City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. APROVAL OF AGENDA y The Agenda was approved as presented. 3. APPROVAL OF MINUTES: November 12, 2014 Mr. Hyden made a MOTION to approve the November 12, 2014 Meeting Minutes. Motion was supported by Mr. Evenson. Motion carried 5 - 0. (Tralle abstained.) 4. OPEN MIKE Chair Tralle declared Open Mike at 6:32 p.m. There was no one present for Open Mike. Mr. Hyden made a MOTION to close Open Mike at 6:32 p.m. Motion was supported by Mr. Evenson. Motion carried 5 - 0. (Tralle abstained). 5. ACTION ITEMS DRAFT MINUTES Planning & Zoning Board February 11, 2015 Page 2 A. PUBLIC HEARING to consider rezoning property located at 6966 Lake Drive (PID # 19-31-22-41-0006) and 6970 Lake Drive (PID # 19-31-22-0005) from R-1, Single Family to R, Rural Katie Larsen, City Planner, presented the staff report. Staff does not recommend approval of the rezoning. Ms. Larsen clarified that there is a difference between zoning classifications and land use classifications. Chair Tralle declared the Public Hearing open at 6:50 p.m. Robert and Carol Stanek, property owners, addressed disagreements with the staff report. The structure for the horses on 6966 is temporary and is able to be moved. The horses are not currently located on the property. The intent is to keep the horses on the property during the 4H season from May through October when their daughters are participating in 4H events. Mr. Stanek also noted that Ms. Stanek has been in communication with the Community Service Officer she spoke with over the phone on March 13, 2015 and the CSO kept notes from this conversation. During the March 13 phone call Ms. Stanek was informed that she was zoned Rural and was therefore allowed to have farm animals. The Staneks took this information under good faith. Chair Tralle questioned Mr. Stanek on why they would go to the Police Department rather than the City to find out whether or not they could have farm animals. Ms. Stanek explained that she went to City Hall and no one was available who dealt with zoning, so she was directed by a city staff member to the Police Department since they deal with animals. Chair Tralle observed that this was a major misdirection and questioned why the Police would be discussing this with residents. Michael Grochala, Community Development Director, speculated that the Police probably got involved because animal control is under Section 503 of the city code and animal control is enforced through the Police Department which includes a farm animal provision. The Staneks decided to purchase the 6966 Lake Drive property with the intent to house farm animals using the information they received from the Police. They used the Land Use map during this process and Mr. Stanek explained how confusing it is for a resident to understand the difference between the Land Use Map and Zoning Map. Mr. Stanek also pointed out the contradictions with the Rural and Residential zoning classifications in regards to water and sewer hookup. The Staneks do not have any intentions of using the land for agricultural use. The Staneks understand that combining the two properties would still be slightly less than 10 acres, but rules and regulations are up for interpretation and there should be a focus on the intent. Ms. Stanek pointed out that there are many lots zoned Rural that do not meet the 10 acre standard. If spot zoning is an issue, the Staneks feel confident that their neighbors would be willing to sign a petition to rezone the area. The Comprehensive Plan does not indicate that the area is going to be developed any more than it is now and Ms. Stanek stated that the plan should be altered as situations arise. Ms. Stanek also stated that they DRAFT MINUTES Planning & Zoning Board February 11, 2015 Page 3 have received lots of positive feedback from the goats on their property and she considers the goats a pleasing attribute to the City. Chair Tralle opened the podium up to comments from the audience. Wendy Marsh, 6936 Lake Drive, spoke in favor of rezoning the properties to Rural. She has lived in her house in Lino Lakes since 1964 and expressed her appreciation of nature in the Chain of Lakes area. Ms. Marsh would not like to see the area overly developed. David Storberg, 6978 Lake Drive, has lived in a rural environment most of his life and thinks a rural atmosphere is great. Mr. Storberg spoke favorably of the rezone. Linda Jensen, 6974 Lake Drive, loves the Staneks and their animals. When Ms. Jensen bought the house in 1998, she thought the lake, park system and woods made it a good place to come. She is impressed with the beautiful job the Staneks have done with their animals. Patty Vito, 6974 Lake Drive, discussed how her son has benefited from the Staneks' animals and how it has become a wonderful part of their lives. It seems to Ms. Vito that