RESOLUTION NO. 14-05
RESOLUTION APPROVING AMENDMENT TO SECTION 2.6
OF THE CENTENNIAL FIRE DISTRICT JOINT POWERS AGREEMENT
WHEREAS, the Centennial Fire District Steering Committee ("Committee") has forwarded a
proposed amendment to the City Councils of the three member cities in accordance with Section
16.2 of the Joint Powers Agreement ("JPA"); and
WHEREAS, the Committee voted in favor of recommending an amendment to Section 2.6 of
the JPA, which establishes the voting requirements for Committee members; and
WHEREAS, the proposed amendment to Section 2.6 specifies that two members from any one
city can veto a motion up to four times in any calendar year;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lino Lakes
approves the proposed amendment to Section 2.6 of the Centennial Fire District JPA as
submitted by the Steering Committee.
Adopted by the City Council of the City of Lino Lakes this 21st day of January, 2014.
The motion for the adoption of the foregoing resolution was introduced by Council Member
Stoesz and was duly seconded by Council Member Roeser and upon vote being taken thereon,
the following voted in favor thereof:

Below is the amended language in Section 2.6, which is being proposed by the Centennial Fire
District Steering Committee.
2.6 Voting. Each committee member present at the meeting other than ex officio
administrative staff members shall be entitled to one vote. Unless otherwise provided in
the agreement, the committee may take the action on any issue by a 51 percent of greater
vote of those members present and entitled to vote at a duly called meeting, subject to the
quorum requirement of section 2.5. However, passage of a motion shall require an
affirmative vote from one member of each member city.
Notwithstanding a majority vote for passage of a motion, where two members from any
one city vote against the motion, the motion fails. Such vote will constitute a veto for
that city. A motion to reconsider the issue shall not occur until at least 12 months has
passed from the date of the veto. The chair in their sole discretion shall determine if a
new proposal is the same issue that has already been vetoed; therefore, a motion to
reconsider is prohibited unless one member of the city who voted against the motion asks
for the vote to be reconsidered.
Each city shall be limited to four vetoes in any calendar year.
The provisions of Section 2.6 shall not apply to any City that has given notice of
withdrawal as provided in Section XI, Withdrawal.
In the absence of the designated elected committee official, the designated elected official
alternate of that municipality shall become a voting member of the committee.
There shall be no voting by proxy. Votes must be cast at a committee meeting by a
committee member.
Administrative staff approval of payment of bills as in section 2.3 shall require
unanimous agreement.

INTRODUCTION
The City Council is being asked to approve an amendment to Section 2.6 of the Centennial Fire
District Joint Powers Agreement.
BACKGROUND
On November 19, 2013, the Centennial Fire District Steering Committee voted in favor of
having each member city consider an amendment to Section 2.6 of the Joint Powers Agreement
(JPA), which would add the following language to the voting procedures: "However, passage
of a motion shall require an affirmative vote from one member of each member city."
The Lino Lakes City Council approved the amendment on November 25, 2013. However, the
Circle Pines and Centerville City Councils did not vote in favor of the proposal.
The Steering Committee met again on December 12 and agreed to continue its effort to find
resolution and unanimously approved a 30 -day extension of the withdrawal period to allow the
three cities more time to reach an agreement on voting procedures. All three city councils
approved the extension.
The Steering Committee held another meeting on January 15 and voted in favor of forwarding
a recommendation to the city councils that Section 2.6 be amended to include a provision
granting a "veto vote" where two Steering Committee members from any one city vote against
a motion, with a limit of four vetoes per city in any calendar year.
RECOMMENDATION
Approve Resolution No. 14-05 amending Section 2.6 of the Centennial Fire District Joint
Powers Agreement as proposed by the Steering Committee.
