HomeMy WebLinkAbout08/12/1968 Council Minutes.ir The regular meeting of the Lino Lakes Village Council on August 12, 1968, was called to order at 8:07 p.m. by Mayor L'Allier with all members present. The minutes of the July 22, 1968, meeting having been read, a motion by Mr. Cardinal was made to accept these minutes as corrected. Seconded by Mr. Jaworski. Carried. Mr. L'Allier announced that Commissioner Robert Burman was present and asked for his comments. Mr. Burman stated that he had personally looked at Sunset Avenue boulevard along with the County Engineer and the City Engineer for Blaine. The asphalt had been removed and black dirt had been put in and then seeded, with work about completed. Mr. Burman had also met with E. J. Houle, Weed Inspector, about the problem of the County not spraying the weeds along County roads bordering the Village. Mr. Burman stated that he was not satisfied with County work on its roads and had been pushing for better work. Mr. Burman stated that one of his projects is to push for the construction of a major County maintenance building for the Southeast corner of the County and urged that Lino Lakes request the County to do this, as it would make the equip- ment more readily available. Also, Mr. Burman said that he was trying to work more roadwork for Lino Lakes into the budgeting, and also that the County passes a resolution to present to the Legislature concerning the Metro Council, he would see that we received a copy since Mr. Burman is a strong advocate of strong local government. Mr. Burman then proceeded to discuss the Rice Creeek Watershed problem with the Council, passing out sheets showing what he thought should be done on the problem, and asked that Lino Lakes give him some new resolution which could be incorporated into the County minutes. Mr. Rosengren mentioned that the St. Paul Waterworks has not treated us right because of the great monthly fluctuation of water level Mr. Bohjanen felt that we should take a serious approach to the Conservation Department to see if we can create a watershed. Mr. Bohjanen informed Mr. Burman that there were several driveway, approaches on Sunset which had a real high grade and asked whether this would be repaired. Mr. Burman replied that persons affected should call him and Mr. Ruud, and that, hopefully, the road will be put back as it was. Mr. L'Allier inquired what the status of the East service road from 35E north now was. Mr. Burman stated that the State has a contract, the County has been trying to get a better job done; it looks as if the State will turn the road back either to Lino Lakes or the County (more likely the County) and then the County will have to take out the hill. There was a question on the East County Line Road; the Anoka County Commissioners have gone on record on this; they are trying to arrange a meeting with Washington County to get something done, as this should be a county road. Mr. Cardinal thanked Mr. Burman for the work the County has done on Birch Street and asked whether the County would take it over all the way to Centerville Road; this would depend on getting the fight of way and County policy is changing on this procedure. Mr. L'Allier thanked Mr. Burman for attending the meeting and giving us his view points. 1 1 1 6 3 S Mr. Ken Rehbein was asked to come forward. Mr. Locher read the section of the building ordinance pertaining to useage of residental land, finding no mention of a riding stable or arena given. Mr. Rehbein invited the Council to attend one of the horse shows, stating that 2/3 of the riders attending were teenagers (which kept them off the streets) and that it was good entertainment. W. Rehbein re -' quested that his property be rezoned to commercial. Mr. Locher explained that there was no mention of a horse arena under commercial in the ordinance. There was discussion among the Council about leaving the land as residential with a recreational restriction or rezoning it with a special use permit. Mr. Bohjanen moved that we call for a hearing on September 23, to rezone to commer- cial all 30 acres for Kenneth Rehbein, this land lying at the Southeast corner of the intersection of Pine and Fourth Avenue. Seconded by Mr. Jaworski. Mr. L'Allier stated that he preferred that the matter go before the P&Z first. Vote: Aye—Mr. Jaworski, Mr. Rosengren and Mr. Bohjanen. No - - -Mr. Cardinal and Mr. L'Allier. Motion carried. Mr. Jaworski then moved that we call for hearings on September 18 before the Plan- ing