The regular meeting of the Lino Lakes Village Council held on September 9, 1968,
was called to order at 8 p.m. by Mayor L'Allier with all members present.
The Park Board minutes were read with Mr. Jaworski mentioning that a developer had
complained about the strictness of 10% land donation under Ordinance 21B. Mr.
Bohjanen then moved that Mr. Locher write to this developer telling him that we
are abiding by Ordinance 21B and that he could bring up the matter at the time
he comes before the Planning and Zoning Board for action. Seconded by Mr.
Jaworski. Carried.
The September 10 meeting scheduled for discussion of a full -time man was postponed
until after the last budget meeting due to the primary election falling on the 10th.
The budget meetings were set for September 19 and 26 at 8 p.m. The Clerk was
instructed to inform Mr. Wally Hill, our auditor.
Mr. Bohjanen mentioned that the Community and Business Development Committee had
looked at the 701 Program and had presented their ideas the next evening at the
joint meeting of the Planning and Zoning and the Council. They are still working
on the brochure.

Mr. Cardinal stated that the next Planning and Zoning meeting would be on
September 1$ with the scheduled hearings for Mr. Miller and Mr. Ken Rehbein.
He also mentioned that he had received a complaint on junk cars next to
Vivian Rehbein's property on Highway 49.
Mr. Cardinal stated that he had looked at 30 acres on Main Street which could
be used for a Village Hall and that the owner was willing to give the Village
a one -year option (at $100.00) to consider buying the property at $550.00
per acre. The land contains some high ground and is located on a County road
set at a nine ton limit. Mr. Bohjanen stated that we should consider putting
a maintenance building up on a County road. Mr. L'Allier said that this could
possibly be rented for County use.
Thereupon, Mr. Jaworski moved to authorize Mr. Cardinal to proceed with se-
curing the option on the 30 -acre parcel at $100.00 as stated. Seconded by
Mr. Rosengren. Carried.
Mr. Edw. A. Wiener of 6359 Ware Road petitioned the Council to allow him to
put a trailer behind his home for his ailing, aged mother -in -law to live in
until her demise. He had not asked his neighbors but didn't think they would
object. He had tried to get an opening at the Baldwin Lake Trailer Park but
had nor success. He thought it would take 30-60 days to get it set up, has
two acres of property. Mr. Bohjanen moved that a hearing for a Special Use
Permit be set up as soon as possible for a trailer on Mr. Wiener's property,
the first date being available, October 16. Seconded by Mr. Rosengren. Carried.
Mr. Rosengren stated that he had-received copies of various ordinances per-
taining to underground cables, but had had no time to study them. He men-
tioned that the power line on the Claggett property would have to go overhead
due to excessive water in the ground.
Also, the culvert had been picked up from Tom Anderson and the credit for it
taken off his bill. The contractors are ready to prime and seal Bald Eagle
Blvd., Rolling Hills Drive and 64th West of the freeway this week.
It was mentioned that the gravel in the Village Hall parking lot was poor;
Mr. Rosengren will ask Mr. Ludwig to fill it in.

