MEMBERS PRESENT : Councilmembers Carlson, Dahl, O'Donnell, and Mayor Bergeson MEMBERS ABSENT : Councilmember Reinert Staff members present: City Clerk, Ann Blair; Director of Administration, Dan Tesch; and City Engineer, John Powell. SETTING THE AGENDA The agenda was approved as submitted. CONSENT AGENDA Councilmember Dahl moved to approve the Consen seconded the motion. Motion carried unanimous 110 ITEM , as submitted. Councilmember Carlson ACTION A. CONSIDERATION OF EXPE i) February 25, 2002 (Check 64434, $322,948.14) ii) Centennial Fire District hec No. 13077 - 13102, $240,019.18) OPEN MIKE Approved Approved Mayor Bergeson noted that members of the audience may be present this evening regarding a proposed ordinance related to Peltier Lake. He noted this item was not on this evening's agenda but will be considered at the Monday, March 11, 2002 Council meeting, during which the Council will be conducting a public hearing, providing an opportunity for affected residents to speak regarding the proposed ordinance. He invited members of the audience to speak this evening also during Open Mike. Jerry Lindner, 7413 Peltier Lake Drive, stated he was present this evening to speak on behalf of the majority of the Peltier Lake Association Board members regarding an ordinance proposed to the City Council at their work session on February 6, 2002, which would place some surface water useage COUNCIL MINUTES FEBRUARY 25, 2002 restrictions on portions of Lake Peltier. He stated the majority of the Peltier Lake Association Board met, per their bylaws, and passed a motion to come before the Lino Lakes City Council in an attempt to stop this ordinance. Mr. Lindner presented the Councilmembers with a letter of recommendation from the Peltier Lake Association Board. He stated that the Board has ample evidence to support the fact that the information presented to the Council has been presumptuous and misguided. He asked that a presentation regarding these concerns be scheduled for a future Council work session or meeting, prior to the March 11, 2002 public hearing. Mr. Lindner stated he believed that the Lakeshore property owners have not had an opportunity to discuss this issue, which he stated he felt was due to "secrecy" surrounding the proposal. Additionally, he stated the property owners have not been able to review the minutes of the February 6, 2002 work session, during which the ordinance was propose s to the Council. He stated many of the property owners feel they have been misrepresented by W » LeBlanc, and have expressed these concerns in letters, which he presented to the Councilmembers. Mr. Lindner stated he believed Mr. LaBlanc's intent was to _i restrictions on the northern portion of Peltier Lake, and to continue to pursue additional restother portions of the lake. He noted the Lino Lakes City Council has a proven track co .s of making fair and rational decisions based on all the facts and it was his hope that this wilco ue. Mr. Lindner stated he would do so. George Lindy, 6823 East Shado \ eake Drive, expressed concern regarding a letter submitted from the Lino Lakes Environmental Board to the City Council. He felt that unsubstantiated conclusions had been drawn from information provided to the Environmental Board and that the subject letter was somewhat the basis of the proposed ordinance. He supported Mr. Lindner's comments that this issue should be further examined prior to the public hearing and that public comment should be allowed during the March 6th City Council work session. Mayor Bergeson noted Mr. Lindy serves as the Chairman of the Park Board, but was in attendance this evening as a concerned citizen, not in representation of the views of the Park Board. Councilmember Carlson noted the February 6, 2002 work session minutes will be considered for approval this evening, providing the minutes are not pulled from the agenda. 2 COUNCIL MINUTES FEBRUARY 25, 2002 City Clerk Blair stated per request earlier today she had provided a draft copy of the February 6th meeting minutes to Mr. Lindner. Hal Wagner, 1525 Peltier Lake Drive, stated he has had many conversations with his neighbors regarding the proposed ordinance and all have asked whether the Peltier Lake Association Board has been represented with regard to this issue. Mayor Bergeson indicated Mr. LeBlanc had been in attendance during the last Council work session. He indicated that Mr. LeBlanc had identified himself as a member of the Association Board, but he was not certain whether Mr. LeBlanc had intended to be acting on behalf of the Association Board. UNFINISHED BUSINESS There was no unfinished business to consider. NEW BUSINESS CONSIDER APPROVAL OF MEETING MINUTES February 6, 2002 Work Session Minutes February 11, 2002, Council Meeting Minutes Mayor Bergeson noted there had been an in-depth discussion regarding the proposed Peltier Lake ordinance during the February 20, 2002 Council work session, however, those minutes were not on COUNCIL MINUTES FEBRUARY 25, 2002 the agenda for approval this evening. City Clerk Blair concurred and indicated draft copies of the minutes would be available upon request. Councilmember O'Donnell moved to approve the February 6, 2002 Work Session Minutes and the February 11, 2002, Council Meeting Minutes, as submitted. Councilmember Dahl seconded the motion. Motion carried unanimously.
