The purpose of the special meeting was to review the draft of the Ordinance. Council asked Mr. Brixius to highlight the changes at ar ro a the new Zoning Ordinance. SECTION 1. SUBDIVISION 2. The definition of Boundary Line Fencing and interior fencing were added. Page 1-18. The definition of Flood Profile was added. Page 1-19. Council Member Bergeson asked what is the difference between a mobile home and a manufactured home. Mr. Brixius reviewed the definitions. Subd. 1 (B). The 600 foot notification process was discussed. Staff has proposed minor changes to this section. Page 2-2. H. The 60 day review period and the extension of an additional 60 days was also discussed. State Statute specifically applies to this area. The responsibility for the notification of property owners or property occupants is discussed on page 2-20. Page 2-2. E. This section was not part of the original Zoning Ordinance. Council Member Kuether noted that when the Council denies a request, the request cannot come back before the Council for one year. Page 2-8. The term Interim Use Permits may need additional definition particularly since the Town Center may include shops with living quarters above them. Mr. Wessel explained that the Town Center will be a mixed use situation. Page 2-10, Subd. 4. Mr. Brixius was asked if 6(A) should include six (6) findings of fact. Council referred to the situation where some backyards along Lake Drive contain accessory buildings that seem too close to the street. Council suggested an item be added to the Ordinance requiring buildings to be set back at least a certain number of feet from the roadway. Page 3-8. 3A(1.) These are standards developed by EDAAB. Item 2B(1.). Mr. Wessel noted that if the City wishes to eliminate bus barns from this provision, Rehbein Transit should be notified. Page 3-11. Mayor Landers and Council Member Kuether were in attendance. Council Members Bergeson, Lyden and Neal were not present. Planning Coordinator, Mary Kay Wyland; Community Development Director, Brian Wessel and Clerk -Treasurer Marilyn Anderson were also present. A quorum of the Council was not present and this meeting was conducted informally. PAGE 5 SPECIAL COUNCIL MEETING JANUARY 14, 1997 Page 3-19. b(1). This item was changed to restrict the size of accessory buildings to a maximum number of square feet rather than one attached garage and one tool shed. b(4). The square footage in this section reflects a small increase. Page 3-24. Refuse and Recyclable Material. This section has been enhanced. Page 3-27. Exterior Storage. Exterior storage in Rural and Residential Districts were specifically detailed for parcels of less than 10 acres. Page 3-30. Required Fencing, Screening and Landscaping. Item No. 2. Council Member Kuether added the following statement: "The City assumes no liability for replacement of landscaping on easements". Item No. 3(a).