and Zoning Board and on September 23 before the Council for a special use permit on Mr. Rehbein's at Fourth and Pine, this to be included for the purpose of a riding stable and arena, indoor and /or outdoor, to accompany the commercial zoning. Seconded by Mr. Rosengren. Carried unanimously. Mr. Rehbein was then questioned about his trailer home parked on Fourth Avenue. He stated that he had been unaware of the ordinance forbidding this as there were other trailers parked in the Village. The person occupying the home is a friend from Michigan, out of work and money, whom Mr. Rehbein moved here and settled in the trailer for a period of one or two years until he can build a house, and is presently working for him, and as such should be a hardship case (similar to that of Rogalla's.) Mr. Bohjanen moved that we call for a special use permit hearing for Mr. Rehbein's trailer effective for a period of one year. The motion died for lack of a second. Mr. Rosengren moved that we give Ken Rehbein a 90 -day permit for his trailer, and that Mr. Rehbein could receive a 90 -day extension permit from the Building Inspector when the first permit was up. Seconded by Mr. Bohjanen. Carried. Mr. Rehbein was instructed to see Mr. Dupre. Mr. Ed Schwankel was called before the Council to discuss his trailer home parked on Orange Street. Mr. Schwankl stated that he had brought in the trailer two years ago, lived in it for 15 months, meanwhile using it as an office, and that he was now renting it (more or less) to a man who was helping him in his business which was quite a convenience to him. Also,the trailer is parked on commercial property. Thereupon, Mayor L'Allier moved to grant a 90 -day permit to Mr. Schwankl for his trailer; this permit will be terminated at the end of 90 days and the trailer must be removed; this cannot be considered a hardship case. Seconded by Mr. Cardinal. Vote: Aye - Mr. Jaworski, Mr. Cardinal, Mr. Rosengren and Mr. L'Allier; No -- Mr. Bohjanen. Carried. Mr. Schwankl was instructed to see Mr. Dupre. Next Mr. Dick Olson was called before the Council because of his trailer parked on Highway 8. Mr. Dupre stated that Mr. Olson had received one 90 -day permit more than a year ago, but had not asked for a 90 -day extension permit. Mr. Olson explained that he was not living in the trailer becasue he wanted to but because he was having financial difficulties and could not raise the money to complete his home. He inquired whether he might move into his basement to live; Mr. Dupre stated he could not. After discussion Mr. Bohjanen moved to grant Mr. Dick Olson a 90 -day extension permit to keep his trailer parked at its present location. Seconded by W. Rosengren. Carried. Mr. Floyd Miller was present to request a special use permit to erect a building on his property, on West Rondeau Lake Road, which he would use as an office and storage building for two trucks. Plans showed that the building would look similar to a house; the property was not zoned commercial. This would be a base operation for his cabinet-making crew, and would be used in building cabinets for his own homes. Mr. Cardinal moved that we call for hearings before the P&Z on September 18 and the Council on September 23 to consider issuing a special use permit to Mr. Floyd Miller to use said building as an office and storage space for two trucks. Seconded by Mr. Bohjanen. Carried. The Building Inspector was authorized to issue a building permit to Mr. Miller immediately. Mr. Jaworski mentioned that the Northwest Citizen's Bank club was through in Sunrise Park and had left is very clean. W. Jaworski therefore moved that the bond for the Northwest Citizen's Band Club he released. Seconded by W. Bohjaneu. Carried. Mr. Jaworski also mentioned that the Personnel Commission had finished their work and that they would begin doing job descriptions for Village employees before interviewing persons for positions. W. Jaworski then moved that the Personnel Commission be authorized to set forth the descriptions of and the qualifications required for all Village employees. Seconded by Mr. Bohjanen. Carried. Mr. Bohjanen reported that the C&BDC had nothing to report since the last Council meeting. Mr. Rosengren stated that he had also viewed Sunset and Lakeview area, that the contractor should fix up Sunset to residents satisfaction or do the job over. Mr. Rosengren reported that Tom Anderson had not used one culvert which the Village had given him last summer and would like permission to