HomeMy WebLinkAbout08/22/1966 Council Minutes170 Lino Lakes Council meeting of August 22, 1966 was called to order at 8 p.m. by Mayor Domning. All members present. Minutes of the last meeting were read. Motion by Backlin, second by Domning to accept the minutes as read. Motion carried. Mr. Locher reported on progress to clean up conditions on the Windom realty property at 6981 Sunrise Avenue. A representative of the company had failed to appear at the Council meeting as requested. Motion by Ross second by Damning to contact the village health officer to check the premises. Motion carried. 1 Mr. Anderson, of the Anoka County Surveyor's Office, reported their progress in the county and our village on a remonumentation program for horizontal control of land. All section corners will be located and/or permanently marked. This work began in 1959 and will be completed in another t to 7 years. Mr. Anderson requested the village notify his office if any markers are damaged through road maintenance etc. A criminal offense exists where any of these monuments be defaced or removed. Clerk Zelinka reported Mrs. Sarner's concern as to her reappointment to the Village Assessors position. Mrs. Sarner must begin her bookwork before the end of 1966. Motion by Ross, second by Backlin to reaffirm Mrs. Sarner's appointment from January 1, 1966 for 2 years as Village Assessor. Motion carried. Mrs. Peters, co-owner of Red Floor Inn (now DBA/Knotty Pine Inn) had contacted the village in regards to I.S.P. checks, picked up morethan a year ago by then Councilman Irving Anderson and turned over to Mr. Locher. Mr. Locher had previously assured Mrs. Peters the village can do nothing about the situation, but would check into her complaint again. A letter was read from Johnson Bros. Construction stating the company is posting an additional 10,000 performance bond to cover restoration of Rondeau Lake Drive used as a haul road in borrow pit operations. Treasurer reported a balance of $24,714.74 plus $5,000 in bank certificates. Backlin motioned, second by L'Allier, to purchase an additional $5,000 in certificates. Motion carried. Mr. Locher reported on the long standing Judicial Ditch #3 situation. He had written to two judges and received no answers. The Anoka County Auditor's Office had advised that the Washington County Attorney should initiate proceedings for settlement. Motion by Ross, second by Domning, the submitted list of 12 names for the September 13th election board be approved. Motion carried. Mr. Backlin reported continuous rain was causing muddy roads and slowing gravel work. Motion by Domning, second by L'Allier for Backlin to get a bid for sod to complete ditch work on Lakeview Avenue and Gladstone Street. Motion carried.. A decision was made to have the N.W. Bell Telephone Company designate on a village map their below ground cables. A meeting had been held with Mr. Thies, adjacent land-owner to the south of 77th Street. As Mr. Thies had been uncooperative, Mr. Backlin stated three alternatives in the matter; 1. Establish a center line for the road and take 33 feet either side as a right -of -way. 2. Condemnation proceedings. 3. Purchase 1 rod of land from Mr. Thies for $300.00. Mrs. Marier, adjacent land -owner to the north stated her desire to have the road repaired and willingness to donate the necessary right -of -way providing the road be relocated farther to the south. L'Allier moved, with second by Ross, to have Gotwald survey from Mr. Thies' north property line to establish the road's centerline and report his findings. In addition, Mr. Backlin may purchase, if necessary, land for rightof -way not to exceed $300.00. Motion carried. Mr. Locher advised that since ownership is not registered in Thies' name, the deed must be signed by former owners and Mr. Thies if the land purchase is made. Gotwald reported that Viking Construction Company, low seal coat bidder, had not posted a performance bond after a 15 to 20 day wait. Gotwald ltd notified the company the contract was null and void. Mr. Backlin motioned, second by Ross, to award the work to the next lowest bidder, Schifsky Con- struction. Motion carried. Gotwald and Backlin had checked the request made by Mr. Ficocello for removal of a culvert at 7942 - 4th Avenue, and advised securing a signed statement releasing the village from any resulting responsibility. Mr. Ross motioned to this effect. No action was taken. Mr. Locher suggested the Council establish an ordinance regulating the purchase of culverts. Peter Scherer stated the county roads in the eastern part of the village used as detours during highway construction were in bad condition. The White Bear School bus will not use 64th Street to the north unless the road is repaired. Backlin will contact the County Engineer's office in regards to repairs and ask the White Bear School District to send a letter to the County registering their complaints. Glenn Rehbein presented a plat of land abutting Highway 8. The land is 7 acre short of legal requirements and Mr. Rehbein requested Council's consent to a variance of Ordinance 21A. Ross motioned to permit the request with a resolution drawn up by Locher. Second by L'Allier, motion carried. Rehbein will send a copy of the resolution to the County. Planning Meeting minutes of August 22 were read. A discussion was held on the proposedland fill operations to be located on 38 acres at County Road 14, west of 4th Avenue. Ross reported the streets in the Baldwin Lake Motor Court were still in bad condition. Locher will contact the attorney for the Huntley's, owners of the location. L'Allier stated Centerville had requested our village join with them in efforts to oppose a variance for the discharging of sewage into Howard Lake by Forest Lake Village. A resolution to this effect,'signed by the village officials had been presented to Forest Lake. A copy of the reso- lution was read and placed on file. L'Allier reported he had looked at possible future park property owned by Mr. Miller constituting 72 acres on 7th Avenue. Mr. Miller will sell the complete location at $550 per acre. Mr. LaCasse will check on the valuation of the land with L'Allier. 1'T2 Locher advised there are no records for village roads and easements and if the village maintains a road for 6 years or more, the Village then assumes responsibility for repairs. Roadways of 33 feet had not been tested in the courts as yet. The Village is entitled to a 33 foot ease- ment on each side. Motion by Backlin, second by Domning to pay bills. Motion carried. All members present. Minutes were read, discussed and corrected. Ross moved, with second by Backlin, that minutes be accepted as corrected. Motion carried. A petition with approximately 60 names was .,presented to the Council by Elaine Jaworski against the proposed land fill dump in the vicinity of Main Street. However, since Rosengren has not yet requested a hearing before the Planning and Zoning Committee, Domning suggested we table the matter until such time as formal action is started. Ross moved we receive the petition and place on file for future reference. Second by L'Allier, motion carried.
