City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. PUD Final Plan/Final Plat for Turnberry Crossing Second Addition Katie Larsen, City Planner, presented the staff report. Staff recommends approval of the PUD Final Plan/Final Plat for Turnberry Crossing Second Addition. The following items shall be addressed prior to approval by the City Council unless otherwise noted: 1. All comments from the City Engineer letter dated June 3, 2015 shall be addressed. 2. The following executed documents shall be recorded with Anoka County within 90 days of City Council approval of the final plat: a. Ordinance vacating drainage & utility easement b. Final Plat c. Development Agreement d. Declaration for Maintenance of Stormwater Facilities 3. The following items shall be submitted to the City prior to issuance of a Grading Permit: a. Revised plans based on staff comments b. Executed Declaration for Maintenance of Stormwater Facilities c. NPDES Permit d. RCWD Permit e. Securities and Escrows as detailed in the Development Contract f. Grading Permit Fee of $150 4. The following items shall be submitted to the City prior to issuance of a Building Permit: a. Revised plans based on staff comments b. An electronic PDF of the final approved plans c. An as -built grading survey d. Building Permit Fee as determined by the Building Official 5. Sheet 2, Impervious Coverage Exhibit a. The guest parking stalls between Lots 9-10 and Lots 13-14 shall not be removed and shall be replaced with pervious pavers. b. The impervious surface calculations do not match those on Sheet 4. Please revise the appropriate sheet. 6. Sheet 4, Grading Plan. a. The impervious surface calculations do not match those on Sheet 2. Please revise the appropriate sheet. 7. Sheet 5, Landscaping/Planting Plan. a. Per the original PUD, 105 trees shall be planted. The Plant Schedule only indicates 95. Please revise schedule and plan to show 105 tree plantings. b. All sodded areas shall be irrigated. The irrigation shall extend further into the southwest corner of the site. c. Stormwater management ponds and their seed mix types shall be clearly marked on the plan sheet. d. Under Landscape Notes, remove "All disturbed areas to be turf seeded...." comment. This shall be drafted by the developer, approved by the City and recorded. b. Drainage and utility easements shall be dedicated between Lots 1 & 2 and Lots 2 & 3. Mr. Root asked if there had been any more discussion of mailboxes, as a few community members had concerns about this. Ms. Larsen replied staff did discuss this further but concluded it is not something the City will regulate. Roger Hokanson, project developer, approached the podium and confirmed he understands the requirements and is ready to start the project. Mr. Laden made a MOTION to recommend approval of the Turnberry Crossing Second Addition PUD Final Plan/Final Plat. Motion was supported by Mr. Masonick. Motion carried 6 - 0. (Tralle abstained.) VI. DISCUSSION ITEMS A. Watermark Discussion Michael Grochala, Community Development Director, presented information and analysis of three primary areas of concern raised by the board at the May 13, 2015 Planning & Zoning Board meeting: commercial component, lot sizes, and public values. Staff requested board direction regarding these areas. Key points of discussion among the board included: Commercial component ➢ Market analysis ➢ Comprehensive Plan language and application • Lot sizes ➢ Open space ➢ Impact on City ➢ Market demand • Public values ➢ Drainage After discussion of these topics, Chair Tralle polled the board members on each area. 1. The board was comfortable with eliminating the commercial component, provided additional master planning is undertaken showing connectivity to the surrounding commercial areas. 2. Fourteen parcels are residential and 3 parcels are a private airport. All parcels are on private well and septic systems. ANALYSIS History In January 2015, the City received a rezoning request from Robert and Carol Stanek to rezone their properties located 6966 and 6970 Lake Drive from R-1, Single Family Residential to R, Rural for the purpose of keeping animals. Farm animals were already being kept on site. The Planning & Zoning Board held a public hearing on February 11, 2015. Both staff and the Planning & Zoning Board recommended denial due to concerns of spot zoning. On March 9, 2015, the City Council passed Resolution No. 15-21 denying the rezoning. Staff was directed by the Planning & Zoning Board and Council to research an ordinance amendment that would allow for the keeping of farm animals in residential zoning districts. The zoning ordinance currently allows for the keeping of farm animals on rural properties zoned R, Rural or R-X, Rural Executive. Residentially zoned parcels (i.e. R-1, R-2, etc.) do not allow for the keeping of farm animals. Lot size is not a factor in either case. Ordinance