HomeMy WebLinkAbout12/23/1968 Council Minutes1 107 The Lino Lakes Village Council meeting of December 23, 1968 was called to order by Mayor L'Allier at 8:12 p.m. with all members present except Mr. Rosengren who arrived late. The following corrections were made to the December 9 minutes: Page 2, paragraph 3 -- last sentence should read - -Mr. L'Allier mentioned that we should be sure that the County plows Harold Hansen's road. Page three, paragraph eight should read -- Mr. Jaworski moved to authorize the purchase of outside telephone bells with a cut -off switch to be used at the Constable's homes. Page four -- paragraph three, last sentence should read - -He also asked that the names of owners of unsightly property be given to the police department for inspection. Mr. Jaworski moved to accept the December 9, 1968 minutes as corrected. Seconded by Mr. Cardinal. Carried. Mr. Cardinal moved to approve cigarette license applications for the following: Henry Rosengren, Ruth Cegla, Henry J. Speiser, and Jimmy C. Aragon. Seconded by Mr. Bohjanen. Carried. The 1969 bid from the animal control officer, Bruce Fleming, was read; there was no change over that of 1968. The Clerk stated that the following persons still had outstanding fees: Mr. Wm. Bloom - quist, Mr. Ed Wiener, Mr. R. A. Claggett, and Mr. Florian Kedrowski. Mr. Cardinal moved that the Clerk send letters to these persons reminding them of overdue fees. Seconded by Mr. Rosengren. Carried. After presenting the materials on voter registration provided by the League, the Clerk was asked to contact Mrs. Kuderling to see whether there was a printer who had the card forms already set up for printing. Mr. Bohjanen moved to authorize the purchase of 100 auto theft report blanks for the police. Seconded by Mr. Jaworski. Carried. The Clerk presented the estimated fund balances for December 31, 1960, showing the ex- pected liquor license receipts, etc. along with a transfer of $5,000 from Parks to Roads resulting in the following: General -- $2120; Parks -- $3284; Roads- -$950; Gopher- -$792; Fire -- $2546; Civil Defense - -$688; Debt Redemption -- $7745; Total funds -- $18,125 about $10,378 above December 31, 1967. No action was taken on the transfer. Mr. L'Allier thanked the Council members for their efforts in holding down the spending in 1968. The Clerk mentioned that Mr. Goebel of Art Goebel Ford in Coon Rapids had stated that the 1949 truck traded to them had probably been junked out.; Mrs. LeTourneau had called to state that the wrecked cars had been removed the day after Mr. Myhre had been there and that any other cars on the premises belonged to the new owner or were in Circle Pines. Two single and one double file boxes had been ordered for voter registration cards at a cost of $25.76. A letter announcing a course in "Metropolitan Problems" to be taught at Anoka- Ramsey State Jr. College was read. Mr. Cardinal moved to set the office hours for the Clerk - Treasurer for 1969 to be from 10 am - 2 p.m. on Monday, Wednesday, and Friday and from 7 -8 p.m. on Tuesday, evenings until June 1, when she will go to a five -day week with the same hours. Seconded by Mr. Rosengren. Carried. The Planning and Zoning Board minutes were read. 0 Mr. Howard Speiser appeared before the Council to request a variance for a lot less than 2 1/2 acres in size on Birch Street. Mr. Cardinal moved, upon the recom- mendation of the Planning and Zoning Board, to grant a variance to Mr. Speiser upon the property described as follows: The South 229.74 feet of the East 104.35 feet of the West 744 feet of the NW 1/4 of the SW 1/4 of Section 29, Township 31, Range 22 in Anoka County Minnesota; said distances being measured parallel to the South and West lines of said NW 1/4 of the SE 1/4; subject to an easement for road purposes over the Southerly 33 feet thereof. Seconded by Mr. Bohjanen. Carried unanimously. Another representative for the Rural Cooperative Power Association of Elk River was present to answer questions on the line to cross Lino Park. He stated that there was a rate of $175 per lot compensation for the overhanging line and also compen- sation for any poles placed on the property. A 75' easement is necessary so that the company can clear tree branches. He said the company was reasonably sure that they could maintain a 40' minimum height over the 1000' span. The Council requested a letter from RCPA indicating whether the company maintains responsibility for any damage should the line become severed. Mr. L'Allier appointed Mr. Rosengren and two people of his choice to appraise the park property for the