The regular meeting of the Lino Lakes Village Council held on November
9,1970, was called to order at 8:05 p.m. by Mayor L'Allier with all
members present.

meeting held on November 4th as written. Seconded by Mr. Bohjanen.
Motion carried with Mr. Jaworski abstaining as he had been absent.
The Clerk was asked to read the results of the local election.
The Clerk reported that a notice had been received from the Metro
Transit Commission approving the proposed bus service by Rice -
Edgerton Lines. Sample ordinances on no burning had been received
from Mr. Hutchison of the Anoka County Health Dept. as well as copies
of the Blaine ordinance regarding same.
The Lino Elementary Parents Club requested a bingo permit for November 20th
at the school. Mr. Jaworski moved to grant a bingo permit for November 20th
to the Parent's Olub. Seconded by Mr. Bohjanen. Carried unanimously.
Letters had been received from both Anoka and Ramsey Counties regarding the
request for a review of the speed limit on County Road J west of Hwy 49. The
Lexington fire report for the third quarter was read.
Mr. L'Allier stated that a problem had arisen before the election regarding
the ballot on the proposed park land purchase. Mr. Locher stated that on
the 9th of October, as required by State law, he had ordered printing of
these ballots as well as the general Village ballots through the Arpka
County Union & Shopper and had specifically asked that one pad of each
ballot be delivered directly to the County Auditor's office for use by
absentee voters. Mr. Locher had proofread the ballots on the 15th; they
were to be printed either that day or the next and delivered immediately
thereafter. However, there had been an error in the shipping department
and the ballots were not delivered to the Auditors office. Mr. Locher
had received a letter from Mr. Tam Pease of the Shopper which he read,
stating the dates of delivery of the ballots to the Clerk, that the 2
pads had-not been taken out or delivered as ordered, and offering his
apologies for the mistake. Mr. Locher stated that the situation was
moot since the vote on the park ballot was far apart. Only 7 absentee
voters were affected since one applicant was not a registered voter.
Mr. L cher had discussed the matter with the Attorney General and the
County Attorney; it was decided that the ballot should go on the
election since it was an innocent error. There were no questions on
the subject.
Mr. Cardinal reported that he had received a letter from Ken Rehbein
requesting that the Engineer be present at the P&Z hearing on the 18th of
November to answer questions; Mr. Cardinal wished to make this request.
Mr. Bohjanen stated that no motion was necessary since it was at the
builder's request. W. Cardinal also requested that the Building Inspector
attend the next P&Z meeting.
Mr. L'Allier asked Mr. Dupre for a report on the Olson home. Mr. Dupre
stated tilt he had inspected the home this evening and had talked to Mr.
Olson prior to the meeting. Mr. Dupre stated that the house needed 3
windows in the front, plus siding and sheetrock. He didn't feel that it
would take long to do. Mr. Cardinal noted that questions on the construct-
ion had originated at the P&Z, mentioning that from the outside one can't
see progress on the inside. He wished to know how soon Mr. Olson would do
the remaining work. Mr. Olson stated that he was handling it as fast as
be could; that money was not available, especially for homes without city
sewer and water. He had to wait for the windows before putting on the

brick and the siding. He stated that the inside was cuing fine.
Mr. L'Allier asked Mr. Dupre if Mr. Olson was making reasonable progress; Mr.
Dupre stated that he was making progress but it was slow. There was further
discussion with Mr. Locher reading a portion of Section B of 2. Pertits of
the Building Code. It was agreed that the building permit was still in effect
if Mr. Olson was working on the house.
Mr. Jaworski requested permission to buy 2 more lights at the hockey rink for
an approximate cost of $75. After considerable°disoussion, Mr. Jaworski moved
to purchase 2 lights for the hockey rink and to check on the. adequacy of the
lighting system in Lino Park. Seconded by Mr. Cardinal. Carried unanimously.
Mr. Rosengren moved to obtain 2 security lights from REA for the fronting sides
of the new building. Seconded by Mr. Bohjanen. Carried unanimously. Mr.
Rosengren will call them and have the lights installed.
Mr. Rosengren reported that he bed received two well bids, from Dave Sampson
ad Ernie Ludwig. There was some discussion on the bids which were given to
Mr. Locher to check. Mr. Bohjanen wondered if there would be water by the 21st.
