REVIEW REGULAR AGENDA ITEMS
There was no change to the regular agenda.
The following agenda items were discussed.
Item 3A Consideration of New Off -Sale Liquor License for Liquor Barrel, Inc. at 7997
Lake Drive — Julie Bartell explained that on May 12, 2008, the City Council took action to table
the off -sale liquor and tobacco license application of the Liquor Barrel in order to give further
consideration to the license application. Following the meeting, staff encouraged council
members to identify any needed information to facilitate a staff response. The information
requested and staff response was reviewed.
Attorney Baumgartner explained that city's do have some discretion in granting or renewing
licenses. The important factor is not to act arbitrarily or capriciously.
When asked about the impact of another liquor establishment on public safety resources, Chief
Pecchia noted that the department does not have any specific objections. They do receive grant
funding each year to do compliance and enforcement activity.
It was noted by the council the Liquor Barrel application must be considered under the current
ordinance. The council may want to look in the future at new elements to the city's regulations
but that cannot impact this application.
It was noted that an off sale establishment that was opened in 2006, MGM Wine and Spirits, had
apparently gone out of business this year. The council wondered if MGM were to return with a
license request, would the city be obligated to grant it, as a renewal or new license? The City
Attorney suggested again that cities do have some discretion in granting liquor licenses and
should have grounds to deny a license, even if it were a new applicant.

Adam LeMare, Lakes Liquor, questioned the wisdom in opening another store in a market that
didn't support MGM.
Item 2A Consider acceptance of final study on utility rate report from Springsted, Inc. —
Finance Director Rolek noted that staff is seeking only acceptance of the report at this time.
With that acceptance, staff will begin working on a communications plan for presentation of the
concept to the public. Patty Kettles of Springsted, Inc. will have a short presentation at the
council meeting.
Animal Ordinance — Community Development Director Grochala reviewed the ordinance that
includes changes requested at the council work session review, including the voice control
change. Staff is requesting second reading of the ordinance.
Police Department Annual Report - Public Safety Director Pecchia noted the draft report. It
will be finalized after the council accepts the draft.
Chief Pecchia also reported on storm damage from the previous weekend. (Map distributed).
Tornado activity started on Peltier Lake and moved east to Hugo and caused damage. The map
indicates the extent of wind and hail damage in the city. That information is submitted to the
county and from there to the state to qualify for assistance. A barn and a storage bin were
completely destroyed in the Hardwood Creek area. City Hall suffered minor roof damage and
city well houses had some damage. One house has been left uninhabitable and there was one.
reported injury from a falling branch near Peltier Lake. There are approximately 2,500 homes in
the city that received notable damage; in addition 50 of the homes in the manufactured home
park were damaged. Emergency operations were in place quickly and worked well. At the end
of the day, every block in the city was checked. At this point, the city Web site has information
for the public.
When the council asked what support the city is giving to Hugo, Mayor Bergeson explained that
he and the city administrator had visited the mayor (of Hugo) and were not informed of any
direct needs at that time. The city will remain in touch and open to providing assistance as
needed.
The meeting was adjourned at 6:30 p.m.