most of the neighborhood supports the Staneks and wouldn't find the rezone a problem. She indicated that the area has a very mixed use already with an airport and businesses, so she doesn't think it would be an issue adding a Rural zone in the area. Even though the Comprehensive Plan lists this area as Residential, Ms. Vito expressed that the neighborhood wants the Rural rezone to happen. Neighbors enjoy having the animals there; the Staneks take good care of them and the children in the community benefit greatly from it. Kevin Vito, son of Ms. Vito at 6974 Lake Drive, took to the podium to show his support explaining how great the Staneks take care of the animals. Chair Tralle recognized the support shown by the neighbors and reminded everyone that the Planning & Zoning Board is an advisory group and cannot set anything in place. Mr. Root explained that, while he does see the benefits, he is not in favor of rezoning the properties. Mr. Root's concerns included: The two properties do not meet the size requirement of Rural properties. If the properties are rezoned, future land use could be seen as a problem. Rezoning the properties may give the impression of showing special treatment to the property owners. Mr. Laden asked staff if they had discussed the possibility of creating a conditional use permit or if there was any way to view this as a non -conforming use. Ms. Larsen explained that neither avenue would be applicable in this situation. Ms. Larsen mentioned that staff did consider the idea of rezoning the entire stretch since it sounds DRAFT MINUTES Planning & Zoning Board February 11, 2015 Page 4 like the neighbors would be in favor of that, but staff needed to focus on the Land Use Application that was submitted for two lots. Mr. Laden stated that he thinks an ordinance change would allow people in similar situations with large Residential lots to have some farm animals on their property. Mr. Laden explained that, even though he is generally not a fan of spot zoning, he is in favor of rezoning the properties to Rural as he feels it would be in conformance with the Comprehensive Plan. Mr. Masonick is also in favor of the rezoning. Mr. Evenson and Mr. Root do not see a problem with residents having a limited amount of farm animals if the property is big enough, however they feel this issue is better resolved with an ordinance change rather than rezoning. Mr. Masonic asked what the Staneks will need to do with their animals in the meantime. Staff advised that the Staneks are allowed to keep their animals until the issue has been resolved. Chair Tralle invited citizens to speak at the podium again. Ms. Marsh, Ms. Jensen and Mr. Storberg reiterated their support for the rezoning. Ms. Stanek explained that she worked with Ms. Larsen and Patrick Moonen, Building Inspector, on how to address this issue and they had discussed ordinances, conditional use, variances, etc. Ultimately the Staneks were guided to start with rezoning. Mr. Masonick made a MOTION to close the Public Hearing at 7:43 p.m. Motion was supported by Mr. Laden. Motion carried 5 - 0. (Tralle abstained.) Chair Tralle mentioned that he has been involved with 4H for many years and thinks highly of the program. However, he stressed that the properties are significantly smaller than the 10 acres required for a Rural zone. Chair Tralle agrees with Mr. Root that this should go to an ordinance change rather than rezoning the properties. Chair Tralle sympathizes that the Staneks own lots of land but can't seem to do much with it and that they were provided with incorrect information. Mr. Root made a MOTION to recommend denial of rezoning property located at 6966 Lake Drive and 6970 Lake Drive from R-1, Single Family Residential to R, Rural. Motion was supported by Mr. Evenson. Motion carried 3 - 2. (Laden and Masonick voting nay. Tralle abstained.) The Board felt that this is an opportunity to create an ordinance change which would benefit others in a similar situation. Ms. Larsen indicated that the Board could make a motion to have staff investigate and put some consideration into an ordinance amendment to bring back to the Planning & Zoning Board. Mr. Laden made a MOTION to recommend staff research an ordinance amendment that would be applicable to keeping farm animals in a Residential zone. Motion was supported by Mr. Root. Motion carried 5 — 0. (Tralle abstained) DRAFT MINUTES Planning & Zoning Board February 11, 2015 Page 5 Mr. Grochala pointed out that the biggest problem going forward with an ordinance change would be finding the ideal acreage size. Mr. Stanek questioned what kind of timeframe they are looking at for an ordinance change. Chair Tralle explained that the timeframe is unpredictable. B. PUBLIC HEARING to amend Chapter 1001: Subdivision Regulations and Chapter 1007: Zoning Code, Sections 1, 2 and 3 Katie Larsen, City Planner, recommended continuing the Public Hearing to allow more time for staff to review changes and present to the Board. Mr. Hyden made a MOTION to continue the Public Hearing to the March 11, 2014 Planning & Zoning Board meeting. Motion was supported by Mr. Laden. Motion carried 5 - 0. (Tralle abstained.) 