compensation due for the line and to report the findings at the next meeting. At 8:54 the hearing for a special use permit and rezoning for Molin Concrete Products Company was called to order. Mr. Gotwald was asked for his thoughts on necessary screening between the company's land and Twitchell Cemetery. He thought the nicest screening would be a combination of lombardy poplar or lilac bushes with spruce or other evergreen; a manual is available. Mr. Locher stated that proper notices had been mailed and published and all prerequisite requirements had been met for the hearings. The representative stated that a total of five acres (260' z 830') was being held for the cemetery; this left 55 acres for Molin. The correct legal description involving the five acre parcel will begiven to Mr. Locher to publish once in the paper. After discussion Mr. Cardinal moved that Ordinance 6L be adopted, and that a special use permit be granted to Molin Concrete Products Company to construct, maintain, and operate, according to law, a concrete products manufacturing operation, in- cluding all necessary structures and improvements incident thereto on the lands situate in the Village of Lino Lakes, Anoka County, Minnesota, and which are de- scribed in Ordinance 6L with the stipulation that adequate screening (to be worked out with the Engineer) be provided across the west and north sides of the Twitchell Cemetery. Seconded by Mr. Rosengren. Carried. Mr. Bohjanen moved to adjourn the hearing at 9:06 p.m.; seconded by Mr. Jaworski. Carried. Mr. Stockstead, who had previously appeared concerning a rezoning at the Southeast corner of 35E and Main Street for construction of a DX Sunray Travel Mart, asked for hearings to be set. Since the P&Z had approved his request, a special hearing was set up for Mr. Stockstead before the P&Z on January 15, 1969, at 8:30 p.m. and a hearing before the Council on January 27 at 8:30 p.m., on a motion by Mr. Cardinal seconded by Mr. Jaworski. Motion Carried. Mr. Stockstead was advised that a variance could be requested at that time, the lot being only 1.7 acres in size. Mr. Gotwald stated that he was present at this meeting because he would be unable to attent the first meeting in January. He presented the up -to -date actual zoning map. Mr. Cardinal moved to accept this map as official zoning map of the Village subject to any subsequent additions and revisions. Mr. Gotwald agreed to update the map at each rezoning. Seconded by Mr. Rosengren. Carried. 1 109 Mr. Rosengren was authorized to see that someone put the map into the frame and cover it with plastic. Small copies of the map were recommended to be sold at 25 each. Mr. Gotwald also presented the proposed zoning map, showing two large areas of industrial zoning as well as areas for multiple dwellings, etc. Mr. Jaworski moved that this proposed zoning map be returned to the P&Z Board by way of a letter from the Clerk to Mr. Cardinal, giving the explanation of the urban codes, etc. asking the P&Z to work from it and come up with recommendations for comprehensive zoning by a target date of September 1969. Seconded by Mr. Bohjanen. Carried. Mr. Car- dinal commended the P&Z and Mr. Gotwald for their work on this map. Mr. Rollie Anderson, County Surveyor, spoke on the tie- corners being placed in Lino Lakes, telling of the difficulties where the lakes are involved, etc. He stated that 84 per cent of thecorners are now tied in the Centerville and Lino Lakes,area; the crew had made a good gain in 1968. He presented reaps showing the corners presently tied for the county as well as several other new highway maps. He asked that the County be advised whenever sewer work or other work involving earthmoving equipment beinvolved so that the corners tan be protected. Mr. Rosengren moved that the Clerk order three sets of plat map covers from the County at a cost of $4.80 per set. Mr. Anderson will give these to Mr. Locher to deliver. Seconded by Mr. Cardinal. Carried. The Park Board minutes were read. Mr. Jaworski read a list of accomplishments of the Park Board in 1968 and thanked the Park Board for their endeavors. After discussion of the snowmobile problem in the parks (killing seedlings, etc.), Mr. Jaworski moved that signs be put up and notice put in the paper that snowmobiles and motorcycles be banned from the park properties. Seconded by Mr. Cardinal. Carried. Mr. Jaworski stated that Mrs. Forrest Tagg had resigned from the Park Board due to lack of time to attend the meetings. No successor was recommended. Mr. Jaworski moved that a letter be written to the State Highway Department asking