pick it up since Mr. Anderson had not yet paid for it. Mr. Cardinal thus moved that Mr. Rosengren write a note for Mr. Anderson to sign giving Mr. Rosengren permission to remove the unused culvert and accessories. Seconded by Mr. Jaworski. Carried. If Mr. Rosengren is unable to obtain such a signed note, he is to contact the Attorney. There was some discussion on the matter of buried cables and pipelines. The Clerk was instructed to secure model ordinances from the League on this. There is considerable concern as there are plans to construct large H- frames for electric service in the area, possibly some going south of Main Street. Mr. Rosengren mentioned that Bob Lundgren was cutting along the roads. 1 1 Mr. Gotwald presented the four privately submitted bids for roadwork to be done on Bald Eagle, Rolling Hills and 64th; the highest bid was $4,478.00, the lowest was $2,691.50 by T. A. Schifsky and Sons, Inc. W. Gotwald recommended that the Council authorize Mr. Rosengren to contact Mr. Schifsky to get the work started. He also mentioned that he had talked with W. Lindberg on finishing the work on 64$h; W. Lindberg will bring the road up to the Village Road Department's specifications. 65 Mr. Cardinal moved to authorize Mr. Rosengren to contact Mr. Schifsky to begin the prime and seal - coating work at his bid of $2,291.50. Seconded by Mr. Jaworski. Carried. Mr. Cardinal also moved that we contact Mr. Schifsky about sealing the two skating rinks, this to be paid out of Park and Playround funds. Seconded by Mr. Jaworski. Carried. Mr. Rosengren moved to have Mr. Schifsky put oil on Aqua Lane as far as just below the Kelling hill (residents past that point can request and pay for the oil if they wish), this being estimated at 1000 gallons, costing $150 -200. Seconded by Mr. Jaworski. Carried. The Village will blacktop the bridges. Mr. Gotwald mentioned that he had studied the layout for the proposed trailer park by Chuck Larson on 35W on Fred Rehbein property and that he had found some of the lots werenot up to size, he will talk to Mr. Larson's surveyor. He suggested that the matter at present be sent to the P&Z to consider for rezoning and petitions signed later. Mr. Bohjanen then moved that the matter of Chuck Larson's proposed trailer court be refered to the P&Z. Seconded by Mr. Rosengren. Carried. Mr. Gotwald stated that the topography maps could be waived on Cecil LaMstte's plat, but that he should provide tentative sketches for layout further west in his draw- ings and show the proper streets. Mr. Rosengren moved that we accept the State's diagram for fencing along 35W subject to Mr. Gotwald's approval. Seconded by Mr. Cardinal. Carried. Mr. Locher had received the legal description from Mr. Harold Hansen for his drive- way which he wished to have the Village take voer for partial maintenance. According to Mr. Gotwald, the roadway was up to specifications with the possible exception of the depth of the gravel. After much discussion of whether the road should be sealed, whether the Village ought to take it over and how much maintenance should be done as well as future problems as the land abuting the road is built up, the Council was reminded that the minutes, of 1967 showed that the Village would take it over once the legal description was provided. Also, last fall the Engineer recommended that this be one of the roads which we accept for partial maintenance. Bohjanen moved that the Council accept Mr. Harold Hansen's roadway for partial maintenance as described under Section 15 of Ordinance 20 (snowplowiing when neces- sary and blading on request by residents after approval by the road department) as previously agreed with Mr. Hansen and on record; with the provision that Mr. Gotwald would first check the gravel on the roadway and would contact Mr. Hansen to add more gravel if necessary before any building permit would be issued to Mr. Issacson or the Village accept such road for blacktopping and partial maintenance; also, the Village Attorney will draw up a legal document for signing by Mr. Hansen per- taining to partial maintenance and stating that we have no other committments concerning said roadway, no maintenance to be done until such signature is ob- tained. Seconded by Mr. Jaworski. Vote: Aye--Mr. Jaworski, Mr. Cardinal, Mr. Bohjanen and Mr. L'Allier; No--Mr. Rosengren. Carried. Mr. Bohjanen made a motion to grant a variance to Mr. Edwin Isakson to build a home on Otter Lake on property abuting the Hansen driveway having the following legal description: The east 110 feet of the West 610 feet of that part of Government Lot 7, Section 31, North, Range 22 Wewt, Anoka County, Minnesota lying South of the North 1031.86 feet thereof. Together with a road ease - ment over the South 60 feet of the North 1031.86 feet of the West 610 feet of said Government Lot 7. 