Mr. Rosengren stated that he would like to see the matter of the 30 acres and
a municipal building go on the ballot this year. Mr. L'Allier thought that
it would have to wait until the December 1969 election in order to give the people
a chance to think about it. He thought the property could go on a contract
for deed and the building on a bond issue. Mr. Locher stated that this would
be okay as long as it comes out of general revenue funds. Mr. Bohjanen thought
it should be discussed at the early budget meeting. Mr. Rosengren thought
that we should not put up a fancy building now but something that could be
possibly turned over to the Road Department later when permanent Hall is
erected. Mr. Gotwald was asked to contact construction people for cost
estimates on a metal building with office space and a fancy front. Mr. Gotwald
stated that this was similar to what several suburban Villages had done when
putting up municipal buildings. Mr. L'Allier said that something would be
needed soon for a full -time Clerk and road crew.
Mr. Rosengren inquired whether Mrs. Howard had made any progress on the trailer
court. Mr. L'Allier mentioned that according to the stipulations on her special
use permit she could not proceed with the 50 new lots until streets, etc. are
finished. Apparently she has not started yet, having had financial trouble. The Clerk
Clerk was instructed to waite Mrs. Howard reminding her of the stipulations and
in case of problems invite her to the next Council meeting. Mr. Bohjanen
stated that her purchase of Harold Lehman's property had been completed.
Mr. Bohjanen asked that Slow- children sign be put up on Linda Street per re-
quest of residents. Mr. Rosengren stated that it would be done soon;; also
they may have no time to do the planned work on Linda besides putting in two
culverts there.
Mr. Locher stated that he had written to Lindberg Construction concerning 64th.
Mr. Gotwald said that the outfit has a new supervisor and nothing has been done.
Mr. Gotwald will call Mr. Bob Allen of Lindberg to tell him that unless Lindberg
completes the work immediately, the Village crew will go in on Monday and bill
Lindberg for the work.
Mr. Locher stated that notices of candidacy filing dates must be posted by
September 14th.
Mr. Locher produced photocopies of the deed stubs on highway easement forms
concerning the town road intersecting Baldwin Lake Road. For the most part these
were obtained from Mr. Hilton in January of 1952 and filed on March 30, 1954.
He also reread the letter from Mr. Lundheim on the matter; and stated that he had
talked with the County Attorney who hasn't had time to work on it. After dis-
cussion it was decided that the road could be turned over to the Village after
formal vacating, but will have to wait and see.
Mr. Rosengren questioned whether we should vacate the short strip of road on
the East shore of Rondeau Lake Road. As we have not maintained it we have
nothing to worry about.
Mr. L'Allier stated that he and Mr. Gotwald had attended a Metro Council re-
ferral meeting on the application of Forest Lake and Hugo for sewer construc-
tion and sewage treatment systems. Forest Lake wants to build a plant to dis-
charge additional effluent into the Sunrise River and Hugo wants to build a plant
to discharge effleunt into Peltier Lake. Forest Lake had inquired about building
an interceptor from County Road J to Forest Lake. Apparently Dick Sha of NSSSD
had stated that there was capacity for both in the present lines good until 2000.
Mr. L'Allier moved that we send a letter to the Metro Council suggesting that
they undertake whatever studies are necessary to determine which would be more
feasible, discharging the sewage of Oneka and Hugo to White Bear Lake system
as opposed to the NSSSD system and that they consider studies made on this.

Mr. Rosengren moved that we authorize Mr. Gotwald to attend a brief Metro Council
meeting this Thursday to present the Village sewer studies to look into, and
state that we would not partake in this plan financially. Seconded by Mr.
Bohjanen. Carried. Mr. Bohjanen stated that Lino Lakes should attend NSSSD
meetings so we can watch NSSSD closely and fill them in on our thoughts. Lino
Lakes' not joining gives more unused capacity in the line for someone elses
benefit.
Mr. L'Allier presented a letter received from the Conservation Department asking
us to pass a resolution setting up a bow and arrow season in the Village and
publicising the same. After discussion and reading of Ordinance 27, it was de-
cided that bow and arrow hunting was not prohibited. Mr. L'Allier did not see
asking more hunters into the Village as there are many local hunters. Mr.
Cardinal mentioned that lots of people are hunting deer with slugs and this is
illegal here. There is also the law against trespassing to be considered.

