Stranik, D. Roeser, M. Keller, B. Menke MEMBERS ABSENT: J. Schwartz, B. Combs, D. Roeser, K. Corson OTHERS PRESENT: M. Divine APPROVAL OF MINUTES The Minutes of July 16, 2009 were approved with corrections. CONSIDERATION OF EDAC POSITION PAPER AS ADDENDUM TO EDAC PLAN Ms. Divine stated she said she sees two issues: a process by which EDAC gets involved in development, and criteria with which to evaluate a development. It was moved and seconded to approve the list of Evaluation Criteria as a part of the EDAC strategic plan. Motion passed unanimously. Members discussed EDAC roles at neighborhood meetings and whether EDAC members should take the lead at those meetings and introduce the developer. General consensus was that EDAC should not take lead roles, that is the developer’s responsibility. EDAC can act as mediator to provide resolution between the developer and council. It was agreed that EDAC would put the Economic Development Process on the next agenda for further discussion. CONSIDERATION OF BRINGING EDAC PLAN TO CITY COUNCIL FOR APPROVAL It was moved and seconded to place the EDAC Plan on the City Council agenda for approval at its August 24, 2009 council meeting. Motion passed unanimously. CONSIDERATION OF RECOMMENDATION OF SUPPORT FOR THE CONCEPT PLAN FOR A GROCER ON HODGSON ROAD/COUNTY ROAD J. It was moved and seconded that EDAC recommend that the city council provide support to the developer to move forward with the concept plan for the grocery store that this developer proposes. This recommendation recognizes that a range of issues need to be addressed to a reasonable satisfaction. EDAC requests council direction on whether the committee should continue to work with the developer to move this development proposal forward. Motion passed unanimously. CONSIDERATION OF AMENDING THE ZONING ORDINANCE TO ALLOW PUBLIC, EDUCATIONAL AND RELIGIOUS BUILDINGS AS CONDITIONAL USES IN GENERAL BUSINESS AND LIMITED BUSINESS ZONING DISTRICTS AND AMENDING THE CITY CODE SO THAT THE SEPARATION DISTANCE FOR 1 2 LIQUOR LICENSE SHALL NOT APPLY IF SCHOOL OR CHURCH IS IN LIMITED OR GENERAL BUSINESS ZONING DISTRICT. Ms. Divine informed the committee that a church would like to be the VFW, but churches are not allowed in commercial zoning districts. She reviewed the planner’s staff report which notified the council that a federal law does not allow cities to discriminate against like uses, and churches were considered similar in use to lodges and clubs. Therefore, staff was recommending that the zoning ordinance be changed. Council had requested EDAC’s opinion on this request. EDAC sent the following recommendation to council: EDAC members agreed that the enactment of federal law that requires like uses to be treated equally was enough reason to adopt the amendment to the ordinance. Beyond that members acknowledged that this amendment would allow uses that could remove properties from the commercial tax roles. However, such uses were reasonable within areas that had infrastructure to support them and they attracted people who would use city amenities such as restaurants and shopping. EDAC recommended unanimously to support the proposed amendment to the GB and LB Zoning Districts. A question arose regarding the need to include educational and public uses within GB and LB Zoning Districts. EDAC requested staff opinion regarding the elimination of those uses which are also not taxed from the amendment. However, members agreed that these uses attract people who use commercial services. It was moved and seconded to recommend approval of the ordinance as applies to churches only, removing schools and institution as conditional uses, unless city staff indicates a need to keep those uses in the ordinance. Motion approved unanimously. DISCUSSION OF JOINT EDAC/COUNCIL MEETING Ms. Keller said it was positive regarding opening the lines of communication. UPDATES Kraus Anderson Staff noted that the developer will hold a second neighborhood meeting on Tuesday, Aug. 25 and go to a council work session on Sept. 8. DEED Linda Tabor of DEED would like to attend a future meeting and describe what she does. Ms. Divine was instructed to draft a memo of the points from this meeting for EDAC to see, and then get to the council. Mr. Roeser will send out the draft of his development evaluation proposal. Televising All Council meetings The Charter Commission is proposed a charter amendment to televise all council meetings, including work sessions. This could potentially expand to include all boards and committees. Next meeting will be September 3 at 7 a.m. Meeting adjourned.