6 (3 Seconded by Mr. Jaworski. Vote: Aye—Mr. Jaworski, Mr. Cardinal, Mr. Bohjanen, and Mr. L'Allier. No--Mr. Rosengren. Motion carried. Mr. Locher stated that he had checked the title on the Blomquist Addition plat and found the title clear. Mr. Gotwald stated that he had again checked with the County Surveyor on the matter of the 50; roadway requirement and that the surveyor would accept the plat as it is with the 35' easement. Mr. Locher reported that the League had sent a letter stating that under Minnesota Statute 1955, Chapter 765, voluntary workers including Civil Defense members are considered employees and are therefore eligible for workmen's compensation when ordered to duty by a political subdivision. Mr. Locher will talk to the insur- ance agent about coverage for the Civil Defense. The following names for election judges were suggested by the County GOP: Mrs. William Houle, Mrs. Richard Crandall, Mrs. Secretan, Mrs. L. J. LeTendre, Mrs. R. A. Stanley, Mrs. James Livingston, Mrs. Heckenliable; the following by the County DFL: Mrs. Arthur Haskins, Mrs. Kay Olson, Mrs. Agaes LaMotte, Mrs. Erma Grygellko, Mrs. Signe Miller, Mrs. Ruth Rector. The Council members suggested the following names: Mrs. Richard Lichtscheidl, Mrs. Michael Peloquin, Mss.. Charles Gotwaldt, Mrs. Lowell Nygren, Mrs. Robert Sorg, Mrs. George Tauer, Mr. Kenneth Youker and Mrs. Earl Holley. Mr. Cardinal moved to accept the foregoing list of names for election judges for the primary and general elections this fall. Seconded by Mr. Bohjanen. Carried. Mr. L'Allier mentioned that the Governor would soon announce someone to fill the vacancy on the Metro Transit Commission and suggested that we adopt a resolution supporting Bruce Nawrocki of Columbia Heights for that position. Mr. L'Allier then moved that the council adopt a resolution favoring Bruce Nawrocki for the Metro Transit Commission and that the Mayor and Clerk work on drafting this resolution to send to the Governor. Seconded by Mr. Bohjanen. Carried. The Clerk read a letter from the League concerning the Metro Council Sewer Plan and planning meetings for discussion by interested officials. Mr. Bohjanen moved that we get in touch with the League on this suggesting evening meetings if possible. Seconded by Mr. Jawroski. Carried. Mr. Dupre complained about a single garage which had been moved in on commercial property by Mr. Flanagan without securing a moving permit. Seconded by Mr. Jaworski. Carried. Mr. Dupre mentioned that the house on the corner of Elm Street and Highway 8 will be taken down, but the owner has been ill. Mr. Schwankl in the audience asked whether two or more garages could be located on the same piece of property in a commercial location. The attorney said that there was no maximum limit on this. Mr. Schwankl then complained that the building hung over his fence, that the two garages were so close on the Flanagan property that the overhang on one had been trimmed and that there was no parking area left. The concensus of the Council was that the Fire Marshall should check for a pos- sible fire hazard and that the Council should look at the situation before the next meeting. Mr. Locher mentioned that the County Auditor would call a meeting of municipal clerks before September 3 to instruct them on election proceedings. Mr. Rosengren moved to authorize the Clerk- Treasurer to attend this meeting. Seconded by Ir. Jaworski. Carried. 67 It was decided to hold off on deciding membership in the League of Minnesota Municipalities for the year beginning September 1 until next meeting. The Clerk read a letter from Mr. McFadden of the State Highway Department denying installation of street lights at three locations and stating that this was local responsibility. An answer from Mr. James Ray conerning the Fire Contract with Centerville was received, stating that he couldn't see any change in our insurable position, and that the Attotney;would be better qualified to answer the question. The Pollution Control Agency acknowledged receipt of our letter concerning Forest Lake effluent. Mr. Jaworski moved to pay the bills as audited. Seconded by Mr. Bohjanen. Carried.
