SETTING THE AGENDA
Council Member Neal asked that Item No. 5, Minnesota Correctional
Facility be added to this agenda.
COMPLIANCE WITH CAMPAIGN REPORTING REQUIREMENTS
Mayor Reinert asked if all persons and/or committees have
complied with the City Ordinance and provided reports that were
due on December 2, 1993. The Clerk -Treasurer said that not as
yet. Mayor Reinert noted that this is a violation of the City
Code and asked that the matter be placed on the Council agenda
for Monday, December 13, 1993.
AMERICANS WITH DISABILITIES ACT (ADA) COMPLIANCE COMMITTEE REPORT
Mr. Volk introduced Ms. Dvorak who is currently the Lino Lakes
Therapeutic Recreation Coordinator. He noted that ADA has been
enacted by the Federal government and this City must make an
effort to comply with the requirements. Mr. Volk recommended
that the City Council consider appointing Ms. Dvorak as Lino
Lakes ADA Coordinator and also establish an ADA Compliance
Committee to work with her. The ADA Coordinator would coordinate
a plan to get this City into compliance with AdA also receive
complaints and make recommendations regarding the complaints.

Ms. Dvorak presented a draft of an ADA Compliance Committee plan
of action which indicates what she hopes the committee would do.
The plan includes items that should be done and deadlines that
must be met and the assessment of buildings and costs to bring
all buildings into compliance.
Council Member Kuether asked if ADA affects the commercial
development. Mr. Wessel said it probably does but not to the
same extent as public buildings. Ms. Dvorak explained that ADA
requires all public buildings to be surveyed and brought into
compliance.
Mr. Volk explained that he has already met with Ms. Dvorak and
Mr. Asleson and reviewed several ADA plans from other
municipalities. The City of Mankato has prepared a plan similar
to what is contemplated for Lino Lakes and it will be used as a
guide. A copy of the Mankato plan will be sent to the City
Council in their Council packets.
This matter will be placed on the agenda for Monday, December 13,
1993.
SURFACE WATER MANAGEMENT PROGRESS REPORT
Mr. Keehn used the overhead projector to present the progress of
the Surface Water Management Plan. He briefly noted that this
Plan has been under development for some time and the final draft
should be ready by Christmas and available at City Hall and the
Circle Pines Library for public inspection.
The draft includes a mission statement and a policy manual. This
plan is directed more towards regional ponding rather than
ponding in each separate subdivision. This will be different
than the current policy.
Mayor Reinert asked if areas that were built in a flood zone will
be addressed. He noted that this is a problem and causes
property values to decrease. Mr. Keehn explained how these areas
should be taken out of the flood plain area and the flood plain
maps revised. A procedure for implementing this will be included
in the Surface Water Management Plan. Mr. Keehn also gave a
brief history on how the original flood plain map was compiled.
Mayor Reinert noted that if this continues to be an issue the
City could be faced with a class action lawsuit because the City
issued building permits in a flood plain area. Mr. Keehn noted
that some homes were built prior to the start of flood insurance
and the owners may not even be aware that they•are now in a flood
plain. Council Member Bergeson noted that it is possible that
some high water marks have changed over time. Mr. Keehn

explained that the Capital Improvement Program portion of the
Surface Water Management Program recommends that the City update
the Federal Emergency Management Agency (FEMA) study and maps.
Mr. Keehn noted that water quality goals will be approached from
a regional standpoint rather than a local prospective. The
citizens task force will be established to set standards for
water quality.
Mr. Keehn explained that it has always been the intent that the
City will permanently take over the permitting authority as well
as records management and documentation.
Mr. Schneider noted that he had received a letter from the Rice
Creek Watershed District (RCWD) to the Board of Water and Soil
Resources (BWSR) indicating that they have elected to act as the
Local Government Unit (LGU) for the entire District beginning
January 1, 1994. However, BWSR is encouraging municipalities to
become their own LGU and declare that the municipality will
follow all wetland regulations.
Mr. Keehn told the City Council that a resolution is being
prepared to be presented to the City Council on Monday adopting
the permanent rules of the Wetland Conservation Act.
Mr. Keehn suggested that after the City declares itself as the
LGU, they may consider selecting several different firms who are
qualified to actually prepare wetland delineations. Council
Member Bergeson asked if RCWD is in favor or opposed to the
municipalities becoming their own LGU. Mr. Schneider said that
indications are the RCWD wants to continue to be the LGU. He
will be meeting with RCWD to go over the entire plan and talk
about implementation details.
Mayor Reinert asked if the preparation of the Surface Water
Management Plan was on schedule. Mr. Keehn said yes and
explained the progress of certain items in the Plan.
Mr. Schneider explained that timing is becoming important in
regard to ditch maintenance. State statutes read that if a ditch
has not been maintained by the RCWD within the past 20 years, the
land reverts to wetland. It appears that nothing has been done
by the RCWD with the ditches in Lino Lakes and the opportunity to
call RCWD to maintain the ditches is quickly diminishing.
Recently the City entered into a joint agreement to study the
ditches in the 4th Avenue area and we have verbal agreement from
RCWD for help in rectifying some ptoblems in this area. He was
told this help from RCWD is top priority.

Mayor Reinert noted that some funds are now coming into the
Surface Water Management Fund and asked if they could help reduce
the possible assessment to the landowners. Mr. Schneider said
yes and this fund will also fund studies on particular areas of
the City.
Council Member Bergeson noted that RCWD still is able to levy
taxes from Lino Lakes and if the City becomes its own LGU and
nothing is needed from the RCWD, will this levy continue. This
information was not known.
ANNUAL APPOINTMENTS
Mr. Schumacher handed to each Council Member a presentation from
the Assistant to the City Administrator listing all of the
positions open for appointment this year. The Park Board, and
the Planning and Zoning Board positions will be advertised and
those members whose terms are expiring will be asked if they wish
to be re -appointed.
Mr. Schumacher noted that the terms for the Economic Development
Authority Advisory Board (EDAAB) are for three (3) years and
currently they all expire on the same date. He asked the City
Council to consider staggering these appointments. Council
Member Bergeson explained that continuity is important and does
not happen when all terms expire at the same time.
Mayor Reinert said that he is considering appointing a Council
liaison to the Charter Commission. He felt this would help to
keep the two (2) entities in close contact. He also suggested
that the Charter Commission appoint a liaison to the EDAAB.
Appointments will be considered at the first Council meeting in
1994.
Minnesota Correctional Facility - It was noted that something
unusual is happening at this facility. The wood shop has been
closed or moved to another facility and there is talk of raising
the population to 1,000 persons. There will be a meeting at the
facility on December 15, 1993 at 1:30 P.M. to let the public know
what changes are being anticipated.
Agenda
The entire December 13, 1993 agenda was reviewed. It was noted
that the public hearing will involve Accu -Tool only and not Green.
Haven Press. That building -•project has been put on hold until
spring.