Amendment Staff discussed amending the ordinance to allow for the keeping of farm animals on residential parcels based on lot size. Our concerns are determining the ideal lot size. Rural districts require a minimum of 2 acres per 1 animal unit (e.g. 1 horse is 1 animal unit). If we changed the ordinance to 2 acre minimums, inevitably, a property owner on a 1.75 acre parcel would want a variance. The city also has varying lot sizes for both rural and residentially zoned parcels. Several rural properties are less than the minimum 10 acre requirement and several residential properties are greater than 0.25 acre. Staff acknowledges discrepancies between the zoning map and ordinance and the existence of substandard lots. Lot size alone can also be somewhat problematic considering an R-1 zoned parcel could be greater than 1 acre but a large portion of the property contains wetland or an easement that would not be considered buildable. For example, several parcels along Sioux Lane in the Spirit Hills development are greater than 1 acre but 75% is unbuildable wetland. Staff would not expect farm animals in this area. Rezoning To avoid issues regarding lot sizes, buildable area and potential variance requests and to allow the Stanek's to keep their horses, goats and other farm animals, staff recommends rezoning 15 parcels along Lake Drive from R-1, Single Family to R, Rural and 2 parcels from R-IX, Single Family Executive to R, Rural. The keeping of farm animals is a land use and should be regulated through zoning districts vs. lot size requirements. Fourteen (14) residential parcels along Lake Drive vary in lot sizes from approximately 1 to 5 acres and lot widths from 100 feet to 300 feet. They are unsewered parcels on private well and septic systems and most have single family homes. Although these lots meet R-1 lot size and width requirements, they are considered substandard lots because they are not connected to public water and sanitary utilities. These parcels would still be considered substandard if rezoned to R, Rural because they would not meet the 10 acre lot size requirement; however, they would be consistent with other smaller rural properties that are on private systems. The rural zoning district establishes a "holding W zone" and maintains open space until municipal water and sewer were available. At the time individual parcels need to hook up to the system, the parcels would be rezoned to R- 1. This is similar to the parcels in the 500 block of Lois Lane (i.e. Isabell Estates, Hailey Manor, etc.) and along W Shadow Lake Drive. It is important to note the parcels cannot be subdivided until municipal services are extended whether they are zoned R, Rural or R-1. The 3 other parcels are owned by Surfside Seaplane Base, a privately owned seaplane operation. One parcel is zoned R-1 and the other 2 parcels are zoned R-1X, Single Family Executive. An amended conditional use permit was issued in 1985 for the construction of a hangar; however, the current zoning ordinance does not allow for public or private airports in either the R-1 or R-1X districts. These parcels are considered legal non -conforming. The R, Rural district allows for public or private airports with a conditional use permit. Rezoning these parcels to R, Rural allows the seaplane base to make improvements to the site with an amended conditional use permit and be considered a legal use. They will still be considered substandard if rezoned to R, Rural because they will be less than 10 acres. It is also important to note that in regards to the keeping of farm animals, the rural zoning district requires a minimum of 2 acres per 1 animal unit. Whereas all of the parcels would be allowed smaller farm animals such as chickens, bees and goats, only 3 parcels are large enough to allow for larger farm animals such as horses. Comprehensive Plan Land Use Plan The existing land use of the 14 residential parcels is categorized as rural residential. The definition of rural residential is "residential purposes, including mainly single family homes at very low densities supported by individual sewage treatment systems". These parcels are consistent with the existing land use definition. The future land use of these parcels is guided low density residential. The purpose of this category is to provide for housing at densities of 1.6 to 3.9 units per net acre that is served by municipal sewer and water. The current density is approximately 2.75 units per gross acre. These parcels are consistent with future land use in regards to density. The sanitary sewer district #2 has capacity for servicing these parcels upon extension of the utility along Lake Drive. Page 3-29 of the Comprehensive Plan (Implementation of the Land Use Plan) states: "To ensure consistency between official controls (e.g. zoning) and the Comprehensive Plan (Goal 2), the City of Lino Lakes will: • A zoning