Members present: Ross, Speiser and Backlin. Clerk Zelinka absent. Minutes of the previous meeting were read and corrected. Motion by Speiser second by Backlin to accept minutes as corrected. Carried. Treasurer's report was read. Motion by Ross, second by Speiser that the clerk and treasurer purchase 2,500 treasurer receipt forms from Miller Davis Company, or elsewhere, if a lesser quantity can be printed. Carried. Mr. Gotwald reviewed a map from the Minnesota Highway Department consti- tuting a general layout plan of the proposed Highway 35W. Council questioned Highway 8 exits and entrances, elevations and drainage. Motion by Backlin second by Ross, to ask for a drainage ditch from the 7100 block of Sunset Avenue to the creek. Carried. Mr. Gotwald stressed the map was a general plan and the Council would be able to approve a "construction plan" later. Upon reviewing a proposed 35W bridge at County Road 14, it was noted three residents would be affected by the lack of a service lane. Mr. Gotwald stated that the highway department claims the department does not intend a service road. Mr. Charles-Cape, one of the land owners involved, stated to the best of his knowledge, he had signed a settlement of house and property and not roads. He understood there was to be a service road. Motion by Ross, second by Backlin that Gotwald would contact Mr. McCubrey of the state highway department and ask for his presence at the Council meeting of February 28th with the residents concerned in the matter to be in attendance. Motion carried. Mr. Backlin reported on the down-grade condition of E. Holly and West Rondo Roads. Backlin motioned to have Mr. Ralstead maintain E. Holly Road, with a pony grader, as this would be more economical than Columbus Township with their heavy equipment. No action was taken. In a discussion regarding the contractor's responsibility in restoring damaged village roads after their use as haul roads during the construction of Highway 35E, Mr. Gotwald suggested the village post the roads for 3-5 ton limits. At such time as the contractor contacts the village for an over-load permit, the Council in turn could ask for a bond covering probable damage of the roads to be used. Motion by Backlin, second by Ross, to post 140 E. Holly and W. Rondo Roads, the same as any other village road, as per the engineer's instructions. carried. Mr. Backlin reported 14 holes in various locations had been dug through the frost line to benefit drainage, and that culverts installed last fall in the Lakeview area have been very satisfactory. Mr. Speiser asked the attorney for an opinion on the legality of the "49" Club selling set-ups on Sunday. Mr. Locher said a State Law passed in 1961 forbids this practice, but felt interpretation of the law was broad and opinions varied from the Liquor Commission. Officer Raymond reported the "49" Club claims the set-up serving was granted by the Commission. Ross motioned, seconded by Backlin to secure an opinion from the attorney General through the Anoka County Attorney's office as to whether or not an establishment may sell set-ups and allow consumption, but not sale of intoxicating liquors on their premises on Sundays. Carried. Mr. Domning stated no more sales until the matter is clarified. Ross questioned the present practice of accepting two 3- payments for the liquor licenses in the village, as collecting on delinquent payments offers a serious problem. Locher read Section 4, Subdivision 1 of our Liquor Ordinance #31, which states in part "an application for a license shall be accompanied by a treasurer's receipt in full payment." Ross motioned to rescind Council's previous action of June 23, 1964, which allows partial payments, by operating according to Ordinance #31, second by Speiser, carried. Officer Raymond was asked to check on the dance license for the Apple Inn. In a discussion pertaining to a bouncer being present at public dances in the Village, the attorney read from Ordinance #12, which states only dances charging admission would be subject to police or deputized subor- dinate in attendance. Ross motioned, seconded by Backlin to change Ordinace #12 and for the lawyer to draw up an amendment. Carried. Ross requested Council's permission to buy aerial maps, which would aid the village assessor. Cost of the map's would be $28.00 a set. Permission granted. Ross also questioned what control the village would have over industrial parks. Whether or not the village could restrict to industry only, with no rezoning. Mr. Locher would check into this. Ross reported he had been investigating costs of an insurance package for the village. Speiser suggested we try for a village insurance man. Ross motioned the deputy clerk purchase a file cabinet with lock, second by Backlin. Carried. Ross also requested use of the Village Hall on March 1, from 8:00 to 9:00 p.m. for the D.F.L. caucus. All in favor, carried. Mr. Domning reported on the special gas meeting with the Circle Pines Utilities held on February 8th. A resolution drawn up from the meeting met with objections and corrections from the future gas users in attend- ance. A letter from the Citizens committee was presented and read, stating their wishes in the matter. A new resolution was composed, which read as follows, (in essence: "a feasibility study in 30 days, the purchaser's contract amended to read an intention of use until construction is com- pleted and construction completed by heating season of 1966; also instal- lation of a continuous one source gas line." Motion by Domning, second by Speiser, the new resolution on gas be accepted. Carried. 141: A report from the Personnel Commission was presented and read. Ross moved, second by Backlin, to file and study the report. Motion carried. Mrs. Michaud, a resident, questioned the Council as to what authority the Building Inspector Dupre had. Dupre had tagged Michaud's building for faulty construction, whereupon the contractor quit. In an ensuing District Court Case against the Contractor, based on Inspector Dupre's authority, the Michaud's lost the case. With more details, Locher advised the Michaud's to a Civil Court suit. Motion by Speiser, second Mr. Locher read Ordinance Motion by Backlin, second Motion by Ross, second by by Ross, the bills be paid.