Mr. Rosengren reported that he had gotten a quote on a 5 foot broom for the Cub
tractor for the factory price of $595 minus a discount of $50;,freight charges
would add about $30. We would pick it up and install it. Mr. Jaworski stated
that it would save money on cleaning the rinks; Mr. Rosengren stated that it
could be used for sweeping the streets during road work. After discussion,
Mr. Jaworski moved to purchase the broom for $474, the cost to be split equally
between the Parks and the Roads funds. Seconded by Mr. Rosengren. Carried
unanimously.
Mr. Rosengren reported that progress on the outside of the building was depend-
ing on the bricklayers; otherwise it was coming along well. The building will
be ready to go in by the 21st, but will not be finished; we will push them. Mr.
Bohjanen stated that he had talked with Mattson's home office today, but had
been unable to reach Mr. Hagen to do business; he sight theVme night have
to move some stuff to make room.
Mr. Rosengren stated that he would like to put the gasoline, tank and pinup out
on bids or perhaps the Village should buy the tank and pump and let bids on
the gasoline alone. There was considerable discussion on this. The Clerk was
asked to check the amount of gas used per year by the various departments
excluding the Police who use ethyl gasoline. Denny Houle suggested that the
Village anchor the tank to keep it from floating when the gas level is low;
also, the tank would be cheaper to buy from the supplier. After further die-
evasion, Mr. Rosengren moved to authorize advertizing for bids for gasoline,
tank and pump, and to make provisions for the buyback of the tank if it
seems feasible. Seconded by Mr. Cardinal. Carried unanimously.
Mr. Rosengren moved, on Mr. Gotwald's recommendation, to release the State's
bond for hauling on 80th. Seconded by Mr. Jaworski. Carried unanimously.
The Clerk is to check the bond for Schuh on 80th; if there is none, she is to
contact Mr. Gotwald.

Mr. Rosengren stated that he had been requested by,El Rehbein and Son, Inc. to
release their bond for a borrow pit. Mr. Gotwald didn't feel that the work had
been completed on this yet. W. Cardinal moved to authorize ¥r. Backlin and
the Engineer to inspect the pit after Mr. Rehbein has corrected the problem;
Mr. Gotwald will write a letter allowing the release of the bond. Seconded
by Mr. Rosengren. Carried unanimously.
The well bide were discussed some'more. Mr. Locher noted that a 4" stainless
steel screen was included in Ludwig's bid. Other things were not specifically
included by Mr. Sampson. Also, that Mr. Sampson's bid was for $5 per foot; Mr.
Ludwig's for $4.50 per foot, but that Mr, Sampson's bid was still lower than
Mr. Ludwig's even if we had to go 100' deeper. It was decided that Mr. Rosengren
should get a written statement from Mr. Sampson on what was included in his
bid; he would also try to get a committment on the starting and finishing dates
of the work.
Mr. Bohjanen reported that he bed intended to have the flyers ready tonight,
but that he had not picked them up although they were read. The flyers are
dated for the 21st, so the date can't be changed.
Mr, Bohjanen wondered how long it would take to put up the flagpole; it would
only take 3 days to get it made. The cost will be $125 for a pole with a 4 1/2'
base, 50' high. It would include everything but the rope. He had not asked
for a bar'to put the lights on since we hadn't decided just where they should go.
Mr, Baoklin suggested that the lights for the flag be placed on the building
instead if the pole were close enough. Mr. Baoklin stated that if tley had the
dimensions of the holes on the base plate, they could pour concrete anytime.
Mr. Bohjanen stated that they will deliver the pole, but we must install it.
The slab will be underground. Mr. Rosengren thought REA might bury the pole.
Mr. Bohjanen stated that Mr. Lee Smith wished to comment on theplaque. Mr.
Smith stated that it would be similar to that of Lexington, measuring 10" by 14"
with the names of the officials and the date. There was some discussion. It
was decided that this would be acceptable; that ,a spot would be left on one
corner of the building for the plaque. Mr. Smith will proceed.
Mr. Bohjanen stated that he didn't know just how the button sales were going,
but that they had run up $300 worth of expenses by now. He was trying to
promote free beer, so that they could make the $34 to cover the insurance policy.
Mr. Bohjanen stated that they would probably have another C&BDC meeting at his
house on Thursday.
