LIQUOR COMPLIANCE HEARING MINUTES May 14, 2007 <br />APPROVED <br />CITY OF LINO LAKES <br />MINUTES <br />LIQUOR COMPLIANCE HEARING <br />4 <br />5 <br />6 DATE : May 14, 2007 <br />7 TIME STARTED : 6:03 p.m. <br />8 TIME ENDED : 6:16 p.m. <br />9 MEMBERS PRESENT : Councilmember Carlson, O'Donnell, Reinert, <br />10 Stoltz and Mayor Bergeson <br />11 MEMBERS ABSENT : None <br />12 <br />13 Staff members present: City Administrator, Gordon Heitke; City Attorney, William Hawkins; Public <br />14 Safety Director, Dave Pecchia; Police Captain, Kent Strege; and City Clerk, Julie Bartell <br />15 <br />16 HEARING ON LIQUOR CODE VIOLATIONS <br />17 <br />18 Captain Strege reported that compliance checks on city liquor establishments were conducted by the <br />19 Police Department. American Legion Post 566, 7731 Lake Drive, was cited on two occasions — for <br />20 serving to an underage buyer and for allowing consumption of alcohol outside of their building. The <br />21 department utilizes a Best Practices Grid to consider penalties for compliance violations; their <br />22 recommendations were presented. <br />S23 <br />24 It was clarified that a stayed suspension would remain in place for one year and that all liquor <br />25 establishments receive training and notification when compliance checks will occur. <br />26 <br />27 The public hearing was opened. <br />28 <br />29 Charlie Lundgren, Commander -Elect of American Legion Post 566, addressed the Council. He will <br />30 be taking office on June 18 and is very concerned about the violations. The Legion has posted signs <br />31 allowing no outside drinking, installed a temporary fence that would be used on for an upcoming <br />32 special event, have installed a scanning device to check identification, and have reviewed their <br />33 policies with all the bartenders. <br />34 <br />35 There being no one else present wishing to address the Council, the hearing was closed. <br />36 <br />37 It was noted that the Council has consistently utilized the Best Practices Grid in considering <br />38 penalties. <br />39 <br />40 Council Member O'Donnell moved to approve and forward the recommendation of the Police <br />41 Department to the city council meeting.. Motion carried unanimously. <br />42 <br />43 ADJOURN <br />44 <br />1 <br />
