This includes communities, who do not have sewers but have capacity in existing lines. Mr. L'Allier's recommendation was that we ask for a deferment as the Village is undeveloped at this time. Mr. Cardinal moved to pay the bills as audited. Seconded. by Mr. Rosengren. Motion was made to adjourn at 10:56 p.m. by Mr. Jaworski. Seconded by Mr. Cardinal. Aye. Mr. Jaworski moved to accept the minutes of the August 10th meeting as corrected. Seconded by Mr. Cardinal. Carried unanimously. Affidavits of publication for Ord. No. 53 and the ad on weed cutting had been received. The Clerk reported that a copy of the summons in the case of St. Paul Water Dept. versus Cecil LaMotte, et al, had been delivered to her home by a Deputy Sheriff the previous Saturday. She had been told that it was not a notice to appear in court, but only a copy for our files; also, a signature was not required. After dis- cussion, Mr. Cardinal moved to authorize the Attorney to check with the Sheriff's office on the matter and to put in an answer in behalf of the Village. Seconded by Mr. Rosengren. Carried unanimously. A request by Northwestern Bell Telephone Co. to place buried cable in Hansen's road had been reviewed and recommended by the Engineer. It was noted that the cable is at present lying on the side of the road. Mr. Jaworski moved to approve the request. Seconded by Mr. Cardinal. Carried unanimously. Housing figures for 1969 for Lino Lakes were read from the latest DATA -log put gut by the Metro Council. Mr. Dupre stated that he sends in figures from building permits monthly to the Census Bureau. The Clerk was asked to make copies of the 1969 figure for the Council and Planning and, Zoning. A letter from Commissioner Burman was read concerning the University- sponsored Civil Defense meeting to be held in Anoka on Sept. 8th at 7 p.m. Mr. L'Allier_ noted that Mr. Cape and Mr. Jaworski would be attending, and urged any other interested officials to attend. .An application for installation of individual sewage disposal systems by Morris B. Carlson Trenching was given to the Attorney to look over. A letter from Mr. Robert Hutchison (who was on the agenda for 8 :30) was noted. A letter announcing the fall regional meetings of the League of Minn. Municipalities was passed around. The Clerk stated that Mr. Gotwald had just finished the report for the,Conservetion Dept. on flood plans. Mr. L'Allier read data from this report. Mr. Cardinal moved to adopt a resolution to send the required "Letter of Intent" containing the report to the Conservation Dept. Seconded, by Mr. Rosengren. Carried unanimously. Copies will be made for the Council and Mr. McLean. After discussion, Mr. Cardinal moved to set the dates, of Sept. 22 and 24 for budget meetings. Seconded by Mr. Rosengren. Carried unanimously. These will be noted on the calendar for 8 p.m. W. Locher stated that the bond and insurance for Morrie B. Carlson were in order, it noted that a new application form should be made up since Ord. 53 has been adopted. Mr. Cardinal moved to grant a license for individual sewage disposal work to Morris B. Carlson Trenching. Seconded by Mr. Rosengren. Carried unanimously. W. Robert Hutchison was asked to step forward for his comments. He stated that the 1969 Legislature had authorized the County to set up public health services and that he had been hired in July to start these services along with another man whg would act as a trouble - shooter. Mr. Hutchison stated that they are working full time; also'they-do not deal with municipal sewer and water, roads or apprehension and violation of ordinances. However, their duties concern food, sanitation, sewer failures (also in trailer parks), animal control, etc. He will work with the PCA as far as solid waste problems go. He noted that the County did not yet have any comprehensive ordinances dealing with any of these problems except No. 1 on sanitary landfills, but that he hoped these would eventually be forthcoming. Mr. Hutchison gave his thoughts on what Lino Lakes' need for his services might be: 1. Food, 2. Private water and sewer systems and 3. Surface water quality due to discharge of effluent, especially from trailer parks. There was some general discussion on how his office is to be run and how complaints are to be handled, as well as the Johnson Landfill. Mr. Hutchison stated that he would like a complete copy of our ordinances. Mr. Locher noted that the County Administrator's office was presently making copies of his ordinance book and W. Hutchison could likely get another copy made for himself. Mr. L'Allier inquired whether Mr. Hutchison's office would undertake the responsibility of the local health inspector and was told that they were trying to see if this service was desired. Mr. Hutchison noted that there could be some small fees for such things as sampling since this could become an awful burden for his office. 