6. DISCUSSION ITEMS A. Proiect Updates Michael Grochala, Community Development Director, provided an update of current city projects. 7. Update for consistency with State Statute, 2. Update to address a number of legal issues, 3. Update for consistency with good planning practice and provide protections for the City, 4. Update for consistency with other City documents, 5. Improve readability but eliminating duplicate requirements and simplifying the language, 6. Provide some general organization and clean-up of technical issues. 1 These changes are intended to make the ordinance more user-friendly by making it easier to understand and implement. ANALYSIS Staff is reviewing the revisions with the City Attorney and requires more time to ensure the amendments are thorough and adequate. RECOMMENDATION Staff recommends closing the Public Hearing. We will re -advertise the public hearing notice when amendments are ready for Board and public review. In July 2014, the Planning & Zoning Board and City Council reviewed and approved an amendment to the PUD Development Stage Plan/Preliminary Plat of Century Farm North to include a 0.991 acre parcel located 7880 Sunset Avenue owned by Jeff Morell. The parcel was rezoned to PUD, Planned Unit Development to be consistent with Century Farm North. The project also includes the realignment and extension of Robinson Drive to Sunset Road. Previous Council approvals include: • Ordinance No. 06-14 to Rezone Property located at 7880 Sunset Avenue from R, Rural to PUD-Planned Unit Development • Resolution No. 14-43 Approving Amendment to PUD Development Stage Plan/Preliminary Plat • Resolution No. 14-49 Approving Petition and Waiver Agreement from Century Farm North Development, Inc. and Jeffrey E. Morell for Robinson Drive Improvements • Resolution No. 14-68 Approving the Deposit Agreement for Robinson Drive Improvement Project • Resolution No. 14-57 Authorizing the Preparation of Plans and Specifications, Robinson Drive Improvements The current Land Use Application is for consideration of the following: • PUD Final Plan/Final Plat The following staff report is based on the revised plan set prepared by Plowe Engineering, Inc. dated February 9, 2015 and received by the City on February 9, 2015. At the time the original PUD was approved in 2003, the City's Comprehensive Plan for medium density residential development allowed for 3 to 6 dwelling units per acre and the original density was 2.93 units per acre. Although the current Comprehensive Plan for medium density requires 4.0 to 5.9 dwelling units per acre, the developer has the right to develop at a density consistent with the original PUD. The increased density to 3.76 units per acre moves in a direction more consist with the current Comprehensive Plan. PUD Final Plan/Final Plat Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The PUD Final Plan/Final Plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance. Resolution 14-43 approved the PUD Development Stage Plan/Preliminary Plat with conditions required prior to approval of the PUD Final Plan/Final Plat. The conditions have been satisfied unless otherwise noted in this report. As noted in the July 28, 2014 Council Staff Report, the PUD Preliminary Plat Amendment was scheduled to be approved at the June 9, 2014 City Council meeting; however, the developer requested three (3) single family lots be removed from the proposed preliminary plat. Consequently, no parkland needs to be vacated as previously proposed. Staff determined the request reasonable and it did not require review again by the Planning & Zoning Board. The final plat is consistent with the amended preliminary plat. Blocks and Lots The final plat creates 29 lots and 3 outlots. Outlot A is a wetland. Outlot B is a stormwater management facility. Outlot C is for future townhome development. Easements Standard drainage and utility easements are being dedicated on individual lots and over stormwater management facilities. Twenty foot wide drainage and utility easements are shown along the rear lot lines for storm water management. Conservation easements will also be dedicated over Outlots A & B for protection of the wetlands and wetland buffers. Street and Utilities In July 2014, the developer signed a Petition and Waiver Agreement for road construction, utility extension and right-of-way dedication for Robinson Drive. The Agreement authorized the City Engineer to prepare plans and specifications for the improvements and allowed the City to levy construction improvement costs