A lady in the audience asked whether North Central was furnishing the gas for
the new building; she stated that they are done with the work and we probably
wouldn't have gas in this fall. Mr. Backlin stated that he had talked with the
company representative who hadn't mentioned not doing the work; the order was
sited some time ago. There was some discussion. Mr. Rosengren stated that
he had talked with Mr. Warren Williams of the ampany who had told him that
they are overbooked for this fall. Mr. Rosengren will content Mr. Williams
further on the matter.
Mr. Bohjanen reported that starting Nov. 16, the Rice Edgerton Bus Line will
put one more round -trip bus on the daily schedule. Mr. L'Allier noted that Mr.
Al Ross was keeping tabs on the proceedings of the bus company. Mr. Ross noted
that there was no bus service on Sunday and there will be a hearing on Nov. 10th
on revising service further for the company.

Mr. Rosengren moved to award the well contract to the low bidder, Dave Sampson,
providing that Mr. Gotwald and Mr. Rosengren meet with the bidder to clarify
items included in the bid and to see that the bid conforms with the specs;
also that after written verification from*. Sampson, Mr. Locher will draw
up a contract, asking for a starting date and asking for completion,. if
possible, by the 21st of November. Seconded by Mr. Jaworski. Carried
unanimously.
Mr. Rosengren noted that Mr..Gotwald has advertized bid specs for the new
truck. Mr. Gotwald commented that this was for the truck chassis only.
Mr. L'Allier stated that the opening of 135E would be held next Monday at
1:30 pm at the intersection of I35E and I694 in Little Canada with a proces-
sion through the various communities along I35E ending at Der Lech Haus in
Forest Lake.
Mr. Gotwald read his recommendation for the release of the bond held for Cecil
.LaNitte on the Second Addition portion of LaMotte Road; the letter indicated
that except for low boulevards in certain areas and the relocation of part of
the existing drainage ditch in the Outlot, he recommended releasing ell of the
bid except for $500 which should be held until these two things are taken care
of in the spring. Mr. Rosengren moved to authorize the Clerk to write to the
First State Bank of Hugo to release the bond for Ocil LaMotte except for an
amount of $500 which is to be held until further notification. Seconded by
Mr. Bohjanen. Carried unanimously.
Mr. Gotwald reported that he had checked Rolling Hills Drive and had found
some damage from the hauling. The work had been done without proper bond or
notification; the roadway easement property was no longer Mr. Reiling's since
the plat is on file. About 2000 yards of dirt, worth $2000, had been removed
to fill another piece of property. This was in violation of the ordinance.
Mr. Gotwald recommended that if the Village wishes to pursue the matter that
we can tag him for the removal of dirt without permission and /or require him
to repair the seal - coated road for an approximate cost of $100 for 8 tons
of blacktop. Mr. L'Allier recommended that Mr. Locher be authorized to
write Mr. Railing and his contractor requesting reimbursement for damages
and requiring them to get a permit for.such work since they were in violation
of the ordinance. Mr. Locher commented that the work had stopped when they
were told that they -were in violation. Mr. Gotwald suggested that they be
required to come back and do restoration work. The 4% grade of the adjacent
hill caused the silting out on the roadway. Upon further discussion it was
noted that the dirt removal would have had to be done in the future anyway.
After more diacussbn, Mr. Rosengren moved that Mr. Locher write the owner
and contractor telling them that there will be no further construction without
the proper permits and that they should contact Mr. Gotwald on the work to
be done. Seconded by Mr. Cardinal. Carried unanimously.
Mr. Rosengren noted that there is a bus turnaround on Rolling Hills Drive,
but he doesn't know where the end of that street is. After discussion it
was decided that the plows will turn around in the yard at the end of the
driveway this winter, but that the end of the street should be marked and
e proper turnaround made next year.

Mr. Gotwald stated that within 2 weeks he will notify the Mayor to set a
special meeting to review the specs for the Jandric water and sewer systems
with the Fiscal Agent and the Attorney. He will contact the Clerk to set
a meeting.
