Mr. George Lindy, Chair of the Park Board, stated the Park Board does not feel like they
have to sell the referendum. Residents need to decide whether or not they want to support
it.
Council directed staff to move forward with a spring referendum for the athletic complex
and neighborhood parks.

Administration Director Tesch asked Public Service Director DeGardner to contact
Councilmember Reinert and Mayor Bergeson regarding their opinion on a spring
referendum.
SSR & W MINOR SUBDIVISION REQUEST, JEFF SMYSER
City Planner Smyser advised that Mr. Willard Morton's firm, SSR & W Development,
LLC, owns property in Lino Lakes. The SSR & W property includes 80+ acres in Section
9. The application is to split off 11 acres from an existing 40 -acre parcel, and combine
the new 11 -acre piece with a one -acre strip that connects to Main Street. SSR & W
would then sell the new lot to allow for a new home site. Staff tands that Mr. Brad
Racutt wants to buy the property and build a new home.

point to providing future road connection. This would provide safe access and

subdivision ordinance supports this by prohibiting the creation of flag lots.
Access to the new lot will be from Main Street. As long as this is the access intended by
both the City and the applicant, it is reasonable to make the access a public right-of-way
that accomplishes a number of public purposes. In addition, it provides continued access
to the adjacent property.
Councilmember Carlson expressed concern because the City has already compromised
this plan as far as the road to the south. There is also a median on 77th that loses the

connection to Apollo. She stated the City is building a road that no longer has a
connection. She asked how the road would line up when asking for the 66 feet.
Mr. Tim Kytona, Surveyor, suggested the City grant access where the access is in lieu of
placing easements in place for roads. The flag lot would be an existing flag lot.
Councilmember Carlson asked about all the pine trees if the road was developed.

CSAH 49 RECONSTRUCTION UPDATE, MICHAEL GROCHALA/JOHN
POWELL
City Engineer Powell distributed a memo from Dick Thompson summarizing the
neighborhood meeting held on November 12. He reviewed the memo noting an

addendum was added to the October 29 meeting summary relating to the resident's
concerns and unhappiness with the road plan.
City Engineer Powell stated the plan is to bring a road design to the Council work session
on December 5, 2001. He stated he believes the County has compromised on some issues
and the speed study that was done did indicate the speed limit should be raised. A
context sensitive design is the tool to use to get the speed limit lowered to 45 mph.
Another neighborhood meeting will be held Monday, November 26, 2001.
Community Development Director Grochala advised he was present at the meeting.
Some of the citizens that are involved are unhappy and don't fee r concerns are being

Mr. Arnie Entzel, resident of Lino Lakes, stated it is rather disturbing because it sounds
like the plan is cut and dried. It sounds like there was nothing brought to the meeting by
residents that made a difference. Residents were willing to make changes. The problem
is the four -lane highway and that is what the residents thought the meeting was about. He
passed out a copy of what residents want for the roadway. He stated it is ridiculous for
people to lose their land for a four -lane highway that goes nowhere. The majority of
residents who attended the meetings are opposed to a four -lane highway and the meeting

summaries are not indicating that. The residents were led to believe that they would have
input to the road design. The only input residents have had is where to put the bushes.
Mr. John Hudgens, resident of Lino Lakes, stated he finds it hard to believe that Ramsey
County can do things that Anoka County cannot. Shoreview lowered the speed limit on
that roadway and it seems that they are still getting the turn -back funds. He stated he
feels that Anoka County can do the same things, but they don't want to. Residents were
told that the old design was out and the plan would start over. The road is still a four -(4)
lane road. The County did change the speed limit to 45 mph but did not change the
amount of right of way or the amount of lanes. He expressed concern regarding the
construction easement and noted residents do not want to lose th ees. The

City Engineer Powell indicated he will request a written statement from Ramsey County
regarding this issue. He will also ask the County if they can have 86 feet of right of way
if the City purchases the additional right of way. He noted -the City does have the need
for utility extensions down to County Road J.
Councilmember O'Donnell stated he is very concerned that if the City doesn't work this
out while it has a voice the County will do the project without City approval.

City Engineer Powell stated that after the meeting Monday night, he will ask the County
to develop the most narrow road plan that is acceptable and then the Council can vote on
it.

City Planner Smyser a ised when the Shirley Kaye's project was reviewed there were no
lights proposed in the parking lot. There was a discussion of lighting in relation to the
lake. The Police Department has since expressed concern regarding safety in the parking
lot. Staff would like to contact Shirley Kaye's to discuss the lighting issue. Staff would
prefer that they do not have to do the whole site plan review for just the lighting. The
Environmental Board and Planning and Zoning Board are agreeable to that as long as the
lighting meets the City ordinance. The City does not typically review lighting plans apart
from the original site plan review.

DRAFT INTERIM ORDINANCE PROHIBITING RESIDENTIAL
SUBDIVISIONS, JEFF SMYSER/MICHAEL GROCHALA
City Planner Smyser distributed a memo regarding the adoption of an interim ordinance.
He referred to the draft ordinance noting the purpose of the moratorium is to allow time
for the City to amend its ordinances to implement the Comprehensive Plan. He reviewed
the draft ordinance noting what the moratorium will and will not include.
Councilmember O'Donnell referred to the cover sheet that states "an interim ordinance
that will prohibit new residential ..." and stated the word "prohibit" indicates something
that is not in the spirit intended by the ordinance. He requested s change the wording.
City Planner Smyser reviewed the schedule for the interim ordin a ce no 't would be

schedule for Amending Official Controls. He noted it will s ction to extend
