City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. APPROVAL OF MINUTES: April 8, 2015 Mr. Laden made a MOTION to approve the April 8, 2015 Meeting Minutes. Motion was supported by Mr. Masonick. Motion carried 4 - 0. Watermark Presentation by Rick Packer, Mattamy Homes Katie Larsen, City Planner, introduced Rick Packer, Director of Land Development with Mattamy Homes. Mr. Packer gave a presentation on the Watermark development. Board members discussed their main concerns, including: • Commercial land use • Lot width and sizes • Ponds and trails • Public values B. Community Solar Gardens Ms. Larsen provided preliminary information on community solar gardens. The City has received inquiries on community solar gardens and there may be more talk of solar gardens in the future. C. Proiect Updates Ms. Larsen provided an update of current city projects. IX. The PUD Development Stage Plan/Preliminary Plat was approved in 2004 and the Final Plat was approved in 2005. The original preliminary plat included 10 two-family dwelling units (twin homes) and 1 three -unit attached townhome for a total of 23 units. All units were approved as two story units. The PUD Development Stage Plan/Preliminary Plat was amended on May 11, 2015 with Council Resolution No. 15-46 to allow for the construction of one-story units on 11 lots (Lots 1-11). There is no increase or decrease in the total numbers of units. A total of 23 units will be constructed on site. Previous Council actions: • Ordinance No. 02-04, Rezoning Property from R-4, High Density Residential to R-3, Medium Density Residential (February 9, 2004) • Resolution No. 04-126, Approving Conditional Use Permit for PUD and Development Stage Plan/Preliminary Plat (September 13, 2004) • Resolution No. 05-30, Approving Final Plat (March 2005) • Resolution No. 15-46, Approving Amendment to PUD Development Stage Plan/Preliminary Plat, Turnberry Crossing (May 2015) This staff report is based on the following plan sets: • Plowe Engineering, Inc. dated May 13, 2015 and received by the City on May 15, 2015 • EG Rud & Sons, Inc. dated May 13, 2015 and received by the City on May 15, 2015 ANALYSIS PUD Final Plan/Final Plat Council Resolution No. 15-46 approved an amendment to the PUD Development Stage Plan/Preliminary Plat with conditions required prior to approval of the PUD Final Plan - Final Plat. The conditions have been satisfied unless otherwise noted in this report. The final plat is consistent with the amended preliminary plat. Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The PUD Final Plan/Final Plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance. Blocks and Lots The final plat of Turnberry Crossing Second Addition modifies Lots 1-11 and Lot 24 of Turnberry Crossing. Turnberry Crossing Second Addition creates Lot 1-12. Lots 1-3 are one story detached townhomes. Lots 4-11 are one story twin homes. Lot 12 is the common open space. There is no increase or decrease in the total numbers of units. A total of 23 units will be constructed on site. W Easements The existing drainage and utility easement over Lot 24, Turnberry Crossing will be vacated by the City Council. A new standard drainage and utility easement will be dedicated on the final plat over the Lot 12, Turnberry Crossing Second Addition. Additional drainage & utility easements will be dedicated on the final plat between Lot 5- 6 and Lot 9-10, Turnberry Crossing Second Addition. Streets & Utilities Public streets, public utilities and private driveways were installed with the original development. No new streets, driveways or utilities are proposed. Public Land Dedication Since there is no net change in the number of housing units, no additional park dedication fees are required. Landscaping Landscaping is subject to the original PUD Landscape Plan. Building Design Standards Per Resolution No. 15-46, the following building design standards shall apply: • All units shall have full brick or stone columns on the front elevation similar to those on Lots 16-19 and Lots 22-23, Turnberry Crossing. • All units shall have a brick or stone base around the side and rear elevations similar to those on Lots 16-19 and Lots 22-23, Turnberry Crossing. • Lots 20-21, Turnberry Crossing shall have brick or stone on the front elevation extending from the ground to the roofline around the window similar to those on Lots 16-19 and Lots 22-23. • Lots 12-15, Turnberry Crossing and Lots 1-11, Turnberry Crossing Second Addition shall have at a minimum brick or stone on the front elevation from the base to the bottom of the window sill. The developer has provided two additional color sidings for a total of four different siding color options. Shoreland Management Overlay District and Impervious Surface Coverage The property is subject to the Shoreland Management Overlay District because it is located within 1,000 feet of both Marshan and Rice Lake. Both lakes are considered natural environment lakes per the MNDNR. Impervious surface coverage of the development cannot exceed 35%. Due to the increase in the size of the floor plan of the single level structures, the impervious surface also increased. To mitigate the issue and maintain 35%, the developer shall install porous pavers in the driveways, guest parking stalls and sidewalks per the approved Sheet 2, Impervious Coverage Exhibit. Anoka County Highway Department The County provided comment on the project and has no concerns. See Attachment 4. Development Agreement A Development Agreement shall be drafted by the City, executed by the City and the developer and recorded by the developer. Maintenance Agreement-Stormwater Management Facilities A Declaration for Maintenance of Stormwater Facilities shall be required by the developer and recorded with Anoka County. RECOMMENDATION Staff recommends approval of the PUD Final Plan/Final Plat for Turnberry Crossing Second Addition. The following items shall be addressed prior to approval by the City Council unless otherwise noted: 1. All comments from the City Engineer letter dated June 3, 2015 shall be addressed. 2. The following executed documents shall be recorded with Anoka County within 90 days of City Council approval of the final plat: a. Ordinance vacating drainage & utility easement b. Final Plat c. Development Agreement d. Declaration for Maintenance of Stormwater Facilities 3. The following items shall be submitted to the City prior to issuance of a Grading Permit: a. Revised plans based on staff comments b. Executed Declaration for Maintenance of Stormwater Facilities c. NPDES Permit d. RCWD Permit e. Securities and Escrows as detailed in the Development Contract f. Grading Permit Fee of $150 4. The following items shall be submitted to the City prior to issuance of a Building Permit: a. Revised plans based on staff comments b. An electronic PDF of the final approved plans c. An as -built grading survey d. Building Permit Fee as determined by the Building Official al 5. Sheet 2, Impervious Coverage Exhibit a. The guest parking stalls between Lots 9-10 and Lots 13-14 shall not be removed and shall be replaced with pervious pavers. b. The impervious surface calculations do not match those on Sheet 4. Please revise the appropriate sheet. 6. Sheet 4, Grading Plan. a. The impervious surface calculations do not match those on Sheet 2. Please revise the appropriate sheet. 7. Sheet 5, Landscaping/Planting Plan. a. Per the original PUD, 105 trees shall be planted. The Plant Schedule only indicates 95. Please revise schedule and plan to show 105 tree plantings. b. All sodded areas shall be irrigated. The irrigation shall extend further into the southwest corner of the site. c. Stormwater management ponds and their seed mix types shall be clearly marked on the plan sheet. d. Under Landscape Notes, remove "All disturbed areas to be turf seeded...." comment. Sod shall be required in all open spaces. 