that the snowplow crews exercise more care in plowing the intersection of 326 and Fourth since the north side of the intersection is always blocked after the plowing. Seconded by Mr. Bohjanen. Carried. Mr. Bohjanen reported that the C&BDC were still considering the plumbing code- -when they are finished they will turn the booklet over to the P&Z. The Lexington Fire Department will burn the house at Elm and Highway 8 on December 28 or 29 if there is no snowstorm. The building is the second oldest building in Anoka County, having once served as a way station and post office at a different location. Mr. Bohjanen reported that the survey was finished on the questionaire sent out to persons who had requested to build businesses in Lino Lakes and then changed their minds. The results of the questionaire were presented in a letter, part of which was read. Mr. Bohjanen then asked that the C&BDC be allowed to meet with both the Engineer and the bonding consultant sometime in January ,.or February so that policies of both could be set forth to businesses. After discussion it was decided that the 12 persons answering the questionaire be invited to attend a meeting with the Engineer, Bonding Consultant and the Council. Mr. Bohjanen also stated that the brochure was ready for a rough draft and a letter is being prepared. Mr. Rosengren reported that they are still working on the County's bills;, there are some mistakes in it. The Village is now stockpiling sand and salt, purchased from Ashbach in White Bear Lake, at $1.70 per ton. Bid forms for seal- coating work will be sent out early in March. They hope to have the overall plan for road work ready in the spring. Mr. Gotwald mentioned that the manager from Shoreview had applied for a grant for sewer from NSSSD in County Road J from Lexington to Highway 49. They will send us a letter asking whether lino Lakes is interested in joining the line at J and 49, in which case a 60" line will be installed rather than a smaller one just for Shoreview. Mr. Cape, Civil Defense Director, listed the accomplishments of the CD in 1968, thanking all those who had helped. Mr. L'Allier thanked the CD for their fine work, stating that they and the Auxiliary were among the most active in the County. Also, Mr. Cape is taking courses to qualify himself as a certified CD Director. The Clerk was asked to send letters to the CD and Auxiliary telling them that we appreciate their activity and we encourage their participation in 1969 and offer any help we might give. Mr. Bohjanen agreed to meet with Commissioner Burman to establish a fair price on Lot 2, Block 4, Lexington Park- Lakeview. Mr. Locher stated that he had a letter from the County Attorney stating that he had found no records in their department concerning ownership of Town Road (Baldwin Lake Road) bordering Baldwin Lake and therefore disown it. However, they will conduct more investigation. Mr. Locher had also talked with Bob Johnson, Jr., of the County Attorney's office who feels that the road south of Centerville Lake should go straight from the Park to Centerville Road and also that the County should maintain such a road. They are still studying the matter. Mr. Locher stated that the Village had no liability to mailboxes. Mr. Jaworski moved that a letter be written to the County Commissioners asking that they have the State establish a speed limit on Cty. Rd. 14. Seconded by Mr. L'Al- lier. Carried. Mr. L'Allier moved that effective Jan. 1, 1969, the Mayor appointes Elwood West to be the Senior Constable responsible for the keeping of all records; and that the Clerk be authorized to immediately advertise the hiring of an assistant Constable at $75 per month with a deadline of January 15 for the taking of ap- plications, these to be turned over to the Personnel Commission to have a recom- mendation for the Council be January 27th. As soon as this man can be trained we will take applications for a second man as assistant constable at $75 per month. Thus, with four men on the force a rotating schedule can be set up. Seconded by Mr. Jaworski. Carried. Mr. L'Allier listed accomplishments of 1968 including the new existing zoning, proposed zoning and thoroughfare maps, sewer study with Centerville, new park and taxi ordinances, new businesses, option on 30 acres of land, etc. He thanked the Council members for their work, stating that we could not be satisfied with what had been done, but must strive for more. Mr. Cardinal moved to pay the bills as audited. Seconded by Mr. Jaworski. Carried. Mr. Jaworski moved to adjourn at 11:00 p.m. Seconded by Mr. L'Allier. Carried.
