COUNCIL MINUTES

The purpose of the meeting was to discuss the moratorium,
Ordinance No. 01 - 92 enacted January 13, 1992.
Mayor Reinert explained that the moratorium was discussed at the
previous Council work session and because action could not be
taken during a work session, this special Council meeting was
called to further discuss the matter in an open forum and take
action if the full City Council deemed it necessary.
Mayor Reinert explained why the City Council felt it was
necessary to put the moratorium ordinance in place. He also
explained that a number of mechanical items have been developed
and put into place that will benefit staff and developers. Mayor
Reinert noted that the City did not appear to have a development
policy at the beginning of the year. At this time a policy has
been developed and is being enacted by Council resolution.
Mayor Reinert had previously asked that a study be completed that
would show what impact a proposed new development would have on
this City, the school district and the community. He suggested
that this study could be completed by the staff or by a
consultant. The study would be similar to the study recently
completed by the City of Lakeville. He proposed to discuss this
matter further.
Mayor Reinert asked the City Council how they felt the City
should develop. What would be a good balance between starter
homes and "higher end" homes? What should the "infill" policy
be? Now that the mechanics of development are in place, in what

direction should the City go?
The Lakeville growth study was discussed. Mayor Reinert
explained that he had talked to the staff and the staff feels
that they can put together a similar document "in house ". Some
computer software may be needed but is available. Mr. Schneider
explained that he has already developed much of the information
needed regarding utilities and this is already on computer. He
displayed a MUSA map and explained some of the information that
he has already developed and stored in computer files. Mr.
Schneider also explained that the staff feels capable of putting
together this document. However, time is a critical issue. Mr.
Schumacher said that from a legal standpoint, after the study has
been completed and accepted by the City Council, it should be
made part of the Comprehensive Plan or a plan of that nature.
Council Member Neal asked when the staff felt the study could be
completed. Mr. Schneider explained that it could be completed by
the end of the year and he still could deal with issues that need
his attention on a daily basis.
Mayor Reinert asked other Council members for their thoughts on
this matter. Council Member Bergeson said he had read the
Lakeville study and was in favor of preparing a study for Lino
Lakes. He noted that many times he has seen staff working late
into the evening and expressed concern about the time it will
take to complete the study. Council Member Bergeson said he had
no question about their technical ability.
Council Member Bergeson noted that some times studies start with
a conclusion and then facts are developed to support the
conclusion. He hoped it would happen in this study. Council
Member Bergeson suggested that the study be completed first and
then the policy developed next.
It was noted that the Lakeville study was completed with the help
of a large citizen group. Mr. Schumacher noted that the group
met diligently and the study was completed in a short time. He
also noted that there was input from the school district and
businesses as well as from the staff. Mr. Schneider felt that a
lot of input from the community would be needed. He also felt
that "what if" scenarios should also be developed.
Council Member Elliott said she felt it would be logical to
encourage an "in house" study and to get a great deal of input
from the residents. She noted that if the residents are involved
in developing a philosophy for growth, they feel they have had
some control of their own destiny.
Council Member Neal asked that residents be selected from

different areas of the City. He felt that the study is a good
idea and in effect this will give the City back to the people.
Council Member Bergeson asked that the staff be careful that
citizen input does not come to early. Mayor Reinert agreed and
said that once direction starts to develop, then citizen input is
needed.
Mayor Reinert asked about the development checklist developed by
Mr. Schneider. Mr. Schneider explained that this is a four (4)
or five (5) page document with about 75 to 100 steps to be
completed by the developer and staff. This document is now in
place and being used.
Mayor Reinert asked about the status of the Comprehensive Plan.
Mr. Schumacher noted that the public hearings on the amendments
will be held July 13, 1992. All adjustments should be adopted at
that time.
It was noted that the lot inventory list was in place.
Mr. Schneider explained that the "in fill" policy will be brought
to the July 8, 1992 Council work session. He outlined the policy
and noted that utilities cannot be extended beyond the current
MUSA boundary lines. He also noted that proposed development
within the MUSA boundary lines must be able to support that
portion of the utility system.
The Comprehensive Plan Amendments were discussed. Mr. Schneider
explained that a new zoning map will be brought to the City
Council for approval. This map will incorporate the new
Amendments.
Mr. Schumacher noted that the municipal facilities study was
completed. Fire Station No. 2 was listed as a priority in the
Study. The fire station is now complete. He explained that
development will greatly impact municipal facilities. Mr.
Schumacher noted that these facilities are very costly.
Mr. Schneider explained that the Sewer and Water Comprehensive
Plan is complete. He displayed a map which sets out boundaries
and limits of service for 30 years or more. He noted that the
trunk water system and the new elevated water storage facilities
are the result of this study and are also an attempt to put
capacity in reserve. Mr. Schneider explained that eventually
this City will require three (3) elevated water storage
facilities.
Mr. Schneider addressed developers agreements and noted these
agreements contain 24 items of financial guarantees. He

explained that with the help of the City Attorney, a single check
list of items is listed on one (1) sheet so that the
contractor /developer has a better idea of how much money is
needed to complete the agreement. Mr. Schumacher said that the
developers agreement and the development checklist help avoid
confusion.
It was noted that a surface water management document is still
needed. This should be completed before the end of the year.
Mayor Reinert noted that this is a busy period for the City. He
also noted that things do not always go well and mentioned the
Centerville /Lino Lakes consolidation matter, the annexation
proceedings and lawsuits. Mayor Reinert explained that when all
items previously mentioned are completed, the City can avoid such
issues in the future.
The City Council discussed extending the moratorium until all
matters are completed. Mr. Schumacher explained that the fiscal
analysis study could be outlined in a more specific form and this
outline brought to the Council for review. Mayor Reinert said he
did not want to continue the moratorium just for its sake but
would rather focus on specific needs. He noted that the needs 11
years ago are not the same today. Mr. Schumacher felt confident
that the staff could do the fiscal analysis study and still
complete work on new plats and other issues. He said the staff
could always come back to the Council if there was an onslaught
of new plats. Mayor Reinert asked that the entire process be
outlined and a time table attached.
Selection of citizen participants was discussed. Mayor Reinert
suggested that there be representation from the Planning and
Zoning Board, Park Board and the Economic Development Committee.
Council Member Bergeson said he felt that the fiscal analysis
study and the moratorium are two (2) separate issues. He felt
whether the study was started or completed on time was not
necessarily a reason to have a moratorium. Council Member
Bergeson also said he would like to see some money set aside in
the 1993 Budget to be used to complete the study if necessary.
Mayor Reinert asked that the study outline be completed to get
some idea how much money would be needed. Council Member
Bergeson said he felt that six (6) months was not very much time
to complete the fiscal analysis study and asked that the Council
be updated at every Wednesday afternoon Council work session.
Council Member Elliott moved to start the project of completing a
fiscal analysis plan for the City of Lino Lakes that will provide
a flexible guideline for development and the specific framework
for the plan will be brought to the City Council at the July 27,

1992 Council meeting. Council Member Bergeson seconded the
motion. Motion carried unanimously.
Council Member Neal moved to adjourn at 7:42 P.M. Council Member
Elliott seconded the motion. Aye.
These minutes were considered, corrected and approved at the
regular Council meeting held on July 27, 1992.