8. Final Plat a. A Consent to Plat is required from the mortgage holder. This shall be drafted by the developer, approved by the City and recorded. b. The grading plan contours are from the original plat and need to lighter line weight to represent the work being completed with this plat. Currently the plan shows grading work within existing ponds that are not going to be disturbed. The NWL and HWL should be labeled on the stormwater plan. The Utility plan should show the exiting utilities in a lighter line weight to represent the work being completed with this plat. 2. A 5-foot wide drainage and utility easement is to be added between pads 1 & 2, and 2 & 3. 3. A construction access and phasing plan was submitted and is on file. Since this is less than the 31 or more total unit threshold for requiring the construction of CSAH 23 left turn lanes, the CSAH 23 left turn lane construction will not be required to be completed in conjunction with this development. However, it should be noted that ACHD does not have any programmed reconstruction for this section of CSAH 23 in our current 10 year program, so should the City have concerns about left turn maneuvers at this intersection, we would be supportive of the left turn lane construction occurring in conjunction with this development. TRANSPORTATION DIVISION Highway May 4, 2015 Nicole DeDeyn City of Lino Lakes 600 Town Center Parkway Lino Lakes, MN 55014-1182 RE: Preliminary Plat - Turnberry Crossing 2nd Addition Dear Nicole, We have reviewed the preliminary plat for Turnberry Crossing 2nd Addition, (previously reviewed as: Marshan Townhomes 2nd Addition 3/26/2004), to be located in the northeast quadrant of CSAH 23 (Lake Drive) and Aqua Lane within the City of Lino Lakes and I offer the following comments: As depicted on the plat an additional 15 feet of right of way has been dedicated to Anoka County (100' of right of way width east of centerline CSAH 23). Right of access along the entire length of this parcel has been dedicated to Anoka County. The proposed change from in this plat from Marshan Town homes 2nd Addition does not alter the impacts to the county highway system, and consequently, our comments regarding this site remain unchanged from our previous review dated 3/26/04 (copy attached). The ACHD Engineering Plan Review Process will apply to this plan. At present there are existing right turn lanes at Aqua Lane. The Marshan Townhomes 2nd Addition letter recommended that there should be right, thru and left turn lanes at Aqua Lane and that comment remains unchanged. Calculations must be provided along with a grading and erosion control plan that delineates the drainage areas for this site. The post -development rate/volume of runoff must not exceed the pre -developed rate/volume of runoff for the 10-year, critical design storm. The ACHD Engineering Plan Review fee for this development is estimated at $550.00. Contact Gina Pizzo, Engineer III at 763.862.4248, Gina. An additional 15 feet of right of way adjacent to CSAH 23 will be required for future reconstruction purposes. If the city does not require the developer to dedicate the additional right of way as part of this development, all building/parking setbacks should be based on the future right of way width of 60 feet east of centerline on CSAH 23. In addition, any trail or utility easements deemed necessary by the City of Lino Lakes along this portion of CSAH 23 outside of the county right of way should be dedicated as part of this development. We. , have reviewed the Intersection Sight Distance Requirements for the CSAH 23/Aqua Lane intersection. It appears that the sight comer for the southeast quadrant of this intersection is -obstructed by an existing structure located on private property outside of the. boundaries of this development. Consequently, this sight distance deficiency is considered non -correctable at this time. The City and the developer shall ensure that all applicable sigh distance requirements are satisfied to the greatest extent possible for this development. There are trees and plantings shown on the Landscape Plan (sheet 8 of 11) that would introduce new sight obstructions for the sight comer in the northeast quadrant of the CSAH 23/Aqua Lane intersect6ion (see attached sketch). The Landscape Plan shall be revised to eliminate any new obstructions to this site corner. Please note that no plantings or signs will be permitted within the county right of way. Care must be exercised when locating signs, buildings, structures, plantings; berms, etc. outside of the county right of way, so as not to create sight distance obstructions for the affected public roadway or access point. No direct access to CSAH 23 is proposed for this development, which is acceptable to -this department, and all units will have access via Aqua Circle and Aqua Lane. The right of access along CSAH 23 shall be dedicated to Anoka County and any existing access driveways onto CSAH 23 within the boundaries of this development shall be removed, and the right of way restored to match the existing depth, grade, and slopes. This development will introduce a significant number of new turning maneuvers at the CSAH 23/Aqua Lane intersection and will have an impact on the safety and operations of this intersection. There are currently right turn lanes on northbound and southbound CSAH 23 at Aqua Lane. Since there are no reconstruction projects planned, funded, scheduled or programmed for this section of CSAH 23, all costs associated with the implementation of this concept plan (including design, engineering review fees, and construction) shall be the responsibility of the developer. An engineering plan review fee estimated at $550.00 will apply to this project. Contact Andrew Witter, Construction Services Engineer, for information regarding the engineering plan review process. Calculations must be provided along with a grading and erosion control plan that delineates the drainage areas for this site. The post -development rate/volume of runoff must not exceed the pre - developed rate/volume of runoff for the 10-year, critical design storm. Please submit the drainage calculations, grading and erosion control plans, and turn lane construction plans along with the ACHD Design Requirements Checklist for County Highway Modifications (copy attached) and the applicable engineering plan review fee to Mr. Witter for his review and approval. If the City and the developer wish to meet with county staff to discuss the county highway modifications for this plat prior to submittal of formal engineering plans, we would be happy to do so. It should be noted that residential land use adjacent to highways usually results in complaints regarding traffic noise. Traffic noise adjacent to residential areas could exceed noise standards established by the U.S. Department of Housing and Urban Development and the Minnesota Pollution Control Agency. Anoka County policy regarding new developments adjacent to existing county. highways prohibits the expenditure of highway funds for noise mitigation measures. The City and/or the Developer should assess the noise situation and take any action deemed necessary to minimize associated impacts at this site from any traffic noise. A permit for work within the County right of way is required and must be obtained prior to the commencement of any construction (Permit for Work Within County R/W = $110.00). License