Mr. Dupre stated that he had not yet checked on the sewer problem on Otter
Lake Road.
Mr. Jaworski moved that the Village adopt new Ordinance *45 concerning taxi-
cabs and authorize the publication of same as it had been corrected by the
Attorney. Seconded by Mr. Bohjanen. Carried unanimously.
Mr. Cardinal moved that the Village adopt new Ordinance $46 concerning road
load limits and authorize publication of same. Seconded by Mr. Rosengren.
Carried.
Mayor L'Allier gave the following police report: 2 accidents, 1 medical assist
1 domestic call, 1 burglary, 11 escapees from the Youth Center (6 hours)
putting 1,034 miles on the police car in 98 hours.
Mr. Myhre reported that he had looked for the horses reportedto be on acreage
on Hodgson Road opposite Birch Street but could find nothing.
Mr. L'Allier reported that the Attorney General, Senator Grieg, the Assistant
Highway Commissioner and others had been present at the ribbon - cutting ceremony
on September 4, and that the Assistant Highway Commissioner had stated that
135 would be open to Duluth next year.
Affidavits of publication had been received for Ordinance 6J, hearing on 6K
and notice for filing affidavits of candidacy.
Copies of Circle Pines' audit concerning Lino Lakes gas were passed out to the
Council.
The insurance policy for the Civil Defense Auxiliary for the auction on Sept.
8 was shown.
The Clerk stated that $1,147.70 had been received from the State for Mobile
Home taxes. Also, an answer from Governor LeVander acknowledging receipt of
our resolution for Bruce Nawrocki. Agent Bob Johnson had forewarded a work-
men's compensation schedule showing addition of the Civil Defense members.
Copies of the trailer park ordinance from Blaine were passed around.
The Fire Marshall stated that he had looked over the situation at Flanagan's
and Schwankl's.and found no problem. Mr. Schwankl stated that he had planned
on building a loading platform for his oil tanks along the adjoining fence;
also, that the garage couldn't be seen from Highway 8. Mrs. Flanagan stated
that they had plans to connect the two garages into one large building.
Mr. Schwankl complained that the eave hung over his fence and water would
drain on his property. Mrs. Flanagan was willing to cut off the eave. After
more discussion, it was decided that it would be necessary to establish the
boundary line by survey. Mr. Bohjanen thus moved that no permit be issued
for the garage until the line is definitely located by survey. Seconded by
Mr. Rosengren. Carried unanimously.
Mr. Cardinal then moved that the Building Inspector issue the necessary permit
when proof of the line is established, that is a certificate of survey. The
Building Inspector should check for irons, if there, no survey is necessary.
Also, the eave should be cut off on east side before the permit is issued.
Seconded by Mr. Rosengren. Carried unanimously.
Mr. Locher was asked to write to the Northwest Saddle Club for collection of
rezoning fees.
Motion by Mr. Jaworski, seconded by Mr. Cardinal to pay the bills as audited.
It was stated that Dick Olson is not living in his trailer.
Motion by Mr. Bohjanen, seconded by Mr. Jaworski to adjourn at 10:33 p.m.

The special hearing for rezoning and special use permits for Kenneth Rehbein and
Floyd Miller was called to order at 8:03 p.m. on September 23, 1968 by Mayor L'Allier
with all Council members present.
The first order of business was in regards to Mr. Ken Rehbein's request for reson-
ing of 30 acres at Fourth and Pine from residential to commercial. The affidavits
of publishing and posting of notices of the hearings were shown. The portion of
the Planning and Zoning Commission minutes regarding their approval of Mr. Rehbein's
request was read. There was no discussion from the audience on either his request
for rezoning or a special use permit for an indoor arena.
W. Cardinal then moved that Ordinance No. 6K be adopted, setting forth the rezon-
ing from residential to commercial use of the following property:
The West three - fourths of the Northwest one - quarter of the Northwest
One- quarter Of 3/4 of NW 1/4 of NW 1/4) of Section Five (5), Township
Thirty -one (31) Range Twenty -two (22), Anoka County, Minnesota
belonging to Mr. Ken Rehbein, and that he be granted a special use permit to con-
struct, maintain and operate, according to law, a riding stable and horse show
arena, and necessary structures and improvements incident thereto on said property.
Seconded by Mr. Bohjanen. Carried unanimously.
Upon being asked how soon he would start building, Mr. Rehbein produced drawings
showing a pole -type building about 80 by 250 feet to be constructed east of his house
