Lino Lakes Council meeting of May 23, 1966 called to order at 8:00 p.m. by Mayor Domning.
All members present.
Minutes were read, corrected and on motion by Ross, second by Backlin, accepted as read.
Motion carried.
Mayor Domning introduced Mayor Ed Ramsdall of the City of Blaine, who spoke on the
proposed Anoka County Municipalities Association. Although this is a volunteer group,
Mayor Ramsdall felt they could offer considerable help on problems arising with the
rapid growth of Anoka County. A copy of the proposed financing for the group was left
with the Council.
Mr. Shaughnessy and Mr. Hawkins were present from the East end of the Village to voice a
protest against allowing a public dump to be created in an old gravel pit. In support of
his protest, Mr. Hawkins stated he had talked to the St. Paul Water Department who were
opposed because of the proximity of the dump to Lake Meade. He felt the Highway Department
would voice an objection, if approached, because one bank of the pit would be the frontage
road for 35E. Mr. Hawkins also felt the Conservation Department and the Water Polution
Control would be interested in this situation if it were brought to their attention.
Mr. Ross replied the Planning and Zoning Board have already been approached by Mr. Herbst
and his Attorney, Charles Weaver, for permission to operate such a dump, however, the
matter has been turned over to the Water Polution Board, and nothing further will be done
until they make a decision.
The Clerk read a letter from the Northern States Agency stating the bond for the
Nathe Brothers had been reinstated and would be reissued on the due date of June 30th.
Locher explained he had investigated the original letter and now found the policy in
order covering the Nathe's with the required liquor liability insurance.
Ross inquired if an Attorney General's opinion had yet been received on the "set up"
license for the Nathe's. Locher replied that although nothing definite has been put
in writing, the opinion from the County Attorney's office is that a conflict still
appears to exist within the Liquor Commissioner's office, and the law itself is vague
to the point where if any business wishes to remain open on Sunday to serve set -ups,
that no disciplinary action will be taken.
Locher also read Section 4, Subdivision 3 of Ordinance 11 setting up fees for liquor
licenses, and recommended that it be corrected to indicate what fees will be charged
after 1966, and to also increase to a minimum of $50$100,000 on insurance protection.
Locher will prepare an amendment, which if passed at the June 13th meeting can still be
published and in effect by June 30th when the new licenses are issued. L'Allier
recommended the Council consider $100/$300,000 protection, as there was very little
difference in the premium for the amount of increased protection.
The Clerk read a resolution passed by the County concerning assessments on park areas.
Since this does not immediately affect the village, no action was taken.
The Treasurer passed out a written report on fund balances, and following discussion,
Ross moved, with second by Backlin, that we transfer $4,000 from General to Roads &
Bridges, until the June draw is received. Motion carried.
Mrs. Juleen also requested that the audit books be corrected to show Mrs. Dupre as the
Treasurer during 1965.
Upon recommendation of Mrs. Juleen that (1) cancelled checks from 1930 to 1955, (2)
verified claim accounts from 1950 to 1953, (3) School survey records previous to 1940,
(4) election data from 1936 to 1940 and check stubs from 1955 to'56 be destroyed,
Locher drew up a resolution showing the Council's approval of such action. The Minnesota
Historical Society will be contacted to see if they are interested in the school survey
records.

Backlin asked Locher if any decision had been made concerning right -of -way of Mr. Thies.
Answer was nothing yet, Locher and Gotwald had both contacted Mr. Fleming the attorney,
but no indication has been made by him that Mr. Thies is available for a meeting.
III Locher also stated he had spent considerable time checking the land of Lundbergs, and
can find nothing about easements that definitely defines this area. The only conclusion
arrived at was that if the village had been maintaining the road for at least 6 years,
then a cartway easement would have been established.
Backlin discussed asking the County to take over a short portion of 80th Street, which
is a continuation from the county line across the new bridge. Will try to set up a
meeting with the County Commissioners to discuss this.
Gotwald discussed working over that portion of Lakeview in front of LaRock's to get rid
of the water problem. One way would be leveling and bituminous coating at a cost of
approximately $1,500.00, an alternative would be running a ditch through with 24'
culverts which would run $500 to $600.00. He also suggested that all dirt removed could
be hauled to Ware Road and used for fill.
Backlin felt we should consider doing the work with our own equipment,and suggested
tabling the matter until the entire Council could meet on the location and further discuss
the best method to be used.
Gotwald stated he had checked on the culvert in front of the Youth Center, that it had
been replaced with a large size permanent culvert and was operating satisfactorily.
Locher had tried to contact Mr. Hamblin of the Water Department, but would have to meet
with him when he returned from vacation after June 1.
III Ross reported that at the Planning and Zoning meeting on May 18, several things were
taken under consideration. The Plumbing and Heating code was discussed and the
Planning committee has a recommendation for the Council to consider. He moved that we
turn this file over to our attorney to put into legal language for us to discuss.
Backlin seconded, motion carried. Locher stated this could be handled by a hearing
rather than a resolution and ordinance.
Ross also moved that we continue our clean -up efforts and that the police enforce a
conclusion to those notices of violation which have been issued. Second by Backlin,
motion carried.
L'Allier reported he had talked to Mr. Lasch of District 12, and the school will use
the park beginning June 16 through August 15, Monday through Friday, 9 am to 12 noon.
They would also like to use the park building and will provide supervisors. I would
recommend permission be granted to the school district and Mr. Lasch for this purpose.
Second by Domning, motion carried.
Ross again suggested putting two more lights into the park, and this will be further
looked into.
Downing reported he had contacted several men at Northern States Power relative to
purchase of gas for the village, however, NSP felt the Federal Power Commission would
not go along with this since two suppliers were already in the area. I have read again
the original franchise given us for study by North Central, and which can be reworded.
III I think it is the Village's place to prepare a franchise and offer it to them.
A petition was handed to the Council at this point by Bill Bohjanen signed by approxi-
mately 315 people who asked the Council to consider private gassupplier rather than
Circle Pines Utility Company.

L'Allier moved that we have our attorney begin negotiations with Attornts Maun &
Simon of North Central to prepare a franchise which the Council can give to North
Central. Zelinka seconded, motion carried.
Domning set a special meeting for Friday, June 3 at 7 :00 p.m. to go over this
franchise before presenting it to North Central.
Ross also reported that a special hearing will be held on the 13th of June in
Anoka County Courthouse regarding the splitting of Lot 11 on North Road and Lakeview.
The present covenant on the properties of the Lakeview Area doesnot permit such
splitting until 1975.
Backlin moved we pay the following bills, second by Ross, motion carried.

xxxThis meeting was held on Thursday, May 26th, at which time Ross moved we have
Gotwald and Backlin proceed with ditching and whatever is necessary to correct the
water situation on Lakeview. Second by Backlin, motion carried.
The Council also inspected the construction where started at the corner of Elm and
Sunset, and discussed with the engineer the possible water problems that may arise.
Second Avenue was inspected, and the possibility of having the County come in with
heavy equipment to grade through from Elm to Highway 8 was discussed.