Permit Bonding, method of construction, design details for the turn lane construction, work zone traffic control, restoration requirements and follow-up inspections are typical elements of the permitting process. Please contact Roger Butler, Traffic Engineering Coordinator, or Josie Scott, Traffic Engineering Technician, for further information regarding the permit process. AFTER THE PERMIT IS TERMINATED UNDER THIS PART, IF THERE IS ANY SUBSEQUENT DEVELOPMENT ON THE REMAINING PORTIONS OF THE SITE WHERE CONSTRUCTION ACTIVITY WAS NOT COMPLETE, NEW PERMIT COVERAGE MUST BE OBTAINED IF THE SUBSEQUENT DEVELOPMENT ITSELF OR AS PART OF THE REMAINING COMMON PLAN OF DEVELOPMENT OR SALE WILL RESULT IN LAND DISTURBING ACTIVITIES OF ONE (1) OR MORE ACRES IN SIZE. A. CONSTRUCTION ACTIVITY HAS CEASED FOR AT LEAST 90 DAYS. B. DATES OF TRAINING AND NAME OF INSTRUCTOR(S) AND ENTITY PROVIDING TRAINING. C. CONTENT OF TRAINING COURSE OR WORKSHOP INCLUDING THE NUMBER OF HOURS OF TRAINING. PART 111.E - SWPPP AMENDMENTS THE PERMITTEE(S) MUST AMEND THE SWPPP AS NECESSARY TO INCLUDE ADDITIONAL REQUIREMENTS, SUCH AS ADDITIONAL OR MODIFIED BMPS THAT ARE DESIGNED TO CORRECT PROBLEMS IDENTIFIED OR ADDRESS SITUATIONS WHENEVER: 1. THERE IS A CHANGE IN DESIGN, CONSTRUCTION, OPERATION, MAINTENANCE, WEATHER OR SEASONAL CONDITIONS THAT HAS A SIGNIFICANT EFFECT ON THE DISCHARGE OF POLLUTANTS TO SURFACE WATERS OR UNDERGROUND WATERS. 2. INSPECTIONS OR INVESTIGATIONS BY SITE OWNER OR OPERATORS, USEPA OR MPCA OFFICIALS INDICATE THE SWPPP IS NOT EFFECTIVE IN ELIMINATING OR SIGNIFICANTLY MINIMIZING THE DISCHARGE OF POLLUTANTS TO SURFACE WATERS OR UNDERGROUND WATERS OR THAT THE DISCHARGES ARE CAUSING WATER QUALITY STANDARD EXCEEDANCES (E.G., NUISANCE CONDITIONS AS DEFINED IN MINN. R. 7050.0210, SUBP. 2). 3. THE SWPPP IS NOT ACHIEVING THE GENERAL OBJECTIVES OF MINIMIZING POLLUTANTS IN STORMWATER DISCHARGES ASSOCIATED WITH CONSTRUCTION ACTIVITY, OR THE SWPPP IS NOT CONSISTENT WITH THE TERMS AND CONDITIONS OF THIS PERMIT. 4. AT ANY TIME AFTER PERMIT COVERAGE IS EFFECTIVE, THE MPCA MAY DETERMINE THAT THE PROJECT'S STORMWATER DISCHARGES MAY CAUSE, HAVE REASONABLE POTENTIAL TO CAUSE, OR CONTRIBUTE TO NON -ATTAINMENT OF ANY APPLICABLE WATER QUALITY STANDARD, OR THAT THE SWPPP DOES NOT INCORPORATE THE APPLICABLE REQUIREMENTS IN PART III.A.8., (IMPAIRED WATERS AND TMDLS). IF A WATER QUALITY STANDARD CHANGES DURING THE TERM OF THIS PERMIT, THE MPCA WILL MAKE A DETERMINATION AS TO WHETHER A MODIFICATION OF THE SWPPP IS NECESSARY TO ADDRESS THE NEW STANDARD. IF THE MPCA MAKES SUCH DETERMINATIONS) OR ANY OF THE DETERMINATIONS IN PARTS 111.B.1.-3., THE MPCA WILL NOTIFY THE PERMITTEE S IN WRITING. IN RESPONSE, THE PERMITTEE(S) MUST AMEND THE SWPPP TO ADDRESS THE IDENTIFIED CONCERNS AND SUBMIT INFORMATION REQUESTED BY THE MPCA, WHICH MAY INCLUDE AN INDIVIDUAL PERMIT APPLICATION. IF THE MPCA'S WRITTEN NOTIFICATION REQUIRES A RESPONSE, FAILURE TO RESPOND WITHIN THE SPECIFIED TIMEFRAME CONSTITUTES A PERMIT VIOLATION. PART III.C. - TEMPORARY SEDIMENT BASINS WHERE FIVE (5) OR MORE ACRES OF DISTURBED SOIL DRAIN TO A COMMON LOCATION, THE PERMITTEE(S) MUST PROVIDE A TEMPORARY SEDIMENT BASIN TO PROVIDE TREATMENT TO THE RUNOFF BEFORE IT LEAVES THE CONSTRUCTION SITE OR ENTERS SURFACE WATERS. A TEMPORARY SEDIMENT BASIN MAY BE CONVERTED TO A PERMANENT BASIN AFTER CONSTRUCTION IS COMPLETE. THE TEMPORARY BASIN IS NO LONGER REQUIRED WHEN PERMANENT COVER HAS REDUCED THE ACREAGE OF DISTURBED SOIL TO LESS THAN FIVE (5) ACRES DRAINING TO A COMMON LOCATION. THE PERMITTEE(S) IS/ARE ENCOURAGED, BUT NOT REQUIRED, TO INSTALL TEMPORARY SEDIMENT BASINS WHERE APPROPRIATE IN AREAS WITH STEEP SLOPES OR HIGHLY ERODIBLE SOILS EVEN IF LESS THAN FIVE (5) ACRES DRAINS TO ONE AREA. THE BASINS MUST BE DESIGNED AND CONSTRUCTED ACCORDING TO THE FOLLOWING REQUIREMENTS: 1. THE BASINS MUST PROVIDE LIVE STORAGE FOR A CALCULATED VOLUME OF RUNOFF FROM A TWO-YEAR, 24-HOUR STORM FROM EACH ACRE DRAINED TO THE BASIN, EXCEPT THAT IN NO CASE SHALL THE BASIN PROVIDE LESS THAN 1,800 CUBIC FEET OF LIVE STORAGE FROM EACH ACRE DRAINED TO THE BASIN. 2. WHERE THE CALCULATION IN PART III.C.1. HAS NOT BEEN PERFORMED, A TEMPORARY SEDIMENT BASIN PROVIDING 3,600 CUBIC FEET OF LIVE STORAGE PER ACRE DRAINED TO THE BASIN SHALL BE PROVIDED FOR THE ENTIRE DRAINAGE AREA OF THE TEMPORARY BASIN. 3. TEMPORARY BASIN OUTLETS MUST BE DESIGNED TO PREVENT SHORT-CIRCUITING AND THE DISCHARGE OF FLOATING DEBRIS. THE BASIN MUST BE DESIGNED WITH THE ABILITY TO ALLOW COMPLETE BASIN DRAWDOWN FOR MAINTENANCE ACTIVITIES, AND MUST INCLUDE A STABILIZED EMERGENCY OVERFLOW TO PREVENT FAILURE OF POND INTEGRITY. THE OUTLET STRUCTURE MUST BE DESIGNED TO WITHDRAW WATER FROM THE SURFACE IN ORDER TO MINIMIZE THE DISCHARGE OF POLLUTANTS, EXCEPT THAT THE USE OF A SURFACE WITHDRAWAL MECHANISM FOR DISCHARGE OF THE BASIN MAY BE TEMPORARILY SUSPENDED DURING FROZEN CONDITIONS. ENERGY DISSIPATION MUST BE PROVIDED FOR THE BASIN OUTLET (SEE PART IV.6.5.). 4. SEDIMENT BASINS MUST BE SITUATED OUTSIDE OF SURFACE WATERS AND ANY BUFFER ZONE REQUIRED UNDER APPENDIX A.C.3, AND MUST BE DESIGNED TO AVOID DRAINING WATER FROM WETLANDS UNLESS THE IMPACT TO THE WETLAND IS IN COMPLIANCE WITH THE REQUIREMENTS OF APPENDIX A, PART D. 5. THE TEMPORARY BASINS MUST BE CONSTRUCTED AND MADE OPERATIONAL PRIOR TO 10 OR MORE ACRES OF DISTURBED SOIL DRAINING TO A COMMON LOCATION. 6. WHERE A TEMPORARY SEDIMENT BASIN MEETING THE REQUIREMENTS OF THIS PART IS INFEASIBLE, EQUIVALENT SEDIMENT CONTROLS SUCH AS SMALLER SEDIMENT BASINS, AND/OR SEDIMENT TRAPS, SILT FENCES, VEGETATIVE BUFFER STRIPS, OR ANY APPROPRIATE COMBINATION OF MEASURES ARE REQUIRED FOR ALL DOWN -SLOPE BOUNDARIES OF THE CONSTRUCTION AREA AND FOR SIDE -SLOPE BOUNDARIES AS DICTATED BY INDIVIDUAL SITE CONDITIONS. IN DETERMINING WHETHER INSTALLING A SEDIMENT BASIN IS INFEASIBLE, THE PERMITTEE(S) MUST CONSIDER PUBLIC SAFETY AND MAY CONSIDER FACTORS SUCH AS SITE SOILS, SLOPE, AND AVAILABLE AREA ON SITE. THIS DETERMINATION OF INFEASIBILITY MUST BE DOCUMENTED IN THE SWPPP PRE PART III.A.5. PART III.E - RECORD RETENTION THE SWPPP (ORIGINAL OR COPIES) INCLUDING, ALL CHANGES TO IT, AND INSPECTIONS AND MAINTENANCE RECORDS MUST BE KEPT AT THE SITE DURING CONSTRUCTION BY THE PERMITTEE(S) WHO HAS/HAVE OPERATIONAL CONTROL OF THAT PORTION OF THE SITE. THE SWPPP CAN BE KEPT IN EITHER THE FIELD OFFICE OR IN AN ON -SITE VEHICLE DURING NORMAL WORKING HOURS. ALL OWNER(S) MUST KEEP THE FOLLOWING RECORDS ON FILE FOR THREE (3) YEARS AFTER SUBMITTAL OF THE NOT AS OUTLINED IN PART II.C. THIS DOES NOT INCLUDE ANY RECORDS AFTER SUBMITTAL OF 1. THE FINAL SWPPP 2. ANY OTHER STORMWATER RELATED PERMITS REQUIRED FOR THE PROJECT 3. RECORDS OF ALL INSPECTION AND MAINTENANCE CONDUCTED DURING CONSTRUCTION (PART IV.E. INSPECTIONS AND MAINTENANCE) PART III.E - RECORD RETENTION (CONT) 4. ALL PERMANENT OPERATION AND MAINTENANCE AGREEMENTS THAT HAVE BEEN IMPLEMENTED, INCLUDING ALL RIGHT-OF-WAY, CONTRACTS, COVENANTS AND OTHER BINDING REQUIREMENTS REGARDING PERPETUAL MAINTENANCE AND 5. ALL REQUIRED CALCULATIONS FOR DESIGN OF THE TEMPORARY AND PERMANENT STORMWATER MANAGEMENT SYSTEMS. PART III.F. - TRAINING REQUIREMENTS THE PERMITTEE(S) SHALL ENSURE THE FOLLOWING INDIVIDUALS IDENTIFIED IN THIS PART HAVE BEEN TRAINED IN ACCORDANCE WITH THIS PERMIT'S TRAINING REQUIREMENTS. 1. WHO MUST BE TRAINED: A. INDIVIDUAL(S) PREPARING THE SWPPP FOR THE PROJECT B. INDIVIDUAL(S) OVERSEEING IMPLEMENTATION OF, REVISING, AND AMENDING THE SWPPP AND INDIVIDUAL(S) PERFORMING INSPECTIONS AS REQUIRED IN PART IV.E. ONE OF THESE INDIVIDUALS) MUST BE AVAILABLE FOR AN ONSITE INSPECTION WITHIN 72 HOURS UPON REQUEST BY THE MPCA. C. INDIVIDUAL(S) PERFORMING OR SUPERVISING THE INSTALLATION, MAINTENANCE AND REPAIR OF BMPS. AT LEAST ONE INDIVIDUAL ON A PROJECT MUST BE TRAINED IN THESE JOB DUTIES. 