1 a� W. L'Allier stated that he felt that this was an excellent idea, that there is a drastic need in the County for such services and that W. Hutchison's work would be welcomed by all the municipalities. Mr. L'Allier moved that Lino Lakes correspond with a letter to the Board of,County Commissioners giving our eom- piete support for such functions, encouraging the County to adopt a Health Code and welcoming the undertaking of the municipal health inspector's duties by the County sanitarian. Seconded by Mr. Jaworski. Carried unanimously. Carbon copies will be sent to the building inspector, the health inspector, and W. Hutchison. The Clerk will send the other items requested by W. Hutchison. W. Locher discussed the,new PCA regulations on no burning with Mr. Hutchison, who suggested that the date of the standards be changed from July, '72 to January 1, '71. Mr. Locher noted that for now the municipality must enforce the PCA regulations. He felt that there should be uniformity throughout the county on these regulations as this would make W. Hutchison's job easier. Mr. Hutchison stated that he needed a county ordinance in order to enforce the laws. W. Locher read from the letter accompanying the Pollution Control Agency's APC 8 regulations, and suggested that we ask for the extension of time to adopt a no -burn ordinance as allowed in the letter. W. Cardinal moved to correspond to W. Badalich of the PCA with copies to Mr. Shaw and W. Lindell (both noted in the PCA letter) as well as to the County Board and Mr..Hutchison, indicating that we are in the process of working with the County to come up with a uniform no burn ordinance throughout the County and that we feel we should be given an extension of time to March 1, 1971 to comply with adopting such an ordinance. Seconded by Mr. Jaworski. Carried unanimously. Copies of the letter will be sent to the Council, Planning and Zoning, W. Dupre, and Dr. Midboe. W. Hutchison suggested setting up a meeting on this. W. Cardinal moved to authorize the ASC of Anoka to hold their election of officials at the Village Hall on Sept. 11 at 8 p.m. Seconded by W. Jaworski. Carried , unanimously. W. Cardinal mentioned that the Planning and Zoning had not met on August 19th as there was not a quorum., Since W. Don Wahlberg had requested a variance for a 1 -acre parcel on Lilac Street, W. Cardinal asked that a special Planning and Zoning meeting be set so that W. Wahlberg wouldn't have to wait 7 weeks for his variance; he suggested Sept. 1 at 8 p.m. or at least before Sept. 14th. The Clerk will contact W. McLean and poll the members as to a good date. W. Locher told Mr. Wahlberg that the legal description he had was sufficient and that he would not need a survey for the variance. Jaworski mentioned that W. George Martin, Chairman of the Lexington Park Board had requested a 3.2 beer license for a ball tournament to be held over the Labor Day weekend at both Village parks as well as St. Joseph's park. W. Jaworski moved to grant the 3.2 beer license as.requested with the stipulation that a certificate of insurance is received. Seconded by Mr. Cardinal. Carried unanimously. W. Jaworski stated that he,had received a complaint on thistles on Tilsen land at the southeast corner of Lilac and 4th, and that there had been no response to a phone call regarding same. Mr. Jaworski therefore moved that a letter be sent to Tilsen stating,that the weeds must be cut as soon as possible, and also sprayed in the spring, or else the Village will do the work and assess the charges and the cost of assessing to the land to be paid with the taxes. Seconded by Mr. L'Allier. Carried unanimously. 184 Mr. Jaworski mentioned that another problem was dumping of tires, furniture and other things on property north of Lilac and east of Sunset. The Attorney determined that this would be parcel 6000 of the SW 1/4 of the SW 1/4 of Section 7. Mr. Jaworski moved to contact the owner of.the parcel by letter to make them aware of the problem. Seconded by Mr. LtAllier. Carried unanimously. The Attorney suggested calling the County Treasurer for the owner and his address. Mr. Jaworski moved that another letter be sent to Dick Zelinka concerning his property at the corner of Eim and 49, including a copy of a previous letter on the subject, telling him that if the weeds are not cut, the basement filled in and the place cleaned up that the Village will do the work and assess the costs to the property. Seconded by Mr. Cardinal. Carried unanimously. It was mentioned that this sort of complaint should be taken to the police and the road supervisor rather than the Council. Mr.,Rosengren stated that Baldwin Lake Road was finished. There had been a problem with North Central's gas installation work, but a phone call by the Attorney had gotten quick action. The same was the case with dust control needed on 80th with quick action obtained from the State. Mr. L'Allier noted that State trucks had been hauling water on 24th Ave. from Main Street and that they should water and grade. the