City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. CONTINUED PUBLIC HEARING to consider amendment of Chapter 1001: Subdivision Regulations and Chapter 1007: Zoning Code, Sections 1, 2 and 3 Katie Larsen, City Planner, presented the staff report. Staff recommended closing the Public Hearing and stated that the public hearing will be re -advertised when amendments are ready for Board and public review. Chair Tralle declared the Public Hearing open at 6:35 p.m. Mr. Hyden made a MOTION to close the Public Hearing at 6:35 p.m. Motion was supported by Mr. Evenson. Motion carried 4 - 0. (Tralle abstained.) B. PUD Final Plan/Final Plat for Century Farm North 6th Addition Ms. Larsen presented the staff report. Staff recommended approval of the PUD Final Plan/Final Plat for Century Farm North 61h Addition. The Board and staff discussed the timeline for installation of the trail system. Ms. Larsen indicated that the timeline is based on availability of funds. Adam Ginkel, Engineer for the site, was present and welcomed any questions regarding engineering. He confirmed that he is pleased with the plans and everything should be ready to go by the time it gets to the Council. Jeff Morrell, Developer for the site, was also present and is satisfied with the plans. Mr. Masonick made a MOTION to recommend approval of the PUD Final Plan/Final Plat for Century Farm North 6th Addition. Motion was supported by Mr. Hyden. Motion carried 4 - 0. (Tralle abstained.) VI. DISCUSSION ITEMS A. Project Updates Ms. Larsen provided an update of current city projects. Diane Hankee, City Engineer, provided an update on the 2015 Reconstruction Project, Shenandoah Neighborhood Improvement Project. VII. The PUD Development Stage Plan/Preliminary Plat was approved in 2004 and the Final Plat was approved in 2005. The original preliminary plat included 10 two-family dwelling units (twin homes) and 1 three -unit attached townhome for a total of 23 units. All units were approved as 2 stories units. To date, 3 two-family dwelling units have been constructed for a total of 6 units. Previous Council actions: • Ordinance No. 02-04, Rezoning Property from R-4, High Density Residential to R-3, Medium Density Residential (February 9, 2004) • Resolution No. 04-126, Approving Conditional Use Permit for PUD and Development Stage Plan/Preliminary Plat (September 13, 2004) • Resolution No. 05-30, Approving Final Plat (March 2005) Due to market changes and demand increase for single level housing products, the developer is requesting an amendment to the PUD Development Stage Plan/Preliminary Plat to allow for the construction of one-story units on 11 lots (Lots 1-11). The Land Use Application is for the following: • Amend the Development Stage Plan/Preliminary Plat of Tumberry Crossing to allow for the construction of one-story units on Lots 1-11 • Vacate drainage and utility easement (City Council action) This staff report is based on the following plan sets: • Plowe Engineering, Inc. dated March 4, 2015 and received by the City on March 4, 2015 • EG Rud & Sons, Inc. dated March 4, 2015 and received by the City on March 4, 2015 ANALYSIS PUD Development Stage Plan/Preliminary Plat Amendments One -Story Units The market demand to build one-story units results in a larger building footprint than the two-story units. This requires an amendment to the preliminary plat to increase the base lot dimensions of Lots 4-11. The total floor area of the one-story unit is 1,268 s.f. which is less than the two-story units but still meets the R-3 District minimum requirement of 900 s.f.. At the time the original PUD was approved in 2005, the City's Comprehensive Plan for medium density residential development allowed for 3 to 6 dwelling units per acre. Although the current Comprehensive Plan for medium density requires 4.0 to 5.9 dwelling units per acre, the developer has the right to develop at a density consistent with the original PUD. As noted, there is no increase or decrease in the number of units. Zoning Requirements and Standards The PUD provides flexibility from the strict standards of the zoning ordinance. Unless otherwise stated in the amended PUD resolution, the regulations and performance standards of the zoning ordinance and R-3 Medium Density Residential District will be in effect. Building Design Standards All new units shall have stone or brick on the front elevation extending from the ground to the roofline around the window. Side and rear elevations shall also have stone or brick extending along the full base. Both lakes are considered natural environment lakes per the MNDNR. Impervious surface coverage of the development cannot exceed 35%. Due to the increase in the size of the floor plan of the single level structures, the impervious surface also increased. To mitigate the issue and maintain 35%, the developer shall install porous pavers in the driveways and sidewalks of Lots 1-15 and pervious sidewalks on Lots 20-21. The developer is also proposing to remove 4 guest parking stalls. Staff does not recommend removal of the guest parking stalls. Instead, they shall be replaced with porous pavers. Allowable Impervious 59,715 s.f. Proposed Impervious 59,582 s.f. DIFFERENCE (133 s.f.) MNDNR reviewed the preliminary plat and plans and have no concerns. Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The PUD Development Stage Plan/Preliminary Plat amendment has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed development is not considered premature, is consistent with the original PUD and meets the performance standards of the subdivision and zoning ordinance. 5 Blocks and Lots The PUD amendment maintains the original 1 block and 24 lots. There is no increase or decrease in the total numbers of units. A total of 23 units will be constructed on Lots 1- 23. Lot 24 is the open space around the individual units. Easements The existing drainage and utility easement over Lot 24 shall be vacated by the City Council. A new standard drainage and utility easement shall be dedicated over the amended Lot 24 with the final plat for Turnberry Crossing 2nd Addition. Storm Water Management and Erosion and Sediment Control A Site Drainage Narrative was prepared by Plowe Engineering, Inc. on March 4, 2015. The proposed development is consistent with the development approved in 2005 with the exception of the larger building footprint. Infiltration requirements under RCWD have been revised since the initial development. The proposed infiltration basins meet the infiltration volume requirements. Drainage patterns are consistent with the original plan. A new RCWD permit is required. The stormwater management plan and SWPPP shall be reviewed by the City Engineer, Environmental Coordinator and Rice Creek Watershed District for compliance. Utilities Public water, sanitary and storm sewer utilities were installed with the original development. No new utilities are proposed. Public Land Dedication Since there is no net change in the number of housing units, no additional park dedication fees are required. Tree Preservation and Mitigation Plan A Tree Preservation and Mitigation Plan is not required since the site has been rough graded and any potential tree removal is within the basic use area (BUA) and the basic use area is not an environmental sensitive area (ESA). Landscaping Landscaping is subject to the original PUD Landscape Plan. The Landscape Plan submitted with the PUD amendment is generally consistent with the original plan. Co Comprehensive Plan The amended PUD Development Stage Plan/Preliminary Plat is consistent with the original PUD and the Comprehensive Plan. Wetlands and Floodplain There are no wetlands or floodplain located within the project site. Final Plat A land use application for PUD Final Plan/Final Plat for Turnberry Crossing 2nd Addition shall be required. At such time, the developer shall enter into a Development Agreement and other documents as the City deems necessary. RECOMMENDATION Staff recommends approval of the amendment to PUD Development Stage Plan/Preliminary Plat for Turnberry Crossing contingent upon the following comments: 1. All comments from City Engineer letter dated March 27, 2015 shall be addressed. 2. All comments from Environmental Coordinator letter dated April 3, 2015 shall be addressed. 3. All comments from Anoka County Highway Department letter (to be provided) shall be addressed. 4. A RCWD permit shall be required. 5. Sheet 1, Certificate of Survey: a. There is an existing shared access easement over the north property and the adjacent property. This easement and document # shall be shown. b. Under Zoning and Setbacks, PDO shall be changed to CUP PUD. (This shall be changed on all plan sheets). c. Perimeter (North line) setback shall be changed from 29 feet to 25 feet. (This shall be changed on all plan sheets). d. Under Comprehensive Plan, "full build out" shall be omitted. (This shall be changed on all plan sheets). 6. Sheet 2, Impervious Coverage Exhibit: a. The guest parking stalls shall not be removed. b. The guest parking stalls shall be replaced with porous pavers to meet impervious coverage calculations. This shall be noted on the plans. 7. Sheet 3, Preliminary Plat: a. The lot and block numbering shall be consistent with the Tumberry Crossing final plat. b. Building setback line along north perimeter shall be revised from 29 feet to 25 feet. c. The detail for the townhomes proposed on Lots 6, 7, 10 and 11 shall also be included. 7 8.