2. TRAINING CONTENT: THE CONTENT AND EXTENT OF TRAINING MUST BE COMMENSURATE WITH THE INDIVIDUAL'S JOB DUTIES AND RESPONSIBILITIES WITH REGARD TO ACTIVITIES COVERED UNDER THIS PERMIT FOR THE PROJECT. AT LEAST ONE INDIVIDUAL PRESENT ON THE PERMITTED PROJECT SITE (OR AVAILABLE TO THE PROJECT SITE IN 72 HOURS) MUST BE TRAINED IN THE JOB DUTIES DESCRIBED IN PART III.F.1.B. AND PART III.F.1.C. 3. THE PERMITTEE(S) SHALL ENSURE THAT THE INDIVIDUALS ARE TRAINED BY LOCAL, STATE, FEDERAL AGENCIES, PROFESSIONAL ORGANIZATIONS, OR OTHER ENTITIES WITH EXPERTISE IN EROSION PREVENTION, SEDIMENT CONTROL, PERMANENT STORMWATER MANAGEMENT AND THE MINNESOTA NPDES/SDS CONSTRUCTION STORMWATER PERMIT. AN UPDATE REFRESHER -TRAINING MUST BE ATTENDED EVERY THREE (3) YEARS STARTING THREE (3) YEARS FROM THE ISSUANCE DATE OF THIS PERMIT. IV.B. EROSION PREVENTION PRACTICES 1. THE PERMITTEE(S) MUST PLAN FOR AND IMPLEMENT APPROPRIATE BMPS SUCH AS CONSTRUCTION PHASING, VEGETATIVE BUFFER STRIPS, HORIZONTAL SLOPE GRADING, INSPECTION AND MAINTENANCE OF PART IV.E. AND OTHER CONSTRUCTION PRACTICES THAT MINIMIZE EROSION AS NECESSARY TO COMPLY WITH THIS PERMIT AND PROTECT WATERS OF THE STATE. THE LOCATION OF AREAS NOT TO BE DISTURBED MUST BE DELINEATED (E.G., WITH FLAGS, STAKES, SIGNS, SILT FENCE ETC.) ON THE PROJECT SITE BEFORE WORK BEGINS. THE PERMITTEE(S) MUST MINIMIZE THE NEED FOR DISTURBANCE OF PORTIONS OF THE PROJECT THAT HAVE STEEP SLOPES. FOR THOSE SLOPED AREAS WHICH MUST BE DISTURBED, THE PERMITTEE(S) MUST USE TECHNIQUES SUCH AS PHASING AND STABILIZATION PRACTICES DESIGNED FOR STEEP SLOPES (E.G., SLOPE DRAINING AND TERRACING). 2. THE PERMITTEE(S) MUST STABILIZE ALL EXPOSED SOIL AREAS (INCLUDING STOCKPILES). STABILIZATION MUST BE INITIATED IMMEDIATELY TO LIMIT SOIL EROSION WHENEVER ANY CONSTRUCTION ACTIVITY HAS PERMANENTLY OR TEMPORARILY CEASED ON ANY PORTION OF THE SITE AND WILL NOT RESUME FOR A PERIOD EXCEEDING 7 CALENDAR DAYS. STABILIZATION MUST BE COMPLETED NO LATER THAN 14 CALENDAR DAYS AFTER THE CONSTRUCTION ACTIVITY IN THAT PORTION OF THE SITE HAS TEMPORARILY OR PERMANENTLY CEASED. 3. IF USING STORMWATER CONVEYANCE CHANNELS, THE PERMITTEE(S) MUST DESIGN THE CHANNELS TO ROUTE WATER AROUND UNSTABILIZED AREAS ON THE SITE AND TO REDUCE EROSION, UNLESS INFEASIBLE. THE PERMITTEE(S) MUST USE EROSION CONTROLS AND VELOCITY DISSIPATION DEVICES SUCH AS CHECK DAMS, SEDIMENT TRAPS, RIPRAP, OR GROUTED RIPRAP AT OUTLETS WITHIN AND ALONG THE LENGTH OF ANY CONSTRUCTED STORMWATER CONVEYANCE CHANNEL, AND AT ANY OUTLET, TO PROVIDE A NON -EROSIVE FLOW VELOCITY, TO MINIMIZE EROSION OF CHANNELS AND THEIR EMBANKMENTS, OUTLETS, ADJACENT STREAM BANKS, SLOPES, AND DOWNSTREAM WATERS DURING DISCHARGE CONDITIONS. 4. THE PERMITTEE(S) MUST STABILIZE THE NORMAL WETTED PERIMETER OF ANY TEMPORARY OR PERMANENT DRAINAGE DITCH OR SWALE THAT DRAINS WATER FROM ANY PORTION OF THE CONSTRUCTION SITE, OR DIVERTS WATER AROUND THE SITE, WITHIN 200 LINEAL FEET FROM THE PROPERTY EDGE, OR FROM THE POINT OF DISCHARGE INTO ANY SURFACE WATER. STABILIZATION OF THE LAST 200 LINEAL FEET MUST BE COMPLETED WITHIN 24 HOURS AFTER CONNECTING TO A SURFACE WATER OR PROPERTY EDGE. THE PERMITTEE(S) SHALL COMPLETE STABILIZATION OF THE REMAINING PORTIONS OF ANY TEMPORARY OR PERMANENT DITCHES OR SWALES WITHIN 7 CALENDAR DAYS AFTER CONNECTING TO A SURFACE WATER OR PROPERTY EDGE AND CONSTRUCTION IN THAT PORTION OF THE DITCH HAS TEMPORARILY OR PERMANENTLY CEASED. TEMPORARY OR PERMANENT DITCHES OR SWALES THAT ARE BEING USED AS A SEDIMENT CONTAINMENT SYSTEM DURING CONSTRUCTION (WITH PROPERLY DESIGNED ROCK -DITCH CHECKS, BIO ROLLS, SILT DIKES, ETC.) DO NOT NEED TO BE STABILIZED DURING THE TEMPORARY PERIOD OF ITS USE AS A SEDIMENT CONTAINMENT SYSTEM. THESE AREAS MUST BE STABILIZED WITHIN 24 HOURS AFTER NO LONGER BEING USED AS A SEDIMENT CONTAINMENT SYSTEM. APPLYING MULCH, HYDROMULCH, TACKIFIER, POLYACRYLAMIDE OR SIMILAR EROSION PREVENTION PRACTICES IS NOT ACCEPTABLE STABILIZATION IN ANY PART OF A TEMPORARY OR PERMANENT DRAINAGE DITCH OR SWALE. 5. PIPE OUTLETS MUST BE PROVIDED WITH TEMPORARY OR PERMANENT ENERGY DISSIPATION WITHIN 24 HOURS AFTER CONNECTION TO A SURFACE WATER. 6. UNLESS INFEASIBLE DUE TO LACK OF PERVIOUS OR VEGETATED AREAS, THE PERMITTEE(S) MUST DIRECT DISCHARGES FROM BMPS TO VEGETATED AREAS OF THE SITE (INCLUDING ANY NATURAL BUFFERS) IN ORDER TO INCREASE SEDIMENT REMOVAL AND MAXIMIZE STORMWATER INFILTRATION. THE PERMITTEE(S) MUST USE VELOCITY DISSIPATION DEVICES IF NECESSARY TO PREVENT EROSION WHEN DIRECTING STORMWATER TO VEGETATED AREAS. PART IV.C. - SEDIMENT CONTROL PRACTICES 1. THE PERMITTEE(S) MUST EMPLOY SEDIMENT CONTROL PRACTICES AS NECESSARY TO MINIMIZE SEDIMENT FROM ENTERING SURFACE WATERS, INCLUDING CURB AND GUTTER SYSTEMS AND STORM SEWER INLETS. A. TEMPORARY OR PERMANENT DRAINAGE DITCHES AND SEDIMENT BASINS THAT ARE DESIGNED AS PART OF A SEDIMENT CONTAINMENT SYSTEM (E.G., DITCHES WITH ROCK -CHECK DAMS) REQUIRE SEDIMENT CONTROL PRACTICES ONLY AS APPROPRIATE FOR SITE CONDITIONS. B. IF THE DOWN GRADIENT SEDIMENT CONTROLS ARE OVERLOADED (BASED ON FREQUENT FAILURE OR EXCESSIVE MAINTENANCE REQUIREMENT), THE PERMITTEE(S) MUST INSTALL ADDITIONAL UPGRADIENT SEDIMENT CONTROL PRACTICES OR REDUNDANT BMPS TO ELIMINATE THE OVERLOADING, AND THE SWPPP MUST BE AMENDED TO IDENTIFY THESE ADDITIONAL PRACTICES AS REQUIRED IN PART 111.E 1.-3. 2. SEDIMENT CONTROL PRACTICES MUST BE ESTABLISHED ON ALL DOWN GRADIENT PERIMETERS AND BE LOCATED UPGRADIENT OF ANY BUFFER ZONES. THE PERIMETER SEDIMENT CONTROL PRACTICE MUST BE IN PLACE BEFORE ANY UPGRADIENT LAND -DISTURBING ACTIVITIES BEGIN. THESE PRACTICES SHALL REMAIN IN PLACE UNTIL FINAL STABILIZATION HAS BEEN ESTABLISHED IN ACCORDANCE WITH PART IV.G. 3. THE PERMITTEE(S) SHALL RE -INSTALL ALL SEDIMENT CONTROL PRACTICES THAT HAVE BEEN ADJUSTED OR REMOVED TO ACCOMMODATE SHORT-TERM ACTIVITIES SUCH AS CLEARING OR GRUBBING, OR PASSAGE OF VEHICLES, IMMEDIATELY AFTER THE SHORT-TERM ACTIVITY HAS BEEN COMPLETED. THE PERMITTEE(S) SHALL COMPLETE ANY SHORT-TERM ACTIVITY THAT REQUIRES REMOVAL OF SEDIMENT CONTROL PRACTICES AS QUICKLY AS POSSIBLE. THE PERMITTEE(S) MUST RE -INSTALL SEDIMENT CONTROL PRACTICES BEFORE THE NEXT PRECIPITATION EVENT EVEN IF THE SHORT-TERM ACTIVITY IS NOT COMPLETE. 4. TEMPORARY SOIL STOCKPILES MUST HAVE SILT FENCE OR OTHER EFFECTIVE SEDIMENT CONTROLS, AND CANNOT BE PLACED IN ANY NATURAL BUFFERS OR SURFACE WATERS, INCLUDING STORMWATER CONVEYANCES SUCH AS CURB AND GUTTER SYSTEMS, OR CONDUITS AND DITCHES UNLESS THERE IS A BYPASS IN PLACE FOR THE STORMWATER. 6. WHERE VEHICLE TRAFFIC LEAVES ANY PART OF THE SITE (OR ONTO PAVED ROADS WITHIN THE SITE): A. THE PERMITTEE(S) MUST INSTALL A VEHICLE TRACKING BMP TO MINIMIZE THE TRACK OUT OF SEDIMENT FROM THE CONSTRUCTION SITE. EXAMPLES OF VEHICLE TRACKING BMPS INCLUDE (BUT ARE NOT LIMITED TO) ROCK PADS, MUD MATS, SLASH MULCH, CONCRETE OR STEEL WASH RACKS, OR EQUIVALENT SYSTEMS. B. THE PERMITTEE(S) MUST USE STREET SWEEPING IF SUCH VEHICLE TRACKING BMPS ARE NOT ADEQUATE TO PREVENT SEDIMENT FROM BEING TRACKED ONTO THE STREET (SEE PART IV.E.5.D.). 7. THE PERMITTEE(S) MUST INSTALL TEMPORARY SEDIMENTATION BASINS AS REQUIRED IN PART III.C. OF THIS PERMIT. PART IV.C. - SEDIMENT CONTROL PRACTICES (CONT.) 8. THE PERMITTEE(S) MUST MINIMIZE SOIL COMPACTION AND, UNLESS INFEASIBLE, PRESERVE TOPSOIL. MINIMIZING SOIL COMPACTION IS NOT REQUIRED WHERE THE FUNCTION OF A SPECIFIC AREA OF THE SITE DICTATES THAT IT BE COMPACTED. 