15 Mayor Bergeson explained that the Local Board of Appeal and Equalization of the City of Lino Lakes
16 meets for the purpose of reviewing and correcting the assessment of the city for the year 2007,
17 payable in 2008. All persons considering themselves aggrieved by said assessment or who wish to
18 complain that the property of another is assessed too low were given the opportunity to address the
19 Board. The Mayor reminded those present that only appeals for the current year valuation or
20 classification could be made.

22 Linda Weiner, Anoka County Assessor's Office, presented the Board with the Anoka County, 2007
•23 Board of Appeal and Equalization, County Assessor's Report document and presented a brief
24 overview of the property tax process and a recap of the current assessment.

26 The following individuals addressed the Board:

28 Rose Flor, 7133 Sunrise Drive presented the Board with information on her property. She is a
29 professional real estate agent and she feels her property is valued too high. She would not be able to
30 refinance the home at that value set by the county. Increasing land value apparently has an impact,
31 however, looking at MLS land values and similar homes in the school district, market value is
32 actually around $170,000 (she is being taxed on a value of $197,100 for 2007/payable 2008).

34 Assessor Weiner indicated she had met with Ms. Flor and a reduction has been made. The valuation
35 determination was explained in information that was distributed to the Board. The process for
36 appealing to the county was explained.

38 Carol Kenfield, 6832 Black Duck Drive stated that her home is for sale and has been for some time.
39 It was recently found that the home is located within a flood zone. The real estate agent who listed
40 the home submitted a letter indicating an opinion of a substantially lower value to the home. The
41 determination of the home's location within a flood plain is based on a FEMA (Federal Emergency
42 Management Association) map.

•1 Assessor Weiner provided the Board with written information in response to Ms. Kenfield's concern.
2 Assessor Weiner's research had been difficult as it was hard to find any similar situations for
3 comparables, or even to find flood property information.

5 The Council discussed at length the issue of a home within a flood zone with a determination that
6 they did not have adequate information to make a change to the assessor's calculations.

8 Motion by Reinert, seconded by Carlson, to refer the matter to Anoka County with a request for
9 consideration of the flood zone status of the property. The motion carried unanimously.

11 Char Elmquist, 6210 Otter Lake Road stated that she addressed the Board last year and worked out a
12 reduction based on some major repair issues at the property. There are remaining major repair issues
13 as well as a possible mold problem; the property owners are requesting a reduction.

15 Assessor Weiner recalled that the previous year reduction was based on repair issues. Any change
16 due to mold would require official documentation.

18 Council Member O'Donnell moved to refer the matter of the property at 7133 Sunrise Drive to Anoka
19 County. Council Member Reinert seconded the motion. Motion carried unanimously.

21 Council Member Stoltz moved to refer the matter of the property at 6310 Otter Lake Drive to Anoka
22 County. Council Member O'Donnell seconded the motion. Motion carried unanimously.

24 County Assessor staff asked that a message from Richard McNamara, 548 Apollo Drive (Lino Lakes
25 Business Center) be entered into the record to allow Mr. McNamara to reserve his right to appeal to
26 the County.

30 There being no further business, Council Member Reinert moved to adjourn at 7:05 p.m. Council
31 Member O'Donnell seconded the motion. Motion carried unanimously.