against the property. al In January 2015, the developer decided to use the City's plans and specification and complete the construction improvements on their own and not have assessments. Public Land Dedication and Fees The original Century Farm North fulfilled the public land dedication requirements for the entire development through parkland dedication and trail construction. The PUD amendment created 8 additional lots that are subject to the City's Park Dedication fee at $2,500 per lot. The following park dedication requirements shall be met: Zoning Century Farm North 61h Addition is zoned PUD, Planned Unit Development as approved by the City Council with Ordinance 06-14. Comprehensive Plan The PUD Final Plan/Final Plat is in compliance with the Comprehensive Plan in terms of the Resource Management System, Land Use Plan, Housing Plan, and Transportation Plan as detailed in previous staff reports. Development Contract A Development Contract shall be drafted by the City, executed by the City and the developer and recorded by the developer. Maintenance Agreement-Stormwater Management Facilities Century Farm North 6th Addition includes the construction of stormwater facilities and a stormwater maintenance agreement shall be required. RECOMMENDATION Staff recommends approval of the PUD Final Plan/Final Plat for Century Farm North 61h Addition. The following items shall be addressed prior to approval by the City Council unless otherwise noted: 1. All comments from the City Engineer letter dated March 4, 2015 shall be addressed. 5 2. All comments from the Environmental Coordinator letter dated March 5, 2015 shall be addressed. 3. All comments from the Anoka County Highway Department letter (to be provided) shall be addressed. 4. Outlots A and B, Century Farm North 6th Addition shall be deeded to the City. 5. The developer shall prepare the deeds for Outlot A and B and submit them to the City for review and approval. 6. A Development Contract shall be drafted by the City, executed by the City and the developer and recorded by the developer. 7. A Maintenance Agreement for Stormwater Management Facilities shall be drafted by the City. 8. Approval from Rice Creek Watershed District shall be required prior to recording of the final plat. 9. Conservation easement documents and exhibits shall be drafted by the developer, approved by RCWD and the City and recorded by the developer. 10. Conservation easements shall be dedicated over wetland buffer areas as required by Rice Creek Watershed District. 11. Conservation easement language shall include allowance for construction of trails, parks, storm water management facilities, retaining walls, etc. 12. If the house located at 7880 Sunset Avenue is removed, demolished or loses its legal non -conforming status, the driveway will be required to be relocated from Sunset Avenue to Robinson Drive. 13. The house located at 7880 Sunset Avenue shall immediately hook up to municipal water and sanitary services when available. 14. The existing well located at 7880 Sunset Avenue shall be properly abandoned per state and local regulations. 15. The existing septic drain field located at 7880 Sunset Avenue shall be properly removed per state and local regulations. 16. Signs shall be installed at the end of Morell Drive and Cardinal Way stating "Future Road Extension". 17. All plan sheets: a. Revise plans to show 8' bituminous trail extending from Morell Drive east to farthest extent. b. Remove 8' bituminous trail segment south of Robinson Drive. Since the 3 lots were removed, this trail segment shall not be constructed at this time. 18. L1, Landscape Plan: a. The developer is responsible for installing all trees and landscaping. b. Trees and landscaping along Morell Drive, Outlot A, Outlot B, Cardinal Way and along the south side of Robinson Drive from Morell Drive east shall be installed with the construction of street and utilities. c. Trees and landscaping along individual single lots may be installed after home construction is complete on each lot. d. Provide a detail of seed mix proposed for stormwater facilities. 19. PP, Preliminary Plat: a. The density chart shall be for the entire Century Farm North development. Please use the chart provided on page 3 of this staff report. Con b. The preliminary plat appears to have an extra layer turned on and is difficult to read, especially Outlot A. Revise if possible. 20. Final Plat a. The City Engineer shall review standard drainage and utility easements to verify they cover all drainage swales and stormwater facilities especially along rear yards. b. Outlot B appears to have a "circle" contour on it. Please verify if this is required. c. Easement language on Outlot A and Outlot B shall be revised to "Drainage and Utility Easement Over All of Outlot AB" as applicable. d. Delineated wetland boundaries shall be shown. e.