9. THE PERMITTEE(S) MUST PRESERVE A 50 FOOT NATURAL BUFFER OR (IF A BUFFER IS INFEASIBLE ON THE SITE) PROVIDE REDUNDANT SEDIMENT CONTROLS WHEN A SURFACE WATER IS LOCATED WITHIN 50 FEET OF THE PROJECT'S EARTH DISTURBANCES AND STORMWATER FLOWS TO THE SURFACE WATER. NATURAL BUFFERS ARE NOT REQUIRED ADJACENT TO ROAD DITCHES, JUDICIAL DITCHES, COUNTY DITCHES, STORMWATER CONVEYANCE CHANNELS, STORM DRAIN INLETS, AND SEDIMENT BASINS. THE PERMITTEE(S) IS/ARE NOT REQUIRED TO ENHANCE THE QUALITY OF THE VEGETATION THAT ALREADY EXISTS IN THE BUFFER OR PROVIDE VEGETATION IF NONE EXIST. HOWEVER, PERMITTEE(S) CAN IMPROVE THE NATURAL BUFFER WITH VEGETATION. PART IV.D. - DEWATERING AND BASIN DRAINING 1. THE PERMITTEE(S) MUST DISCHARGE TURBID OR SEDIMENT -LADEN WATERS RELATED TO DEWATERING OR BASIN DRAINING (E.G., PUMPED DISCHARGES, TRENCH/DITCH CUTS FOR DRAINAGE) TO A TEMPORARY OR PERMANENT SEDIMENTATION BASIN ON THE PROJECT SITE UNLESS INFEASIBLE. THE PERMITTEE(S) MAY DISCHARGE FROM THE TEMPORARY OR PERMANENT SEDIMENTATION BASINS TO SURFACE WATERS IF THE BASIN WATER HAS BEEN VISUALLY CHECKED TO ENSURE ADEQUATE TREATMENT HAS BEEN OBTAINED IN THE BASIN AND THAT NUISANCE CONDITIONS (SEE MINN. R. 7050.0210, SUBP. 2) WILL NOT RESULT FROM THE DISCHARGE. IF THE WATER CANNOT BE DISCHARGED TO A SEDIMENTATION BASIN PRIOR TO ENTERING THE SURFACE WATER, IT MUST BE TREATED WITH THE APPROPRIATE BMPS, SUCH THAT THE DISCHARGE DOES NOT ADVERSELY AFFECT THE RECEIVING WATER OR DOWNSTREAM PROPERTIES. IF THE PERMITTEE(S) MUST DISCHARGE WATER THAT CONTAINS OIL OR GREASE, THE PERMITTEE(S) MUST USE AN OIL -WATER SEPARATOR OR SUITABLE FILTRATION DEVICE (E.G. CARTRIDGE FILTERS, ABSORBENTS PADS) PRIOR TO DISCHARGING THE WATER. THE PERMITTEE(S) MUST ENSURE THAT DISCHARGE POINTS ARE ADEQUATELY PROTECTED FROM EROSION AND SCOUR. THE DISCHARGE MUST BE DISPERSED OVER NATURAL ROCK RIPRAP, SAND BAGS, PLASTIC SHEETING, OR OTHER ACCEPTED ENERGY DISSIPATION MEASURES. 2. ALL WATER FROM DEWATERING OR BASIN -DRAINING ACTIVITIES MUST BE DISCHARGED IN A MANNER THAT DOES NOT CAUSE NUISANCE CONDITIONS, EROSION IN RECEIVING CHANNELS OR ON DOWNSLOPE PROPERTIES, OR INUNDATION IN WETLANDS CAUSING SIGNIFICANT ADVERSE IMPACT TO THE WETLAND. 3. IF THE PERMITTEE(S) IS/ARE USING FILTERS WITH BACKWASH WATER, THE PERMITTEE(S) MUST HAUL THE BACKWASH WATER AWAY FOR DISPOSAL, RETURN THE BACKWASH WATER TO THE BEGINNING OF THE TREATMENT PROCESS, OR INCORPORATE THE BACKWASH WATER INTO THE SITE IN A MANNER THAT DOES NOT CAUSE EROSION. THE PERMITTEE(S) MAY DISCHARGE BACKWASH WATER TO THE SANITARY SEWER IF PERMISSION IS GRANTED BY THE SANITARY SEWER AUTHORITY. THE PERMITTEE(S) MUST REPLACE AND CLEAN THE FILTER MEDIA USED IN DEWATERING DEVICES WHEN REQUIRED TO RETAIN ADEQUATE FUNCTION PART IV.E. - INSPECTIONS AND MAINTENANCE 1. THE PERMITTEE(S) MUST ENSURE THAT A TRAINED PERSON (AS IDENTIFIED IN PART III.A.3.A.) WILL ROUTINELY INSPECT THE ENTIRE CONSTRUCTION SITE AT LEAST ONCE EVERY SEVEN (7) DAYS DURING ACTIVE CONSTRUCTION AND WITHIN 24 HOURS AFTER A RAINFALL EVENT GREATER THAN 0.5 INCHES IN 24 HOURS. FOLLOWING AN INSPECTION THAT OCCURS WITHIN 24 HOURS AFTER A RAINFALL EVENT, THE NEXT INSPECTION MUST BE CONDUCTED WITHIN SEVEN (7) DAYS AFTER THE RAINFALL EVENT. 2. ALL INSPECTIONS AND MAINTENANCE CONDUCTED DURING CONSTRUCTION MUST BE RECORDED WITHIN 24 HOURS IN WRITING AND THESE RECORDS MUST BE RETAINED WITH THE SWPPP IN ACCORDANCE WITH PART III.E. RECORDS OF EACH INSPECTION AND MAINTENANCE ACTIVITY SHALL INCLUDE: A. DATE AND TIME OF INSPECTIONS B. NAME OF PERSON(S) CONDUCTING INSPECTIONS C. FINDINGS OF INSPECTIONS, INCLUDING THE SPECIFIC LOCATION WHERE CORRECTIVE ACTIONS ARE NEEDED D. CORRECTIVE ACTIONS TAKEN (INCLUDING DATES, TIMES, AND PARTY COMPLETING MAINTENANCE ACTIVITIES) E. DATE AND AMOUNT OF ALL RAINFALL EVENTS GREATER THAN 1/2 INCH (0.5 INCHES) IN 24 HOURS RAINFALL AMOUNTS MUST BE OBTAINED BY A PROPERLY MAINTAINED RAIN GAUGE INSTALLED ONSITE, A WEATHER STATION THAT IS WITHIN 1 MILE OF YOUR LOCATION OR A WEATHER REPORTING SYSTEM THAT PROVIDES SITE SPECIFIC RAINFALL DATA FROM RADAR SUMMARIES. F. IF ANY DISCHARGE IS OBSERVED TO BE OCCURRING DURING THE INSPECTION, A RECORD OF ALL POINTS OF THE PROPERTY FROM WHICH THERE IS A DISCHARGE MUST BE MADE, AND THE DISCHARGE SHOULD BE DESCRIBED (I.E., COLOR, ODOR, FLOATING, SETTLED, OR SUSPENDED SOLIDS, FOAM, OIL SHEEN AND OTHER OBVIOUS INDICATORS OF POLLUTANTS) AND PHOTOGRAPHED. G. ANY AMENDMENTS TO THE SWPPP PROPOSED AS A RESULT OF THE INSPECTION MUST BE DOCUMENTED AS REQUIRED IN PART III.B. WITHIN SEVEN (7) CALENDAR DAYS. 3. INSPECTION FREQUENCY ADJUSTMENT A. WHERE PARTS OF THE PROJECT SITE HAVE PERMANENT COVER, BUT WORK REMAINS ON OTHER PARTS OF THE SITE, THE PERMITTEE(S) MAY REDUCE INSPECTIONS OF THE AREAS WITH PERMANENT COVER TO ONCE PER MONTH. B. WHERE CONSTRUCTION SITES HAVE PERMANENT COVER ON ALL EXPOSED SOIL AREAS AND NO CONSTRUCTION ACTIVITY IS OCCURRING ANYWHERE ON THE SITE, THE SITE MUST BE INSPECTED DURING NON -FROZEN GROUND CONDITIONS AT LEAST ONCE PER MONTH FOR A PERIOD OF TWELVE (12) MONTHS. FOLLOWING THE TWELFTH MONTH OF PERMANENT COVER AND NO CONSTRUCTION ACTIVITY, INSPECTIONS MAY BE TERMINATED UNTIL CONSTRUCTION ACTIVITY IS ONCE AGAIN INITIATED UNLESS THE PERMITTEE(S) IS/ARE NOTIFIED IN WRITING BY THE MPCA THAT EROSION ISSUES HAVE BEEN DETECTED AT THE SITE AND INSPECTIONS NEED TO RESUME. C. WHERE WORK HAS BEEN SUSPENDED DUE TO FROZEN GROUND CONDITIONS, THE INSPECTIONS MAY BE SUSPENDED. THE REQUIRED INSPECTIONS AND MAINTENANCE SCHEDULE MUST BEGIN WITHIN 24 HOURS AFTER RUNOFF OCCURS AT THE SITE OR 24 HOURS PRIOR TO RESUMING CONSTRUCTION, WHICHEVER COMES FIRST. 4. THE PERMITTEE(S) IS/ARE RESPONSIBLE FOR THE INSPECTION AND MAINTENANCE OF TEMPORARY AND PERMANENT WATER QUALITY MANAGEMENT BMPS, AS WELL AS ALL EROSION PREVENTION AND SEDIMENT CONTROL BMPS, UNTIL ANOTHER PERMITTEE HAS OBTAINED COVERAGE UNDER THIS PERMIT ACCORDING TO PART 11.B.5. OR THE PROJECT HAS UNDERGONE FINAL STABILIZATION, AND AN NOT HAS BEEN SUBMITTED TO THE MPCA. 5. THE PERMITTEE(S) MUST INSPECT ALL EROSION PREVENTION AND SEDIMENT CONTROL BMPS AND POLLUTION PREVENTION MANAGEMENT MEASURES TO ENSURE INTEGRITY AND EFFECTIVENESS DURING ALL ROUTINE AND POST -RAINFALL EVENT INSPECTIONS. ALL NONFUNCTIONAL BMPS MUST BE REPAIRED, REPLACED, OR SUPPLEMENTED WITH FUNCTIONAL BMPS BY THE END OF THE NEXT BUSINESS DAY AFTER DISCOVERY, OR AS SOON AS FIELD CONDITIONS ALLOW ACCESS UNLESS ANOTHER TIME FRAME IS SPECIFIED BELOW. THE PERMITTEE(S) MUST INVESTIGATE AND COMPLY WITH THE FOLLOWING INSPECTION AND MAINTENANCE REQUIREMENTS: A. ALL PERIMETER CONTROL DEVICES MUST BE REPAIRED, REPLACED, OR SUPPLEMENTED WHEN THEY BECOME NONFUNCTIONAL OR THE SEDIMENT REACHES ONE-HALF (1/2) OF THE HEIGHT OF THE DEVICE. THESE REPAIRS MUST BE MADE BY THE END OF THE NEXT BUSINESS DAY AFTER DISCOVERY, OR THEREAFTER AS SOON AS FIELD CONDITIONS ALLOW ACCESS. B. TEMPORARY AND PERMANENT SEDIMENTATION BASINS MUST BE DRAINED AND THE SEDIMENT REMOVED WHEN THE DEPTH OF SEDIMENT COLLECTED IN THE BASIN REACHES ONE-HALF (1/2) THE STORAGE VOLUME. DRAINAGE AND REMOVAL MUST BE COMPLETED WITHIN 72 HOURS OF DISCOVERY, OR AS SOON AS FIELD CONDITIONS ALLOW ACCESS (SEE PART IV.D.). C. SURFACE WATERS, INCLUDING DRAINAGE DITCHES AND CONVEYANCE SYSTEMS, MUST BE INSPECTED FOR EVIDENCE OF EROSION AND SEDIMENT DEPOSITION DURING EACH INSPECTION. THE PERMITTEE(S) MUST REMOVE ALL DELTAS AND SEDIMENT DEPOSITED IN SURFACE WATERS, INCLUDING DRAINAGE WAYS, CATCH BASINS, AND OTHER DRAINAGE SYSTEMS, AND RESTABILIZE THE AREAS WHERE SEDIMENT REMOVAL RESULTS IN EXPOSED SOIL. THE REMOVAL AND STABILIZATION MUST TAKE PLACE WITHIN SEVEN (7) DAYS OF DISCOVERY UNLESS PRECLUDED BY LEGAL, REGULATORY, OR PHYSICAL ACCESS CONSTRAINTS. THE PERMITTEE(S) SHALL USE ALL REASONABLE EFFORTS TO OBTAIN ACCESS. IF PRECLUDED, REMOVAL AND STABILIZATION MUST TAKE PLACE WITHIN SEVEN (7) CALENDAR DAYS OF OBTAINING ACCESS. THE PERMITTEE(S) IS/ARE RESPONSIBLE FOR CONTACTING ALL LOCAL, REGIONAL, STATE AND FEDERAL AUTHORITIES AND RECEIVING ANY APPLICABLE PERMITS, PRIOR TO CONDUCTING ANY WORK IN SURFACE WATERS. D. CONSTRUCTION SITE VEHICLE EXIT LOCATIONS MUST BE INSPECTED FOR EVIDENCE OF OFF -SITE SEDIMENT TRACKING ONTO PAVED SURFACES. TRACKED SEDIMENT MUST BE REMOVED FROM ALL PAVED SURFACES BOTH ON AND OFF SITE WITHIN 24 HOURS OF DISCOVERY, OR IF APPLICABLE, WITHIN A SHORTER TIME TO COMPLY WITH PART IV.C.6. E. STREETS AND OTHER AREAS ADJACENT TO THE PROJECT MUST BE INSPECTED FOR EVIDENCE OF OFF -SITE ACCUMULATIONS OF SEDIMENT. IF SEDIMENT IS PRESENT, IT MUST BE REMOVED IN A MANNER AND AT A FREQUENCY SUFFICIENT TO MINIMIZE OFF -SITE IMPACTS (E.G., FUGITIVE SEDIMENT IN STREETS COULD BE WASHED INTO STORM SEWERS BY THE NEXT RAIN AND/OR POSE A SAFETY HAZARD TO USERS OF PUBLIC STREETS). 