rehbein's duplexes was 10 feet from a neighboring lot at one point. After dis-
cussion, Mr. Bohjanen moved that a letter be sent to the Building Inspector with
carbon copies to all Council members, stating that he should check to see that
all houses built in oaaaeroial areas are at least 10 feet from the property lines.
Seconded by lk. Rosengren. Carried.
Mr. L'Allier read the police report for April as follows: 2,793.2 miles driven,
230 business and home checks, 27 complaints, 19 escapees from Lino Youth Center,
6 escapees returned to the center by our dept., 14 hours spent on escapees plus
1 1/2 hrs. spent unrelated to escapees, 14 assists to/by other depts., 6 junk
warnings given, 4 grass fires, 2 petty thefts (1 solved), 3 aids given to
motorists, 2 domestics, 2 stolen snowmobiles, 2 accidents, 2 medioals, 1 dog
bite, 1 runaway juvenile, 1 burglary (solved with 2 arrests), 1 auto theft.
lam. L'Allier noted that after the repent rash of escapees frost the Youth Center,
that the police had met with the administrator and security men at the Center,
that they had toured the oanplex and discussed the problem of late notification
of escapees. The officials stated that they hadn't wanted to bother us =leas
they were unable to catch the escapees themselves. We got the point across that
we wished immediate notification when an escape was discovered.

A letter from Representative Vernon Pleiaance was read which endorsed our
request for legislation on State Aid monies for roads for municipalities under
5,000 population. Copies will be made for the Council.
On Mr. Locher's suggestion, Mr. Jaworeki moved to authorize the Engineer and the
Clerk to open the bids on the municipal building on June 22, 1970, at 1:30 p.m.
for tabulation and presentation to the Council that evening. Seconded by Mr.
Rosengren. Carried unanimously.
Mr. L'Allier asked Mr. Rosengren to check out a report that a dam is being built
on Rice Creek near the bridge on Hodgson Road.
Mr. Rosengren reported that he had checked the water level in Rice Creek earlier
and found that Rioe Lake is higher than usual because the water is flowing back-
wards into Reshanau Lake; usually. Rioe Lake is about 1 foot lower than Reshanau.
Mr. Bohjanen asked Mr. Locher if a check could be made into the costa of the
present Municipal Court system as opposed to the former system. Reports are
circulating that the officers won't make arrests because it goats too much to
go to court. Mr. L'Allier agreed that the officers have to take time off from work
to attend the day -time sessions. Mr. Locher explained the procedure when the
aocuaid pleads 'not guilty', noting that the Village -gets 50% of the fine on a
Village ordinance conviction after oosts are deducted, but that we get practi-
cally nothing when the violation is tagged by the Highway Patrol, Sheriff's
Office or Water Patrol, even though we are obligated. to prosecute the case. He
felt it would bear some discussion with our legislators. Mr. Bohjanen stated
that he had mentioned the matter to our representative once; he seemed willing
to proceed with legislation, feeling it was only fair. that since the State and the
County get the money, they should pay to prosecute..
After discussion, Mr. Bohjanen moved that letters be written to our Representative
and Senator asking them to study the matter and consider drafting legislation
which would return the cost of such prosecution to the municipalities.
Seconded by Mr. L'Allier. Carried unanimously. The matter will be discussed at
the next meeting. -
Upon a request by W. Myhre, Mr. L'Allier moved to authorize permission for our
police force to join with the Lexington and Circle Pines police forces to sponsor
a July 4th celebration. Seconded by W. Rosengren. Carried unanimously.
Mr. Locher stated that they would be covered under our insurance.
Rosengren moved to pay the bills as audited. Seconded by Mr. Bohjanen. -
Carried unanimously.
Mr. Rosengren moved to adjourn at 10:26 p.m. Seconded by Mr. Bohjanen. All voted.

The regular meeting of the Lino Lakes Village Council held on June 8, 1970,
was called to order at 8:08 p.m. by Mayor L'Allier with all members present.
Mr. Jaworaki moved to accept the minutes of the May 25th meeting as written.

The Clerk reported that a certificate of insurance from Berghorst Plumbing
had been received. It was given to the Attorney for approval. The Lexington
Fire Report for the first quarter of 1970 was read.
A letter from Mrs. Phyllis Blaylock as well as one from *e. Deidre Winter
were read concerning Mrs. Winter's being an employee of the hospital and not
being able to serve as an election judge for the Hospital Bond election on
June 30th. The substitute name of Miss Dorothea Schmidt was suggested. Mr.
