Minutes accepted at the meeting of March 11, 1968

The regular meeting of the Lino Lakes Village Council was called to order on March
11, 1968, by Mayor Ralph L'Allier at 8:06 PM with all members present.
The minutes of the February 26 meeting were read. Mr. Bohjanen moved that the
minutes be accepted as read with the addition of the resolution concerning the
lighting facilities on 35W. Seconded by Mr. Cardinal. Carried.
A special hearing on a petition for rezoning by Acton Construction Co. was than held.
Mr. Acton gave his plans for construction of buildings and development of about 50%
of the 29 acre parcel. Mr. Locher stated that he had sent notices of the public
hearing to all the property owners within 200 feet of the proposed land to be rezoned,
read the affidavit of posting by the building inspector and read the affidavit of
publication of the notice of public hearing from the Blaine Life. The Council had
previously waived the requirement of a signed petition. Thereupon, Mr. Cardinal moved
that the Village of Lino Lakes pass a resolution to adopt Ordinance No. 6H. Seconded
by Mr. Bohjanen. Carried.

Mr. Ken Rehbein asked the Council whether he could obtain building permits for some
of the lots in his property on Main and W. Rondeau as they did not front on an existing
Village road. Mr. Bohjanen moved that the Council turn this matter over to the P&Z
at their next meeting, that Mr. Cardinal would contact Mr. Gotwald to inspect the
property and report on it at the next regular Council meeting to be considered then.
Seconded by Mr. Jaworski. Carried. The P&Z will also hold a public hearing on
platting of a section of this property.
The Village's financial report for February was read showing a balance of $545.76
in the checking account as of Feb. 29th. Receipts were $5,673; disbursements were
$6,080.42. The County Treasurer had been asked for an advance of $5,000 on the
March allotment.
There was discussion on the matter of the CD jackets not being delivered by Uniforms
Unlimited. Check #1695 written to them is still out.
Mr. Locher will check with the PERA on the Village's outstanding contributions.
Mr. Jaworski reported that the light at the St. Joseph's Church was moved out near
the street previously. The Village is now paying for this light.
Mr. Bohjanen reported on the March 6 C&BDC meeting. He also stated that the Water-
shed Assn. of Fridley seemed to want a change of plans in having the County Commis-
sioners handle the Rice Creek problem rather than the Legislature.
The State Hwy Dept. turned down the locating of our sign at the junction of Hwys 8
and 49. The county has offered the use of their right -of -way along North Road and
it was decided to put the sign at the corner of Hwy 8 and North Road.
Mr. Rosengren stated that St. Joseph's Church wants complete plans for work to be
done on Sunrise, so no work can be done on it yet. He also reported that the County
will furnish a culvert on 80th.
Mr. Backlin reported that vandals had taken down a sign at the Domning corner, and
that there is no Stop sign on Lakeview and Sunrise at North Road and street signs are
also missing. Mr. Rosengren will contact the engineering firm to replace the sign and
landscape the dirt piles at the location. A list of culverts and signs needed is
being made.
Mr. Rosengren moved that the Village install "Children Playing ", "Slow ", and "20 mph"
speed signs on Baldwin Lake Road. Seconded by Mr. Cardinal. Carried. Mrs. Bohjanen
asked whether 30 mph wasn't the legal state limit and if the police could enforce a
lower limit. Mr. Locher will check. Mr. L'Allier instructed the police to enforce
the 20 mph signs.
Mr. L'Allier stated that there will be another meeting with Mr. Maurice Chandler on
March 28, He asked the Council and the P&Z to be present.
Mr. L'Allier also reported on the hearing held by the Minn. Water Control Commission
on March 6 regarding Forest Lake's request. Forest Lake had stated that it would cost
them some $297,000 to divert their effluent to the Sunrise River. The case was taken
under advisement.
It was mentioned that Mr. Harold Hansen had not yet sent a legal description of his
roadway to Mr. Gotwald.
Mention was made of the Metropolitan Airport Commission hearings to be held on April 22,
regarding possible building of an airport north of the Cities in the near future.
Mr. Bohjenen suggested that Lino Lakes hold a joint meeting with Blaine on this sub-
ject or to discuss it at the Anoka County Assn. of the League of Municipalities on
March 27th.
The police report for Feb. as follows: 36 radio calls, 3 burglaries, 6 tickets,
9 escapees from the Youth Cnter involving four hours time, travelled 1161 miles.
Hours: Mr. Raymond, 55 hr, Mr. West, 55 hrs., and Mr. Myhre 45 hrs. There had been
no complaints at the public police meeting.
Mr. Locher reported that according to the St. Paul papers, Mr. Albertson has presented
a bill which would require prosecution now handled on retainers by the Villages to be
bendled by the County Attorney's office. This would be much more profitable for the
village, also the County has more investigative power. He will write Mr. Albertson
for details.

Mr. Backlin reported on a complaint from Baldwin Lake Road about the snowplow
causing a washout on a driveway, and the owner wishing to know if the Village would
fix the problem. It was the consensus of the Council that a private road is to
be maintained and repaired by the property owner except for the present snowplowing
now being done.
Mr. Backlin also mentioned that there was no street sign up on Mr. Hansen's road
due to it having been taken down during construction work.
Mr. Don McShannock of Hodgson Road complained of a camping trailer in his yard having
been shot full of buckshot allegedly coming from his neighbor's property. Nothing
can be done by the Village in this matter because the gentleman had no proof that
his neighbors had done this and did not wish to sign a complaint.
Mr. Dupre presented a copy of the building permit, dated April 22, 1959, for Mrs.
LeTourneau's home. Therefore, there is nothing the Village can do as there is a
three -year stature of limitations. Mr. Bohjanen moved that the Clerk write a letter
to Mrs. Rose LeTourneau advising her of the building permit, sending her a copy of
same, and suggesting that she may get some action through her mortgage attorney.
Seconded by Mr. Rosengren. Carried.
Mr. L'Allier withdrew his request for the Building Inspector to inspect Mrs. Le
Tourneau's home based on Mr. Locher's opinion that there is no legal action that the
Village can take and it would be a waste of funds to pursue it further.
Residents of Baldwin Lake Road present stated that there were two holes dug on the
LeTourneau property and that concrete and footings had been poured. Mr. Jaworski
then moved that the Building Inspector inspect these holes and red -tag same if
concrete has been poured as no permits have been issued. The Clerk will contact
the Bldg. Inspector on the matter and give written notice of violation of an ord-
inance if the tags are issued. Seconded by Mr. Cardinal. Carried.
Mr. Rosengren moved to pay the bills as audited. Seconded by Mr. Cardinal. Carried.
Mr. Bohjanen made a motion to pass a resolution that in the matter of rezoning and
special hearings, the Clerk hold off on the billing for same until all the costs are
tabulated, including fees for the Building Inspector, publication, attorney and
engineer. Seconded by Mr. Jaworski. Carried.
Mr. Rosengren moved to adjourn at 10 :13.