6. ALL INFILTRATION AREAS MUST BE INSPECTED TO ENSURE THAT NO SEDIMENT FROM ONGOING CONSTRUCTION ACTIVITY IS REACHING THE INFILTRATION AREA. ALL INFILTRATION AREAS MUST BE INSPECTED TO ENSURE THAT EQUIPMENT IS NOT BEING DRIVEN ACROSS THE INFILTRATION AREA. PART IV.F. - POLLUTION PREVENTION MANAGEMENT MEASURES THE PERMITTEE(S) SHALL IMPLEMENT THE FOLLOWING POLLUTION PREVENTION MANAGEMENT MEASURES ON THE SITE: 1. STORAGE, HANDLING, AND DISPOSAL OF CONSTRUCTION PRODUCTS, MATERIALS, AND WASTES: THE PERMITTEE(S) SHALL COMPLY WITH THE FOLLOWING TO MINIMIZE THE EXPOSURE TO STORMWATER OF ANY OF THE PRODUCTS, MATERIALS, OR WASTES. PRODUCTS OR WASTES WHICH ARE EITHER NOT A SOURCE OF CONTAMINATION TO STORMWATER OR ARE DESIGNED TO BE EXPOSED TO STORMWATER ARE NOT HELD TO THIS REQUIREMENT: A. BUILDING PRODUCTS THAT HAVE THE POTENTIAL TO LEACH POLLUTANTS MUST BE UNDER COVER (E.G., PLASTIC SHEETING OR TEMPORARY ROOFS) TO PREVENT THE DISCHARGE OF POLLUTANTS OR PROTECTED BY A SIMILARLY EFFECTIVE MEANS DESIGNED TO MINIMIZE CONTACT WITH STORMWATER. B. PESTICIDES, HERBICIDES, INSECTICIDES, FERTILIZERS, TREATMENT CHEMICALS, AND LANDSCAPE MATERIALS MUST BE UNDER COVER (E.G., PLASTIC SHEETING OR TEMPORARY ROOFS) TO PREVENT THE DISCHARGE OF POLLUTANTS OR PROTECTED BY SIMILARLY EFFECTIVE MEANS DESIGNED TO MINIMIZE CONTACT WITH STORMWATER. C. HAZARDOUS MATERIALS, TOXIC WASTE, (INCLUDING OIL, DIESEL FUEL, GASOLINE, HYDRAULIC FLUIDS, PAINT SOLVENTS, PETROLEUM -BASED PRODUCTS, WOOD PRESERVATIVES, ADDITIVES, CURING COMPOUNDS, AND ACIDS) MUST BE PROPERLY STORED IN SEALED CONTAINERS TO PREVENT SPILLS, LEAKS OR OTHER DISCHARGE. RESTRICTED ACCESS STORAGE AREAS MUST BE PROVIDED TO PREVENT VANDALISM. STORAGE AND DISPOSAL OF HAZARDOUS WASTE OR HAZARDOUS MATERIALS MUST BE IN COMPLIANCE WITH MINN. R. CH. 7045 INCLUDING SECONDARY CONTAINMENT AS APPLICABLE. D. SOLID WASTE MUST BE STORED, COLLECTED AND DISPOSED OF PROPERLY IN COMPLIANCE WITH MINN. R. CH. 7035. E. PORTABLE TOILETS MUST BE POSITIONED SO THAT THEY ARE SECURE AND WILL NOT BE TIPPED OR KNOCKED OVER. SANITARY WASTE MUST BE DISPOSED OF PROPERLY IN ACCORDANCE WITH MINN. R. CH. 7041. 2. FUELING AND MAINTENANCE OF EQUIPMENT OR VEHICLES; SPILL PREVENTION AND RESPONSE: THE PERMITTEE(S) SHALL TAKE REASONABLE STEPS TO PREVENT THE DISCHARGE OF SPILLED OR LEAKED CHEMICALS, INCLUDING FUEL, FROM ANY AREA WHERE CHEMICALS OR FUEL WILL BE LOADED OR UNLOADED INCLUDING THE USE OF DRIP PANS OR ABSORBENTS UNLESS INFEASIBLE. THE PERMITTEE(S) MUST CONDUCT FUELING IN A CONTAINED AREA UNLESS INFEASIBLE. THE PERMITTEE(S) MUST ENSURE ADEQUATE SUPPLIES ARE AVAILABLE AT ALL TIMES TO CLEAN UP DISCHARGED MATERIALS AND THAT AN APPROPRIATE DISPOSAL METHOD IS AVAILABLE FOR RECOVERED SPILLED MATERIALS. THE PERMITTEE(S) MUST REPORT AND CLEAN UP SPILLS IMMEDIATELY AS REQUIRED BY MINN. STAT. § 115.061, USING DRY CLEAN UP MEASURES WHERE POSSIBLE. 3. VEHICLE AND EQUIPMENT WASHING: IF THE PERMITTEE(S) WASH THE EXTERIOR OF VEHICLES OR EQUIPMENT ON THE PROJECT SITE, WASHING MUST BE LIMITED TO A DEFINED AREA OF THE SITE. RUNOFF FROM THE WASHING AREA MUST BE CONTAINED IN A SEDIMENT BASIN OR OTHER SIMILARLY EFFECTIVE CONTROLS AND WASTE FROM THE WASHING ACTIVITY MUST BE PROPERLY DISPOSED OF. THE PERMITTEE(S) MUST PROPERLY USE AND STORE SOAPS, DETERGENTS, OR SOLVENTS. NO ENGINE DEGREASING IS ALLOWED ON SITE. 4. CONCRETE AND OTHER WASHOUTS WASTE: THE PERMITTEE(S) MUST PROVIDE EFFECTIVE CONTAINMENT FOR ALL LIQUID AND SOLID WASTES GENERATED BY WASHOUT OPERATIONS (CONCRETE, STUCCO, PAINT, FORM RELEASE OILS, CURING COMPOUNDS AND OTHER CONSTRUCTION MATERIALS) RELATED TO THE CONSTRUCTION ACTIVITY. THE LIQUID AND SOLID WASHOUT WASTES MUST NOT CONTACT THE GROUND, AND THE CONTAINMENT MUST BE DESIGNED SO THAT IT DOES NOT RESULT IN RUNOFF FROM THE WASHOUT OPERATIONS OR AREAS. LIQUID AND SOLID WASTES MUST BE DISPOSED OF PROPERLY AND IN COMPLIANCE WITH MPCA RULES. A SIGN MUST BE INSTALLED ADJACENT TO EACH WASHOUT FACILITY THAT REQUIRES SITE PERSONNEL TO UTILIZE THE PROPER FACILITIES FOR DISPOSAL OF CONCRETE AND OTHER WASHOUT WASTES. PART IV.G. FINAL STABILIZATION THE PERMITTEE(S) MUST ENSURE FINAL STABILIZATION OF THE SITE. FINAL STABILIZATION IS NOT COMPLETE UNTIL ALL REQUIREMENTS OF PARTS IV.G.1.-5. ARE COMPLETE: 1. ALL SOIL DISTURBING ACTIVITIES AT THE SITE HAVE BEEN COMPLETED AND ALL SOILS ARE STABILIZED BY A UNIFORM PERENNIAL VEGETATIVE COVER WITH A DENSITY OF 70 PERCENT OF ITS EXPECTED FINAL GROWTH DENSITY OVER THE ENTIRE PERVIOUS SURFACE AREA, OR OTHER EQUIVALENT MEANS NECESSARY TO PREVENT SOIL FAILURE UNDER EROSIVE CONDITIONS. 2. THE PERMANENT STORMWATER MANAGEMENT SYSTEM IS CONSTRUCTED, MEETS ALL REQUIREMENTS IN PART III.D. AND IS OPERATING AS DESIGNED. TEMPORARY OR PERMANENT SEDIMENTATION BASINS THAT ARE TO BE USED AS PERMANENT WATER QUALITY MANAGEMENT BASINS HAVE BEEN CLEANED OF ANY ACCUMULATED SEDIMENT. Edina, MN 55439 NA Mattamy Homes continues to move forward on the design and development of their master planned residential community called Watermark. The development is located in the northwest quadrant of I-35E and CSAH 14/Main Street. It contains 12 parcels totaling approximately 372 gross acres and consists of a residential mix of single family lots and townhomes totaling 876 housing units. In August of 2014 Mattamy Homes submitted an application for concept plan review. Comments on the plan were provided by each of the city advisory boards as well as the City Council. A summary of the board and council comments is attached. Comments were generally supportive of the proposal. Over the past 8 months staff has worked with Mattamy to address drainage and transportation issues and refine the concept plan. The Park Board also began work with the developer on the preliminary park design, a major component of the site development. At the May 13, 2015 meeting, Rick Packer of Mattamy Homes presented an overview of the existing site conditions, layout considerations and proposed amenities, landscaping and overall theme accents for the development. During discussion the Planning & Zoning Board raised three primary issues which need to be clarified prior to moving forward with a formal PUD application. They are as follows: 1) Concern with the exclusion of commercial development component 2) Concern over the proposed lot widths and sizes 3) Lack of defined public values obtained through the design flexibility allowed by the use of the PUD. ANALYSIS The 370 acre site has been the center point of extensive planning efforts over the past eleven years. Those efforts have resulted in the adoption of the CSAH 14 Alternatives Analysis, the Alternative Urban Areawide Review (2005), a