HomeMy WebLinkAbout05/22/2006 Council Minutes• • • LINO LAKES CITY COUNCIL PUBLIC NOTICE NOTICE IS HEREBY GIVEN, that the City Council of the City of Lino Lakes, Minnesota will meet at 5:30 p.m. on May 22, 2006, to discuss penalizing liquor establishments that have failed to comply with any provision or condition of the City Code or any state law or regulation governing the sale of intoxicating liquor. The City Council may consider suspending, revoking, imposing a financial penalty or requiring other conditions to continue business. This meeting will be held at the Lino Lakes City Hall, 600 Town Center Parkway, Lino Lakes, Minnesota. For questions or need special accommodations, please contact the City Clerk at 651-982-2400. Julianne Bartell, City Clerk SPECIAL COUNCIL MEETING MAY 22, 2006 APPROVED • 1 CITY OF LINO LAKES 2 MINUTES 3 4 5 DATE : May 22, 2006 6 TIME STARTED : 5:34 p.m. 7 TIME ENDED : 5:40 p.m. 8 MEMBERS PRESENT : Councilmember Carlson, O'Donnell, Reinert, 9 and Mayor Bergeson 10 MEMBERS ABSENT : Stoltz 11 12 13 Staff members present: City Administrator, Gordon Heitke; Finance Director, Al Rolek; 14 Police Sergeant, Bill Hammes; and City Clerk, Julie Bartell 15 16 LIQUOR COMPLIANCE HEARING AND CONSIDER PENALTIES. 17 18 Mayor Bergeson advised the purpose of the special meeting is to conduct a liquor 19 compliance hearing and consider penalties. 20 21 Sergeant Hammes advised the Police Department conducted liquor regulation compliance 22 checks at all Lino Lakes' liquor establishments. On February 24, 2006, the following 23 three establishments failed the compliance checks: 24 25 American Legion Post #566 26 Circle Lex VFW 27 Miller's on Main 28 29 Each of the above noted license holders have received notice. It is requested that the City 30 Council determine whether these establishments violated the Lino Lakes Code of 31 Ordinances, Section 701 relating to Liquor Licensing and what, if any, action should be 32 taken. 33 34 Sergeant Hammes stated the three establishments fall into the same category on the Best 35 Practices Grid. Therefore, if the Council determines individually that the establishments 36 have violated the Lino Lakes City Code, Section 701, staff would recommend imposing 37 the following penalties for each: 38 39 1. $500 financial penalty 40 2. Require all employees who serve alcohol to attend server training 41 3. Mandatory liquor code handbook to be available to all employees at all 42 times 43 • SPECIAL COUNCIL MEETING MAY 22, 2006 APPROVED 1 Mr. Chad Wagner, Miller's on Main, came forward and outlined his required staff 2 training and process for violations. He noted the employee who did fail the test is no 3 longer serving alcohol. 4 5 Councilmember Reinert moved that the American Legion Post #566, Circle -Lex VFW 6 and Miller's on Main did violate the Lino Lakes City Code, Section 701. Councilmember 7 Carlson seconded the motion. Motion carried unanimously. 8 9 Councilmember Reinert moved to adjourn the hearing at 5:40 p.m. Councilmember 10 O'Donnell seconded the motion.