Mr. Gotwald had received a letter from the Chamonix people stating that the
water level in Reshanau Lake was now normal. After the rains the level had
come up 11 inches in 3 days. There was some discussion on the lake levels in
general. Crystal Ahlman thought that since all the lakes are high that the
Reehanau level was still low.in comparison.. Mr. Gotwald stated that this
was not true since Reshanau Lake is usually 1 to 2 feet higher than the rest
and this level is a normal condition. He mentioned that there has been some
discussion in communities downstream that the lakes should be dammed to keep
all the lakes at the 8.81 (high •water) level.

Crystal asked if it would be public when the bond issue was discussed.
Mr. Gotwald said yes that a special informational meeting with the Council
would he held. Later, the Council would instruct Jandric whether to proceed
or not; then Metro Sewer Board approval would be needed; then a hearing.
The Council could still reject the bond issue after that before it would
come up for sale. In answer to Crystal, Mr. Gotwald stated that we were not
sure at all whether we will bond $350,000 for Jandric sewers; it looks like the ,f,,k
treatment plant will be taken over by the Metro Sewer Board; this would cut
the total sewer and water cost to $300,000. " "sAal stated that if they don't
then the Village will back it all. Mr. Gotwald stated that Jandric will haft
a performance bond. Crystal stated that it was unusual for a Village to back
a developer. Mr. Gotwald stated that it is done in all of Ramsey County.
Crystal wanted to know if others could get into the line. Mr. Gotwald stated
that a treatment plant was allowed, not a line. But if an adjacent developer
wished he could use the same plant if he petitioned in time. Mr. Gotwald
noted that the water plant was designed to serve the 700 acre Jandric
development, but it could go to serve. 1/3 of the Village.
Crystal asked if it was definite that Jandric owns 700 acres; she quoted a
newspaper article about the donation of 6.7 acres of park land --thus that Jan -
dric only owned 67 acres. Mr. Gotwald noted that the,67 acres was only on the
first plat and that they have 3 plats filed so far. Crystal argued further
about the ownership of the land. Mr. L'Allier noted that the plat had been
authorised to be signed and that the persons whom Jandric was buying from were
listed on the plat maps. Crystal stated that long -term options and contracts
doesn't mean Jandric owns the land. She was happy that another developer can
tie into the line. Mr. Gotwald stated that this was if a connection were
available and must be decided in 2 weeks. The plan was for only 200 units now.
If the Metro Sewer 'bard allows a trunk line then all developers along the line
could petition for use in the line. Crystal stated that in other villages a
developer puts in his own lines. Mr. Gotwald stated that this was under a
franchise and.thme were no longer available in this area. There was more dis-
cussion with Mr. Gotwald advising Crystal to check with White Bear Lake, New
Brighton and Blaine to see how things are - worked there. Mr. Rosengren commented
that as far as the, amount of land goes, the Zopfi farm alone was 300 acres. Mr.
Gotwald noted that the sewer plans were only for the East side of Reshenau Lake
and that we must wait for the Metro Sewer Board before developing on the West
side.

lair. L'Allier pointed out that even if Jandrio does not own the lend, that if it
is.under contracts for deed, under bond process a 100% assessment would bind
the people who have the contracts for deed. Crystal stated that she would dis-
cuss the matter further with the Council before we proceed with the bonding.
W. Gotweid noted that by the time the system is completed for the Jandrio area
that there will be a large townhouse complex; therefore the building's value
would be above the bonded amount. Even now, the taxable value of the empty
land was much higher since it had been platted.
Mr. Bohjenen asked about the gravel at the new building. Mr. Rosengren stated
that the gravel was there and just needed blading. There would only be trouble
if we had a fast hard freeze. Mr. Bohjanen asked what was being done about the
hole. Mr. Rosengren stated that it was filling up; we could decide what to do
with it next year.
lfr. Locher stated that in responae to inquiries he had received a letter from the
Clerk of District Court, giving the summation of the court trial of Clyde Rehbein
on.his failure to get a septic systems license. He rem* the letter which gave
the details of the. fines with,e suspension of A portion if he obtained such a
license within 30 days (of Oct. 7th). The Clerk stated that W. Rehbein had
made an application and that the matter was on the agenda.
Mr. Locher stated that Mr. Lee Smith had inquired about setting another hearing
on his referral for rezoning. The last hearing date had been August 10th and
les continued indefinitely pending notification (30 days) of a desired hearing.