district or districts will be established as "holding zones" for urban development. These holding zones are applicable to all land use designations on the 2030 Land Use Plan. Specific areas will be zoned to a district (i.e., R-1, R-1X, R-2, NB, LB, etc.) consistent with the land use designation (i.e., Low Density Residential, Commercial, Industrial, etc.) al when municipal services are available and the current staging area is expanded to include the area." The R, Rural zoning district has been established as a "holding zone". When municipal services are extended along this stretch of Lake Drive and properties hook up to the system, they shall be rezoned to R-1 which is consistent with low density sewered residential development. The 3 parcels are owned by Surfside Seaplane Base are guided private airfield for private aviation use. The current operation of the seaplane base is consistent with the comprehensive plan's land use designation. Sanitary Sewer Plan These parcels are within Sewer District #2 and the IA: 2008-2015 utility staging area. The sanitary sewer system in this staging area has capacity to accommodate development along this stretch of Lake Drive. Municipal utilities are stubbed to Lake Drive at the north at Ivy Ridge Lane and at the south at 2nd Avenue. Rezoning The Planning and Zoning Board shall hold a public hearing and judgment of the rezoning shall be based upon the following factors: 1. The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The proposed action of rezoning the 14 residential parcels to R, Rural is consistent with the Comprehensive Plan. The parcels are guided low density residential. The R, Rural zoning district has been established as a "holding zone" until municipal services are available. When municipal services are extended along this stretch of Lake Drive and properties hook up to the system, they shall be rezoned to back to a residential zoning district (e.g. R-1, R-IX, etc) which is consistent with low density severed residential development. The proposed action of rezoning the 3 airport parcels to R, Rural is consistent with the Comprehensive Plan. The parcels are guided private airfield. The R, Rural zoning district allows for private airports with a conditional use permit. 2. The proposed use is or will be compatible with present and future land uses of the area. The proposed use of keeping of farm animals and the existing use of operating a private seaplane base are compatible with present and future land uses in the area. 5 The existing land use of the 14 residential parcels is categorized as rural residential. These parcels are consistent with the existing land use definition. The keeping of farm animals is more consistent with rural residential properties than R-1 single family properties. The future land use of these parcels is guided Low Density Residential. These parcels are consistent with the future land use in terms of density and availability of utility extension. The 3 parcels owned by Surfside Seaplane Base are guided private airport for private aviation use. The current operation of the seaplane base is consistent with the comprehensive plan's land use designation. 3. The proposed use conforms with all performance standards contained herein. The proposed use of keeping of farm animals meets the performance standards of the zoning ordinance which allows no more than one animal unit per 2 acres. The use shall also meet all requirements of Chapter 503 of the city ordinance. The current use of a private airport meets the performance standards of the zoning ordinance. Future improvements to the site will require an amended conditional use permit and compliance with the ordinance. 4. The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. Per the City's Comprehensive Plan, the parcels are within the IA: 2008-2015 utility staging area. The watermain and sanitary sewer systems have capacity to accommodate development along this stretch of Lake Drive upon extension to the subject properties. 5. Traffic generation by the proposed use is within capabilities of streets serving the property. Traffic generation by the proposed keeping of farm animals and existing private airport is within capabilities of the streets serving the property. Lake Drive/CSAH 23 is a minor arterial road. Traffic generation would not be increased or decreased by the proposed rezoning. Shoreland District, Wetlands and Floodplain The parcels are located within the Shoreland District of Rice Lake. Wetlands exist on the parcels although no formal delineations have been completed. The 1982 FEMA Flood Insurance Rating Map (FIRM) indicates a Zone A3 flood plain district on the parcels as well. Co RECOMMENDATION Staff recommends approval of the rezoning of 15 parcels from R-1, Single Family Residential and 2 parcels from R-IX, Single Family Executive Residential to R, Rural based on the findings noted above.
