CONSIDERATION OF TELECOMMUNICATION ORDINANCE, MARY KAY WYLAND/ALAN BRIXIUS Mr. Brixius explained that 1996 Federal Communications of personal communication services. Council discussed particular provisions of the proposed ordinance and then directed staff to prepare an ordinance extending the moratorium on the placement of wireless communications towers. Staff requested that Council review the proposed ordinance, especially page eight (8) and let staff know if there are additional questions. The ordinance extending the moratorium will be placed on the September 22nd agenda and the Telecommunications Ordinance will be placed on the October 8th work session agenda. PAGE 1 COUNCIL WORK SESSION SEPTEMBER 17, 1997 DISCUSSION OF PROPOSED PAWN SHOP ORDINANCE, OFFICER STEVE MORTENSON Staff explained that pawn shops have become very lucrative businesses. As inner cities adopt stricter pawn shop ordinances, the pawn shops tend to move to the suburbs. Staff is proposing adoption of a pawn shop ordinance now so that the City will be ready to respond to an application for a pawn shop. The ordinance would determine where pawn shops can be located and place restrictions on its operation. Copies of a draft Pawn Shop Ordinance were given to the Council Members. The ordinance proposed for Lino Lakes is a composite of the ordinances adopted by the City of Coon Rapids and the City of Minneapolis. The City Attorney has reviewed the draft and his comments were incorporated into the draft. Adoption of the draft ordinance would allow the City of Lino Lakes to become part of an automated computer system that would allow tracking of stolen items. Mr. Brixius noted that there is an effort to get each city in the metropolitan area to ado ordinances. Law enforcement agencies feel that this plan would make it dif len items in pawn shops. This matter will be brought to the next work session. CRIME PREVENTION MONTH, OCTOBER, 1997, OFFICER STEVE MORTENSON A proclamation has been prepared to proclaim October as crime prevention month. The proclamation will be on the September 22nd Council agenda. DISCUSSION OF TEMPORARY FRESH AIR RETURN DUCT FOR CITY HALL, TOM JACKSON At this time, there is no provision for the exchange of fresh air in the city hall. Since air quality in the city hall is a health issue affecting everyone working there, staff proposed PAGE 2 • COUNCIL WORK SESSION SEPTEMBER 17, 1997 that the Council consider purchasing a fresh air system. The cost could be $4,000 to $7,000. Staff was directed to prepare specifications for a fresh air system and advertise for bids. Staff was also directed to determine if air quality is a concern at the Police Department building and the Parks and Recreation building. This matter will be brought back to the Council when bids have been received. CONSIDERATION ACCEPTING TRAIL EASEMENT, CLEARWATER CREEK, MARY KAY WYLAND When the Clearwater Creek subdivision was approved by Council, a trail was shown running along the west border of the subdivision. Staff showed Council pictures of the area and noted that if the trail is to be constructed as platted, an old grove of trees would have to be removed. Council discussed relocating a portion of the trail to the east side of - of trees. This would place the trail closer to the new homes that will be ► - ed • ° those lots. Conditional Use rmit, Dean Quimby, 7313 Lake Drive - Although this area is zoned properly for Mr. Quimby's automotive repair shop, a CUP is needed to allow out -door storage of vehicles waiting to be repaired or serviced. UPDATE ON SEPTIC MAINTENANCE REQUIREMENTS, PETE KLUEGEL The City adopted an ordinance requiring that all septic systems be pumped and inspected every three (3) years. Staff mailed the first septic system compliance notices, which requires that the first inspection be performed before September 15th of this year. There has been good response to this notice. The septic pumpers have indicated that they have a backlog of pumping requests and will not be able to do all their inspections before the September 15th deadline. Staff asked that the deadline be extended one month. • Council directed staff to prepare an ordinance extending the deadline to October 15th. This matter will be added to the September 22nd Council agenda. PAGE 3 COUNCIL WORK SESSION SEPTEMBER 17,1997 CONDITIONAL USE PERMITS (CUP), PETE KLUEGEL Mr. Kluegel presented a list of current CUP' s. He noted that seven (7) CUP' s are inactive and recommended that they be removed from his list. Council briefly reviewed the list and directed Mr. Kluegel to bring this matter to the September 22nd Council meeting. PUBLIC FACILITIES UPDATE, BRIAN WESSEL Mr. Wessel and Mr. Schumacher will be meeting with the architect next Thursday to continue working on the plans for the public facilities. The eminent domain process with Mr. Ed Vaughan is proceeding and staff is currently negotiating with Mr. Funkhauser for easements over his property which adjoins the property where the civic buildings will be constructed. Council Member Bergeson noted that at the last EDAAB meeting, a suggestion was made to purchase Mr. Fundhauser's property. Staff will explore a land con 'lar to the Glenn Rehbein contract. DISCUSSION 0 INSURANCE BENEFITS, COUNCIL MEMBER BERGESON Council was given a memorandum written by staff, which provides a summary of Minnesota law regarding retiree health coverage. A copy of the law was attached to the memorandum as well as a copy of the Stanton Survey listing public agencies that do and do not offer and/or pay for retiree coverage. Council directed staff to gather additional information and bring this back to Council for further discussion. BRIEF DISCUSSION REGARDING AN ORDINANCE REGULATING THE SALE, POSSESSION AND USE OF TOBACCO, TOBACCO PRODUCTS AND TOBACCO RELATED DEVICES, MARILYN ANDERSON PAGE 4 • • COUNCIL WORK SESSION SEPTEMBER 17,1997 The State Legislature adopted legislation effective August 1, 1997 requiring all retailers who sell tobacco or tobacco products to be licensed. Counties will be required to implement a licensing system for retailers located in cities that do not have valid licensing ordinances. Cities wishing to maintain local control over tobacco sales will be required to adopt a licensing ordinance and any city that already has a licensing ordinance will be required to amend it to comply with at least the minimum standards imposed by the new law. Staff is aware of the new requirements and will be obtaining information from the League of Cities and other municipalities who have already adopted the new requirements. An amended Lino Lakes Tobacco Ordinance will be drafted and brought to the Council for approval. Council will be updated on this matter. Mayor Landers gave each Council Member a copy of a letter written by Attorney, Ann Goering regarding the Schumacher litigation.