comprehensive plan amendment (2006), and the 2030 Comprehensive Plan update (2011). These efforts in turn have led to the reconstruction of CSAH 14 (Main Street) from I-35W to I-35E and more importantly the I-35E and Main Street Interchange. All of these efforts where consistent with the City's goal to master plan the I-35E corridor. When evaluating potential development of the site the City's three primary tools are the Comprehensive Plan, the AUAR and the Planned Unit Development standards of the zoning ordinance. Comprehensive Plan The Comprehensive Plan is divided into different chapters that detail goals and objectives and define general public values in regards to resource management, land use, housing, economic development, transportation and public utilities. This site is guided Mixed Use. This designation provides for both commercial and/or residential uses with a housing density of up to 4.5 units per net acre. Page 3-17 states "the mix of commercial and residential uses will vary for each site, as will the residential density. It is important to note that the information provided in Table 3-4 is preliminary, and is intended to serve as a guide for future decision -making. As plans for specific mixed use areas are refined, suggested density, total units, and the residential/commercial split may be revised. To best serve the community's changing needs and market conditions, flexibility in these areas is essential. Gross and net acreages for mixed use development presented in Table 3-4 represent the potential for new mixed use development, and do not account for existing mixed use development projects in the city." Page 10-21 refers specifically to the Hardwood Creek concept plan and states "a 370-acre development site is located'/4 mile north of Main Street, between I-35E and CSAH 21 (201h Avenue). This site is to be developed with commercial and residential uses. The concept plan for the development includes 500,000 to 600,000 square feet of commercial space on 70 acres of the site. A variety of single family and multi -family residential developments will include a maximum of 1,150 dwelling units. The net residential density shall not exceed 4.5 units per acre, with no less than 2/3 of the residential area reserved for low density residential development, when including all land not within the commercial area. Said low density area may include a variety of housing types (both detached and attached units) provided that the density does not exceed 3.0 units per acre. There will be significant open space as well. While these are the approximate use parameters, the specifics of development in this area are to be part of a master plan using a planned unit development approach." It is important to remember we are not reviewing the Hardwood Creek concept plan. This is a new project and needs to be evaluated on its own merits. AUAR The AUAR is a comprehensive environmental review of possible development scenarios within the I-35E corridor. The centerpiece of the plan is the Conservation Design Framework which identifies opportunities for the establishment of multifunctional greenway corridors. For much of the corridor, including the Watermark site, these greenways will be created from non-existent native areas or areas of low quality or low functioning resources. Zoning Ordinance Per 1007.024 PUD, Planned Unit Development, Purpose and Intent Statement: • Provide for the grouping of lots or buildings for development as an integrated, coordinated unit as opposed to traditional parcel by parcel, piecemeal, or sporadic approach to development. • Introduce flexibility of site design and architecture for the conservation of land and open space through clustering of lots, buildings and activities, which promote the goals outlined in the Comprehensive Plan or serve another public purpose. • Developments are to be characterized by central management, integrated planning and architecture, joint and common use and maintenance of parking, open space and other similar facilities, and harmonious selection and efficient distribution of uses. The PUD, by allowing deviation from the strict provisions of this Ordinance related to setbacks, heights, lot area, width and depths, yards, etc., is intended to encourage: • A development pattern in harmony with the objectives of the Comprehensive Plan. • Innovations in development that address growing demands for all styles of economic expansion, greater variety in type, design, architectural standards, and siting of structures through the conservation and more efficient use of land in such developments. • The preservation and enhancement of desirable site characteristics such as existing vegetation, natural topography and geologic features and the prevention of soil erosion. • A creative use of land and related physical development which allows a phased and orderly transition of varying land uses in close proximity to each other. • An efficient use of land resulting in smaller networks of utilities and streets thereby lowering development costs and public investments. • Promotion of a desirable and creative environment that might be prevented through the strict application of City zoning and subdivision regulations. Commercial Development The Comprehensive Plan provides for an 80/20 mix of residential to commercial development on the site. The original Hardwood Creek proposal identified up to 600,000 square feet of the commercial development on approximately 70 acres of the site. Staff has analyzed the commercial component of this site with brokers, commercial developers and an economic development specialist and they all concur that this site is not a preferred location for commercial development. Approximately 200 acres of land surrounding the I-35E interchange is currently guided for commercial development. This land could accommodate approximately 1.5 million square feet of development. For comparison purposes the Marketplace Development containing Target and Kohl's consists of approximately 350,000 square feet on 40 acres. While the site contained a large proposed commercial component with the original 2005 Hardwood Creek development proposal, the commercial market has changed considerably. During the concept review process the City Council concurred that commercial component would not be a necessary component of the development. The Comprehensive Plan specifically states that "As plans for specific mixed use areas are refined, suggested density, total units, and the residential/commercial split may be revised. To best serve the community's changing needs and market conditions, flexibility in these areas is essential." Density, Lot Width and Housing Product As previously mentioned the site is guided mixed use with the intent of providing a number of different housing opportunities. For mixed use districts the city uses the Planned Unit Development Process to establish the specific development standards that will be applied throughout the development. Mattamy Homes has proposed to provide a variety of single family detached housing products on varying lot widths. These products are intended to provide multiple housing options to meet market demand. The comprehensive plan allows for a maximum of 1,150 housing units at a density of 4.5 units per net acre with two-thirds reserved for low density development (i.e. single family detached homes). Watermark is proposing 876 units at 3.04 units per net acre. The proposed lot widths support housing products in Watermark that vary in footprint widths from 32', 40', 50' and 60'. (This does not include the townhomes.) Focusing on the housing product and establishing