road. The grader had gone over, it on Sunday but it was bad again. Mr. Locher was asked to contact the State on this and ask them to fix it up since it was not designated as a haul road.. was noted that Main Street would be closed for three -weeks over the freeway; Mr. Locher was asked to see what the detour would be, in case it would involve 24th. Mr. Rosengren stated that the north one mile of 4th Avenue was blacktopped and the south mile was primed. If there was sufficient money they would do some temporary work on Oak Lane to help with the dust problem. Mr. Jaworski asked if they could run the packer on 4th, but was told it was too soft and must wait for cooler weather. Mr. Rosengren mentioned that Mr. Backlin had been keeping an eye on the construction of the new building; the cement should be finished by the end of the week. Mr. Rosengren stated that Mr. Lundgren wanted $7.50 per hour this year for cutting the weeds along the roads; this would come to about $525 total., Mr. Jaworski moved to hire Bob Lundgren at $7.50 per hour using his. own rig to out the weeds. Seconded by Mr. Rosengren. Carried unanimously. Mr. Rosengren stated that he had looked at a broom for sale in Hastings. The price was $285, but he had been unable to talk with the owner; he will check back on this as well as on other equipment which is for sale. Mr. Rosengren reported that trucks had been hauling. today on Rolling Hills Drive which is posted at 3 ton limit. This contractor is hauling dirt, to make roadways into the Otter Lake Hills plat; however, a borrow pit permit is necessary, and it is probable that some Villageproperty is being moved. Mr. Locher suggested that the Engineer check the work to see if,the right. of ways are being followed. Mr. L'Allier read the police report as follows: 2,548.3 miles driven, 219 business and home checks, 35 complaints, 18 assists to/by other departments, 13 legal papers served, 11 junk warnings (resulted 8 junk cars removed),,6 accidents (car and airplanes), 6 cases of vandalism, 5 stolen items - total worth $720.00, 2 stolen items recovered - total worth $60.00, 4 escapees - time involved 1 hr. 45 min., 5 domestics, 2 medicals, 2 downed,power lines attended, 1 house fire, and 1 dog bite. 1 1 1 Mr. L'Allier stated that the billing for the sewer assessment from the Metropolitan Sewer Board would be received in 2 weeks. Mr. Jaworski moved to authorize the Engineer to meet with the Metro Sewer Board to determine the amount of the assessment and how it had been arrived at, and to make a determination of whether it was fair and adequate; this to be reported at the next meeting. Seconded by Mr..Cerdinal. Carried unanimously. Mr. L'Allier presented a resolution recommending reducing the size of the State Legislature, paying its members a reasonable wage, placing the Governor and the Lt. Governor on a single ballot and urging reapportionment at the earliest possible date. Mr. L'Allier moved to adopt this resolution. Seconded by Mr. Jaworski. Carried unanimously. Mr. Karth reported that there was a trailer house on the old Harry Proulx property on Peltier Lake which was being lived in without a permit. Mr. Cardinal moved to have the Attorney contact these people telling them that they are in violation of our ordinance. Seconded by Mr. Rosengren. Carried unanimously. Mr. Myhre will get the names of the trailer owners for Mr. Locher. Mr. Cardinal moved to pay the bills as audited. Seconded by Mr. Jaworski. Carried unanimously. A special meeting on policing was held on September 14, 1970 at the Lino Lakes Village Hall. A large audience was in attendance including members of the part time police forces of Lexington, Circle Fines, Centerville and Lino Lakes, County officials including the County Administrator and Commissioner Kordiak. Persons seated at the table included Mayor Benjy Munson of Lexington, Mayor Lende Anderson of Circle Pines, Sheriff Talbot, County Attorney Bob Johnson, Bill Mavity from the Metro Council Criminal Justice Dept., Robert Drowns, author of the combined proposal, as well as members of the Lino Lakes Council. 1 Mayor L'Allier called the meeting to order at 7:40 p.m., noting the purpose of the meeting to discuss the alternatives for future policing of this area. Mr. Mavity, who had to leave early for another committment, was asked for his thoughts. He stated that he was not here to support one position over another on the law enforce- ment program to be adopted. W. Mavity had reviewed the combined proposal for policing and felt that it would qualify for Federal assistance since a high priority is placed on proposals which lend themselves to a high degree of cooperation between various agencies. He noted that Federal assistance is no panacea for the solution of local problems. Mr. Mavity stated that the proposal could serve as a model of coordination III for the Law Enforcement Agency and that it would give a greater degree of cooperation. It would meet the priorities.