Mr. Smith and Mr. Ray Jones of Superior Oil had requested that the matter be
referred to the P&Z on Nov. 18th for study and a hearing before the Council on
Nov. 23 be set, with notices to be sent. Mr. Locher noted that he can reduce
the area for consideration, that this mainly concerned Parcel 2500 which lies
between 135W, +01d Hwy 8 and Liles Street plus a small triangle being renegotia-
ted from the State. The pieee was 4.8 acres total and would be rezoned for a
major hotel - motel - restaurant - service station. Mr. Smith stated that plans would
be brought on the 18th.
Mr. Locher noted that a. portion of this land is already commercial, that we would
need to rezone the remainder. He feels, that the service station would fit into
the commercial area, but they wish`'to proceed with the entire project as soon
as possible.
W. Bohjanen moved to place the hearing for. Smith on the agenda for the P&Z
at 9:30 p.m. on the 18th of November and to set a hearing before the Council at
9:30 p.m. on the 23rd of November. Seconded by*. Cardinal. Carried unanimously.
Mr. Smith inquired about getting a deviation of a few feet on a previous sign
applicatbn which was denied; W. Locher stated that we would want the P&Z to
study the matter. He read the hardship waiver clause in Ord. No. 51. W.
Locher stated he would send the notices of the rezoning hearing out tomorrow.
The applications for Deputy Clerk were passed around for persuai. The Clerk
was asked to read the main points of the 3 applications. One applicant, Mrs.
Steffen, doesn't live in the Village. The Clerk noted that the present Deputy
had finished her work and returned all her equipment to the Hall. W. Rosen -
gren mentioned the Personnel Commission which had been disbanded the past Jan-
uary. Mr. L'Allier felt that it might be revived the first of the year if we
decided to go to fulltime work.

$r. L'Allier noted, with Mr. Locher's agreement, that under State lawn, that the
Clerk has the power to appoint a Deputy Clerk with the Couneil's approval. The
Clerk thought she would prefer the applicant who has no children at home since
it would be more convenient for her to work at the Hall when necessary. Mr.
L'Allier stated that he preferred someone who lived in the Village. Upon,
further discussion Mr. Cardinal moved to hire Mrs. Mary McCoy as the Deputy
Clerk until the end of the year when reappointment could be made. Seconded
by Mr. Jaworski. Carried unanimously. The Clerk stated that she would call
Mrs. McCoy in the morning.
Mr. Rosengren reported that they had not yet had a Building Comwittee meeting,
but were trying to get together. He had discussed carpeting with the company
who was doing his place, and was advised to use carpeting throughout.
Mr. Locher had studied the dower license application from Clyde Rehbein. A
license was to have been obtained within 30 days, but since the Council meeting
was not within that time, it would technically pass. Mr. Bohjenen moved to
approve a septic systems license for Clyde Rehbein providing that he gets the
necessary bond and insurance. Seconded by Mr. Rosengren. Carried unanimously.
Mr. L'Allier mentioned that we had asked Mr. Dupre for a report on the Jandric
foundations. Mr. Dupre stated that he doesn't know why anyone would complain
about those foundations. Crystal stated that the.00mplaint was on the workman-
ship, that there were holes between the blocks that you could put your hand
through. Mr. Dupre stated that he didn't see any holes. Crystal thought that
they must have been fixed.
Mr. Cardinal inquired about the list of registered voters --that it was to be
given to anyone but salesmen? He was told yes. Mr. Cardinal stated that Mr.
Al Ross had contacted him on this. Mr. Ross stated that he had no objection to
the list being given to political parties, but, if it went to other people we
would just be receiving junk mail. He wondered it same c rpl- ebulintt be
placed over whom the lists were given to. He also thought they should be
charged more than 251 per list. Mr. Rosengren wondered what was wrong with just
having a list in the Hall for the people to look at. Crystal stated that copies
were neceasary for political things. After discussion, Mr. L'Allier stated
that Mr. Locher had suggested that any request for a list should be brought to
the Council for an Okay.
Mr. Clausen of Baldwin Lake Road stated that a petition had been brought around
which was against the no- shooting proposed for the SW corner of,the Village.
He stated that -he wouldn't sign it because he doesn't want any hunting there,
but he felt that people should be allowed to shoot at clay pigeons if they
wished with the owners permission. There was discussion on the matter; it
will be brought up at the next PAZ meeting.