side yard setbacks on both sides creates separation between housing units on varying lot sizes. This provides for the most efficient use of land, cost effective design of street and utilities and maximizes open space. Lot widths are a product of the house width plus side yard setbacks. al Side Yard (ft) House Width (ft) Side Yard (ft) Lot Width (ft) 6 32 6 44 7.5 40 7.5 55 7.5 50 7.5 65 7.5 60 7.5 75 While the site's mixed use designation does not require conformance with typical single family zoning district requirements it is necessary to point out that of the 711 single family detached lots: • 292 lots (41 %) exceed the lot area standards of the R2, Two Family Residential District • 165 lots (23%) exceed the lot area requirement of the R-1, Single Family Residential Districts • 100 lots (14%) exceed the R-1 District minimum lot width of 80' • 388 lots (55%) abut open space Definition of Public Values Beginning with the Foxborough development in 2004 the City attempted to establish a collaborative development process by working with developers to increase the public values obtained within the context of economic realities. Dating back to the AUAR, which established the Conservation Design Framework, and the original Hardwood Creek project, a number of key public values have been defined for the project: Site Specific Public Values • Improve water quality • Create interconnected, continuous open space system with trail network • Enhance ecological systems on site • Improve stormwater management (flow rates, volume and quality) • Increase natural open space over conventional development • Increase city tax base • Needed transportation improvements • Diverse housing opportunity • Walkability In addition through development of the site and the flexibility offered through the PUD process the City has or will obtain the following: 1. I-35E & CR 14/Main Street Interchange completed (approximately $1.5 million investment) 2. Large scale master planned development 3. Continuity in landscape, park and building design 5 4. Architectural control 5. Establishment of greenway system 6. Combination of 12 separate parcels into 1 contiguous development 7. AUAR supports this development 8. Different housing types supports life cycle housing and market 9. Increased market and tax revenue 10. Economic development driver (roof tops drive commercial development and growth) 11. 55% of the lots abut open space 12. Minimum 15 foot separation between houses vs. current standard 10 foot separation between garages 13. Regional stormwater management system improving water quality and volume control 14. Development that is at the lowest end of the required density spectrum 15. Gross density is 2.35 units per acre 16. Park and trail system with neighborhood community center developed on the front end of the development 17. More single family detached homes than attached townhomes RECOMMENDATION None. Citv Council Work Session -June 2.2014 Minutes • Mayor Reinert noted that he still has concern about lot width and he wonders if lots sizes could be adjusted. Mr. Packer responded by explaining how the development is planned based on the market. • Council Member Stoesz said he asked at the last review about the school district boundaries. Has the developer researched the possibility of having those boundaries run along natural borders? Mr. Packer said yes. • Council Member Kusterman remarked that he understands the questions but knows, at the end of the day, this company is in business to do it right and provide a development where homes will sell. He has some continuing concern about how the noise on I35E will impact the homes but he acknowledges that the development attempts to mitigate that situation. • Council Member Roeser noted that he likes the multigenerational concept, allowing for different ages and stages in life. • The mayor said he is hearing the council express some apprehension but he isn't hearing that the council won't continue discussing these plans. He recommends that staff continue to work on breaking down the numbers. Environmental Board Comments -September 24, 2014: • Overall comments were in favor of the development. • Address the AUAR Mitigation Plan in the preliminary plat design and submittal materials. • Potential impacts to ecologically sensitive areas should be minimized. • Design stormwater management plan with a treatment -train approach. • Provide a noise analysis and mitigation plan. • Locate the central park adjacent to the corridor if possible. • Investigate the potential for creating a cultural site that may include space for community gardens. • Submit landscape plans for screening the west edge, the open space areas, and the earthen berm. • Provide a SWPPP that is site specific and in conformance with the MPCA construction site permit requirements. • Provide a street cross-section with detail for utilities, sidewalks, and boulevard trees. Park Board Comments -October 6, 2014: • Overall comments were in favor of the development. • Proposed community center would need to be owned and operated by an association; not the city. • Public trail should be rerouted through greenway on north side of development. • Trail connections should be made from cul de sacs or mid -block on long street sections to greenway trail. • Need to provide shorter looping of trail system. • Bump outs along the street shall be installed to serve as parking for the public park. • Trail shall be extended along 201h Avenue. • Provide better trail access to park. • Discussed maintenance of sidewalks. • Discussed that sidewalks are not credited for park dedication but trails are credited. Planning & Zoning Board Comments -October 8, 2014 • Overall comments were in favor of the development. • A mixed use area should include some commercial development. • Discussion as to whether a market study should be done. • Consider turn lanes on 20th Avenue. Staff noted that a street light will also be considered. • Ensure adequate parking space for the public park. • A utility phasing plan will allow for development in other areas of the city. • City should get the best product for the city rather than the quickest development. • Consider creating an outlot to be used for future commercial development. • Variety of lot sizes and widths and housing products are supported by the Board. EDAC Comments -October 9, 2014 • Overall comments were in favor of the development. • Recommended retaining commercial land in the project. Council Work Session -November 3, 2014 • Mayor Reinert expressed concern about the lack of change from the last review of the project. The project looks "off weight" for Lino Lakes. Community Development Director Grochala noted that the area is generally guided for medium density and that is what the plans indicate. • Commercial development possibilities. • Townhome location. • Lot sizes, street widths and setbacks. • The parkland should be developed early and there is funding in first phase to do so; trails would be included. • Density requirements are linked to Comp Plan but that can be amended. • 20th Avenue traffic; a traffic analysis will be included. • Noise walls. • Council Member Stoesz is cognizant that the market drives development and he wants project that is viable long-term. • Council Member Roeser prefers bigger lots throughout but can understand that isn't always possible; he agrees with the Mayor that the models are not correctly located for the long term. • Council Member Rafferty said he has to actually see what proposed lot sizes looks like when built (he will participate in a tour). • There was concurrence that commercial will not be included.
